Richard J/.~ebbon, City Clerk AN ORDINANCE MAKING APPROPRIATIONS OF INTEREST EARNED ON GENERAL REVENUE SHARING FUNDS AND GENERAL REVENUE SHARING FUNDS EXPECTED TO BE RECEIVED FOR FISCAL YEAR ENDING JUNE 30, 1976, IN THE SUM OF FOUR MILLION~ SEVEN HUNDRED SIXTY EIGHT THOUSAND DOLLARS ($4,768,000) AND REGULATING THE ?AY- MENT OF MONEY OUT OF THE CITY TREASURY WHEREAS, the City of Virginia Beach has recieved interest totaling $631,338 from investment of general revenue sharing funds on deposit; and WHEREAS, the City of Virginia Beach expects to receive $4,136,662 from general revenue sharing for fiscal year ending June 30, 1976~ NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF T~IE CITY OF VIRGINIA BEACH, VIRGINIA: That the amounts herein named aggregating four million, seven hundred sixty eight thousand dollars ($4,768,000) or so much thereof as may be necessary and received are hereby appropriated for the following capital improvements for fiscal year ending June 30, 1976. No department, bureau, agency or individual receiving appropriations under the provisions of this ordinance shall exceed the amount set forth except with consent and approval of City Council first being obtained, but it is expressly provided that the restrictions with respect to the .expenditure of the funds appropriated shall apply only to total amounts for types of projects set forth in this ordinance. VIRGINIA: 1. It is hereby determined to be necessary and expedient for the City of Virginia Beach to construct and improve various public facilities and improvements, all of which will promote the development and pUblic Welfare of the City, and to borrow money for such purpose~ and issue the City's general obligation bonds therefor. 2. Waterf~eld, Jr. City Council approved the attached Resolution, to request the State High- way and Transportation Commissioner to proceed with the acquisition of necessary rights of way for Project U000-134-109, PE-I01, Witchduck Road, and to convey title to the City of Virginia Beach. The City, in turn, agreed to reimburse the State Highway and Transportation Department for 15~ of all costs incurred in the acquisition and conveyance of such rights of way: RESOLUTION WHEREAS, Section 33.1-89 of the Code of Virginia, as amended by the 1970 session of the General Assembly, authorizes the State Highway & Transportation Commissioner to acquire rights of way for the construction, reconstruction, alteration, mainte- nance and repair of public highways within municipalities on projects which are constructed with State or Federal participa- tion; and WHEREAS, Section 33.1-89, as amended, further provides that the State Highway & Transportation Commissioner may exercise such authority only upon receipt of official request from the city or town involved, now THEREFORE, BE IT RESOLVED, that the City Council of the City of Virginia Beach hereby requests the State Highway & Transportation Commissioner to acquire the necessary rights of way for Project U000-134-109, PE-101, Witchduck Road within the Corporate Limits of said City and to convey the title to such right of way to the City of Virginia Beach and agrees to reimburs the State Highway & Transportation Department for fifteen percent (15%) of all costs incurred in the acquisition and conveyance of such rights of way; and it is understood that such acquisitions will be handled by the Commissioner under established policies and procedures and his decision in all instances will be final. City.Council defered action until August 18, 1975 on the application of Autot~onic Systems, Inc. for a Use Permit. This application was adver- tised to 'be heard at that time. ITEM #8728 Mayor Payne informed a representative of the Virginia Beach Development Council that he is asking Councilman Standing to recommend to City Council what recommendations should be taken under advisement and possibly adopt concerning the water supply to Virginia Beach. ITEM #8729 Councilman Cromwell indicated that he had received a request from Mr. Gibbs of the Ocean Park Civic League asking the City to determine the property lines an~ rights-of-way on certain unimproved roads in Ocean Park and on Shore Drive as ~ appears that public facilities are being placed on what might be private prope~ The City Manager was requested to investigate the matter.
