at 2:00 p.m., on Monday, July 12, 1976, for the purpose of conducting public

a. City Council is requested to approve on second reading an ordinance
appropriating $1,600,000 to the School Board of the City of
Virginia Beacii, Virginia for the purchase of the GEX property.
b. City Council is requested to approve on second reading an approp-
riation in the amount of $2,175,000 for the following Iiighway and
Engineering projects:

2-400 Holland Swamp Road Phase 1 783,300
2-507 Long Creek Canal 862,000

C. City Council is requested to approve on second reading that revenues
from other agencies be increased by $92,600.00 and expenditures in
commensurate line items be authorzied by a like amount in regard to
categorical funds which must be used in conducting specifically
approved programs such as vocational education, pilot studies, the
National Defense l@ducation Act, etc.
d. City Council is requested to approve on second reading the transfer
of three vehicles from the Fire Department to initiate a Cardiac
Technician zone c@ir program and further, approve on second reading
an appropriation of $13,SOO in the 1976-77 Operating Budget for the
purchase of three new vehicles iri the Fire I)epartmelit.
e. City Council is re@quested to approve on second reading an approp-
riation of $8,500 for the Virgini@i Beach 'Fomorrow Program to be
transferred from tlie @Vorking Capital Account to the City Council's
budget and be drawn Lipon after I)roper vouchers and financial reports
have been submittc@(l.
f. City Council is requested to approve on second reading a Resolution
in support of a gi-ant application for the training and education of
law enforcement officers and personnel. 'rhe application totals $10,000,
of this amount, the local matching re(juirement totals $SOO.
g. City Council is requested to approve on second reading a Resolution
in support of a public highway s@ifety grant application for an
Emergency Vehicle Operator Course. The at)plication totals $8,264,
of this amount, tlie local matchirig re(juirements totals $4,234 of
in-kind services for ,,-alaries.
h. City Council is requested to approve on second reading a grant award
offered by the Division of Justice and Crime Prevention totaling
$54,543 for an aut@omated police defense reporting system, and further
authorize the Cit@, Maiiager to accept this grant on behalf of the
City of Virginia Beacli aiid transfer $1,728 in local matching funds
from the Reserve I-or (,ontingencies-Fe(ter@il Grants.

$1,962.68.

a proposed agreement between Hampton Roads Sanitation District and the

of the interceptor force mains facilities to serve the Little Neck
Peninsula; and further authorize the City Manager to execute the document
on behalf of the City. Necessary funds for the project will be included
in 1977-78 bond issue.

WHEREAS, the Crime Omnibus and Safe Streets Act of 1968, as amended,
provides Federal funds to .issist political subdivisions of the various
states in improving their respective criminal justice systems in order
to reduce or eliminate inadequacies; ana
WHEREAS, there exists nadequacies within the Law Enforcement sector
of the Criminal Justice system of this City; and
WHEREAS, there exists i need in improving training of their police
forces in order to red-,)ce or eliminate inadequacies; and
WHEREAS, the subject training programs will cost a total of $10,000
of which the City's proportionate share amounts to $500; and
WHEREAS, it is necess3@@y that each politi(--al subdivision participating
in the program provide a Droportionate share of the cost thereof,

That Chapter 37 of the Code of the City of Virginia Beach be amended by adding
thereto an Article IV, as follows:
ARTICLE IV.
TERMINATION OF SERVICE UPON REQUEST
OF PRIVATE SEWAGE DISPOSAL SYSTEMS
Section 37-33. Applicablility.
Any water custome@, t.)f the City of Virginia Beach who has not paid the
applicable rates and charges to any private sewage disposal system company within
the City for service rendel'(@d, and who hds been notified pursuant to State statute
to cease disposal of sewage into the system within two months, may have their
service terminated upon @lt@est of the private i.itility involved.
Section 37-34. Procedure.
a) After the st@itutoty period for the customer to cease disposal of
sewage into the system @iis elapsed, the i)rivate, utility company shall notify the
customer in writing thdt wai,er service sl@all be discontinued by the City if pay-
ment for the delinquent ;ewerage bill is @iot re(eived by the utility within ten
(10) days.
b) After t@ie ten @'iO) days haF@ expiv,ed, the private utility company
may notify the Department or Public Utilities tc) turn off water service to the
respective property. A copy of such notification shall be sent to the customer.
c) Within five @.5) days after receir)t of the notice from the private
utility company, the Depar*ment of Publi( Utililies will turn off water service
and hang a notice of tuy'n-otf on the front door of the premises explaining the
reason for discontinuation of service.
d) Upon nolif;cat@ion from the private utility company that service is
to be restored, the City o" Virginia Beach will restore said service within one
business day.
e) A charge of seven dollars ($7.00) will be rendered for each reques+l
from the private utility to discontinue service This charge shall be billed
directly to the private utility company. The Department of Public Utilities will
not make any monetary collection for private utility companies.
f) The Department of Public Utilities will not be liable for any damages
resulting from the discontinuance of water servlce when requested so to do under
this section.
This ordinance shall be effective fropi and after the date of its passage.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA:
That Section 5-22 and 5-31 of Article III of Chapter 5 of the Code of
the City of Virginia Beach, Virginia, is hereby amended and reordained as follows:
Section 5-22. Impoundinq of dog not vaccinated, etc.
Any dog found in the city not vaccinated, as provided for in Section 5-20,
or not wearing an authentic vaccination tag, as provided for in Section 5-23, shall
be impounded by the official charged with enfor(@ing this division, for a period of
seven days. The owner of ayiy such dog ma,y secure the release of his dog by pro-
ducing proof of ownership and either presenting a@i authorized rabies certificate
or by having such dog pri)pc.?-ly res+lrained unti" va(@cinated or inoculated within ten
days of the time of reledse and pa.ying the c()sts of impounding and caring for such
dog. At the expiration (@f the severi-day )er@,)d, any dog not so claimed by its
owner or custodian shall be disposed of by giving it into the possession of any
person who may be willing to pay for the -ost of vaccination plus the fee of $6.50.
If not so disposed of, any such dog shall be destroyed in a humane manner by the
officer enforcing this d-,vision.
Section 5-31. Same - Impounding dogs or cats in violation of Section 5-30; disposi-
tion of iinpounded dog or cat not @,laimed.
It shall be the be the duty of a@ aniinal control officer of the Bureau of
Animal Control who may find any dog or cat running at large in violation of Section
5-30 to take the dog or cat into possessi()n, and a record made at the time and place
of seizure. Impounded dogs or cats shall be kept for not less than seven days
unless sooner reclaimed b,y their owners. If by i permit tag or by other means, the
owner can be identified, the Superintendent of the Bureau of Animal Control shall
immediately within 48 hours of impoundment notify the owner by telephone or mail of
the impoundment of the animal. Dogs or cats not claimed by their owners within seven
days, or placed in suitable new homes after the seven-day holding period, shall ho
humanely euthanized by the Bureau of Animal Control or by an agency delegated by
it to exercise that authority.
This ordinance shall be effective on and after July 1, 1976.
