Councilman Moss advised the Deferred Compensation Board met last week to discuss the possibility of moving the fiduciary responsibility of the 957 Retirement Plan to VRS. In addition to the returns being competitive, the costs are significantly lower with VRS. In fact, it will give employees more choices at lower costs. Councilman Moss complimented the leadership of Patti Phillips and feels employees receive a tremendous benefit with all of her expertise, time and work she dedicates to the Retirement Plan. Councilman Moss advised the Board is planning to provide a presentation to City Council regarding this issue in December and then the legislation will be placed on the Agenda for City Council consideration. September 19 2017 61 CITY COUNCIL COMMENTS ITEM#67402 Councilman Moss requested the status of Amazon Headquarters. Mayor Sessoms advised this will be discussed during today's Closed Session. September 19, 2017 62 CITY COUNCIL COMMENTS ITEM#67403 Councilman Moss advised yesterday the Senator Arms Services Committee did adopt the Authorization; however, this will have to go to the Joint Committee in October. The Senate Appropriations Committee has not voted or adopted an Appropriation Bill, which is key, and subject to the Budget Control Act of 2012, as Amended. September 19, 2017 63 CITY COUNCIL COMMENTS ITEM#67404 Council Lady Henley advised the Draft of the proposed ITA Update is out and there will be a Stakeholder's briefing next Wednesday night in order to provide adequate time for public comment. The update will be provided to City Council on October 10". She requested City Council take time to review the draft and provide input. The update is scheduled to he considered by the Planning Commission in November and then by City Council in December. September 19. 2017 64 CITY COUNCIL COMMENTS ITEM#67405 Council Lady Henley referenced the letter that was included in City Council's packet to the Army Corps of Engineers regarding the Sandbridge Beach Replenishment Project moving forward even though there is no Federal 'Dollars available and will he funded by the SSD. Councilman Moss asked if the lack of Federal Funds is due to where it falls in the Budget Cycle or is it a change of philosophy in the Administration not to fund these types of projects. City Manager Hansen advised the Office of Management Budget has never been a huge supporter of the commitments made regarding shore replenishment and now there is just no funding available. Council Lady Henley advised this project was started in the '90's and was to be funded 65%federal and 35%local. However, due to the size of TowneBank and the volume of transactions it handles, Towne Bank has an interest in numerous matters in which he is not personally involved and of which he does not have personal knowledge. In that regard, he is always concerned about the appearance of impropriety that might arise if he unknowingly participates in a matter before City Council in which TowneBank has an interest. Mayor Sessoms also has similar concerns with respect to Berkshire Hathaway Home Services Town Realty, which is an affiliate of Towne Bank. In order to ensure his compliance with both the letter and spirit of the State and Local Government Conflict of Interests Act (the "Act'), it is his practice to thoroughly review each City Council agenda to identify any matters in which he might have an actual or potential conflict. If during his review of an agenda, he identifies a matter in which he has a "personal interest", as defined by the Act, he will either abstain from voting, or file the appropriate disclosure letter with the City Clerk to be included in the official records of City Council. Mayor Sessoms' letter of January 13, 2015, is hereby made a part of the record. It is my position that state law sets the lowest standard of acceptable conflicts of interests. Unlike the Commonwealth of Virginia's much lower standard of conflict of interests, the Federal standard is one of avoiding even the appearance of a conflict. Tonight's agenda includes a resolution supporting the environmental assessment for the transitioning of the remaining F/A-18 aircraft to Naval Air Station Oceana. The Navy has requested public comment on the environmental assessment, and the resolution is the mechanism whereby City Council could convey its comments to the Navy. The United States Department of Defense is the executive branch department of the federal government that is charged with coordinating and supervising all agencies and functions of the government concerned directly with national security and the United States Armed Forces, including the Navy. As an employee of the Department of Defense, I have concluded that my participation in City Council's discussion and vote on this resolution would result in the appearance of a conflict of interest under the "appearance of a conflict of interest standard." Therefore,my decision is to abstain from the agenda item referenced in this letter for the aforementioned reason. 4109 RICHARDSON ROAD,VIRGINIA BEACH,VIRGINIA 23455 Mrs. Ruth Hodges Fraser 2 September 19,2017 Re: Abstention Pursuant to Conflict of Interests Act § 2.2-3705(F) My bias is to vote, and I am not one to avoid controversy. My duty to preserve the public's trust that I will uphold the highest ethical standards takes precedence. It is to the latter and higher duty that my vote of abstention upholds.
