RESOLUTION/ORDINANCES Resolution to REFER to the Planning Commission proposed amendments to § 901 of the City Zoning Ordinance (CZO) re Conditional Use Permits for multi -family dwellings in the entire B-4 Resort Commercial District. Ordinance to ACCEPT and APPROPRIATE $78,151 in funds from the Federal Emergency Management Agency (FENIA) and $48,197 from the Commonwealth of Virginia Emergency Management to the Fire Department's FY 2004-05 Operating Budget re multi jurisdictional Hazard Mitigation Plan with the Cities of Norfolk, Portsmouth, Suffolk and the County of Isle of Wight. Ordinance to TRANSFER $18,000 from the FY 2005 Council Donations account to the Virginia Beach School Education Foundation as authorized by the Virginia Code. CITY OF VIRGINIA BEACH AGENDA ITEM ITEM: Resolution Referring to the Planning Commission Proposed Amendments to Section 901 Of The City Zoning Ordinance, Requiring Conditional Use Permits for Multi -Family Dwellings In The B-4 Resort Commercial District MEETING DATE: September T, 2004 ■ Background: Current City Zoning Ordinance regulations allow multi -family dwellings as a principal (i.e., of -right) use in the B-4 Resort Commercial District, except in the portion of the B-4 Resort Commercial District that is also within the Shore Drive Corridor Overlay District. Within the Overlay District, which is shown on the City's zoning map as B-4(SD), multi -family dwellings are a conditional use and therefore require a conditional use permit. There is much more land within the B-4(SD) District than in the remainder of the B-4 District. ■ Considerations: The Resolution would refer to the Planning Commission proposed amendments to Section 901 of the City Zoning Ordinance that would change the designation of multi -family dwellings in the B-4 Zoning District from a principal use to a conditional use. If the amendments are adopted, multi -family dwellings would thereafter be a conditional use in the entire B-4 District. The Resolution also requires the Planning Commission to make a recommendation to the City Council at the Planning Commission's special meeting to be held on September 13, 2004. ■ Public Information: The Resolution will be advertised as a normal agenda item. If the Resolution is adopted by the City Council, the amendments would be considered by the Planning Commission and are anticipated to be considered by the City Council on September 28. The amendments would be advertised in the manner of other Planning Agenda items. In addition, all owners of property within the B-4 District outside of the Shore Drive Corridor Overlay District will be notified of both the Planning Commission's September 13 meeting and the City Council's September 28 meeting by letter. ■ Recommendations: Adoption of Resolution referring the proposed amendments to the Planning Commission. ■ Attachments: Proposed amendments to Section 901 of the City Zoning Ordinance. The Federal Emergency Management Agency (FEMA) is offering federal and state funding through the Hazard Mitigation Grant Program. The grant requires multi -jurisdictional coordination in order to be eligible for funding. ■ Considerations: Funds from this grant will be used to hire a consultant to assist cities in hazard mitigation planning. The grant is structured so that the federal government and the state will cover a majority of the total project costs, and all localities are responsible for a soft match that is required. The City will receive $78,151 in federal funds along with $48,197 in state funds. The local match of $6,500 divided up among the localities can be paid through in -kind services such as staff time. ■ Public Information: Public Information will be handled through the normal Council Agenda process. ■ Alternatives: The City could chose to decline the funds it has already been awarded. However, this is an opportunity for the City to participate with other local governments to create a multi -jurisdictional hazard mitigation plan. ■ Recommendations: Accept $78,151 in federal funds and $48,197 in state funds from the Hazard Mitigation Grant Program and appropriate to the Fire Department's fiscal year 04-05 operating budget. ■ Attachments: Ordinance Award letter from the State Dept. of Emergency Management Recommended Action: Approval Submitting Department/Agency: Fire Department City Manacr,*: tI Y I AN ORDINANCE TO ACCEPT AND APPROPRIATE 2 $78,151 FROM THE FEDERAL EMERGENCY 3 MANAGEMENT AGENCY AND $48,197 FROM THE 4 VIRGINIA DEPARTMENT OF EMERGENCY 5 MANAGEMENT TO THE FIRE DEPARTMENT'S FY 6 2004-05 OPERATING BUDGET TO CREATE A 7 REGIONAL HAZARD MITIGATION PLAN 8 WHEREAS, $78,151 from the Federal Emergency Management 9 Agency ("FEMA") and $48,197 from the Commonwealth of Virginia is 10 available to create a hazard mitigation plan for the region. 11 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY 12 OF VIRGINIA BEACH, VIRGINIA: 13 1.
