Motion for adjournment M I N U T E S SPECIAL MEETING VIRGINIA BEACH CITY COUNCIL Virginia Beach, Virginia 27 August 1980 A Special Meeting of the Council of the City of Virginia Beach, Virginia, was called to order by Mayor J. Henry McCoy, Jr., in the Council Chambers, in the Administration Builaing, on Wednesday, 27 August 1980, at nine o'clock in the morning, for the purpose of presenting two Ordinances on Water and Sewer Bonds and Road Bonds for second reading, as prescribed by Section 3.06 of the City Charter and Section 2-9 of the City Code. Council Members Present: John A. Baum, F. Reid Ervin, Vice Mayor Harold Heischober, Barbara M. Henley, W. H. Kitchin, III, Reba S. McClanan, Mayor J. Henry McCoy, Jr., Donald W. Merrick, Meyera E. Oberndorf and Patrick L. Standing Council Members Absent: Clarence A. Holland INVOCATION: Reverend Roy R. Jackson Retired Virginia United Methodist Church PLEDGE OF ALLEGIANCE ITEM I-D.a.1 ITEM #15537 Upon motion by Councilman Ervin, seconded by Councilman Standing, City Council voted to APPROVE, on 8ECOND READING, the Ordinance authorizing the issuance of water and sewer bondsfor the City of Virginia Beach, in the maximum amount of $46,000,000, subject to the approval of the qualified voters: VOTING: 9-1 8 /27/80 2 - Council Members Voting Aye: John A. Holland 8/27/80 3- AN ORDINANCE AUTHORIZING THE ISSUANCE OF WATER AND SEWER BONDS OF THE CITY OF VIRGINIA BEACH, VIRGINIA, IN THE MAXIMUM AMOUNT OF $46,000,000, SUBJECT TO THE APPROVAL OF THE QUALIFIED VOTERS BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH: 1. It is hereby determined to be necessary and expedient for the City of Virginia Beach to continue its Capital Improvement Program for its water and sewer system, which will promote the health and general welfare of the City and its inhabitants and will facilitate the continued growth and orderly development of the City, and to finance a portion of the cost thereof through the borrowing of $46,000,000 and issuing the City's General Obligation Bonds therefor additionally secured by a pledge of the revenues of the water and sewer system. 2. Pursuant to Article VII, Section 10(a)(2) of the Constitu- tion of Virginia, the Charter of the City of Virginia Beach, and the Public Finance Act, as amended, there are hereby authorized to be issued Water and Sewer Bonds of the City in an amount not to exceed $46,000,000. 3. The Bonds shall bear such date or dates, mature at such time or times not exceeding 40 years from their dates, bear interest at such rate or rates not to exceed 10% per year, be in such denomination and fo=, be executed in such manner and sold at such time or times and in such manner as the Council may hereafter provide by appropriate Resolution or Resolutions. 4. The water and sewer system is an undertaking from which the City may derive a revenue, and such Bonds are not to be in- cluded within the otherwise authorized indebtedness of the City; provided, however, that from and after five years from the date of the election approving the Bonds whenever and for so long as the water and sewer system fails to produce sufficient revenues to pay for the cost of operation and administration (including interest on Bonds issued therefore), and the cost of insurance against loss 4- by injury to persons or property, and an annual amount to be placed into a sinking fund sufficien'. to pay the Bonds at or before maturity, all outstanding Bonds issued on account of such undertaking shall be included in determining the limitation of.the power of the City to incur indebtedness. 5. The Bonds shall be General Obligations of the City for the payment of principal of and interest on which its full faith and credit, as well as the net revenues from its water and sewer system, shall be irrevocably pledged. 6. The Bonds shall not be issued until approved by a majority of the qualified voters of the City voting on the question of their issuance at an election to be held in the City. 7. The City Clerk is hereby authorized and directed to cause a certified copy of this Ordinance to be presented to the Circiut Court of the City of Virginia Beach, Virginia, which is hereby requested to order an election to submit to the qualified voters of the City the question of the issuance of the Bonds provided for herein. 8. This Ordinance shall be in full force and effect from its passage. Adopted by the Council of the City of Virginia Beach, Virginia, on the Twenty-Seventh day of August, 1980. FIRST READING: August 25, 1980 SECOND READING: August 27, 1980 Approved: Mayor, City of Virginia Beach, Virginia - 5 - ITEM I-D.b.1 ITEM #15538 Upon motion by Councilwoman Oberndorf, seconded by Councilman Standing, City Council voted to APPROVE, on SECOND READING, the Ordinance authorizing the issuance of road bonds forthe City of Virginia Beach, in the maximum amount of $22,900,000, subject to the approval of the qualified voters: VOTING: 10-0 Council Members Voting Aye: John A. Holland 8/27/80 6- AN ORDINANCE AUTHORIZING THE TSSUAN@E OF ROAD BONDS OF THE CITY OF VIRGINIA BEACH VIRGINIA, IN THE MAXIMUM AMOUNT OF $22,900,000 SUBJECT TO THE APPROVAL OF THE QUALIFIED VOTERS BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH: 1. It is hereby determined to be necessary and expedient for the City of Virginia Beach to undertake a program of road construction and improvement, including the acquisition of rights- of way and construction of curbs, gutters, sidewalks, bridges and storm drainage facilities, which will promote the development and public welfare of the City, and to finance the cost thereof through the borrowing of $22,900,000 and issuing the City's General Obligation Bonds therefor. 2. Pursuant to the Charter of the City of Virginia Beach and the Public Finance Act, as amended, there are hereby authorized to be issued Road Bonds of the City in an amount not to exceed $22,900,000. The Bonds may be issued as a separate issue or may be combined with Bonds authorized for other purposes and issued as a part of a combined issue of Public Improvement Bonds. 3. The Bonds shall bear such date or dates, mature at such time or times not exceeding 40 years from their dates, bear interest at such rate or rates not to exceed the maximum rate authorized by law at the time the Bonds are sold, be in such denomination and form, be executed in such manner and be sold at such time or times and in such manner as the Council may hereafter provide by approp- priate Resolution or Resolutions. 4. The Bonds shall be General Obligations of the City for the payment of principal of and interest on which its full faith and credit shall be irrevocably pledged. 5. Berry, Jr. Representative, Virginia Beach Research and Advisory Council ITEM #15541 With reference to the Ordinance to amend and reordain Division 3 of Article III of Chapter 2 of the City Code relating to the Admin- istration of the Basic Pay Plan, Councilman Merrick asked the City Manager if this had any relationship to the contract with Executive Management Service, Inc., an Arlington firm previously proposed as consultant in review of the City's Pay Plan. The City Manager advised Council the Ordinance proposed and deferred to September 8, 1980, has application only to the establishment of a true 10% employee wage increase as authorized by the July 1, 1980 Budget. The City Manager stated this would establish a pay schedule equal to a true 5% but that the proposed September 1st date could not now be met. 8/27 /80 -9 - Upon motion by Councilman Ervin, seconded by Councilman Baum, City Council voted to RECESS into EXECUTIVE SESSION for the purpose of discussing a PERSONNEL MATTER; and, adjourn thereafter. City of Virginia Beach, Virginia Special Meeting 27 August 1980 asb:mas At a Special Meetinq of the Virginia Beach City Council, Wednesday, August 27, 1980, with ten Council Members present, City Council adopted the following two ordinances: I. Ordinance authorizing the issuance of water and sewer bonds of the City of Virginia Beach, in the maximum amount of $46,000,000, subject to the approval of the qualified voters in a voter referendum November 4, 1980. Upon motion by Councilmah Ervin, seconded by Councilman Standing, City Council voted to approve the Ordinance authorizing the issuance of water and sewer bonds in the maximum arnount of $46,000,000 subject to the approval of the qualified voters in a voter referendum. VOTING: 9-1 Council members Voting Aye: John A. Baum, F. Reid Ervin, Vice Mayor Harold Heischober Barbara M. Henley, W. H. Kitchin, III, Mayor J. Henry McCoy, Jr., Donald W., Merrick, Meyera E.
