Hudgins, respectfully petitions the Board of Supervisors of Princess Anne County to abandon the streets hero, after set forth according to the statutes made and provided in such cases and more particularly as provided by Title 33, Section 76.13, through Title 33, Section 76.24, of the C ode of Virginia. In support of said petition, your petitioner respectfully sh~s~ unto the Board of Supervisors of Princess Anne County. (1) That the said J. C. Hudgins owns the property on both sides of the two streets herein petitioned to be closed and further that he owns the property at one end of the sixty foot street and that the fifty foot street runs to a dead end on the property owned by Fabian Theaters, Inc., and that said streets have never actually been platted but have merely been referred to on a plat recorded in the Clerk's Office of the Circuit Court of Princess Anne County on March 29, 1926 and entitled "Property of Leolin J. Jarvis" as future streets and that it is the desire of the said J. C. Hudgins to close these streets to prevent any question as to whether or not said streets exist; that said streets desired to be closed are shown on said plat above mentioned, and that one is an unnamed sixty foot street running parallel with Virginia Beach Boulevard shown on said plat as a future strset and that the other is a fifty foot street running at approximately right angles to the Virginia Beach BOUlevard and designated on said plat as City Home Farm Road and further designated as a future street; that the sixty foot street runs a distance of approximately 375 to 400 feet and comes to a dead end at the property of the Fabian Theaters, Inc. on the eastern end and in a dead end to the other property of J. C. Hudgins on the western end; that the said City Farm Road runs approximately 350 to 375 feet to a dead end at the property area for the best interest of the petitioner and County of Princess Anne and the future owners of the said property; that the interest of no-~arty concerned will be injured or damaged by the closing of said streets and that all interest will be promoted thereby, and that neither of said streets as shown on the plat have ever been opened to the public or used as streets and that they ar~ at the present time merely vacant fields as will be seen upon the viewing of the premises. (3) Your petitioner, as provided by statute, attaches hereto a copy of the plat of said property which is duly recorded in Map Book 7, Part 2, Page 138, and that the portion of the streets desired to be closed are the entire streets shown as future streets on the plat. WHEREFORE, Petitioner prays that in accordance with the statutss in such cases made and provided, that the proper notice be given and that the Board of Supervisors of Princess Anne County will find that no public necessity exists for the continuance or establishment of the above referred to streets or passageway, and that the welfare of the public Mill best be served by the abandoning, vacating and closing of the above referred to streets or passageway, and that it will at the proper time after all requirements of the statutes have been complied with, enter an order abandoning, vacating and closing the above referred to streets, upon payment of all cost by the Petitioner herein, and your Petitioner prays that he may have any and all such further relief as he may be entitled. C. Hudgins, requesting that the Board of Supervisors close and vacate parts of two certain streets on the property owned by J. C. Hudgins, namely: (a) Part of the street shown as a "Future 60' Street" on the plat entitled "Plat of Leolin J. Jarvis Property", admitted to record in the Clerk's Office of the Circuit Court of Princess Anne County, Virginia, on March 29, 1926, in Map Book 7, Part 2, at page 138, which part of street extends in an East and West direction across the land of J. C. Hudgins, beginning at the Western boundary line of the property conveyed to J. C. Hudgins by the City of Norfolk by deed dated August 1, 1946, and recorded in said Clerk's Office in Deed Book 202, at page 596, and ending at the Western boundary line of the property conveyed by J. C. Hudgins, et ux, to Virginia Beach Appliance Corporation by deed dated August 4, 1947, and recorded in said Clerk's Office in Deed Book 247, at page 414 (which property is now owned and occupied by Fabian Theatres Incorporated); said street running approximately parallel with Virginia Beach Boulevard. (b) Part of the street shown on the said "Plat of Leolin J. Thereupon, upon motion duly made and seconded, and by the affirmative vote of all present, the recommendation of the Planning Commission, and the Board of Supervisors being satisfied that the statutes for such cases made and provided have been complied with, and finding no public necessity existing for the con- tinuance or establishment of the said parts of streets; on March 29, 1926, in the Clerk's Office of the Circuit Court of Princess Anne County, Virginia, are hereby closed, vacated, and abandoned, and the fee simple title of said parts of streets vest in J. C. Hudgins, which is all of the said streets lying, and being on the land now owned by J. C. Hudgins: (1) Part of the street shown as a "Future 60' Street" on the plat entitled "Plat of Leolin J. Silverman desires to vacate that portion of Jersey Avenue, as shown on the Plat of Euclid Place, as described hereinabove, and such vacation does not abridge or destroy amy of the rights or privileges of other property owners within the bounds of the area of land shown on said plat; and whereas, Morris S.
