ITEM#53428 Robert J. Scott, Director-Planning,presented information relative the eastern side of the Interchange at 1-264 and Independence Boulevard and the results of the Consultant's study. Mr.Scott introduced Brian Curtis and his team from Michael Baker Consultants; Horace Welch - Virginia Department of Transportation Planning Division and William Nash-Kimley-Horn and Associates. The problem is depicted in this photograph with Independence Boulevard going underneath Interstate 264. Independence Boulevard has been an asset to the City since its construction in 1967 when the population was approximately 150,000. The population is now about 450,000. Independence Boulevard has the disadvantage of serving as a dam impeding the flow of traffic from the North side of the road which involves all the remaining northern portion of the City i.e.condos on Shore Drive,as well as south of this Boulevard. There are nine (9) "holes" in this dam commencing at Newtown, Witchduck, Independence, Rosemont, Plaza Trail, Lynnhaven, First Colonial, Great Neck and Birdneck.All traffic in the Citymust flow through one of these nine(9) "holes". There have been minor upgrades to the Independence Interchange since its inception. The concept of a `fly-over"has been part of the City's plans for many years; however, this has fallen in and out of favor over various periods of time. EAST ALTERNATIVE F _ .Ianuary 11. 2005 - 6- CITY MANA GER 'S BRIEFING VDOT INTERCHANGE DESIGN OPTIONS - INDEPENDENCE BOULEVARD and 1-264 JOINT ITEM # 53428 (Continued) Mr. Scott advised of the three (3) alternatives, Alternative C (Resource Bank alternative) can be eliminated. Mr. Scott advised the Planning staff recommended DEFERRAL of the City View One, L.L. C. application until the City Council Session of February 8,2005, to discuss adjustments to the applicant's site plan re the other two (2) alternatives, The staff can also discuss the issue with the other stakeholders, property owners affected, the "umbrella" Central Business District Association and other interested citizens, Mr, Scott advised Alternative A will have some impact on parking relative the office parks (Reflections). Relative the geography of the City which is basically a "box ", the four (4) sides are defined by 1-264, Great Neck, Shore Drive and Independence, Inside this "box" are the majority of the City's inland waterways. One cannot cross that "box" but must go around the perimeter when moving around the City. Mr. Scott advised the staff will provide a recommendation on February Eighth relative the preferred alternative and its effect on the City View application, The question in conjunction with the approval of the CityView application will be: "Can We Decide On a Corridor to Protect?" The three (3) alternatives on the west side of the Interchange will be discussed within the very near future and there are development issues also connected with these alternatives. During this presentation, the staff shall also display a concept of the redesign of Witchduck Road when it crosses under 1-264. January 11,2005 - 7 - CITY COUNCIL COMMENTS 3: 15 P.M. ITEM # 53429 Mayor Oberndorf advised a very prominent lady, the City Clerk, Ruth Hodges Smith, will be celebrating her Birthday, January 15, 2005. The Mayor and City Council wished Ruth a very Happy Birthday. ITEM # 53430 Councilman Schmidt advised the Polar Plunge XIII will be Saturday, February 5,2005. The Polar Plunge will benefit SPECIAL OLYMPICS. Council Members Schmidt and Reeve will participate and urged all Council Members to attend. Mayor Oberndorf and Councilman Diezel will attend. Last year, over $350,000 was raised for Special Olympics Virginia. ITEM # 53431 Councilman Maddox and Reeve referenced today's Virginian-Pilot article, January 11, 2005, concerning the lifeguard and the splitting of the Beach Rental contracts. The City Council has not been briefed on the perimeters of the Contract. The 31st Street project appears to be offered a higher level of service than the other hoteliers. Councilman Reeve inquired if pre-qualification statements were made prior to the submittal of the Bid re financial qualifications and proper staff implementation. Any other hotel which may wish to upgrade services to their clients should have the same opportunity as the 3rt Street Hotel. The City Manager advised information shall be provided in City Council's Agenda package on Friday, January 14, 2005, re the specifications and process concerning the contracts. Contrary to the newspaper article, there has not been a determination re responsive bidders. The City Manager advised there was not a modification made after the bids went out. It is part of the bid package. There are provisions for other hoteliers who wish a similar type of premium service if they desire same at a future time. The Marriott, as well as others, has been expressing a desire. The concept was to create a bidding climate and process in the bids so that upgraded service could be provided at no additional cost to the City. The City Attorney advised he does not oversee the bidding; however, legal advice is provided. City Council was briefed on the Thirty-first Street exception, The City Manager advised a Briefing shall be provided re Beach Rental Services Contract during the City Council Workshop of January 18, 2005. ITEM # 53432 Mayor Oberndorf referenced a telephone call from a lady residing in Lamplight Manor for approximately thirty-eight (38) years. Mayor Oberndorf has also received numerous e-mails. The Web Site of one of the Television Stations (WA VY TV 10 "On Your Side") identified the Joint Land Use Task Force's twenty-four (24) specific points, the "heart and soul" of the Joint Land Use Study. WAVY further reported the neighborhoods of Nottingham Estates, Oceana Gardens Lamplight Manor and Cheltenham Square are considered Accident Potential Zones and a Bill giving the City authority to force residents of these areas to sell their homes will be submitted to the Virginia General Assembly next week. This information was placed in the doorways of each of the homeowners of Lamplight Manor. A copy of WA VY TV 10's Web Page relative the APZs was distributed to City Council and is hereby made a part of the record. Mayor OberndOfj' and Tom Pauls, Comprehensive Planner, advised a reporter from Channel 10, the twenty-four (24) specific points of JLUS were just recommendations and had not been adopted. Mayor Oberndorf requested a response explanation be provided on VBTV. January 11, 2005 - 8 - CITY COUNCIL COMMENTS ITEM # 53432 (Continued) Council Lady McClanan referenced many calls of concern and advised many of these residents are older with health problems. The residents do not understand why their property is more inclined to purchase then the adjacent Lynnhaven Mall. Council Members Reeve and Maddox also advised of citizen concerns. Councilman Reeve advised WA VY 10 has not attended any of the JLUS meetings. Councilman Reeve requested Robert Matthias, Assistant to the City Manager, advise who is sponsoring the Bill to the General Assembly and determine when this item is proposed for discussion. Senator Ken Stolle is sponsoring the Bill to the Senate. The citizens could also go to Richmond and be part of this process. Councilman Maddox suggested prior to the Public Hearing re Joint Land Use Plan on January 18, 2005, there be a Briefing by City Staff explaining the facts re the Joint Land Use Plan. The intent of condemning homes is expected to involve many years. Councilman Maddox suggested an explanation in the Beacon be provided prior to the Public Hearing. The City Manager advised if the Joint Land Use Plan containing the recommendations is adopted, then it would involve potentially years and many sessions of the General Assembly before the issue of taking homes could even be considered. The thought was that some City Council in the future may have to make the tough decision to condemn property in the closer Accident Potential Zones in order to preserve the operation of Oceana. This recommendation was specifically conditioned on a partnership between the State, Federal Government and the locality to provide funding. The Navy currently has the ability to condemn property. January II, 2005 - 9 - AGE N DA REV I E W S E S S ION 3:45 P.M. ITEM # 53433 J.1. Ordinance to AMEND Chapters /-2, 6-3, 6-5, 6-30, 6-114 and 3/-28 of the City Code re the definition of "resort season". (Deferred January 4,2005) Councilman Maddox requested this item be DEFERRED until the City Council Session of February 8, 2005. Issues relative to the "dog beach" and where can individuals walk their pets. Councilman Maddox wishes to explore other possibilities re designated areas for pets. Council Lady Wilson expressed concern re the citizens who live adjacent to the Boardwalk and cannot walk their pets on there. The City Attorney advised the laws must be uniform. Pets have not been allowed on the Boardwalk for many years. Mayor Oberndoif advised there are "dog parks" at Redwing and the Water Tower off Laskin Road. Councilman Diezel also referenced the "dog park" at Providence. This item shall be DEFERRED BY CONSENT, until the City Council Session of February 8, 2005. ITEM # 53434 J.2. Ordinance to AMEND the City Code by ADDING *5-19 re adequate space and time restrictions for tethering animals. Councilman Schmidt advised the intent was tethering dogs. The ordinance shall be AMENDED. Ordinance to AMEND the City Code by adding *5-19 re adequate space and time restrictions for tethering unifftul" dogs Steve Snyder, Animal Control Supervisor, advised the department must prove the dog has been tied up for three (3) hours; and Animal Control does not have the manpower to stake out an individual's yard for three (3) hours. However, this law can be utilized as a tool for enforcing cruelty to animals, educating the public as well as a follow up to "dogfighting" cases i.e many pit bulls tied up in the yards. A State Code exists under Article II of the Animal Welfare Act which covers adequate food, water, shelter, space and exercise. January II, 2005 - 10- AGENDA REVIEW SESSION ITEM # 53435 K.1. (DISTRICT 7 - PRINCESS ANNE) Councilman Reeve advised Natasha 's Bistro currently occupies the site and is no longer in business, The applicant wishes to convert the existing use of the site from a restaurant to an automobile and farm equipment parts store (NAPA). The applicant proposes to demolish the existing structure and construct a new building with a parking area. Council Lady McClanan suggested the staff might wish to review Church schools as being part of the Conditional Use Permits for churches. This is becoming a serious issue. Councilman Diezel concurred and advised he believes when growth occurs in a church, it needs to be measured because of the recent incidence when a church increasedfrom 300 to 900 members. "Adequate space" means sufficient space to allow each animal to (i) easily stand, sit, lie, turn about, and make all other normal body movements in a comfortable, normal position for the animal and (ii) interact safely with other animals in the enclosure. ill When a dog is tethered, "adequate space" means a tether that permits the above actions and is appropriate to the age and size of the dog. The tether must be attached to the dog by a properly applied collar, halter, or harness configured so as to protect the dog from injury and prevent the dog or tether from becoming entangled with other obj ects or dogs, or from extending over an obj ect or edge that could result in the strangulation or inj ury of the dog. Furthermore, the tether must be at least three times the length of the dog, as measured from the tip of its nose to the base of its tail, except when the dog is being walked on a leash or is attached by a tether to a lead line. When freedom of movement would endanger the dog, temporarily and appropriately restricting movement of the dog according to professionally accepted standards is considered to be provision of adequate space. WITNESSETH: WHEREAS, O'Leary and Dana (hereinafter collectively referred to as "Grantors") have initiated an amendment to the Zoning Map of the City of Virginia Beach, Virginia, by petition addressed to the Grantee, so as to change the classification of the Property from R-IO to B-2 Conditional; and WHEREAS, the Grantee's policy is to provide only for the orderly development ofland for v~ous purposes, including mixed use purposes, through zoning and other land development legislation; and WHEREAS, the Grantor acknowledges that competing and sometimes incompatible uses conflict and that in order to permit differing uses on and in the area of the subject Property and at the same time to recognize the effects of the change, and the need for various types of uses, certain GPIN: 14563379030000(B-2), 14563356650000, 14563357840000, 14563368030000, 14563369560000 This Document Prepared By: Payne, Gates, Farthing & Radd, P.C. 999 Waterside Drive, Suite 1515 Norfolk, VA 23510 reasonable conditions governing the use of the Property for the protection of the community that are not generally applicable to land similarly zoned are needed to cope with the situation to which the Grantor's rezoning application gives rise; and WHEREAS, the Grantor has voluntarily proffered, in writing, in advance of and prior to the public hearing before the Grantee, as part of the proposed conditional amendment to the Zoning map, in addition to the regulations provided for in the existing B-2 Conditional zoning district by the existing overall City Zoning Ordinance (CZO), the following reasonable conditions related to the physical development, operation and use of the Property to be adopted as a part of said amendment to the Zoning Map relative to the Property, all of which have a reasonable relation to the rezoning and the need for which is generated by the rezoning; and WHEREAS, said conditions having been proffered by the Grantor and allowed and accepted by the Grantee as part of the amendment to the Zoning Ordinance, such conditions shall continue in full force and effect until a subsequent amendment changes the zoning on the Property covered by such conditions; provided, however, that such conditions shall continue despite a subsequent amendment if the subsequent amendment is part of the comprehensive implementation of a new or substantially revised zoning ordinance, unless notwithstanding the foregoing, these conditions are amended or varied by written instrument recorded in the Clerk's Office ofthe Circuit Court of the City of Virginia Beach, Virginia and executed by the record owner ofthe subject Property at the time of recordation of such instrument; provided, further, that said instrument is consented to by the Grantee in writing as evidence by a certified copy of ordinance or resolution adopted by the governing body ofthe Grantee after a public hearing before the Grantee advertised pursuant to the provisions of the Code of Virginia, Section 15.2-2204, which said ordinance or resolution shall be recorded along with said instrument as conclusive evidence of such consent. NOW THEREFORE, the Grantors, for themselves, their successors, assigns, grantees, and other successors in title or interest, voluntarily and without any requirement by or exaction from the Grantee or its governing body and without any element of compulsion of quid pro quo for zoning, rezoning, site plan, building permit or subdivision approval, hereby makes the following declaration of conditions and restrictions which shall restrict and govern the physical development, operation and use of the Property and hereby covenants and agrees that these Proffers shall constitute covenants running with the said Property, which shall be binding upon the Property and upon all parties and persons claiming under or through the Grantor, his heirs, personal representatives, assigns, grantees and other successors in interest or title, namely: 1. The Property will be developed in substantial conformance with the conceptual site plan entitled "Proposed Rezoning for Restaurant," dated July 28, 2004, prepared by Beck Associates, Consulting Engineers, which has been exhibited to the Virginia Beach City Council and is on file with the Virginia Beach Department of Planning. 2. The Property will be developed in substantial conformance with the Rendering entitled "Luigi's Pizza-- Rendering" which has been exhibited to the Virginia Beach City Council and is on file with the Virginia Beach Department of Planning. 3. The dumpster enclosure will be wood with brick corner posts that match the materials of the building exterior. 4. Eight-foot high monument style sign with materials to match the building exterior. 5. Further conditions may be required by the Grantee during detailed Site Plan review and administration of applicable City Codes by all cognizant City Agencies and departments to meet all applicable City Code requirements. When developed, the area of the Property shown as "Phase f' on the conceptual site plan prepared by NDI Basgier & Associates Division, dated August 3, 2004, and titled "Conceptual Plan for Atlantic Builders, LLC" (the "Conceptual Plan") shall be developed for industrial storage, warehouse, and related office purposes, substantially in accordance with the 2 plan shown on Sheet 1 of 2 of the Conceptual Plan, copies of which are on file with the Planning Department and have been exhibited to the City Council; provided, however, that Grantor shall have the right to reduce the size, number and configuration of the buildings shown on the Conceptual Plan. 2. When constructed, all industrial storage and warehouse buildings located on the area of the Property designated on the Conceptual Plan as "Phase f' shall be constructed using architectural designs in substantial accordance with the renderings titled "Atlantic Builders, LLC Proposed Conceptual Elevations", dated October 18, 2004, which have been submitted to and remain on file with the Planning Department and which have been exhibited to the City Council. 3. When constructed, all exterior building walls facing London Bridge Road or London Bridge Road Extended shall be constructed using either (a) fiber cement panels substantially similar to the sample submitted to the Planning Department with the Grantor's rezoning application and exhibited to the City Council, either in bluestone, neutral or earth-tone colors; (b) split-face block, in neutral or earth-tone colors; or (c) brick, in red, neutral or earth- tone colors. In addition, when constructed, foundation landscaping shall be installed along all exterior building walls facing London Bridge Road or Dam Neck Road. 4. The areas shown on Sheet I of 2 of the Conceptual Plan as "Area to be Preserved 4.6 +/- Acres" and "Area to be Preserved 2.7 +/- Acres" shall not be developed, except as reasonably necessary for the installation of stormwater retention facilities and the installation of landscaping as shown on the Conceptual Plan. 5. When developed, the Grantor shall install landscaping along London Bridge Road Extended and Dam Neck Road in substantial accordance with the landscaping shown on Sheet 2 of 2 of the Conceptual Plan and shall preserve existing, mature trees along those areas, to the extent reasonably possible in light of Grantor's development plans. 6. All buildings and structures located upon the Property shall be set back a minimum distance of fifty feet (50') from the current right-of-way of London Bridge Road Extended. All stormwater retention or treatment facilities located along Dam Neck Road and London Bridge Road Extended shall be set back a minimum distance of thirty-five feet (35') from the current rights-of-way, as shown on Sheet 2 of 2 of the Conceptual Plan. 3 7. No onsite vehicular parking, outdoor storage, loading docks or loading areas shall be permitted between London Bridge Road and any building on any parcel adjacent to London Bridge Road, nor within fifty feet (50') of London Bridge Road Extended. 8. Further conditions lawfully imposed by applicable development ordinances may be required by the Grantee during detailed site plan and/or subdivision review and administration of applicable City Codes by all cognizant City agencies and departments to meet all applicable City Code requirements. 9. When the Property is developed, a privacy fence six feet (6') in height shall be installed between the rear of the easternmost building shown on the Conceptual Plan, extending from the front yard setback line along London Bridge Road to the Phase Line shown on the Conceptual Plan.
