The REGULAR BRIEFING of the Honorable Council of the City of Virginia
Beach, Virginia, was called to order by Mayor J. Henry McCoy, Jr., in
the Conference Room, Administration Building, on Monday, 4 August 1980,
at one o'clock in the afternoon.

ITEM #15387
Mayor McCoy entertained a motion to permit Council to conduct its
INFORMAL SESSION to be followed by an EXECUTIVE SESSION for the
purpose of discussing the following:
1. Di,scussion or consideration of employment,
assignment, appointment, promotion, demotion,
salaries, discipline or resignation of public
officers, or employees of any public body.
(Personnel Matters).
2. The protection of the privacy of individuals
in personal matters not related to Dublic business.
(Personal Matters).
3. Consultation with legal counsel and briefing by
staff members, consultants, or attorneys pertaining
to actual or potential litigation, or other legal
matters within the jurisdiction of the public bodv.
(Legal tlatters).
Upon motion by Councilman Standing, seconded by Councilman Holland,
City Council voted to recess into the EXECUTIVE SESSTON following
the INFORMAL SESSION.

Mayor McCoy requested Council's input regarding the continuation
of Council's policy that the meeting on the first Monday be an
INFORMAL BRIEFING SESSION.
It was the consensus of Council to discuss this matter during the
INFORMAL SESSION of 11 August 1980.
ITEM #15389
Mayor McCoy discussed with Council the request of some Members of
Council for a Charter change regarding:
Election of Mayor by the peoole
Elimination of the Seven-Four Plan
Mayor McCoy polled the Members of Council concerning this matter and
the consensus was not to persue this matter further at this time.
ITEM #15390
Mayor McCoy advised Council of a telephone call he received from
Mr. Richard Guy advising the Mayor that Edward T. Caton, III,
Beverly Middleton, and himself are on a Committee to study the
Freedom of Information Act; however, because there are new Members
of Council, he requested the Mayor to get the consensus of Council
as to whether they wish the Committee to continue.
It was the consensus of Council that the City Attorney would studv
the Freedom of Information Act, and to contact Mr. Richard Guy to
determine if the committee is needed.

Mayor McCoy advised Council he received a reauest from mayor Sid
Oman of Chesapeake requesting Virginia Beach apdoint a committee
to work with the City of Chesapeake to study water supply from
the Northwest River.

Mayor McCoy advised Council that the local Architects and Engineers
of the City have requested a two month delay in their appearance
before Council to permit them to meet with other Councils in the
Tidewater area.
ITEM #15393
Mayor McCoy requested a report from the City Manager regarding the
problems at the Virginia Beach Recreation Center in the Kempsville
Borough.
The City Manager advised mavor McCoy he had received the report;
however, would like to discuss the matter in the Executive Session.

Mayor McCoy discussed with Council the report on the MAYOR'S COMMTTTEE
ON STRATEGIES, and advised there are five (5) alternatives with regards
to Kempsville Road.
1. "Bumping" other projects;
2. Referendum;
3. Increase City's bonding limitations;
4. Legislators to approach the Highway
Commission in the City's behalf; and,
5. "Remain" with the status quo.
The City Manager advised Council he received a telephone call from
the Governor of the State regarding Kempsville Road and explained
the State has no state money for roads.
The MAYOR'S COMMITTEE ON STRATEGIES is to meet for further discussion
and report back to Council at the next Council meeting, (11 August 1980).
ITEM #15395
The City Manager discussed with Council the possibility of a Referendum
on Water and Sewer Projects on the ballot for the 1980 National election
in November.
Mayor McCoy appointed the fcllowing committee to study the proposed
Referendum on Water and Sewer. The Committee is comprised of several
members of the "First Referendum Studv Committee" and Members of the
"Second Water and Sewer Committee":

Captain Joseph W. Crawford, Jr., USN (RET.) presented a report to
Council entitled "Economic Impact of Retired Military Community of
Virginia Beach".
A copy of the report has been made a uart of these proceedings.
ITEM #15397
Councilwoman Henley discussed with Council the proposed Disclosure
Ordinance prepared by Councilman Baum, Councilwoman Henley, and City
Attorney Bimson. This Ordinance will be presented for Council action
on the Formal Agenda August 11, 1980.
ITEM #15398
Councilwoman Henley discussed with Council the 'Droposal to make
Zoning ordinances effective THIRTY (30) DAYS AFTER approval by
City Council.
ITEM #15399
Councilwoman Henley discussed with Council the policy permitting
citizens to appear before Council during the FORMAL SESSION.
Mayor McCoy appointed a "Screening" Committee, comprised of:
The Mavor
The City Manager
The City Clerk
to review requests of citizens for appearance at Council meetings
and either schedule them or direct them to the proper source to
satisfy their concern.

the Executive Session of Council.

The Citv Manager advised Council the emergency number 911 WILL NOT
work in Blackwater (approximately 900 families), and the North end
of Knotts Island. only 427-5000 is applicable to these areas.
ITEM #15402
The City Manager advised Council of the sand replenishment in the
Virginia Beach Borough. The sari-I was bulldozed onto the beach in
the area of 16th Street. This was an emergency resultin4, from the
erosion caused by a recend week-end storm.

Council was advised that as I September 1980 is a Legal Holiday
(Labor Day), there will be no Council meeting on that date.

Letter from the General Registrar certifying to Section 3.09 of
the Virginia Beach City Charter that Six Thousand Two-Hundred
(6,200) signatures on the Citizens for the Family petition are
duly qualified voters and that this number represents Twenty-five
percent (25%) of the number of persons voting in the last General
Election in Virginia Beach.
(10,535 persons signed the various petitions).

Upon motion by Councilman Baum, seconded bv Vice Mayor Heischober,
City Council voted to ADOPT the Resolution granting authority to the
City Manager and the Director of Public Utilities to take whatever
steps necessary for conservation of the City water supply in accordance
with Section 37-11 of the Code of the City of Virginia Beach, Virginia.

A meeting of the Council of the city of Virginia Beach,
Virginia, was held in the Council Chambers, in the Administration
Building, on the Fourth day of August, 1980.
On motion by Councilman Baum, seconded by Vice Mayor
Heischober, the following Resolution was adopted.
R E S 0 L U T I 0 N
WHEREAS, many localities in Tidewater, Virginia, are
presently experiencing water shortages requiring curtailment of
water usage, including Norfolk, Chesapeake and Virginia Beach;
and,
WHEREAS, areas within Virginia Beach can reasonably
expect to experience such a water shortage in the immediate
future as would require immediate implementation of water
conservation programs; and,
WHEREAS, Section 37-11 of the Code of the City of
Virginia Beach, Virginia, authorizes the City Manager and/or
Director of Public Utilities to invoke certain measures for the
conservation of water supplies during such times of water shortaae
uDon determination by tha City Council that a local emergency exists,
arising wholly or substantially out of a shortage of water.
NOW, THEREFORE, BE IT RESOLVED BY THE COU.TICIL OF THE
CITY OF VIRGINIA BEACH, VIRGINIA:
That a local emergencv exists, arising substantially
out of a shortage of water supply, and that the City @lanager and
Director of Public Utilities are hereby authorized to take whatever
steps they deem necessary for conservation of the City water supply
in accordance with Section 37-11 of the Code of the City of Virginia
Beach, Virginia.
Adopted by the Council of the City of Virginia Beach,
Virginia, on the Fourth day of August, 1980.
