RECORU OF COUNCIL BRIEFING FOR ViRGINIA BEACH CITY COUNCIL VIRGINIA BEACH, VIRGINIA 2 June 1980 The REGULAR BRIEFING of the Honorable City Council of the L;ity of Virginia BeaCh, Virginia, was called to order by Mayor Patrick L. Standing, in the Conference Room, Administration Building, Monday, 2 June 1980 at 2:00 p.m. in the afternoon. Council Members Present: John A. Baum, F. Reid Ervin, George R. FerrelT, Barbara M. Henley, Clarence A. Holland, Vice- Mayor J. Henry McCoy, Jr., Donald W. Merrick, Meyera E. Oberndorf, J. Curtis Payne, Roger L. Riggs and Mayor Patrick L. standing Council Members Absent: None ITEM #15206 Mayor Standing entertained a motion to permit Council to conduct its INFORMAL SESSION to be followed by an EXECUTIVE SESSION for the pur- pose of discussing the following: 1. Discussion or consideration of employment, assignment, appointment, promotion, demotion, sa] ari es, di sci pl ine or res i gna tion of pu bl ic officers, or employees of any public body. (Personnel Matters) 2. Consultation with legal counsel and briefing by staff members, consultants, or attorneys pertaining to actual or potential litigation or other legal matters wi thi n the jurisdic tion of the public body. Standing Council Members Voting Nay: None Council Members Absent: None ITEM #15207 Councilman Ervin stated he would be attending the next meeting of the Air Board (Hampton Roads Air Pollution Control District Com- mission) at 2:30 p.m., Thursday, June 5, 1980. Mr. Ervin wanted Council's feeling as to the recommendation that the City of Virginia Beach remain as: CLASS TWO: although from the concensus of the Air Board at its last meeting, the Cities of Portsmouth and Chesapeake were leaning towards CLASS THREE. Mr. Ervin stated the KEY to the Air Act is the "increments". The law sets up certain increments to be allowed each year which per- mits modest growth. The con c ens us of Co unc i 1 was agreement for the recommendat i on of CLASS TWO. Council asked Mr. Ervin to give an indepth report at a later date. 06/02/80 3 - ITLM #15208 vice Mayor McCoy requested the City manager to give a report on the activities at the Virginia BeaCh Recreation Center. ITEm #15209 The City Manager indicated the Library Director prepared infor- mation, Which the Council requested, regarding the "Unsolicited Materials PoliCy" WhiCh will be discusseci in the LXEUUTIVE SESSION. ITEM #15210 Wolfgang Pindur, Ph. D., Principal Investigator, Center for Urban Research and Service, Old Dominion University,presented Councii an executive summary of the Comprehensive Evaluation Of Phase I of the Virginia Beach Police Department's Integrated Criminal Apprehension Program (ICAP). A copy of this report is made a part of the NOTES of this meeting. ITEM #15211 The City Manager requested Council's approval to expidite an Ordi- nance regarding coastal Primary Sand Dune Protection Act for early hearing before City Council in order that it may be adopted and in effect by July 1, 1980. It was the concensus of Council that the City Manager expidite this Ordinance. ITEM #15212 The City Manager presented Council with a report on MediCo-Legal Liabilities, A Focus on Pre-Hospital Emergency Medical services Providers in Virginia. A copy of this report is made a part of the NOTES of this meeting. ITEM #15213 councilwoman Henley stated she had given her report on Financial Disclosure's for Appointed and Elected Officials some time ago. Mrs. Henley stated she has nothing further to add. After discussion by Members of Council, it was agreed an approp- riate Ordinance will be drafted and presented for action at the next regular meeting. 06/02/80 4 - ITEM #15214 The City Manager discussed an Article in the "Wall Street Journal" entitled "Mandate Madness" which was given to Council. ITEM #15215 The City Manager discussed a letter received by the Engineering Division, Department of Public @lorks, from E. H. Bartsch, P. E., Acting Director, Division of Water Programs, Department of Health, Richmond, regarding the City of Virginia Beach VMRC application ( #79-0357 ) for the dredgi ng of the Eastern B ran ch Of the Lynn haven River. The City Manager indicated they would still continue to dredge the Eastern BranCh of the Lynnhaven Kiver. ITEM #15216 Mr. oral Lambert, Director of Public Works, discussed Fill Permits for Lots 23 and 24, Block 1, Pinewood area. Mr. Lambert indicated the filling of these lots would not cause any drainage problems. The City Manager stated this would be deferred and brought back to Council with additional information. ITEM #15217 Tne City Manager indicated that the Building Committee has recom- commended The Shriver-Holland Associates, ArChitects, to design the Virginia Beach Science Musuem.
