ITEM: An Ordinance to Amend Section 23-11 of the City Code Pertaining to Assault
and Battery
MEETING DATE: June 3, 2014
¦ Background: The 2014 General Assembly amended Code of Virginia § 18.2-57
pertaining to the assault and battery of school employees. The amendment replaces
the current listing of school employees by title with the word "employee" and includes all
part-time and full-time employees of private and public elementary and secondary
schools while engaged in the performance of their duties.
¦ Considerations: Amending City Code § 23-11, effective July 1, 2014, will
ensure the City Code provision mirrors the newly amended state statute.
¦ Public Information: Public information will be provided through the normal
Council agenda process.

OF THE CITY CODE PERTAINING TO
ASSAULT AND BATTERY
SECTION AMENDED: § 23-11
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VIRGINIA
BEACH, VIRGINIA:
That Section 23-11 of the Code of the City of Virginia Beach, Virginia, is hereby
amended and reordained to read as follows:
Sec. 23-11. Assault and battery.
(a) Any person who shall commit a simple assault or assault and battery upon another
person shall be guilty of a Class 1 misdemeanor, and if the person intentionally
selects the person against whom a simple assault is committed because of his race,
religious conviction, color or national origin, the penalty upon conviction shall
include a mandatory, minimum term of confinement of at least six (6) months, thirty
(30) days of which shall not be suspended, in whole or in part.
(b) In addition, if any person commits a battery against another, knowing or having
reason to know that such other person is a full-time or part-time teash , pronGnpal,
assistant , employee of any public or private
elementary or secondary school and is engaged in the performance of his duties as
such, he shall be guilty of a Class 1 misdemeanor and the sentence of such person
upon conviction shall include a mandatory, minimum sentence of fifteen (15) days in
jail, two (2) days of which shall not be suspended in whole or in part. However, if the
offense is committed by use of a firearm or other weapon prohibited on school
property, pursuant to § 18.2-308.1 [of the Code of Virginia], the person shall serve a
mandatory, minimum sentence of confinement of six (6) months which shall not be
suspended in whole or in part.
(c) "Simple assault" or "assault and battery" shall not be construed to include the use
of, by any teaGheF, PFORGIpal, assestaRt , gumdaRGe , school
security officer; or full-time or part-time emplovee of any public or private
elementarv or secondarv school while actinq in the course and scope of his acting
official capacity, any of the following: (i) incidental, minor or reasonable physical
contact or other actions designed to maintain order and control; (ii) reasonable and
necessary force to quell a disturbance or remove a student from the scene of a
disturbance that threatens physical injury to persons or damage to property; (iii)
reasonable and necessary force to prevent a student from inflicting physical harm
on himself; (iv) reasonable and necessary force for self-defense or the defense of
others; or (v) reasonable and necessary force to obtain possession of weapons or
other dangerous objects or controlled substances or associated paraphernalia that
43 are upon the person of the student or within his control. In determining whether a
44 person was acting within the exceptions provided in this subsection, due deference
45 shall be given to reasonable judgments that were made by at° r,-PFORsipal,
46 assistant , gumdanGe , school security officer or full-time or part-
47 time employee of any public or private elementary or secondary school at the time
48 of the event.
49 As used in this section, the term "school security officer" means an individual who
50 is employed by the local school board for the purpose of maintaining order and
51 discipline, preventing crime, investigating violations of school board policies and
52 detaining persons violating the law or school board policies on school property, a school
53 bus or at a school-sponsored activity and who is responsible solely for ensuring the
54 safety, security and welfare of all students, faculty and staff in the assigned school.
55 This ordinance shall be effective July 1, 2014.

ITEM: An Ordinance to Appropriate Fund Balance of the Police Federal/State Seized
Assets Special Revenue Fund for Police Equipment and Contractual Services
MEETING DATE: June 3, 2014
¦ Background: The Police Department requests the use of $809,500 from the
fund balance of the Police State/Federal Seized Fund to purchase the following priority
equipment and services that have not been funded through the operating budget.
o In-car camera replacements to replace 41 non-wireless units and 19 older model
units purchased in 2010 ($200,000);
o Remodeling of First Precinct facility and security upgrades to make use of the
space recently vacated by the Forensic Services Unit ($170,000);
o Addition to the City fleet of one Kubota Rough Terrain Vehicle with capacity of
four people to be used to increase the speed and effectiveness of the
department's response to calls for service at Sandbridge Beach (on and off the
beach) ($15,000). The existing all-terrain vehicle used at Sandbridge Beach can
only accommodate one officer;
o Police recruiting funds to increase the pool of recruits ($20,000);
o Specialty training on cell phone and computer forensics for Forensic Services
Unit ($6,500);
o Audio and video equipment to outfit new office space dedicated to the Crime
Analysis Unit in the Detective Bureau ($6,500);
o Court presentation animation suite software to create displays and timeline
reconstruction for court presentations ($5,000);
o Strategies for Youth Juvenile Justice Jeopardy Project to create interactive youth
training on the criminal justice system ($16,500);
o Two replacement surveillance vehicles including various related operational
equipment, and the corresponding removal from the fleet of two older/obsolete
vehicles ($285,000); and
o New promotional process for rank of Sergeant ($50,000).
o Costs for seized vehicles retained for Police operations to be paid to the State or
Federal government ($10,000);
o Funds for confidential informants ($10,000); and
o Specialty and tactical training ($15,000).
¦ Considerations: There is sufficient fund balance in the Police Federal/State
Seized Assets Special Revenue Fund to cover this cost. According to the Department of
Justice, these funds are to be used to provide law enforcement agencies monetary
resources to assist in accomplishing their mission, and cannot be used to supplant local
funding. The Police Department will absorb the additional City Garage, operating and
maintenance cost out of its FY 2014-15 General Fund Operating Budget for the addition
of the rough terrain vehicle.
¦ Public Information: Public information would be made available through the
normal Council Agenda process.
¦ Recommendation: It is recommended that $809,500 be appropriated from the
Police State/Federal Seized Fund to purchase these items.

ITEM: An Ordinance to Appropriate the Dredging Costs of Individual Access Basins to
CIP #8-500, Old Donation Creek Dredging with Costs to be Financed by
Property Owners in the Old Donation Creek Special Service District
MEETING DATE: June 3, 2014
¦ Background: On September 13, 2011, City Council adopted an ordinance to
establish the Old Donation Creek Dredging Special Service District and created capital
project #8-500, "Old Donation Creek Area Dredging." As part of this project, the City will
pay for the dredging of the City spur channel, the special service district will pay for the
neighborhood channel dredging, and property owners pay for dredging of their
individual access basins. This project, combined with project 8-005, "Maintenance
Dredging of the Western Branch Lynnhaven River", is anticipated to be advertised early
summer 2014. Since adoption of the special service district and receipt of the project
permits, the cost of the access basins have been individually re-estimated, and each
district property owner has been provided the opportunity to submit their funds. This
work will be advertised as part of the construction contract.
¦ Considerations: Property owners in the district have the option of providing
individual contributions to pay the costs associated with their individual access basin
dredging. If all eligible owners participate the total cost estimate is $365,000. Only those
access basins, which are fully funded by a property owner, will be included in the
contract for dredging.

Council Agenda process.

WHEREAS, property owners in the Old Donation Creek Dredging Special
Service District have the opportunity to include, at their own expense, the cost of
dredging their individual access basins as part of the City's neighborhood dredging
contract;
WHEREAS, based on the number of eligible-owners, the total cost of dredging
the individual access basins is estimated at $365,000.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
VIRGINIA BEACH, VIRGINIA:
That $365,000 is hereby appropriated, with estimated revenues from property
owners electing to participate in dredging of individual access basins, to CIP # 8-500,
Old Donation Creek Area Dredging. for dredging individual access basins.

Contribution Rate

Board's Election of VRS Board-Certified Rate
MEETING DATE: June 3, 2014
¦ Background: In Item 468(H) of its 2012 Appropriation Act, the General
Assembly provided an option to localities to choose the employer contribution rate for
VRS effective July 1, 2012. This legislation required VRS to disseminate information
regarding the fiscal impacts of the choice, and it required all participating employers
certify that they reviewed and understand the information from VRS. As required, the
Council certified a rate and elected the VRS Board Certified Rate (15.68%). For the
upcoming biennium, the VRS Board Certified Rate is 16.35%.
In addition to certifying the employer contribution rate, the City Council is required to
certify that it concurs with the School Board's employer contribution rate if the School
Board elects the VRS Board rate for the 2014-16 biennium.
¦ Considerations: The two attached resolutions are required by the General
Assembly, VRS, or both. With the exception of the certification regarding review and
understanding of the information provided by VRS, the other certifications are
affirmations of the contribution rates upon which the FY15 budget, adoted May 13th, was
built. The School Board elected by resolution the VRS Board rate for School Board
Non-Professional Employees on May 20, 2014. A copy of that resolution is part of this
package.

5 BE IT RESOLVED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH,

8 The City of Virginia Beach (VRS #55234) does hereby acknowledge that its contribution
9 rates effective July 1, 2014 shall be based on the higher of a) the contribution rate in
10 effect for FY 2012, or b) eighty percent of the results of the June 30, 2013 actuarial
11 valuation of assets and liabilities as approved by the Virginia Retirement System Board
12 of Trustees for the 2014-16 biennium (the "Alternate Rate") provided that, at its option,
13 the contribution rate may be based on the employer contribution rates certified by the
14 Virginia Retirement System Board of Trustees pursuant to Virginia Code § 51.1-145(I)
15 resulting from the June 30, 2013 actuarial value of assets and liabilities (the "Certified
16 Rate"); and

32 directed to carry out the provisions of this resolution, and the City Manager or designee
