Robert Matthias, Assistant to the City Manager, advised a Breakfast has been Scheduled with the City
Legislative Delegation on October 20, 1994. 7he Legislative Package will be transmitted to the
Legislators for the 1995 General Assembly. 7he package is &vided as follows:
FUNDING ISSUES IN PRIORITY ORDER
1. Request $5-MILLION to fund the construction of the
expansion of the rirginia Marine Science Museum.
2. Request $458,950, which is 50% of the (ovt, to relocate the
Pendleton Child Service Center.
3. Request $5-MILLION for partial fundirig ()f the Hurricane
Protection Program
4. Request thc State to pay the City's share of the cost of
establishing the new Family Court System, if the System is
established. The total local cost iv estimated to be $800,000,
STATEWIDE FUNDING POLICY ISSUES
1. Request for fufl funding of education and any mandated
teacher salary increases.
2. Request for full funding for State Aid to Libraries.
3. The Commonwealth is requested to include funiang for
Constitutional Officers'fringe benefits@ which was deleted for
fiscal year 1996 during the adoption of the current biennium
budget.

1. The General Assembly is requested to amend the Code of
Virignia dealing with indecent exposure violations.

2. Ihe General Assembly is requested to change the Code of
rirginia, which would make carrying concealed edged or
pointed weapons (such as ice picks) a violadon of the Code.
3. Ihe General Assembly is requested to amend the Code dealing
with driving while intoxicated that would allow when serious
physical injuries to another are caused, the offender may be
charged with a Class 6 Felony upon thefirst conviction invtead
of a misdemeanor that is currently the case.
4. Ihe General Assembly iv requested to amend the Code, so that
carrying a concealed firearm becomes a Class 6 Felony upon
the first conviction instead of a Class I Mii;demeanor.
5. 7he (;eneral Assembly is requested to amend Secdon 19.2-81
of the Code to allow issuing of warrants for arrest for persons
injured itt aii accident caused by their driving while impaired.
6 ]'he General Assembly is requested to ametid Section 19.2-81
to enable an officer to make an arrest without a warrant for
designated niivdemeanors such as shoplifting, carrying a
conceakd weapon or carrying a weapon on school property,
in violatioti of either the State law "or a similar local
ordinance " upori the reasonable complaint of one who
observed the off(!nse.
7 17ie (,eneral Assembly is requested to amend the Code of
Virginia to expand the Zero Tolerance Provision of the
Omnibus Alcohol Safety Act to include all the DUI boating
codes.
8. The Getteral Assembly is requested to amend the Code of
@irginia, Section 29.1-744.1 to allow a county, city or town, by
()rdinance, t() regulate the distance personal water craft in
operation shall maintain from the shore, docks and swimmers,
provided that such distance is not greater than 100 feet.
9. I'he (,eneral Assembly is requested to amend the Code of
Krginia, Section 46.2-1217 and Section 46.2-1231 dealing
with the towing of motor vehicles,
Verbiage shall be added to the Educational Funding issue. The @tate shall also examine funding the true
cost of the standards of education that the citizens of thc Commonwealth expect their children to receive.
Relative the request to amending Section 19.2-81, concerning enabling an officer to make an arrest
without a warrant, this City Attorriey advised the section would be redrafted to be more speci c.

The Department of Public Utilities has! requested an additional item be added to the Legislative Package:
Bonding of Public Construction Projects.
The General Assembly is requested to amend Section 11 -58 of
the Code of Virginia dealing with Performance and Payment
Bonds to allow past performance to be used in determining
whether a surety can bond a project.

Mayor Oberndorf requested Members of City Council to bring forward proposals for the LegisUdve
Package. If designated appropriate, same will be added to the Legisladve Package to be presented to the
Delegation at their Breakfast on October 20, 1994,
Councibnan Harrison suggested the Freedom of Information Act be AMENDED to allow three members
of City Council rather than just two be allowed to meet.
Councibnan Moss advised the Reapportionment Plan approved on the Referendum be iinplemented. 7he
draft documents shall be distributed to Meinbers of Citv Council in their Agenda packages of October 11,
1994, with a vote on October 25, 1994.
Councibnan Moss advised his guidatice to the City Attorney was basically the elections taking place in
1996 would limit the Borough seats to a 2-year term in order for all the Borough Seats to be voted for
election in 1988. The plan would be fully implemented by the year 2000. 7he Charter Amendment
wording would state: "Upon adoption by the Ce?teral Assembly, the City Council would then draw the
boundary lines, and have the submiysion to the Justice Department by September 1, 1995".

1 A RESOLUTION EXPRESSING THE
2 GRATITUDE OF THE CITY COUNCIL TO THE
3 ATTORNEY GENERAL OF THE COMMONWEALTH
4 OF VIRGINIA FOR HIS EFFORTS IN
5 SUPPORT OF THE LAKE GASTON WATER
6 SUPPLY PROJECT
7 WHEREAS, the Lake Gaston Water Supply Project continues
8 to be the subject of litigation and administrative proceedings,
9 notwithstanding the fact that, after almost two decades of study,
10 there is no credible evidence that the proposed withdrawal of water
11 from the Roanoke River system will cause any significant adverse
12 effects, environmental or otherwise;
13 WHEREAS, for many years, the City of Virginia Beach did
14 not have the support of the Commonwealth of Virginia in litigation
15 concerning the Project;
16 WHEREAS, since assuming office in January, 1994, James S.
17 Gilmore, III, Attorney General of the Colftmonwealth of virginia, has
18 undertaken a vigorous, forceful, and principled course of advocacy
19 in support of the Project by actively and personally participating
20 in the litigation and administrative proceedings concerning the
21 Project;
22 WHEREAS, in doing so, Attorney General Gilmore has
23 demonstrated uncommon statesmanship by recognizing that the
24 completion of the Lake Gaston Water Supply Project will be of
25 benefit to the entire Commonwealth of Virqinia, and not merely to
26 Virginia Beach and its neighbors in Southeastern Virginia; and
27 WHEREAS, by committing the power and prestige of his
28 office, as well as the considerable weight of the legal arguments
29 advanced by him in support of the Project, Attorney General Gilmore
30 has provided immeasurable assistance to the City of Virginia Beach
31 and has greatly furthered the attainment of a critical public
32 project;
33 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
34 OF VIRGINIA BEACH, VIRGINIA:
35 That the City Council hereby expresses its deepest
36 gratitude and appreciation to James S. Gilmore, III, Attorney
37 General of the Commonwealth, for the efforts undertaken by him in
38 support of the Lake Gaston Water Supply Project.
39 BE IT FURTHER RESOLVED BY THE COUNCIL OF THE CITY OF
40 VIRGINIA BEACH, VIRGINIA:
41 That the City Clerk is hereby directed to transmit a

3 STATE FUNDING IN THE AMOUNT OF $147,866, AND FEES IN THE AMOUNT OF
4 $15,408 FOR A TOTAL OF $776,567 IN ADDITIONAL FUNDING AND TO CREATE
5 6.0 FULL TIME PERMANENT FTES AND 6.3 PART TIME PERMANENT FTES TO
6 THE DEPARTMENT OF MENTAL HEALTH, MENTAL RETARDATION, AND
7 SUBSTANCE ABUSE

9 WHEREAS, the Community Services Board and the Department of Mental Health,
10 Mental Retardation, and Substance Abuse are responsible for the coordination and
I I implementation of mental health, mental retardation, and substance abuse services;
12 @EREAS, the department has received $45,200 in additional General Assembly
13 appropriations for disability areas targeted at enhancing service capacity where waiting lists
14 exist;
15 VMEREAS, the department has received $3,000 in additional state funding to provide
16 t@ing consultation on enhancing treatment models for inentally ill substance abusers;
17 WHEREAS, the department has received an additional allocation of $1,281 in federal
18 PATH Homeless grant funding for rent subsidies for the psychiatrically disabled;
19 WHEREAS, the department has received an additional allocation of $8,000 in "State
20 CSA" funds for in-home interventions;
21 @EREAS, the department has estimated a $3,500 increase in state rehabilitative
22 services funding for Employment Services assistance for handicapped customers;
23 NMEREAS, the departinent has received $1,500 in state funding for the renewal of the
24 "Protect Our Kids in Traffic" Grant;
25 WHEREAS, the department has received an increased allocation of $58,311 in federal
26 Part H Early Intervention grant funding for handicapped children and families;
27 VMEREAS, the department has increased estimated medicaid revenues by $227,262 and
28 estimated state matching funds by $965 for consumer services plan enhancements based on
29 Medicaid State Plan Option (SPO) eligibility;
30 VMEREAS, the department has increased estimated medicaid revenues by $306,939,
31 estimated In-Home Client Fees by $15,408, and estimated state matching funds by $14,058 for
32 service plan enhancements for 26 consumers based on state approval of Medicaid Waiver plans
33 funding for residential and day support services, also includes, two 15 passenger vans;
34 @EREAS, the department has received $19,500 in additional federal grant funding for
35 prevention allocations targeted at children of incarcerated parents and Project Link Child Care;
36 WHEREAS, the depaliment has rrceived $71,643 in additional state funding for State
37 Substance Abuse Residential treatment services follow-up funds;
38 WHEREAS, an additional 6.0 Full-Time Pertnanent FTEs and 6.3 Part-Time Permanent
39 FTEs are requested for the Department of Mental Health, Mental Retardation, and Substance
40 Abuse to provide service plan enhancements based on Medicaid State Plan Option eligibility and
41 state approval of Medicaid Waiver plans
42 VMEREAS, the funding requires no increase local funding match;

44 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
45 OF VIRGINIA BEACH, VIRGINIA: 1. That funding in the amount of $45,200 in additional
46 General Assembly appropriations be accepted and appropriated for disability areas targeted at
47 enhancing service capacity where waiting lists exist; 2. That funding in the amount of $3,000

TAKE-HOME POLJCE VEHICLE POLICY. 7he policy of take-home vehicles began as a union
association process between the City and the Police Unit in Indianapolis in 1969. 7his way accomplished
in lieu of pay raises. Henrico, Fairfax and Chesapeake do have existing programs with various
arrangements.
