Atkinson served the City of Virginia Beach as the City Treasurer for 41 years. Mr. Atkinson recently submitted his resignation, effective December 31, 2018. The current term of office for the City Treasurer extends until December 31, 2021 . State law requires the City Council to petition the circuit court for a writ of special election within 15 days of the occurrence of the vacancy. The attached resolution would direct the City Attorney to file the petition with a requested date of the special election of November 5, 2019, which is the date of the November general election. In the interim period, State law provides that the "highest ranking deputy officer...who is qualified to vote for and hold that office, shall be vested with the power and shall perform all of the duties of the office, and shall be entitled to all the privileges and protections afforded by law to elected or appointed constitutional officers, until the qualified voters fill the vacancy by election and the person so elected has qualified and taken the oath of office." Va. Code § 24.2-228.1 . • Considerations: Upon adoption of the resolution requesting a court to order the special election, the City Attorney's Office will file the petition in compliance with the statutory requirements. If the special election is held at the same time as the November general election, the petitions for candidates would be due 81 days before the election, which is August 16, 2019.
