Greater where specified in a CUP. • Minimum rotor clearance - z5' above ground level for horizontal axis turbines and ro' for vertical axis turbines Other General Regulations • No signs, except safety and warning signs • All towers must be monopole unless other allowed by CUP • Noise -not exceed 55dB(A) • Not lighted unless FAA requires • Locate to minimize shadowing and flickering effects on adjacent property • All electrical underground or otherwise hidden • All must have braking system that engages in accordance with manufacturer's specifications 4 r. Definitions 24 •••• 25 Wind ever conversion s stem. COMMENT 36 37 38 The section defines wind energy conversion systems and classifies them as either freestanding 39 or roof-mounted. 40 41 Sec. 202. Height regulations. 42 43 (a) Whenever height limits for buildings and other structures are established, no 44 portion of any building or other structure shall extend above such height limits, except 45 residential chimneys, communication towers, broadcasting 46 towers, radio or television antennas, spires, flagpoles, water tanks, roof-mounted wind 47 energv conversion svstems or monuments otherwise approved for erection; provided, 48 however, that smokestacks may also extend beyond such limits, if they do not exceed in 49 height the distance to the nearest lot line; and further provided that one tower for 50 purposes of an amateur radio station operation, which may contain multiple antennas, 51 may extend beyond said height limits but shall not exceed ninety (90) feet in height above 52 ground elevation. 53 54 (b} No artificial structure or tree or other natural growth which on the basis of its 55 height would constitute an obstruction to air navigation pursuant to Part 77 of the Federal 56 Aviation Administration Regulations, 14 C.F.R. §§ 77.21 et seq. shati be allowed in any 57 district. The director of the department of planning shall prepare a map delineating 58 geometric specifications and height limitations for protecting navigable airspace in 59 compliance with Part 77 of the Federal Aviation Administration Regulations, 14 C.F.R. §§ 60 77.21 et seq. 61 62 COMMENT 63 64 The amendment allows roof-mounted wind energy conversion systems to exceed the height 65 limits otherwise applicable in the various zoning districts within the City. The proposed Section 66 242.5, which appears immediately below, contains independent limitations on the height of wind 67 energy conversion systems, both roof-mounted and freestanding. 68 69 The amendment on Line 4S is a technical correction that replaces the term "llne-of--sight 70 relaying devices" with the currently-used term, "communication towers." Tt is not related to the 71 regulation of wind energy conversion systems. 72 73 Sec. 209 Wind Energy Conversion Systems 74 75 fa) Purpose. The purpose of this section is to promote the use of renewable 76 energv sources by allowing wind energv conversion svstems in appropriate locations 77 while minim~zing visual safety and environmental impacts and promoting the safe 78 effective and efficient use of such svstems 79 80 (b) Applicafion requirements 81 82 (1) Conditional use permit applications In addition to the information 83 re wired b Section 221 a lications for a conditional use ermit for 84 a wind energv conversion system shall include the following items• 85 86 1A) A site plan or plan drawn to scale showing the location 87 height and design of the proposed system including_ any 2 88 accessory buildinas or other appurtenances, adjacent land 89 uses and any other applicable information reauired by the 90 Planning Director: 91 92 LB) A certification from a professional enaineer licensed in the 93 Commonwealth of Virain~a that the proposed svstem complies 94 with all applicable reaulations and requirements of the Vir_ is nia 95 Uniform Statewide Building Code and Federal Aviation 96 Administration; 97 98 ~C} A certification from a professional enaineer licensed in the gg Commonwealth of Vir inia that the structure u on which the 100 groposed wind energv conversion svstem is to be mounted 101 will have the structural integrity to carry the weight and wind 102 loads of the wind enerav conversion svstem and have minimal 103 vibration impacts on the structure; and 104 105 (D) Elevation drawings computer-generated photographic 106 simulations or such other documentation as the Plannm~c. 107 Director rnay require that depict how the proposed Hnnd 108 enerav conversion svstem including accessory buildinas. will 109 ,gRpP as constructed on the proposed site provided. 110 however that this requirement shall not apply if the proposed 111 wind enerav svstem is allowed as a principal use. 112 113 {2 Buildin ermif/sife develo ment ian a iications. Subsection (b) sets forth the conditional use permit application requirements [lines 82•-111] and requirements for site plans and building permit applications [lines 1 i3-116]. Subsection (c) [lines 118-215j sets forth requirements pertaining to lot area, setbacks, height, structural standards, lighting, signage, noise, shadowing/flickertng, electrical connections and braking. Subsection (d) [lines 217-220J requ#res an insgQCtion every two years and submission of the inspection report to the Planning Director. Subsection (e) [lines 222-224] requires the removal of the system if it is not used for one year. Sec. 242.5. Wind energy conversion systems !n addition to general requirements w[nd energy conversion systems shall be subject to the nrovis~ons of Section 209 COMIYIENT The section provides that wind energy conversion systems allowed as conditional uses shall be subject to the provisions of Section 209 of the City Zoning Ordinance.
