FEBRUARY 25, 1972 SPECIAL SESSI MINUTES OF THE HONORABLI@ CITY COUNCIL OF THE CITY OF VIRGINIA BEACII, VIRGINIA February 25, 1972 A Special Me6ting of the City Council of the City of Virginia Beach, called '-y the City @l'inager, Mr. Roger Scott, as provided in Section 2-9 of the City Dde was helci "n the City Council Conference Room on Friday, February 26, 972, at 10:00 a.m. The purpose of the meeting was to review the problems presented by t'le erosion of sand on the beach in the Beach Borough and the proposed dred,.Lng of Rudee Inlet to determine the feasibility of utilizing the sand deposited in the Rudee Inlet Channel to replenish the sand on the beach. An emergency appears to exist in these matters. Councilmen present: Robert H. Callis, Jr., Robert B. Cromwell, Jr., Frank A. Dusch, F. Reid Ervin, George R. Ferrell, Clarence A. Holland, D. @lurray Malbon, J. Curtis Payne, Vice Mayor Earl M. Tebault, Floyd E. Waterfield, Jr., and Mayor Donald H. Rhodes. Councilmen absent: None ITEM # 423@ Present at the meeting from the U. S. Army Corps. of Engineers were: Colonel James H. Tormey Mr. Hyman Fine Mr. William H. Tamm Mr. Curtis Basket resent at the meeting from the Virginia Beach Erosion Commission were: Mr. Richard Short Mr. Barrett Bryant gr. Elsworth Morse from the firm of Langley, MacDonald & Overman Mr. Joe MacDonald, Engineering Consultant to the Erosion Commission Mr. William Overman, Engineering Consultant to the Erosion Commission Present at the meeting from the Virginia Beach Tnnkeepers Association were: Mr. Scott Sterling Mr. Charles Gardner The Mayor requested the City Njanager, @Ir. Roger Scott, to outline the problem and present the report of the City staff. Mr. Scott indicated that the report he received from the Director of Community Services, Mr. Fleming, indicated that there are apparently four possible solutions, which are as follows: 1. Employment of Commercial dredges. 2. Installation of the City owned dredge presently in the Lynnhaven River in Rudee Inlet. 3. Utilizing one or more dredges owned by Erosion Commission. 4. Truck haul of material. Mr. Fleming noted that the U. S. Army Corps. of Engineers' recommendations to the Erosion Commission recommended placing city owned 12 inch dredge in Rudee Inlet on a 24 hour, 7 day a week basis. Estimates submitted with the report indicated that this could be done and would cost approximately $16,700. for a 30-day period. Continued beyond 30 days it would cost an additional $7,000. per month. Considerable discussion ensued during which the emergency nature of the problem with respect to the erosion of the beaches and the possible effect on 'the summer tourist season with consequent loss of revenue was raised. Councilman Cromwell noted that when the city assisted the Erosion Commission w @ the purchase of the last dredge it had been assured that it would main- t n the channel in Rudee Inlet. Councilman (.'allis noted that the cost of c mercial dredging, upon which a time schedule could be imposed wiih regard to the cubic yardage pumped, could be considerably less than the loss of revenue. City Manager Scott advised the Council that the low balance in the surplus fund,should the City Council appropriate $100,000. for dredging, would seriously hamper City operations. A request was made by Councilmen Holland, and Ferrell for clarification of conflicting statements regarding the condition of the beach. Colonel Tormey indicated that his records indicated a lower level of sand on the beaches than normal at this time of year with no positive movement to indicate its immediate build-up. Mr. Joe MacDonald, Consulting Engineer for the Erosion Commission noted that his cross sections indicated a loss of sand on the beaches, but also noted that such erosion periodically occurred, but was subsequently subject to build-up upon changes of the littoral drift and tidal currents. Mr. Scott Sterling and Mr. Charles Gardner, representing the Innkeepers, stressed the need for immediate action after considering the proximity of the summer season. ITEM # 4@-34 It becatae apparent that no satisfactory conclilssion was i,mediate due to the multiplicity of interests and persons present, it being.a matter which, in the opinion of the City Attorney, could be considered in closed session, therefore, upon motion by Councilman Dusch, seconded by Councilman Holland and by recorded vote as follows: Ayes: Councilmen Robert H. Nays: None Absent: None City Council recessed into @xecutive Session at 11:30 a.m. ITEM # 423-) At 12:2S p.m. at the call of the Mayor, City Council reassembled in public session to receive the recommendations of the temporary committee composed of representatives from the U. S. Army Corps. of Engineers, the Virginia Beach Erosion Commission and the Community Services Department of the City of Virginia Beach. Roll Call as follows: Rresent: Councilmen Robert H. Waterfield, Jr. Mr. George Hanbury reported to the City Council that as a result of a con- ference held between the Department of Community Services, the Virginia Beach Erosion Commission and the U. S. Army Corps. of Engineers that agree- ment had been reached that the problem could be solved, or attempted to be solved, with the use of the 12 inch dredge owned by the Erosion Commission now in Owls Creek operating on a twenty-four hours a day basis on a seven day week and the installation of the City dredge in Rudee Inlet also for 24 hour a day seven days a week operation to Testore and nourish the beach front, it is the recommendation of the committee that $17,000., seventeen thousand dollars be appropriated to provide for the installation of the City dredge in Rudee Inlet and that within thirty (30) days a report will be made to the Council as to the effectivenes@ of this operation and at that time further recommendatibns will be made whether to continue the city's operation or bring in a commercial dredge; also, during this period of time further technicalities will be resolved regarding hauling of sand from Lynnhaven to be placed on the beach for continued nourishment. This request was made by the Erosion Commission, the Department of Community Services and the U. S. Armp Corps. of Engineers. louncilman Malbon asked if the $17,000 included the operation of the city redge for thirty days as well as the cost of installation in Rudee Inlet nd was assured that it did cover both costs. Waterfield, JT. City Council authorized the expenditure of $17,000. (seventeen thousand dollars) for expenses to be incurred in dredging sand from Rudee Inlet and the depositing of the subject sand upon the beaches as designated by the Department of Community Services, the Virginia Beach Erosion Commission and the U. S. Army Corps. of Engineers. Approval is contingent, weather con- ditions permittin@, upon the twenty-fotir (24) hour operation of the Erosion Commission's 12 inch dredge presently in Owls Creek, the relocation of the City owned dredge, presently in the western branch of the Lynnhaven River, in Rudee Inlet and the twenty-four (24) hour operation of t@e subject dredge for a thirty (30) day period, weatlier conditions permitting. Approval is lso subject to commitment by the IJ. S. Arm), Corps. of Engineers, on a one ime basis, for one-half (1/2) the cost of dredging the sand from the Rudee @iilet sand trap. Waterfield, Jr. City Council requested that a joint committee consisting of the Erosion Commission, the U. S. Army Corps. of Engineers and the Virginia Beach City staff prepare and submit back to the City Council, within thirty (30) days, a report on the removal and deposit of sand from Rudee Inlet and Owls Creek and its effect on the beaches and in the meantime prepare plans and specifications for the possibility of receiving bids from commercial facilities and to proceed with supplemental report regarding sources of sand including truck haul. In connection with the above motion, Mayor Rhodes sought agreement of the Erosion Commission members and Col. Tormey of the U. S. Army Corp. of Engineers and the City staff concerning responsibility for and preparation for the report requested and was assured that the respdctive parties would work together in this matter.
