WHEREAS, the Council of the City of Virginia Beach, Virginia, adopted a resolution on May 17, 1982, authorizing the City Manager to execute a Lease between the City of Virginia Beach and the Virginia Beach Arts Center, Inc.; and \\'H EREAS , the Lease Agreement specified that the Virginia Beach Arts Cen ter, Inc., would commence construction of the above-mentioned facility on or before September 30, 1983. By resolution dated September 6, 1983, Council extended this date to August 30, 1985; and WHEREAS, the purpose of such Lease was to lease certain property commonly known as Toll Road Park to the Virginia Beach Arts Center, Inc., for the construction and maintenance of a facility dedicated to the furtherence and appreciation of the arts for the public benefit; and \\'HEREAS, Council desires to execute a new Lease Agreement to reflect current conditions; and \\'HEREAS, the Virginia Beach Arts Center plans to start construction within the next few months; and NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL Of THE CITY OF VIRGINIA BEACH, VIRGINIA, that the City Manager is hereby authorized to execute the attached Lease between the City of Virginia Beach and the Virginia Beach Arts Center Inc., for the purposes set out therein. Any such sublease or assignment without such consent shall be void, and shall, at the option of Lessor, terminate this Lease. Section 13. Utilities Lessee shall pay all of the expenses assessed for the connection, operation, and service of telephone equipment used by Lessee on the demised premises. ( 3 ) The procurement of insurance by Lessee shall not relieve Lessee of liability under the indemnity and save harmless provisions of the preceding paragraph of this Lease. Section 17. waiver The waiver by Lessor of, or failure of Lessor to take action with respect to any breach of any term, covenant, or condition herein contained, shall not be deemed to be a waiver of such term, covenant, or condition, or subsequent breach of the same, or any other term, covenant, or condition therein contained. The City shall release funds on a monthly draw basis after the Art! Center has used all available private funding. The avaIlabilIty of City funds shall be contingent on the Art! Center havIng completed at least 20% of construction and realizing at least 80% or pledge revenues projected for that point In time. Requests for payment shall be made thirty days In advance. 3. The City Manager shall be Infonned of all change orders to the construction project; In addition, al1 change orders In excess of $5,000 shall be approved by the City Manager. Oberndorf Council Members Voting Nay: None Council Members Absent: None June 23. 1986 AN ORDINANCE TO APPROPRIATE $4,492,116 FOR THE ACQU ISITION Of= PROPERTY AT THE MUN ICIPAL CENTER .AND ESTABLISH A CAPITAL PROJECT FOR THE ACQUISITION WHEREAS, in January 1985 the city entered into a contract with Waller, Todd and Sadler, Inc. to analyze the space needs at the Municipal Center through the year 2010 and to develop a buildings master plan, and WHEREAS, based upon projected space needs in the study, it was determined that by 1995. thel~e would be a space deficiency of over 300,000 net square feet at the Municipal Center, and WHEREAS, to eliminate this deficiency, the consultant projected the requirement of an additional 36.77 acres of land with a total appraised value of $4,492,116 for future building sites and related site improvements, and ~1ERE.A.S, the purchase of the additional sites at this time will prevent the need of having to pay higher costs in the future and allow the optimum development plan for the Municipal Center, and WHEREAS, the cost of acquiring the additional property may be financed with the proceeds from the sale of excess pl~operty from the Baxter Road Flyover project. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA that $4,492,116 is hereby appropriated for the acquisitiolì of property at the Municipal Center and that a capital pt"oject be established for the acquisition. Jack Jennings A RESOLUTION IN SUPPORT OF THE EFFORTS OF THE VIRGINIA STATE HEALTH DEPARTMENT FOR CONTROL OF AIDS WHEREAS, AIDS - Acquired Immune Deficiency Syndrome- has become a major health concern since it first infected humans in the 1970's; and WHEREAS, there are now more than 21,000 cases of AIDS diagnosed in the United States; and WHEREAS, there are now more than 250 cases of AIDS diagnosed in Virginia of whom over 130 have died of this infection; and WHEREAS, there is as yet no treatment or immuniza- tion for this viral disease; and WHEREAS, public health physicians recognize that accurate education in regard to AIDS transmission and the means to prevent this transmission is the only current means to reduce the spread of this disease. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA: That we endorse the efforts of the physicians at the United State's Center for Disease Control and the efforts of the Virginia State Health Department's physicians respons- ible for prevention of infectious disease in their efforts to accurately educate our citizens in regard to this dread disease and its prevention. Prohibited. (a) No person shall drive or operate in the city any automobile or other motor vehicle, engine or train (i) while such person has a blood alcohol concentration of fifteen ten one-hundredths tEh4-5t (0.10) percent or more by weight by volume as indicated by a chemical test administered in accordance with the provisions of section 21-338, or (ii) while such person is under the influence of alcohol, or (iii) while such person is under the influence of any narcotic drug or any other self-administered intoxicant or drug of whatsoever nature. (b) For the purposes of this section, the term "motor vehicle" shall include mopeds, while operated on the public highways of the city. Section 21-339. Presumptions from alcoholic content of blood. In any prosecution for a violation of section 21-336, the amount of alcohol in the blood of the accused at the time of the alleged offense, as indicated by a chemical analysis of a sample of the accused's blood or breath to determine the alcoholic content of his blood in accordance with the provisions of section 21-338, shall give rise to the following rebuttable presumptions: (1) If there was at that time 0.05 percent or less by weight by volume of alcohol in the accused's blood, it shall be presumed that the accused was not under the influence of alcoholic intoxicants.
