N A true COpy. Tewte: To the HONORABLE BOARD OF SUPV~RVISORS OF PRINCESS ANNE COUNTY. Your petitioner, ELIZABETH RIVER SHORES HOLDING CORPORATION, ! respectfully shows unto the Board of Supervisors of Princess Anne County, i the following case: ! (1) That petitioner has developed Elizabeth River Shores in I Princess Anne County; and i (2) The map of said subdivision is recorded in Map Book 32, i, at Page 22, and a corrected map is recorded in Map Book 37, at Page 41. ~ That the said plat shows a ten foot drainage easement or right granted the i County of Princess Anne, over the Southern ten (10) feet of Lot 68; and i (3) That since the platting of said property it appears more i feasible to relocate said easement, and petitioner desires to have vacated i and abandoned the ten foot drainage easement as it now exists and to make and establish it along and through Lot 69, the Southern line of which i easement will run along and parallel to the Northern line of the lot of iS. J. Faris, conveyed to him by deed duly of record; and (4) That such action does not abridge or destroy the rights of any other owners and that the interest of no party concerned will be injured or damaged by relocating said drainage easement, and that their interest will be promoted thereby; and (5) Petitioner says that the strip to be hereafter used for said drainage easement is a part of Lot 69 shown on the plat and that it is ready and willing to grant the County the right of drainage in, over and through said strip; and (6) Petitioner says that the exchange of said strips of land will be for the best interest of and promote the safety and general welfare of the land owners in the vicinity; that such exchange will not abridge or destroy any of the rights or privileges of the other proprietors and owners of property on said plat ~d~FORE~ petitioner prays that in accordance with the statute in such cases made and provided, that the County vacate the former strip set aside as an easement and accept the new strip in its stead~ and petitioner prays that this Honorable Board will, by proper resolution duly adopted, direct the discontinuance, closing and vacation of said former strip and accept the new one in its place and stead. Respectfully submitted, E ~1 ~LIZABETH RIVER SHORES HOLDING CORPORATION Counsel i WHEREAS~ ELIZABETH RIVER SHORES HOLDING CORPORATION developed t Elizabeth River Shores, a plat of which is recorded in the Clerk's Office I of the Circuit Court of Princess Anne County, Virginia, in Map Book 32, ! at Page 22, and a corrected plat of which is recorded in Map Book 3?, at Page 41; and WEEREAS~ on the map the Southern ten (10) feet of Lot Sixty- ! eight (68) was reserved for a drainage easement; and i WHEREAS, since the development and recordation of the aforesaid i plats, it appears more feasible to relocate said easement and extend the t same through Lot Sixty-nine (69), the Southern line of said easement to ~: run along and parallel to the Northern line of the property conveyed to ~: and owned by S. J. Faris, as shown by deeds duly of record; and .i WREREAS, ELIZABETH RIVER SHORES HOLDING CORPORATION desires the i County to release all rights in the strip set out on said plat for drainage and to accept the new strip in lieu thereof; and WHEREAS, such action does not abridge or destroy any of the rights ~ or privileges of other property owners within the bounds of the area of ~ lands shown on said plat, or of the County of Princess Anne. THEREUPON, upon motion duly made and seconded and by the affirmative vote of all present, it was RESOLVED, That the County of Princess Anne does release ~ll right and interest in the easement as sho~m on the map of Elizabeth River Shores, recorded in the Clerk's Office of the Circuit Court of Princess Anne County~ Virginia, in Map Book 32, at Page 22, and the corrected plat in Map Book 37, at Page 41, comprising the Southern ten (10) feet of Lot 68, as shown on said plat, extending from South Crestline Drive to the waters ~lmzabeth River, and in consideration thereof said Company does hereby grant to the County of Princess Anne, Virginia, an easement over the ten foot strip extending from said South Crestline Drive to said River through Lot 69, the Southern line of which easement runs along the Northern line of the property of Faris, and all rights of the County in the original easement are hereby terminated and transferred to Elizabeth River Shores Holding Corporation. And the Chairman of this Board is hereby authorized and empowered to execute a deed conveying to Elizabeth River Shores all rights in said original easement~ which shall be attested by the Clerk of this Board~ in exchange for a deed from Elizabeth River Shores Holding Corporation for the new easement
