Court Room, in the Borougii of Princess Anne, on Monday, February 24, 1969, at
ten o'clock A. M.

ORDINANCE CLOSING STREET
WHEREAS, proper notice that Clark-Whitehill company, a General Partner-
ship comprised of Barry D. Clark, Tnc. and Howard M. Weisberg, Inc., both
Virginia Corporations, and Clayton F. Russell and Barbara S. Russell, husband
and wife, did make application to the Council of the City of Virginia Beach,
Virginia to have the remaining portion of an unnamed street, formerly known
as 20th Street, abandoned, vacated and closed, said street being physically
non-existent but shown on the plat of Pecan Gardens, which said plat is duly
recorded in the Clerk's office of the Circuit Court of the City of Virginia
Beach, Virginia in Map Book 7 at page 70, was duly posted on January 3, 1969
at the Court House of the Circuit Court of the City of Virginia Beach,
Virginia, and at the front door of the City Hall Annex, Virginia Reach,
and at a point near the described property on Pres-idential Boulevard, for-
merly Avenue C in the City of Virginia Beach, Virginia, all being public
places in said city; and
WHEREAS, said application was made to the aforesaid City Council,and
pursuant to Title 15.1-Section 364 of the Code of Virginia, 1950, as amended,
the Council on January 27, 1969, which was more than ten days after said
posting of the aforesaid notice, appointed Charles S. Kiley, David B. Norman
and A. Worth Petty as Viewers pursuant to the statute for such cases made and
provided, to view the remaining portion of an unnamed street, formerly known
as 20th Street, which said street is physicallynon-existent but is shown on
the plat above mentioned and which is sought to be closed, vacated and dis-
continued, and to rep6rt in writing whether in their opinion any, and if any,
inconvenience would result from the dis-continuing, vacating, closing and

the following resolution was adopted:

WHEREAS, the,Council has previously approved the exchange of
easements with the Virginia Electric and Power Company; and
WHEREAS, the Power Company desires greater clarification of
this approval.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
VIRGINIA BEACH, VIRGINIA:
That the Council approves the granting of an easement to Virginia
Electric and Power Company for a right of way across City property
between the Courthouse and the City Garage, and further, approves
the granting of an easement to Virginia Electric and Power Company
along the line of the Sewage Pumping Station serving the Courthouse,
lying generally north of Princess Anne Road.
BE I-. FURTHER RESOLVED, that the Council accepts the grant of
an easement to the City of Virginia Beach by the Virginia Electric
and Power Company, and understands and agrees that it will pay the
necessary costs estimated at approximately $1,800.00 incurred by the
dislocation of a transmission line owned by the Company in this last
easement.

DISCHARGE OF FIREARMS.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH2
VIRGINIA:
That Section 38-2, of the Virginia Beach City Code is hereby
amended and reordained to read as follows:
Section 38-2. Discharge of firearms; slingshots, etc., on, along
or within one hundred yards of roads, etc., gelierally.
it shall be unlawful for any person to discharge any firearm,
spring-propelled pistol or rifle, air-propelled pistol or rifle or
slingshot in or along any public road in the city or within one
hundred yards of any public road, building or dwell-ing in the city-
or, while on shore, within 100 yards of any public waters; provided,
however, that nothing in this section shall be construed to prohibit
the use of firearms by rp-embers of the police department or city
sergeants acting in performance of their duties or by members of the
military, naval, or air forces of the United States or this state,
acting in performance of their duties.
The foregoing restrictions shall. not be construed to apply to
persons lawfully engaged in the hunting and taking of migratory birds,
within the meaning of the Migratory Bird Treaty Act.

WHEREAS, the Council of the City of Virginia Beach, Virginia,
has heretofore, by resolution, approved the development of a Virginia
State Park to be situa@ed south of the Federal Wildlife Refuge; and
WHEREAS, said concurrence extended solely to the development
of a park in the Barbour's Hill area; and
WHEREAS, the diversion of the entire peninsula south of the said
Federal Wildlife Refuge would have serious adverse effect on the tax
base of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
VIRGINIA BEACH, VIRGINIA:
That the Council vigorously opposes expansion of the State Park
beyond the scope envisaged by its resolution formerly adopted.
BE IT FURTHER RESOLVED, that the City Manager is hereby autho-
rized and directed to exert his best efforts to make this opposition
known to such state officials as may be appropriat.e in order to
obtain their assistance in accomplishing the intent of this Council
as expressed herein.

That Ordinance No. 91 is hereby amended and reordained as

"That the fire districts, as mentioned in the Building, Electrical
and other Codes of the City, shall be as fol.lows:
(a) In the Borough of Virginia Beach, the fire district shall
include all districts and parcels of land zoned in the Master Zoning
Ordinance of the former City of Virginia Beach as M-11 District (@lotel-
Hotel District@, B-1 District (Retail- Business District), and B-2
District (General Business District).
(b) In the Boroughs of Lynnhaveti, B@iyside, Kempsville, Princess
Anne, Pungo and Blackwater, the fire districts shall include all
districts and parcels of land zoned in the Master Zoning Pl.an of the
former County of Princess Anne as R-@l (@fultiple Faniil.y Residence
District), C-Li, 2, and 3 (Limited Coi@,.irercial District 1, 2, and 3),
C-C 1, 2, and 3 (Ceneral Conimercial D4strict 1, 2, and 3), T-1 (Motel

District).
That all ordinances or parts of ordinances in conflict with the

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA
BEACH2 VIRGINIA:
That Section 410.4 - Group "Gll of the Building Code of
the City of Virginia Beach is amended in the last line of
said section by changing the wording appearing under the
column "Story Height" and the column "One Story" from "One"
and 1110,000", respectively, to read "Not Permitted" in each
case.
