CONSENT AGENDA All matters listed under the Consent Agenda are considered to be routine by the City Council and will be enacted by one motion in the fonn listed. There will be no separate discussion of these items. If discussion is desired, that itetn will be removed from the Consent Agenda and considered separately. 1. Ordinance to amend Section 23-27.1 of the Code of the City of Virginia Beach pertaining to the definition of petit larceny. 2. Ordinance to amend and reordain Section 8-21(n) of the Code of the City of Virginia Beach relating to commercial and industrial buildings and trailer lots to which electrical service has been discontinued. 3. Ordinance to amend Section 23-27.2 of the Code of the City of Virqinia Beach pertaining to the concealment of merchandise, etc. 4. Ordinance to amend Section 37-10 of the Code of the City of Virginia Beach relating to the waste of water. 5. Ordinance to amend and reordain Section 29-3(B)(2.1) of the Code of the City of Virginia Beach, Virginia, relating to sewer line fees for two or more family residential units. 6. Ordinance, on second reading, to increase the advance from the General Fund to the City Garage Internal Service Fund by $45,000. 2. ordinance, on second reading, to appropriate $3,124,853 for FY 1981 for the payment of purchase orders brought forward from Fiscal 1980. b. M I N U T E S VIRGINIA BEACH CITY COUNCIL Virginia Beach, Virginia 18 August 1980 The regular meeting of the Council of the City of Virginia Beach, Virginia, was called to order by Mayor J. Henry McCoy, Jr., in the Conference Room, in the Administration Building, on Monday, 18 August 1980 at one o'clock in the afternoon. Council Members Present: John A. Baum, F. Reid Ervin, Vice Mayor Harold Heischober, Barbara M. Henley, Clarence A. Holland, W. H. Kitchin, III, Reba S. McClanan, Mayor J. Henry McCoy, Jr., Donald W. Merrick, Meyera E. Oberndorf, and Patrick L. Standing Council Members Absent: None ITEM #15460 Vice Mayor McCoy entertained a motion to permit Council to conduct its INFORMAL SESSION to be followed by an EXECUTIVE SESSION for the purpose of discussing the following: 1. Discussion or consideration of employment, assignment, appointment, promotion, demotion, salaries, discipline or resignation of public officers, or employees of any public body. (Personnel Matters). 2. Investing of public funds where competiti.on or bargaining are involved where, if made public initially, the financial interest of the governing unit would be adversely affected. (Financial Matters). 3. Consultation with legal counsel and briefing by staff members, consultants, or attorneys pertaining to actual or potential litigation, or other legal matters within the jurisdiction of the public body. (Legal Matters). 08/18/80 2 - Upon motion by Councilman Standing, seconded by Councilman Holland, City Council voted to RECESS into EXECUTTVE SESSION following the INFORMAL SESSION. Standing Council Members Voting Nay: None Council Members Absent: None 08/18/80 3- M A T T E R S B Y C 0 U N C I L M E M B E R S ITEM #15461 Mayor McCoy made several comments regarding the walk to False Cape State Park. ITEM #15462 Mayor McCoy advised Council the City Attorney and the Commonwealth Attorney are to discuss the problems of bid rigging, which has become a matter of concern throughout the State. ITEM #15463 Councilwoman Henley advised Council of the meeting held by the Virginia Marine Resources Commission; and, suggested the Wetlands Board Agendas be provided to any citizen who requests a copy. This matter will be handled through the City Clerk's Office. ITEM #15464 Councilman Ervin advised Council he was having problems with several items on the CONSENT AGENDA; and, requested the following be deferred one week: 1. Ordinance to amend and reordain Section 29-3(B)(2.1) of the Code of the City of Virginia Beach, Virginia, relating to sewer line fees for two or more family residential units; AND, Ordinance to amend and reordain Section 37-29(b)(2.1) of the Code of the City of Virginia Beach, Virginia, relating to water line fees for two or more family residential units. 2. Ordinance to authorize the acquisition of property in fee simple for right-of-way for Cedar Hill Canal Project and the acquisition of temporary and permanent easements of right- of-way either by agreement or by condemnation. The above matter will be voted on in the FORMAL SESSION. 08/18/80 - 4 - ITEM #15465 Councilwoman Oberndorf requested information regarding a letter to the Editor of the Virginian-Pilot concerning a resident';9 complaint against the Virginia Beach Fire Department for watering the median strips. Chief Diezel advised Council the Landscaping Division of the Department of General Services is using a dry pine bark wood mulch on the plants in the median strips. When a motorist drives by and throws his cigerette out the window, the mulch begins to smolder, and residents in the area call the fire department. I N F 0 R M A L A G E N D A ITEM #15466 The City Manager introduced the Director of Social Services, Francis S. Elrod, who presented a report to Council concerning the request of the Social Services Department for additional personnel to handle food stamps. and public assistance applications ITEM #15467 The City Manager advised Council of his recommendation to remove the Ordinance to amend and reordain Section 23-47 of the City Code pertaining to the operation of Shuffleboard or Pinball Machines in restaurants, etc., from the Council Agenda; and, be brought back before Council at a later date to be REPEALED and not amended. ITEM #15468 Chief Harry Diezel appeared before Council during the INFORMAL SESSION and discussed a multi-story Housing project for the Elderly; and, advised Council they go beyond the minumum requirements regarding housing for the elderly to make it a safe building. ITEM #15469 The City Manager advised Council the Water and Sewer Committee Report and the Roads Committee Report will be on the FORMAL AGENDA before the PLANNING AGENDA. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA: That Section 29-3 (B) (2. 1) of the Code of tbe City of Virginia Beach, Virginia, is hereby amended and reordained to read as follows: Section 29-3. Fees generally. (B) Property owners' share of system installation, where connection is made to a line or pumping station being a part of the system within the City installed or purchased by the City (line fee): (2.1) Structures with two (2) or more family residential units, per unit . . . . . . . . . . . $560.00 For purposes of line fee calculations, any single lot which has constructed on it more than one dwelling unit, whether the dwelling unit is attached or detached, will be considered multi-family and will have fees calculated as above. This Ordinance shall be effective upon date of adoption. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA: That Section 37-29(b) (2.1) of the Code of the City of Virginia Beach, Virginia, is hereby amended and reordained to read as follows: Section 37-29. Connection and installation fees. Adopted by the Council of the City of Virginia Beach, Virginia, on the day of 1980 DEFERRED ONE WEEK: 18 August 1980 08/18/80 AN ORDINANCE TO AUTHORIZE THE ACQUISITION OF PROPERTY IN FEE SIMPLE FOR RIGHT-OF-WAY FOR CEDAR HILL CANAL PROJECT AND THE ACQUISITION OF TEMPORARY AND PERMANENT EASE- MENTS OF RIGHT-OF-WAY EITHER BY AGREEMENT OR 'CONDEMNATION WHEREAS, in the opinion of the Council of the City of Virginia Beach, Virginia, a public necessity exists for the con- struction of this important project for public purposes for the preservation of the safety, health, peace, good order, convenience, moral and welfare of the people in the City of Virginia Beach. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA: Section 1. That the City Attorney is hereby authorized and directed to acquire by purchase or condemnation pursuant to Section 15.1-236, et seq. and Section 33.1-89, et seq., Code of Virginia of 1950, as amended, all that certain real property in fee simple including temporary and permanent easements of right- of-way as shown on the plan or plats entitled, "CEDAR HILL CANAL PROJECT," these plans or plats being on file in the Office of Real Estate, Department of Public Works, Virginia Beach, Virginia. Section 2. That the City Attorney is hereby authorized to make or cause to be made in behalf of the City of Virginia Beach, to the extent that funds are available, a reasonable offer to the owners or persons having an interest in said lands, if refused, the City Attorney is hereby authorized to institute proceedings to condemn said property. Section 3. That an emergency is hereby declared to exist and this Ordinance shall be in force and effect from the date of its adoption. Standing Council Members Voting Nay: None Council Members Absent: None 08/18/80 -1 2- AN ORDINANCE TO AMEND SECTION 23-27.1 OF THE CODE OF THE CITY OF VIRGINIA BEACH PERTAINING TO THE DEFINITION OF PETIT LARCENY BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA: That Section 23-27.1 of the Code of the City of Virginia Beach is amended and reordained to read as follows: Section 23-27.1 Petit larceny defined; how punished. Any person who: (1) Commits larceny from the person of another of money or other things of value of less than five dollars ($5.00); or, (2) Commits simple larceny not from the person of another of good and chattels of the value of less than ene two hundred dollars ($200.00), shall be deemed guilty of petit larceny, which shall be punishable as a Class I misdemeanor. This Ordinance shall be in effect from the date of its adoption. Standing Council Members Voting Nay: None Council Members Absent: None 08/18/80 -1 6- AN ORDINANCE TO AMEND SECTION 23-27.2 OF THE CODE OF THE CITY OF VIRGINIA BEACH PERTAINING TO THE CONCEALMENT OF MERCHANDISE, ETC. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA: That Section 23-27.2 of the Code of the City of Virginia Beach is amended and reordained to read as follows: Section 23-27.2. Concealing or taking possession of merchandise; altering price tags; transferring goods from one container to another; counseling, etc., another in performance of such acts. Whoever, without authority, with the intention of con- verting goods or merchandise to his own or another's use without having paid the full purchase price thereof, or of defrauding the owner of the value of the goods or merchandise of any store or other mercantile establishment, or (ii) alters the price tag or other price marking on such goods or merchandise, or transfers the goods from one container to another, or (iii) counsels, assists, aids or abets another in the performance of any of the above acts, shall be deemed guilty of larceny and upon conviction thereof, shall be punished as hereinafter provided. The willful concealment of goods or merchandise of any store or other mercantile establishment, while still on the premises thereof, shall be prima facie evidence of an intent to convert and defraud the owner thereof out of the value of the goods or merchandise. Any person convicted of a violation of this section, when the goods or merchandise involved in the offense is less than &ne two hundred dollars ($200.00), shall be guilty of a Class I misdemeanor. Adopted by the Council of the City of Virginia Beach, Virginia, on the Eighteenth day of August, 1980. Standing Council Members Voting Nay: None Council Members Absent: None 08/18/80 -1 8- AN ORDINANCE TO AMEND SECTION 37-10 OF THE CODE OF THE CITY OF VIRGINIA BEACH RELATING TO THE WASTE OF WATER BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINLA: That Section 37-10 of the Code of the City of Virginia Beach is amended and reordained to read as follows: Section 37-10. Waste of water; repair of leaking pipes, etc. (a) No person shall permit the water to run from any hydrant, meter, cock or fixture without proper care to prevent waste. If any pipe, hydrant, meter, cock or other fixture is found leaking, the owner of the premises shall have the necessary repairs made immediately upon notice thereof from the Department of Public Utilities so to do, and failure to repair shall require the discontinuance of water supply until repairs are made. (b) Any person who shall willfully and maliciously divert or waste any public water supply by tampering with any fire hydrant shall be guilty of a Class 2 misdemeanor. Chewning, III, Retired Professional Engineer, presented to Council a report of the Water and Sewer Committee and advised Council the Committee carefully weighed the commitment of the City in providing a safe and reliable water system and a healty and environmentally acceptable sewer collection system that meets the design requirements of State regulatory agencies. Although extensive efforts have been made to meet this commitment there continues to be sections of the City which have unmet needs. The Committee recognizes the responsibility to provide for these unmet utility needs. The allocation of funds over the period of 1980-1985 from this proposed bond issue falls into these broad categories: A. $12 Million - Water supply development of approximately 12 MGD or 1/3 of our 1985 daily estimated usage. (Fresh water wells and de- salting). B. $9 Million - Refunding of already authorized projects which will save projected interest costs over the life of the bonds of $600,000. C. $7 Million - Sewer and water facilities work in connection with anticipated road and highway projects during the period. D. $18 Million - Improvements to the general system (sewer and water) and installation of facilities in various existing neighborhoods. The Committee recommends the following actions: 1. City Council include in the Referendum the previously authorized $9.1 Million in Revenue Notes, and replace the Notes with Double-Barrel Bonds thereby saving the water and sewer customers substantial interest costs. 2. City Council take the necessary actions to place a Referendum on the ballot of the November general election to be held on November 4, which will be provided for the citizens of Virginia Beach the opportunity to approve Double-Barrel Bonds in the amount of $46 Million. 3 . City inf orm the citizens of the details of the program sufficiently in advance of the election. 4. It is the recommendation that the voters be asked to approve the following projects. These roads include but are not limited to: Newtown Road; Great Neck Road; Holland Road In order to expedite these funds, it is recommended that funds from the Virginia Beach Boulevard project be transferred to these more pressing priorities. It should be understood, however, that the computerized signalization of Virginia Beacb Boulevard as well as plans and right-of-way acquisition should continue under the present time frame. AND, PROVIDED FURTHER, that nothing herein contained shall be construed to enlarge such permission and authority to permit the maintenance or construction of any encroachment other than those specified herein and to the limited extent specified herein, nor to permit the maintenance or construction of any encroachments by anyone other than Robert S. Bartley, his heirs, assigns and successors in title. AND, PROVIDED FURTHER, that the City of Virginia Beach, upon revocation of such authority and permission so granted, may remove any such encroachment and charge the cost thereof to Robert S. Bartley, his heirs, assigns and successors in title and collect the cost in any manner provided by law for the collection of local or state taxes; may require Robert S. Bartley, his heirs, assigns and successors in title to remove such temporary encroachments; and pending such removal, the City may charge Robert S. Bartley, his heirs, assigns and successors in title compensation for the use of such portion of the easement encroached upon the equivalent of what would be the real property tax upon the land so occupied if it were owned by Robert S. Bartley, his heirs, assigns and successors in title; and, if such removal shall not be made within the time ordered hereinabove by this Ordinance, the City shall impose a penalty in the sum of One Hundred Dollars ($100.00) per day for each and every day that such encroachment is allowed to continue thereafter, and shall collect such compensation and penalties in any manner provided by law for the collection of local or state taxes. Standing Council Members Voting Nay: None Council Members Absent: None 08/18/80 4 3- AN ORDINANC E TO APPROPRIATE $3,124,853 FOR FISCAL YEAR 1981 FOR THE PAYMENT OF PURCHASE ORDERS BROUGHTIFORWARD FROM FISCAL YEAR 1980 WHEREAS, during the course of business in Fiscal Year 1980, purchase orders or contracts were issued committing the City to purchases of materials, supplies, equipment or services for use by several departments, divisions, or bureaus; and, WHEREAS, these purchase orders or contracts were charged to appropriations previously authorized for the Fiscal Year ended June 30, 1980, so as to reduce the unencumbered balance of those appropriations; and, WHEREAS, on June 30, 1980, there were purchase orders or contracts totaling $3,124,853 for which materials, supplies, equipment or services had not been delivered or invoiced. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, that the funds totaling $3,124,853 unexpended and represented by purchase orders outstanding on June 30, 1980, be reappropriated as additions to Fiscal Year 1981 appropriations to the respective departments, divisions or bureaus of the City so that upon delivery of the materials, supplies, equipment or services, there shall be sufficient funds to make payment.
