Minutes of the Regular Meeting of April 18, 1977 to be presented for approval and acceptance. 8. Items for Second Reading: a. City Council is requested to approve on second reading an ordinance establishing the tax levy on real estate for the tax period January 1, 1977 through June 30, 1977. b. City Council is requested to approve on second reading an ordinance establishing the tax levy on personal property and machinery and tools for the calendar year 1977. C. City Council is requested to approve on second reading an ordinance to appropriate funds to provide public transportation to the adult activity center for developmentally disabled adults. 9. Letter from the City Manager recommending that City Council approve an ordinance to appropriate $6,742.85 to the Accomack-Northampton Trans- portation District Commission for the continuation of rail service on the Delmarva Line. (Funds will be appropriated from Unappropriated -rnljis) 10. Letter from the City Manager advising the City Council of the status of the Atlantic Mental Health Center in regard to the IRS determina- ,tion that it is not a tax exempt organization and requests authoriza- tion to the City Manager to permit the transfer of construction grant funds to the City and to appro,,)riate funds not to exceed $30,000 to indemnity the Board and its Counsel. 11. Letter from the City Manager recomrdending that City Council approve an ordinance requiring that no motor vehicle, trailer or semitrailer shall be licensed by the City of Virginia Beach unless and until the applicant shall have produced satisfactory evidence that all personal property taxes upon the motor vehicle, trailer or semitrailer to be licensed have been paid which have been properly assessed or are assessable against the applicant by said City. 12. Letter from the City Manager recommending that City Council approve an ordinance to accept a grant totalling $26,383 from the Division of Justice and Crime Prevention and to appropriate these funds: Estimated Revenue Local Total From Other A les Match Appropriation Juvenile Plan Coordinator $25,064 $1,319 $26,383 ($1,319 will be transferred from the Reserve for Contingencies-Federal Grants for the local match. MINUTES OF THE SPECIAL MEETING OF THE IIONORABLE CITY COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA April 25, 1977 A Special Meeting of the Council of the City of Virginia Beach, Virginia, was called to order by Mayor Clarence A. Holland, in the Conference Room, in the Administration Building, Princess Anne Borough, on Monday, April 25, 1977, at 11:00 a.m. Council Members present: John A. Baum, Robert B. Cromwell, Jr., George R. Ferrell, John R. Griffin, Mayor Clarence A. Ilolland, J. Henry McCoy, Jr., Councilwoman Meyera E. Oberndorf, J. Curtis Payne, Roger L. Riggs, Vice Mayor Patrick L. Waterfield, Jr. ITEM #10719 Mayor Holland entertained a motion to permit the Council to conduct an informal discussion to be followed by an executive session for the purpose of discussing the following: 1. Discussion or consideration of employment, assignment, salaries, discipline or resignation of public officers, appointees or employees of any public body. 2. Discussion or consideration of the condition, acquisition or use of real property for public purpose, or other disposition of publicly held property. 3. Investing of public funds where competition or bargaining are involved where, if made public initially, the financial interest of the governing unit would be adversely affected. 4. Consultation with legal counsel and briefing by staff members, consijltants, or attorneys pertaining to actual or potential litigation, or other legal matters within the jurisdiction of the public body. On motion by Vice Mayor Standing, and seconded by Councilman Waterfield, and by recorded vote as follows: Ayes: Councilmen John A. Baum, Robert B. Cromwell, Jr., George R. Ferrell, Jolin R. Waterfield, Jr. Nays: None Absent: None City Council voted to proceed into executive session following the informal discussion. ITEM #10720 Mayor Holland stated that Council has had a public hearing on the budget and Council briefings on the budget and asked Council if they wished to have any furtber discussion on tbe matter. Councilman Ferrell stated he was somewhat concerned over the Pendleton Project. When the project first began two or three years ago it was fully funded by the State, but now, apparently, the City is going to put approximately $50,000 into the Pendleton Project this year . The City Manager stated that the amount was $46,000 in salaries and $25,000 in matching funds with the City of Chesapeake. Mayor Holland stated he visited the Pendleton Project and, in his opinion, the people were doing an excellent job, and for the amount of money the City is participating in the benefits that come out of this project are far greater. Vice Mayor Standing stated the same thing was happening to the Emergency Medical Services. Although Vice Mayor Standing stated he had no quarrel with the services the volunteer organizations provide he does feel, however, that as the budgets get larger the organizations could lose some of their independence and some of their initiative to be independent. ITEM #10721 Councilwoman Oberndorf requested information regarding the Employee Service Award. The City Manager stated that the Service Awards were something Council initiated several years ago. It is predominately a recognition for service and time the employee has given to the City. The cash awards are given to the employee after he/she has been with the City 10 years; between 10 and 20 years, 1 percent of the employee's salary; 20 to 30 years, 2 percent; 30 to 40 years, 4 percent; and, 40 to 50 years, 5 percent of the employee's salary, however, the City Manager did state that the maximum amount of money any one employee can receive is $300.00. ITEM #10722 Councilman Riggs requested Council to consider the possibility of offering a tax break to homeowners if they use the Solor Energy system of heating their homes. The Governor recently signed an ordinance on this matter, and Councilman Riggs requested Council to consider the possibility. ITEM #10723 Councilman McCoy asked if the City was going to hire a consultant regarding the salary increases. If Council does decide to employ a consultant perhaps it would be wise to form a committee to pick the consultant, made up of two Council Members and two from staff. The City Manager stated it would be a study of executive salaries, and the City could wait to have the consultant cover next years budget. ITEM #10724 Mayor Holland stated that since 1968 the Council has had a tax rate that started at $1.29 and, except for 1972, has had a steady decline to where the City has decreased the true tax rate by 32.5 percent. However, while the tax rate decreased assessments increased over this period of time. A reserve of five percent is not an uncommon business approach to having a reserve, and if the City could increase the tax rate by 5 cents it would bring in $1.2 Million, and place this in unallocated funds it would put the City in a better position in which we would be better prepared next year in trying to continue balancing our budget and to have a reserve that would be beneficial to the City. Vice Mayor Standing stated, in his opinion, the Council was speaking of two different things: (1) the Reserve for Contingencies, which you would have for emergencies; and, (2) Reserve that is built up to hold down a tax increase for next year. Vice Mayor Standing further stated that if the City needed to raise taxes to adequately provide services then that can be adequately pre- sented to the citizens of this City as a real need, however, if you want to raise taxes to soften a future tax increase, that might be needed, that's an awfully hard thought to understand. Mayor Ilolland stated this was not being done just for that purpose along, because hefeels that a good, sound fiscal responsibility is a Reserve, just as much as providing services. Councilman Griffin asked the City Manager if, "He had not been trying to maintain a budget without a tax increase would he (City Manager) have had the reserves, or the unappropriated surplus, as low as it is now?" The City Manager stated that any administrator would like to have a sizable reserve, and the reserve of $2.5 Million which was recommended to remain in a "Working Fund" was of such a size that he could not recommend a tax increase in order for the fund to be larger. Councilman Cromwell stated that what concerns him is he has never known a year to go by where there wasn't an emergency to meet. ITEM #10725 City Council adjourned the special meeting at 12:00 Noon. Waterfield, Jr. Nays: None Absent: None At its meeting of November 24, 1975, City Council accepted the federal construction grant, land, buildings, personal property and other assets of the Atlantic Mental Health Center, formerly known as the Atlantic Mental Hygiene Center Advisory Board, Incorporated. $30,000 is potentially subject to a tax in the amount of $3,980. The City takes the position that the Atlantic Mental Health Center is a tax exempt organization, however, the IRS seems to disagree, and we had hoped that the IRS review would be accomplished within a relatively short period of time. However, the matter seems to be prolonged, and as of this date, there is no resolution of the issue. Therefore, City Council authorized the City Manager to sign an agreement with the attorney for the dissolved Atlantic Mental Ilealth Center Board, which would permit the transfer of funds to the City in return for the City's willingness to indemnify the Board and its counsel up to an amount not to exceed $30,000.
