Dear Mr. Guy:
Pursuant to your request, our office has researched the
above-referenced matter and we find that an Ordinance was adopted
on August 18, 1975, to close the above-referenced street. For
some unknown reason, this Ordinance was never recorded and we
cannot locate the original.
Pursuant to Section 8.01-390 of the Code of Virginia, as
amended, I enclose a certified copy of said Ordinance and an
Aff idav it which has been execu ted by Ru th Hodges Srni th, Ci ty
Clerk, for recordation by you. We will be glad to assist you in
the recording of these documents. I thought, however, that you
might wish to handle the recordation yourself to make certain
that these documents appear in your client's chain of title.
It is di f f i cuI t to specula te as to vlhy the Ordinance to
vacate a portion of Pembroke Boulevard was never recorded. We
apologize, however, for this oversight and any inconvenience your
client may have suffered. Hopefully, the enclosed certified copy
of the Ordinance and Affidavit will help resolve this matter.

of the City of Virginia Beach, Virginia, to have the hereinafter descdbed
portion of Pembroke Boulevard closed, vacated and discontinued, and

WHEHEAS, application W&.8 made to the City Planning
Commission and to the City Council, and, pursuant to the statutes in
such cases made and provided, the Council appointed Viewers who have
l~eporteú to the Council that no inconvenience to the public or private
individuals would result from such closing, vacating and discontinúancc; and
WHEREA S, it is the judgment of the Council that such

\o.TJŒREAS, proper notj ce that DR!illEN DEVELOP1'1ENT CORPORATION and
J. DAVIS REED, III, Special Commissioner, would make application to the
City Council of the City of Virginia Beach, on July 7, 1975, to have the
hereinafter described streets closed, vacated and discontinued as public
streets of the City of Virginia Beach was duly posted at the courthouse
of the Circuit Court of the City of Virginia Beach, Virginia, and at two
public places in the City of Virginia Beach, Virginia; and
\nlEIŒAS, sai d application was made to the Council and pursuant
to the statutes in such cases made and provid~d the Council, on July 7,
1975, which was more than ten days after said posting of said notice, ~
appointed Robert J. Scott, George E. Tinnes and Hilliam hi. Fleming, Jr.
as viewers to view said streets sought to be closed, vacated and discon~
tinned and to report: in writing whether in their opinion, any and if
any, what, inconvenience would result from discontinuing the same, and
said viewers have made said report to the Council by their letter dated

which is the southeasterly corner of Lot 3 as shown
on that certain plat entitled "Plat Showing SubdivIsion
