The transportation division: Hauls over 500,000 tons per year Drive over 760,000 miles per year D The Regional Landfill accepts over 325,000 tons per year. D Tire shredder processed over 458,000 tires last year. Cell VII is currently operated as a borrow rz ,�;r - pit to support the landfill operations and - '' '1 is fully permitted for 56 disposal acres. l Cell VIII/IX are for future expansion. 1"--' ,, May 21, 2019 5 CITY COUNCIL'S BRIEFING SOUTHEASTERN PUBLIC SERVICE AUTHORITY ITEM#69274 (Continued) The exact date for the life of a landfill cannot be determined; Operating Cells V and VI are estimated to be filled between 2027-2029 depending on waste disposal amounts: Projected Life of Landfill At the current rate of waste disposed at the Regional Landfill, the current cells(V&VI)will be filled by 2029 but could be as early as 2027 dependent on volume,compaction ratio and achieving the planned slopes. Total projected cost to construct cell VII inclusive of permitting for cells VIII&IX for borrow area and other permit updates is approximately$30 million(in today's dollars.) Cell VII could be filled as early as 2035 if only MSW is disposed in the cell. After elevated leachate levels were reported in 2017, SPSA implemented the SCADA (Supervisory Control and Data Acquisition)System. This system measures and records leachate levels daily to calculate the volume to be discharged in accordance with regulations: Landfill Leachate D In 2017,SPSA had elevated leachate levels in the landfill. D The situation was immediately remedied. D A new SCADA system for leachate management was purchased and installed to improve operations at the landfill. 5P5A May 21, 2019 6 CITY COUNCIL'S BRIEFING SOUTHEASTERN PUBLIC SERVICE AUTHORITY ITEM#692 74 (Continued) Here is an overview of SPSA's Partnership with HRSD: Partnership with HRSD Up until June 1,2018,the leachate from the Regional Landfill was pumped through a force main at the landfill to the HRSD Nansemond Plant. % Due to certain contaminants in leachate and the implementation of the SWIFT program,HRSD requested SPSA redirect the leachate to an alternate pump station. HRSD has agreed to construct a new force main from the landfill to a pump station in Chesapeake. HRSD will pay 2/3 of the cost with SPSA paying 1/3 but no more than approximately$2.5 million. SIS Here is 2018—A Year in Review: 2018 - A Year in Review January 25, 2018- Launch SPSA 2.0 Effective date for new Use&Support Agreements with 8 member communities. Municipal Tip Fee was reduced from$125 per ton to $65 per ton as a result of all debt being paid off and implementation of a blended waste disposal system. Waste from eastern transfer stations is hauled to Wheelabrator and the waste from the western transfer stations is hauled to the landfill. 51'5/1 May 21, 2019 7 CITY COUNCIL'S BRIEFING SOUTHEASTERN PUBLIC SERVICE AUTHORITY ITEM#69274 (Continued) Here is an overview of the Wheelabrator Agreement: Wheelabrator Agreement A contract was awarded to Wheelabrator Portsmouth with an effective date of February 1, 2019. • Term of contract is from February 1, 2019 to June 30, 2027. SPSA has option to extend contract for two(2) additional periods of up to five(5)years each, price to be mutually agreed. • No minimum tons or minimum fee. SPSA is required to deliver the municipal waste received at the Chesapeake, Landstown, Norfolk and Oceana transfer stations to the RDF plant at a rate of$32 per ton. 51 Wheelabrator Agreement Cont'd All ash from the Wheelabrator WTE plant will be delivered to the Regional Landfill at a rate of$25 per ton. Member communities may haul directly to the RDF plant. • As a result of new contract,the municipal tip fee was projected to be reduced to$59 per ton effective July 1, 2019. Due to an increase in tons the municipal tip fee will be $57 per ton effective July 1,2019. Mr. Tajan expressed his appreciation to City Council for their continued support and turned the presentation over to Mr. Kemp: Piney Grove Baptist Church Agenda Item Council District Princess Anne Location 2804 Holland Road 6 Applicant plans to withdraw this item when the new light fixtures are installed and the lights are in compliance with the approved conditions • /40 ® .i6 " Modification of Conditions(Religious Use) Staff Recommends Approval Planning Commission voted 7-3 to recommend Denial The next two (2)slides provide a Brief History of the Piney Grove Baptist Church Application: Piney Grove Baptist Church Brief History: • Planning Commission June 10,2015. • Concerns raised were parking and traffic. • PC suggested removing home fronting Bald Eagle Road to increase parking area. • City Council approval granted July 14,2015. • Conditions required parking lot lights to be on motion sensors when church is not in use. • Condition written by Zoning Administrator Lesley between PC and CC meeting. • Site plan approved October 15,2016.Construction from December 2016 to March 2018. • Neighbor concerns in May 2017-elevated parking lot,landscaping,drainage,and brightness of lights. • June 2017 to present-Staff works with applicant and neighbors to resolve issues noted above. • 8'tall privacy fence installed,shields installed on lights,landscape deficiencies addressed,drainage addressed. • December 2018-Planning Director briefed City Council. • Staff continues to work with ET Gresham to resolve drainage,and Pace to resolve lighting. Mr. Kemp advised the two rear parking lot lights were on but there was no glare and the lights in the middle of the parking lot came on when he approached and were dimmed: Piney Grove Baptist Church Update: Lighting requirements: • New fixtures were delivered to the site first week of May. • New fixtures installed and programmed on May 15. • New fixtures are on motion sensors and will satisfy approved lighting condition. Replace one shrub(Chino Viburnum)along western edge of parking lot; 2. Replace one dead Willow Oak tree along western edge of parking lot; 3. The Veteran's Employment Center is successful in finding jobs for veterans but with the average salary of$46,000, some veterans are leaving the region for higher paying jobs. Council Member Moss advised the Secretary of the Navy sent out a letter this past February seeking a response from interested Cities in establishing a Naval Community College. Council Member Moss advised he will provide the letter to Council for review. Council Member Moss advised the final point was maritime employment, a high-skilled and long-term work force, which provides students graduating from technical schools an opportunity to fill those jobs. Currently, there is RFP out for a bid opening on the Sandbridge Beach Replenishment Project; however, there could be delays depending on the results of the bid process and turtle season. It is further expressly understood and agreed that nothing herein contained shall be construed to enlarge the permission and authority to permit the maintenance or construction of any encroachment other than that specified herein and to the limited extent specified herein, nor to permit the maintenance and construction of any encroachment by anyone other than the Grantee. It is further expressly understood and agreed that the Grantee agrees to maintain the Temporary Encroachments so as not to become unsightly or a hazard. It is further expressly understood and agreed that the Grantee must obtain a permit from the Civil Inspections Division of the Department of Planning prior to commencing any construction within the Encroachment Area (the "Permit"). It is further expressly understood and agreed that the Grantee must obtain and keep in effect liability insurance with the City as a named insured in an amount not less than $500,000.00, per person injured and property damage per incident, combined with the City listed as an additional insured. The Company providing 3 the insurance must be registered to provide insurance in the Commonwealth of Virginia. The Grantee will provide endorsements providing at least thirty (30) days written notice to the City prior to the cancellation or termination of, or material change to, any of the insurance policies. It is further expressly understood and agreed that the Temporary Encroachments must conform to the minimum setback requirements, as established by the City. It is further expressly understood and agreed that the Grantee must submit for review and approval, a survey of the Encroachment Area, certified by a registered professional engineer or a licensed land surveyor, and/or "as built" plans of the Temporary Encroachments sealed by a registered professional engineer, if required by either the Department of Public Works City Engineer's Office or the Engineering Division of the Department of Public Utilities. It is further expressly understood and agreed that the City, upon revocation of such authority and permission so granted, may remove the Temporary Encroachments and charge the cost thereof to the Grantee, and collect the cost in any manner provided by law for the collection of local or state taxes; may require the Grantee to remove the Temporary Encroachments; and pending such removal, the City may charge the Grantee for the use of the Encroachment Area, the equivalent of what would be the real property tax upon the land so occupied if it were owned by the Grantee; and if such removal shall not be made within the time ordered hereinabove by this Agreement, the City may impose a penalty in the sum of One Hundred Dollars 4 ($100.00) per day for each and every day that the Temporary Encroachments are allowed to continue thereafter, and may collect such compensation and penalties in any manner provided by law for the collection of local or state taxes. WITNESSETH: WHEREAS, ZP is the current owner and 7-Eleven is the current or prospective ground lessee of that certain parcel located in the City of Virginia Beach, Virginia, identified by GPIN No. 14665919170000, as more particularly described in Exhibit A attached hereto and incorporated herein by reference (the "Property"); and WHEREAS, the Grantor has initiated an amendment to the Zoning Map of the City of Virginia Beach, Virginia, by petition addressed to the Grantee, so as to change the classification of the Property from B-1 to Conditional B-2; and WHEREAS, the Grantee's policy is to provide only for the orderly development of land for various purposes, including mixed-use purposes, through zoning and other land development legislation; and WHEREAS,the Grantor acknowledges that competing and sometimes incompatible uses conflict, and that in order to permit differing uses on and in the area of the subject Property and at the same time to recognize the effects of the change and the need for various types of uses, certain reasonable conditions governing the use of the Property for the protection of the community that are not generally applicable to land similarly zoned Conditional B-2 are needed to cope with the situation to which the Grantor's rezoning application gives rise; and WHEREAS, the Grantor has voluntarily proffered in writing in advance of and prior to the public hearing before the Grantee, as part of the proposed conditional amendment to the Zoning Map, in addition to the regulations provided for in the existing B-2 zoning district by the existing City's Zoning Ordinance (CZO), the following reasonable conditions related to the physical development, operation and use of the Property to be adopted as a part of said amendment to the new Zoning Map relative to the Property, all of which have a reasonable relation to the rezoning and the need for which is generated by the rezoning; and WHEREAS, said conditions having been proffered by the Grantor and allowed and accepted by the Grantee as part of the amendment to the Zoning Ordinance, such conditions shall continue in full force and effect until a subsequent amendment changes the zoning on the Property covered by such conditions; provided, however, that such conditions shall continue GPIN No. 14665919170000 despite a subsequent amendment if the subsequent amendment is part of the comprehensive implementation of a new or substantially revised zoning ordinance, unless, notwithstanding the foregoing, these conditions are amended or varied by written instrument recorded in the Clerk's Office of the Circuit Court of the City of Virginia Beach, Virginia and executed by the record owner of the subject Property at the time of recordation of such instrument; provided, further, that said instrument is consented to by the Grantee in writing as evidenced by a certified copy of the ordinance or resolution adopted by the governing body of the Grantee, after a public hearing before the Grantee advertised pursuant to the provisions of the Code of Virginia, Section 15.2- 2204, which said ordinance or resolution shall be recorded along with said instrument as conclusive evidence of such consent. NOW THEREFORE, the Grantor, for itself, its successors, assigns, grantees, and other successors in title or interest, voluntarily and without any requirement by or exaction from the Grantee or its governing body and without any element of compulsion of quid pro quo for zoning, rezoning, site plan, building permit or subdivision approval, hereby makes the following declaration of conditions and restrictions which shall restrict and govern the physical development, operation and use of the Property and hereby covenants and agrees that these proffers (collectively, the "Proffers") shall constitute covenants running with the said Property, which shall be binding upon the Property and upon all parties and persons claiming under or through the Grantor, its heirs, personal representatives, assigns, grantees and other successors in interest or title, namely: 1. When developed, the Property shall be developed in substantial conformity with the conceptual site plan entitled "PA RD. AND PARLIAMENT DR. REZONING CONCEPT PLAN", dated February 1, 2019, and prepared by Blakeway Corporation (the "Concept Plan"), a copy of which has been exhibited to the Virginia Beach City Council and is on file with the Virginia Beach Department of Planning. 2. The architectural style and quality of materials used for the retail store building to be constructed on the Property, when constructed, will be in substantial conformity with the exhibit entitled "7-ELEVEN STORE #1044479", dated March 1, 2019, and prepared by Intrepide Design (the "Exterior Elevations"), a copy of which has been exhibited to the Virginia Beach City Council and is on file with the Virginia Beach Department of Planning. 3. When developed, the landscaping installed on the Property shall be in substantial conformity with the conceptual landscape plan entitled "PA RD. AND PARLIAMENT DR. CONCEPTUAL LANDSCAPE PLAN", dated January 30, 2019, and prepared by Blakeway Corporation (the "Landscape Plan"), a copy of which has been exhibited to the Virginia Beach City Council and is on file with the Virginia Beach Department of Planning. 4. The following uses shall not be permitted on the Property: automotive repair garages, car wash facilities, motor vehicle sales, motor vehicle rentals, personal watercraft rentals, and bars or nightclubs. 2 5. Freestanding signage located on the Property shall be monument style, no larger than eight feet (8') in height, and constructed with a masonry base that is substantially compatible with the materials used for the primary building constructed on the Property. 6. Further conditions lawfully imposed by applicable development ordinances may be required by the Grantee during detailed site plan and/or subdivision review and administration of applicable City Codes by all cognizant City agencies and departments to meet all applicable City Code requirements. All references hereinabove to zoning districts and to regulations applicable thereto, refer to the City Zoning Ordinance of the City of Virginia Beach, Virginia, in force as of the date the conditional zoning amendment is approved by the Grantee. The Grantor covenants and agrees that (1) the Zoning Administrator of the City of Virginia Beach, Virginia shall be vested with all necessary authority on behalf of the governing body of the City of Virginia Beach, Virginia to administer and enforce the foregoing conditions, including (i) the ordering in writing of the remedying of any noncompliance with such conditions, and (ii) the bringing of legal action or suit to ensure compliance with such conditions, including mandatory or prohibitory injunction, abatement, damages or other appropriate action, suit or proceedings; (2) the failure to meet all conditions shall constitute cause to deny the issuance of any of the required building or occupancy permits as may be appropriate; (3) if aggrieved by any decision of the Zoning Administrator made pursuant to the provisions of the City Code, the CZO or this Agreement, the Grantor shall petition the governing body for the review thereof prior to instituting proceedings in court; and (4) the Zoning Map shall show by an appropriate symbol on the map the existence of conditions attaching to the zoning of the subject Property on the map and that the ordinance and the conditions may be made readily available and accessible for public inspection in the office of the Zoning Administrator and in the Department of Planning and that they shall be recorded in the Clerk's Office of the Circuit Court of the City of Virginia Beach, Virginia and indexed in the name of the Grantor and Grantee. All trash receptacles shall be emptied regularly so as not to overflow, and litter and debris shall not be allowed to accumulate. 7. Any outdoor storage of materials associated with the Assembly Use shall be prohibited. 8. Consistent with the requirements for a Special Event,for each event exceeding 250 people, the applicant shall obtain a Special Event Permit and shall notify the Police Department, the Fire Prevention Bureau, the Health Department and Emergency Medical Services of the event's time, size and scope of activities. 9. A building permit shall be obtained prior the installation of the temporary tent, which shall only be permitted for up to six months per calendar year. 10. Subject to Section 221 (k)of the Zoning Ordinance, an annual review based on the date of City Council approval shall be performed by the Planning Director of the Assembly Use Conditional Use Permit. This use may be allowed to remain on the site subject to a determination by the Planning Director that the presence of the use is not detrimental to the public health, safety, and welfare.Furthermore, this use, as conditioned herein, shall not cause public inconvenience, annoyance, disturbance, or be incompatible with other uses in the vicinity or otherwise interfere with the reasonable use and enjoyment of neighboring properties by reason of excessive noise, traffic, or overflow parking.
