Ordinance to AMEND Articles I, II and III of Chapter 31 of the Code of the City of Virginia Beach as follows: a. Modify the definition of hazardous waste. b. Enhance the enforcement provisions for the storage and disposal of hazardous waste. C. Modify the refuse collection regulations in the Resort Collection Zone. d. Clarify and modify the General Refuse Collection Provisions. 3. Ordinance to ACCEPT and APPROPRIATE an $800,000 Special Purpose Grant from the United States Department of Housing and Urban Development; and, authorize the City Manager to enter into a contract to acquire and rehabilitate property for use as a homeless shelter. 4. Ordinance to APPROPRIATE $210,999 to the Sheriff's Department's FY 1995-1996 Operating Budget and the Sheriff's Special Revenue Fund re salary increases authorized by the State Compensation Board for reimbursement to the City; and, offset the appropriation by an increase in estimated revenue from the State. 5. Ordinance to TRANSFER $609,650 from Princess Anne Park Expansion (CIP #4-935) to Seatack Community Center Expansion (CIP #4-962) re increased project cost estimates. 6. Dean Block, Director - Management Services, distributed an Outline of the School Capital Imprvvement Program and a Project Summary, which is hereby made a part of the record. 7he SLr-year New Money Request is $206.53-MILLION. Compared to Last Year's approved Capital Improvement Progran; these funds are $206.53-MILLION versus $167.97-MILLION. Relative the Proposed Capital Improvement Program FY 1996-1997/2001-2002 Mr. Block designated by a 'star" those projects which had significant cost increases: 1-063 Indoor Air Quality $22-MILLION (last year: $12-MILLION) 1-046 High School - 1999 $39-MILLION (last year: $29-MILLION) I-060 Middle School - 2001 $30-MILLION (last year: $24-MILLION) Mr. Block denoted with a "circle" the new projects incorporated into this CIP, which were not incorporated in prior years: 1-091 Elementary School ModernkAdon Phase I W. T Cooke $ 3,879,111 Phase II $ 7,514,400 Creeds Bayside Phase III $ 7,421,168 Shelton Park Thalia Phase IV $ 9,645,776 Woodstock Kempsville Meadows Luxford Elementary Information relative cost comparisons of the City Schools and other localities will be provided An itemized cost breakdown of each of the projects will also be furnished. The School Staff has provided guidelines for assigning portables. These are before the School Board and are aimed at standardizing these portables throughout the system and providing improved central control of the allocation of portables. 236 rooms (196 standard classrooms, 40 educational rooms (auxiliary gyms, multipurpose, medi centers, computer and business labs, art and music rooms) will be constructed through the addition program by September 1996. An analysis of these additions resulted in the removal of approximately 122 portables (113 of the portabks). With relation to Elementapy Schools, the City has propmed a square footage standard of 83,000. 7he School staff is planning an 87,500 square footage standard. ELEMENTARY SCHOOLS CORPORATE LANDING 96,620 STRAWBRIDGE 84,938 RED MILL 69,500 Relative Middle Schools, the City has proposed 230,000 square feet while the School staff is planning a 235,000 square footage standard. MIDDLE SCHOOLS CORPORATE LANDING 236,824 LARKSPUR 247,264 Relative High Schools, the City has prcposed a 284,000 square footage standard while the School staff is planning a 277,500 square footage standard. Comparisons will be provided relative the square footage required by the State. An analysis will be prowded relative special education. Mr. Block advised the City works with annual bond limits which in most cases, are not a constraint on the Capital Improvement Program; however, given the request before the City with the School System, these wvuld be a constraint particularly in the first twv years. 7herefore, the annual bond limits would not per7nit the City from carrying out the School's program as requested in the flrst two years. 7he second year eyxeeds the total bond limit. The tax impact of this particular proposal has not been calculated. If the City's bond rating is reduced, the cost of any new debt issued would rise dramatically. 7he debt limit would then have to be reduced. If the costs are higher to issue debt then the cost of projects are going to be greater than anticipated in terms of the total cost over the life of the bond issue. If additional projects are required, the bond rating must be protected. Patricia Phillips, Director of Finance, advised a bond rating was requested for &he Agricultural Reserve Program. Bond Counsel's major concern was more with the condition of the schools than with the Agricultural Reserve ProgranL Moody's has issued its Double A rating and affirmed its rating of Double A for the City of Virginia Beach on Obligation Bonds. Standard & Poors has also rated the ARP at Double A; however, in their repor4 they will not do a negative outlook although they did discuss same. 77iey will not do a downgrade of its General Obligation debt. Bond Counsel will be making negative comments regarding the School system. 7he actual report should be arriving within the next forty -eight hours. 7hey will make a statement that the school situation needs to be resolved and Double A credits simply do not have these types of problems. February 6. 1996 - 4 - CITY MANAGER'S BRIEFING SCHOOL CIP BUDGET STAFF MEETINGS - UPDATE ITEM # 40340 (Continued) Mr. Block advised the recommendation for the School CIP came from staff during the tenure of Dr. Pughsley. 7he Board received same and conducted a Workshop and Pubik Hearing. Comments were made anit to a degree, increased the total recommended earlier by the &aff. 7his was brought back to the School Board for discussion and will be brought to the School Board @y, February 6, 1996, for approval The enrollment projections of the school staff are based on expected rates of growth and around September Thirtieth numbers. The City has questions relative the rates of growth anticipated by the school staff and believe they are overstated. 7he City is also concerned that March 7hirly-ftrst ADM numbers should be utilized the City cannot build to the peak (September 30) and should build to the average W4 on the schools (March 31). Examining the school's projects versus the City's current projections, there are significant differences, which result in the need for 150 fewer classrooms. 77te dialogue relative this concern will be continued with the Schools. A conservative enrolbnent projection is better than a liberal enrolbnent projection. In Pirginia it is both tradition and case law that infiastructure always lags development. F@ida has a concurrence law within its statewide growth management law. However, concurrence in Florida is typically described as being within the CIP period. 7he City cannot afford to build the Schools in antic4mti4on of the growtil One cannot eliminate portables, unless the City builds in antickmtion of growth. 7he Board must examine very carefully the issue ofportables and be prepared to accept some, if the City is to maintain a CIP that is within its current capacity. The School Board has decided not to do anything with technology this year; however, there has been discussion of requesting a Referendum in 1997 for appr@mately $30-MILLION, which would be utilized for the infrastructure for technology. February 6, 1996 - 5 - CITY MANAGER'S BRIEFING ON ROADS PUBLIC/PRIVATE PARTNERSHIP INITIATIVE 12:28 P.M. ITEM # 40341 The City Manager disbibuted information relative the Urban Partnership and Hampton Roads PubUcIPrivate Partnership Inidative, and the Mayor's testimony on the BPOL tax before the Senate Finance CommiUee today, February 6, 1996. 7he Hampton Roads Partnership proposal and the Urban Partnership are different corporate entities and concepts. The material dated January 25, 1996, under the letterhead of the Hampton Roads Mayors and Chairs speaks to the issue of the Hm"n Roads Par9nership. 7he Partnership %All be a separate non-proftt organization created in the Hampton Roads area that would have a Board of Directors (hat would keep apprised of the Mayors and Chairs in the Cities and Counties in the region plus the City Managers. This Partnership would also encompass business leaders and the Presidents of the major universities in the area. The Hampton Roads Partnersho's purpose would be enhancing regional cooperation and fostering regional economic development. A simcture, including Bylaws, has been suggested %ith priorities relative the 2007 Plan. February 6, 1996 - 6 - CITY MANAGER'S BRIEFING URBAN PARTNERSHIP ITEM # 40342 As the Honorable Linwood Holton was unable to attend BY CONSENSUS, City Council RESCHEDULED URBAN PARTNERSHIP BRIEFING until the City Council Session of February 13, 1996. February 6, 1996 7 AGENDA REVIEW SESSION 12:28 P.M. ITEM # 40343 Council Lady Henley referenced the language in the Ordinance concerning the boundaries, names and numbers of the City's seven residence districts: J I Ordinance to establish the boundaries, names and numbers of the City of Virginia Beach's seven residence districts according to Chapter 697 of the Acts of Assembly of 1995, which amended the Councilmanic Electoral Plan; and, the boundaries be adjusted periodically as may be necessary to ensure that the populations of such districts remain approximately equal This item will be discussed relative the selection of the Plan. Councilman Harrison distributed a copy of Plan D-3 (an amended Plan D-2) and proposed names for the various districts. Council Lady Henley expressed concern relative the proposed names. The City Attorney distributed an amended Ordinance which attaches three exhibits: Exhibit A (primary exhibit establishing Election District, Exhibit B (meets and bounds of each of the districts) and exhibit C (Census Block designation of each of the districts), ITEM # 40344 Councilman Dean requested discussion in order to infor7n the general public relative the amendments: J. 2. Resolution to support the efforts of the Leadership Hampton Roads 1996 Program to create a better identify for Hampton Roads; an4 direct the City Manager to erect signs at major entrances to identify frirginia Beach as one of the Hampton Roads localities. 7'he City Manager advised the design, color and placement of the signs is determined by each jurisdiction. 77te pattern happens to coincide nicely with the City's blue and while entrance signs and the City is envisioning them mounted below the 'Virginia Beach Welcome Signs' at the major gateways. Initially there will be about 6 signs. ITEM # 40348 Council Lady Strayhorn distributed a proposed resolution: Resolution re Crispus Altucks 77teatre Cultural Center in NorfoLk re TRT transportation/ISTEA funding. 7he City of Norfolk is requesting City Council's support for the construction of a passenger boarding area for TRT customers and a kiosk describing the history of transportation on Church Street. Council Lady Strayhom requested this item be ADDED to the Agenda under NEW BUSINESS. ITEM # 40349 7he City Attorney referenced the following item to be ADDED to the Agenda: Ordinance to confirm the City Manager's Declaration of a Local Emergency due to the ice storm and dangerous cold wave which hit the City February 2 and 3, 1996. ITEM # 40350 Councilman Baum advised the newspaper had incorrectly stated City Council would discuss the Shore Drive Hazard Elimination Project today, February 6, 1996. Such hypodermic 331 syringe, needle, instrument or device shall not be 332 disposed of without safeguarding by wrapping or securing 333 the same in a suitable manner so as to avoid the 334 possibility of causing injury to the collection 335 personnel. 336 (2) Ashes. Ashes that are to be collected by the city or 337 private collectors must have been wetted and cooled to 338 the touch prior to collection. Ashes shall be placed in 3 39 suitable containers of such size and weight as stipulated 340 in section 31-26 and shall not be placed with the normal 341 refuse unless separately wrapped, so that they will not 342 cause injury to the collection personnel. 343 (3) Pressurized cans. All pressurized cans containing 344 pesticides or any other dangerous materials shall be 345 released of all pressure before being deposited in a 346 receptacle for collection by the city or any private 347 collection agency. 348 (4) Glass. All broken glass or any type of glass that may 349 cause injury to refuse collection personnel shall be 350 separately wrapped to prevent injury and placed with the 351 normal refuse. 352 (5) Pesticides. All pesticide containers and other poisonous 353 containers shall be emptied and the contents thereof shall 354 be disposed of in a lawful manner before being placed for bef ore being 355 collection. 356 (6) Animal waste. Animal waste from domesticated animals such 357 as dogs, cats or birds shall be wrapped separately 358 from other refuse in a manner to prevent spillage prior 359 to placing the same in a refuse container. 360 T 361 The term "hazardous waste" has replaced the term "refuse." Subsection (5) clarifies that the contents 362 of any pesticide container or poisonous contawers must be disposed of in a lawful manner before the empty container is 363 placed for collection. The disposal of animal waste was referred to in Section 31-26. However, that provision has been 364 placed in this section which deah with special refuse items. 1 0 1 2 AN ORDINANCE TO AMEND THE CODE OF THE CITY OF 3 VIRGINIA BEACH BY: MODIFYING THE DEFINITION 4 OF HAZARDOUS WASTE; ENHANCING THE ENFORCEMENT 5 PROVISIONS FOR THE STORAGE AND DISPOSAL OF 6 HAZARDOUS WASTE; MODIFYING THE REFUSE 7 COLLECTION REGULATIONS IN THE RESORT 8 COLLECTION ZONE; AND, CLARIFYING AND MODIFYING 9 THE GENERAL REFUSE COLLECTION PROVISIONS 10 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VIRGINIA 11 BEACH, VIRGINIA: 12 That Articles I, II, and III of Chapter 31 of the Code of the 13 City of Virginia Beach, Virginia, are hereby amended and reordained 14 to read as follows: 15 ARTICLE I. IN GENERAL 16 See. 31-1. Definitions. 17 The following definitions shall apply in the interpretation 1.8 and enforcement of this chapter: 19 Building and construction materials means any material such as 20 lumber, wire, pilings, sheetrock, shingles, brick, plaster, 21 gutters, pipes, concrete, asphalt, stones, topsoil, dirt, dredge 22 spoil or other substances accumulated as a result of the 23 construction, repair, alteration or demolition of infrastructure, 24 including but not limited to, buildings, highways, utilities, 25 streets, sidewalks, or similar structures, dredging or land- 26 clearing activities. 27 Bulk container ste means a metal container of not less 28 than @ four +6-)- (4) cubic yards nor larger than eight (8) cubic 29 yards, made of watertight construction with doors opening on two 30 (2) sides and@or top, and constructed so that it can be emptied 31 mechanically by specially equipped trucks. Containers shall be 32 covered. Hereinafter, upon the effective date of this section, all 33 new bulk containers shall meet these specifications. 34 Business trash means any waste accumulation of dust, paper and 35 cardboard, excelsior, rags or other accumulations, other than 36 hazardous wast, garbage or household trash, which are usually 37 attendant to the operation of stores, offices and similar 38 businesses. 39 City means the City of Virginia Beach. 40 Commercial establishment means any retail, restaurant, 41 manufacturing, wholesale, institutional, r-eii:gie*as, governmental or 42 other nonresidential establishment at which garbage or trash may be 43 generated. For purposes of this chapter the term "commercial 44 establishment" shall not ap]Rlv to churches, synagogues, moscrues, or 45 any other such house of worship. 46 Detachable container means a unit, varying in capacity between 47 five (5) cubic yards and forty (40) cubic yards, which is used for 48 collecting, storing and transporting building and construction 49 materials, business trash, industrial waste, hazardous refuse 50 waste, refuse or yard trash. The unit may or may not use an 51 auxiliary stationary packing mechanism for compaction of materials 52 into the container and may be of the open or enclosed variety. The 53 distinguishing feature of the detachable container is that it is 54 picked up by a specially equipped truck and becomes an integral 55 part of the truck for transporting the waste materials to the 56 disposal site. 57 Garbage means the by-product of animal or vegetable foodstuffs 58 resulting from the handling, preparation, cooking and consumption 59 of food or other matter which is subject to decomposition, decay, 60 putrefaction or the generation of noxious or offensive gases or 61 odors, or which, during or after decay, may serve as breeding or 62 feeding material for insects or animals. 63 Hazardous refuse waste means any substance, material, solid 64 waste or combination of solid waste which, because of its quantity, 65 concentration or Physical, chemical or infectious characteristics 66 may: 67 (1) cause or significantly contribute to an increase 68 mortality or an increase in serious irreversible or in car)acitating 69 illness; or 70 (2) Pose a substantial present or potential hazard to human 71 health or the environment when imprORerly treated, stored, 72 transported, disnosed of, or otherwise managed. 73 For Purposes of this chapter, the term "hazardous waste" 74 shall include, but not be limited to, materials such as poison, 2 75 acids, caustics, chemicals, infected@ materials, offal, fecal 76 matter. biological materials, Petroleum Petroleum products. 77 flammable materials, compressed gases, radioactive materials and 78 explosives. 79 Household trash means every waste accumulation of paper, so sweepings, dust, rags, bottles, cans or other matter of any kind, 81 other than garbage, which is usually attendant to housekeeping. 82 Industrial waste means all waste, including solids, semi- 83 solids, sludges and liquids, created by factories, processing 84 plants or other manufacturing enterprises. 85 Littermeansgarbage, refuse, wastematerials, includincfwaste 86 tires, or any other discarded, used or unconsumed substance which 87 is not handled as specified in this chapter. 88 Loading and unloading area means any stream, river or lakeside 89 or land dock, space or area used by any moving vehicle f or the 90 purpose of receiving, shipping and transporting goods, wares, 91 commodities or persons. 92 Mobile containers means @ containers for refuse previded by 93 the ei:ty feL- use iii tire L-es--, ai-ea- for use bv commercial 94 establishments, and having a capacity of eighty five @@u to 95 one hundred twenty (120) gallons and equipped with 96 wheels for mobility. 97 Multiple residential unit means any duplex, apartment, group 98 of apartments or condominium used as a dwelling place for more than 99 one (1) family. 100 Person means any individual, firm, company, corporation, 101 partnership, association, governmental body, municipal corporation 102 or any other legal entity. 103 Portable packing unit means a metal container, not exceeding 104 forty-five hundred (4,500) pounds gross weight, with four (4) to 105 six (6) cubic yard capacity, that contains a packing mechanism and 106 an internal or external power unit. 107 Refuse means solid waste accumulations consisting of garbage, 108 household trash, vegetative waste, yard trash and business trash as 109 herein defined. 3 110 Residential refuse receptacle means a metal or plastic ill container for refuse, of substantial construction, with a tight- 112 fitting lid, and provided with wheels or handles sufficient for 113 safe and convenient handling for collection at curbside. Except for 114 those areas serviced by automated collection equipment, such 115 receptacles shall have a capacity of not more than thirty-two (32) 116 gallons and a total weight of not more than f if ty (50) pounds or an 117 empty weight of not more than ten (10) pounds, and shall be kept in 118 serviceable condition at all times. Any areas serviced by automated 119 collection equipment shall use ninety-to one hundred twenty gallon 12 0 reend eentainerb automated refuse receptacles as approved by the 121 dir-eatel- ef- publie wei-Irzs city manager or his designee. Any 122 receptacle which does not meet standards set by the department eE 123 pabl:i:e werlrze city manacfer or his designee shall be removed. 124 Exceptions to these requirements may be made by the direeter ef 125 pubile wer!Es city manager or his designee. 126 Resort Area includes all real property within the borough of 127 Virginia Beach. 128 Resort collection zone includes all commercial establishments 129 within the area defined by and including the establishments 130 fronting on the west side of Pacific Avenue to the establishment 131 frenting en the eastern side ef Atlantis A-venue boardwalk; and by 132 Rudee Inlet to 40th 42nd Street. This zone is established to 133 ensure that the Resort Area, with its dense concentration of 134 businesses, its high visibility, and its impact on city resources, 135 is adequately maintained for the numerous visitors and residents 136 who visit the Resort Area. The city manager or his designee may 137 include in the resort collection zone such commercial 138 establishments that operate as a "resort business" and which are 139 located along the periphery of the resort collection zone. 140 Single residential unit means any dwelling place occupied by 141 one (1) family. 142 Small dead animals means dead cats, dogs, small household pets 143 and other animals of similar size. 4 144 Vegetative waste means waste accumulation of tree branches, 145 tree limbs, parts of trees, bark, roots, stumps, bushes or 146 shrubbery generated by yard and lawn care or land-clearing 147 activities. 148 Yard waste, yard trash means waste accumulations of lawn, 149 grass or shrubbery cuttings or clippings and dry leaf rakings, free 150 of dirt, rocks, large branches and bulky or noncombustible 151 material. 152 Yard waste eantai@ es means plastic bags closed by 153 a tight-sealing method of suitable type, such as drawstring, wire 154 tie or knot, made of a clear material, which have a maximum 155 capacity of forty (40) gallons and a maximum weight, when full, of 156 twenty-five (25) pounds. 157 Yard waste container means a container thirteen (13) feet 158 long, seven (7) feet wide and five (5) feet high for residential 159 d waste. 160 COMMNT 161 The term "dumpster" was added to the definition of bulk container to reflect the actual name used by the general 162 public for bulk containers. 163 The term "hazardous waste" was added as an exception to the definition of business trash. 164 Churches, synagogues, mosques, etc., have been mduded from the deru"n of a "commercial establ6hment" 165 because they have historically been treated as residential establ6hments for refuse co@n purposes. 166 The term and der@n of "hazardous refuse" has been changed to reflect the terminology and def'@n used 167 in the Vir&ia Waste Management Act (Va. Code Section 10-1-1400 CL Mj. The change was needed for enforcement 168 purposes. 169 The term "waste tires" was added to the definition of "@" to clarify for enforcement purposes that waste tires 170 are considered waste or discarded materials. 171 The definition of mobile containers d@ the references to the City providing such containers in the resort area, 172 inasmuch as the City no longer provides this servke. Moreover, the capacity of such containers was changed to reflect 173 the actual capacity of the mobile containers currently used in the City. 174 The definition of residential refuse receptacles was @ed as it r@ to roe used for automated 175 co@n. The term currently used by the Waste NUnagement Division is "automated refuse "andtheca@ 176 may vary from 90 to 120 gallons. Additionally, throughout the ord@, the phrase "director or deparunent of pubik 177 works' has been replaced with the phrase 'city manager w bb designee" to allow the Department of Housing and 178 Neighborhood Preservation and other City agencies to enforce the code. 179 The scope of the resort collection zone was changed to explicitly defme the area on which the special resort 180 collection zone regulations apply. 181 The term "Yard waste container" referring to the plastic bap used for yard waste was changed to "yard waste 182 receptacles" because the former term will be used to defme the rou-on containers now used for residential yard waste. 183 These rou-on containers are used in lieu of the debris tr&Um. 184 SOC. 31-2. Administration and enforcement of chapter. 185 The administration and enforcement of the provisions of this 186 chapter, including provisions for refuse collection throughout the 5 187 city, by both private contractors and the City, shall be the duty 188 of the department of public works and the department of housing and 189 neighborhood preservation. 190 See. 31-2.1. Notice of violation, su=ons--Authority to issue. 191 All provisions of this chapter shall be enforced by inspectors 192 assigned to the departments of public works and housing and 193 neighborhood preservation; provided, however, that sections 31-7, 194 31-8, 31-10 and 31-11 shall also be enforced by police officers, 195 assistant fire marshals. and by inspectors of the departments of 196 planning and public utilities. In their enforcement of this 197 chapter, such assistant fire marshals and inspectors shall exercise 198 all authority of police officers including, without limitation, the 199 authority to issue notices of violation and to issue summonses 200 directing the appearance before a court of competent jurisdiction 201 of any person alleged to have violated any of the provisions of 202 this chapter. 203 COMMENT 204 Enfmment auffiority for Sections 31-7, 31-8, 31-10 and 31-11 hu been @ded to include assisftnt rwe 205 manhah. Saine--Xethod of issuance. 208 (a) Upon finding or observing a violation of any of the 209 provisions of this chapter, the inspector 210 or police officer shall issue a notice for a violation to the 211 owner, operator, occupant or other person causing or permitting 2 12 such violation. Service of the notice of violation shall be by 213 delivering a copy of the notice to whom it is directed in person. 214 Said notice shall contain the date and nature of the violation. 215 Additionally, said notice shall require the immediate cessation of 2 16 the violation and shall provide for time within which remedial 217 measures are to be taken to correct said violation. If the party 218 cannot be found, posting of the notice in a conspicuous location 219 upon the land or premises and notice mailed by first class mail to 220 the last known address of the person to whom it is directed shall 221 be deemed adequate under this chapter. 6 222 Upon failure to comply with a notice of violation, a summons 223 shall be issued against and served on the party directing him to 224 appear before the general district court, on the date and at the 225 time specified in the summons, to answer for the violation alleged 226 the date and nature of which shall be set forth in the summons. 227 (b) In any case where an inspector, assistant fire marshal or 228 police officer observes a violation in progress, a summons may be 229 issued against and served on the person committing the violation 230 directing him to appear before the general district court without 231 the necessity of issuing a notice of violation. 232 Sec. 31-3. Violations of chapter. 233 Unless otherwise specif ically provided, a violation of any 234 provisions of this chapter shall constitute a class 1 misdemeanor. 235 In any case where building and construction materials, hazardous 236 waste, or refuse is deposited, transported, transferred or stored 237 in or upon any public or private property in the city without 2 38 acquiring all permits under applicable city, state, and federal 2 39 laws, the mere cessation of such activities shall not be deemed 240 sufficient to correct the violation. Said violation shall not be 241 deemed corrected until such time that all required permits and 242 approvals have been obtained or until such time as the building and 24 3 construction materials, hazardous waste or refuse have been removed 244 from the subject property and disposed of in a lawful manner. 245 In addition to, and not in lieu of the penalties prescribed in 246 this section, the city may apply to the circuit court for an 247 injunction against the continuing violation of any of the 248 provisions of this chapter and may seek any other remedy authorized 249 by law. 250 COMAWNT 251 The term "@us waste" was added to the violations @n to address numerous incidents where hazardous 252 wastes have been illephy deposited on City property and private property. 7 253 See. 31-4. Construction or use of commercial-type incinerators 254 for burning solid waste. 255 It shall be unlawful for any person to construct or use any 256 commercial-type incinerator for the burning of rubbish or other 257 readily combustible solid waste material in any zoning district of 258 the city except those areas zoned for industrial or agricultural 259 uses. 260 Sec. 31-5. Refuse receptacles for parking lots. 261 The owner or manager of any parking lot or establishment with 262 a parking lot shall provide refuse receptacles distributed within 263 the parking area. The department of pubile wer!Es city manager or 264 his designee shall have the authority to determine the number of 265 receptacles necessary to provide proper containerization. No refuse shall be placed 302 adjacent to any bulk or mobile container or refuse receptacle. Hazardous refined waste not to be placed in 316 collection receptacles; special care and 317 preparation rwpired before placing certain refuse 318 items in containers. 319 No hazardous waste, contagious disease refuse or any other 320 refuse that may cause a public health hazard shall be placed in 32 1 any receptacle used for collection by the city or collection by any 322 private agency. The following are several types of special refuse 32 3 items which shall be given special care and preparation before 324 disposing of the same in any refuse container: 325 (1) Hypodermic instruments and other sharp articles. No 326 person shall dispose of or discard any hypodermic 327 syringe, hypodermic needle or any instrument or device 9 3 65 Sec. 31-8. Disposal of refuse and debris from construction, 366 demolition, ote., operations. 367 (a) The city shall not be responsible for the collection or 368 hauling of building and construction materials originating from 369 private property preliminary to, during or subsequent to the 370 construction, repair, alteration or demolition of infrastructure, 371 dredging or land-clearing activities. Such material shall be 372 removed by the owner of the property or by the contractor and 373 disposed of in a lawful manner. No inspection certificate or 374 certificate of occupancy shall be issued until such material has 375 been removed by the owner or contractor. In addition, all 376 contractors must provide refuse receptacles for construction debris 377 and litter to be deposited in at the end of each working day. 378 (b) Building and construction materials, refuse or other 379 debris deposited upon any public or private property as a result of 380 the construction, repair, alteration or demolition of 381 infrastructure, dredging or land-clearing activities shall be 382 immediately removed by the contractor and disposed of in a lawful 383 manner. Construction sites shall be kept clean and orderly at all 384 times. 385 (c) The prime contractor or developer of a construction, 386 demolition, dredging or land-clearing activities site shall be held 387 responsible for maintaining the site as required by this section. 388 See. 31-9. Collection, removal and disposal of industrial 389 waste. 390 Industrial waste shall be collected, removed and disposed of 391 in an approved manner by the operator of the factory, plant or 392 enterprise creating or causing same. 393 Sec. 31-10. Unlawful storage and deposits generally; littering. 394 (a) No person shall s-tore or place any accumulation of 395 building and construction materials, hazardous waste or refuse in 396 any street, median strip, alley or other public place of travel, 397 nor upon any private property, except as stated in other sections 398 of this chapter, or unless such storage or accumulation is 11 399 authorized bv a federal, state or local statute, re@ation or 400 permit, or is specifically related to an ongoing and active 401 building or construction project. For purposes of this subsection, 402 @longoing and active" shall mean that all applicable federal, 403 state and/or local permits have been issued and are in effect or, 404 in the case of any project not requiring a permit, that the owner 405 of the property in question is actively pursuing completion of the 406 project. 407 (b) It shall be unlawful for any person to: 408 (1) Scatter building and construction materials, hazardous 409 waste or refuse about or litter any public or private 410 street, area or place. 411 (2) Cast, throw, place, sweep or deposit anywhere within the 412 city any building and construction materials. hazardous 413 waste or refuse in such a manner that it may be carried 414 or deposited by the elements upon any street, sidewalk, 415 alley, sewer, parkway or other public place or into any 416 occupied or unoccupied premises within the city. 417 (3) Throw or deposit any hazardous waste, refuse or debris in 418 any stream or body of water. 419 (c) The driver of any vehicle shall be responsible for 420 assuring that no litter, hazardous waste, refuse, or building and 42 1 construction materials are thrown from the vehicle or occurs 422 through the lack of proper covering. 423 COMMNT 424 The unlawful storage or amumulation of hazardoin waste has bem added for enforcement purposes. 425 See. 31-11. Placing hazardous waste, refuse or refuse 426 receptacles on, in or over storm drains. 427 No person shall place any hazardous waste, refuse or refuse 428 receptacle or container on, in or over any storm drain. 429 COMMNT 430 The term "hazardous waste" was added for enforcement purposes. 12 431 See. 31-12. Property to be kept free of litter. 432 All owners or occupants shall maintain the real property owned 43 3 or occupied by them in a clean and litter free condition. It shall be unlawful for any person 446 to damage or destroy any refuse receptacle placed at the curbline 447 for collection. 448 See. 31-14. Provision of automated fuse 466 467 (a) It shall be the responsibility of owners of residential 468 structures located in areas of the city serviced by the automated 469 collection system to provide automated refuse receptacles. 470 (b) Within thirty (30) days of the date of occupancy of a new 471 structure located in any such area, the owner or occupant thereof 472 shall provide an automated refuse receptacle. 473 (c) Whenever an automated refuse receptacle is purchased from 474 the city the price of the receptacle shall be based on the total 475 cost of the receptacle to the city. 476 COMAIENT 477 Throughout the Ordimme, the twm "automated container" has be= changed to "automated refuse receptacle" 478 to conform with the actual terminal used by the Waste AUnmement Division. 479 Seca. 31-16--31-25. Except in those 484 areas serviced by automated collection equipment, such receptacles 485 shall be metallic or plastic, with a capacity of not more than 486 thirty-two (32) gallons or a total weight of not more than fifty 487 (50) pounds. Any mobiki 488 e i e by the city shall not be filled to exceed two 489 hundred (200) pounds total weight, and all refuse therein must fit 490 inside the t cle. Refuse may be placed in plastic or 491 polyethylene bags which meet the standards set by the 492 city manage 7 or h . Each receptacle shall 493 have a tight-fitting cover, and each bag shall be tightly secured. 494 The cover of any receptacle shall be kept on at all times except 95 when the receptacle is being filled, emptied or cleaned. 96 97 98 99 14 500 te . Only 508 yard waste containers or yard waste receptacles as def ined in 509 section 31-1 of this chapter shall be used for yard waste. The Grantee's application package, as may be amended by the provisions of this Grant Agreement, is hereby incorporated into this Agreement. In reliance upon and in consideration of the mutual representations and obligations hereunder, HUD and the Grantee agree as follows: Subject to the provisions of this Grant Agreement, HUD will make grant funds in the amount of $800,000 available to the Grantee. At HUD's option, the Grantee may delay initiation of project closeout until the resolution of any HUD monitoring findings. If HUD exercises this option the Grantee must promptly resolve the findings. B. The Grantee recognizes that the Closeout process may entail a review by HUD to determine compliance with the Grant Agreement by the Grantee and all participating parties. The Grantee agrees to cooperate with any review in any way possible, including making available records requested by HUD and the pro ject for on-site HUD inspection. C. Within 90 days of HUD approval to initiate closeout, the Grantee shall provide to HUD the following, in the format(s) approved by HUD: 1. A certification of project completion. 2. WHEREAS, the City of Virginia Beach Development Authority (the'Authority') has considered the application of DEL-International, L.L.C., a Virginia limited liability company (the "Company"), for the issuance of the Authority's industrial development revenue bonds in an amount not to exceed $3,500,000 (the "Bonds') to assist in the financing of the Company's (i) acquisition, renovation and equipping of an existing 11,900 square foot office/warehouse facility (the "Existing Facility') located on a three (3) acre parcel of land at 2645 International Parkway, Oceana West Industrial Park, Virginia Beach, Virginia, and (ii) acquisition, construction and equipping of an approximately 48,000 square foot manufacturing facility (the "Additional Facility") to be connected to the Existing Facility which Additional Facility is to be located on an approximately three and one-half (3.5) acre parcel of land which is adjacent to the Existing Facility (the Existing Facility and the Additional Facility being collectively referred to as the "Facility') which Facility shall be leased to Del-Tek International, Inc., and has held a public hearing thereon on December 19, 1995; and WHEREAS, the Authority has requested that the City Council (the "Council") of the City of Virginia Beach, Virginia (the "City"), approve the issuance of the Bonds to comply with Section 147(f) of the Internal Revenue Code of 1986, as amended (the "Code"); and @EREAS, Pursuant to § 15.1-1378.1 of the Code of Virginia of 1950, as amended, a copy of the fiscal impact statement and a copy of the Authority's resolution approving the issuance of the Bonds, subject to terms to be agreed upon, and a reasonably detailed summary of the comments, if any, expressed at the public hearing have been filed with the Council of the City; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA: 1. The Council of the City approves the issuance of the Bonds by the Authority in a principal amount not to exceed $3,500,000 for financing the acquisition, renovation, construction and equipping of the Facility for the benefit of the residents of the City, to the extent required by Section 147(f) of the Code, to pemiit the Authority to assist in the financing of the Facility. 2. The approval of the issuance of the Bonds does not constitute an endorsement of the Bonds or the creditworthiness of the Company; but, pursuant to Chapter 643, Virginia Acts of Assembly of 1964, as amended, the Bonds shall provide that neither the City nor the Authority shall be obligated to pay the Bonds or the interest thereon or other costs incident 1-21226. IAMH:NS 12119195 2 thereto except from the revenues and moneys pledged therefor, and neither the faith or credit nor the taxing power of the Commonwealth, the City or the Authority shall be pledged thereto. 3. In approving this Resolution, the City, including its elected representatives, officers, employees and agents, shall not be liable and hereby disclaims all liability for any damages to any person, direct or consequential, resulting from the Authority's failure to issue bonds for the Facility for any reason. 4.
