If private utilities do ex~st, the apphcant shall provide easements satisfactory to the utility companies. 4. Closure of the right-of-way shall be contingent upon compliance with the above stated conditions within 365 days of approval by City Council. If all conditions noted above are not accomplished and the final plat is not approved w~thin one year of the City Council vote to close the roadway, thru approval will be conmdered null and vmd. The above conditions, having been proffered by the Grantor and allowed and accepted by the Grantee as part of the amendment to the Zoning Ordinance, shall continue in full force and effect until a subsequent amendment changes the zoning of the Property and specifically repeals such conditions. Such conditions shall continue despite a subsequent amendment to the Zoning Ordinance even if the subsequent amendment is part of a comprehensive implementation of a new or substantially revised Zoning Ordinance until specifically repealed. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA: 1. That the Department of Public Works is hereby authorized to proceed with the design of the safety improvements for Sandbridge Road utilizing an existing design contract. 2. That the Sandbridge Road Citizen Advisory Committee shall be continued so that it may provide input about the development of the safety improvements. 28 29 3O 31 3.
