CODE AMENDMENTS a. ordinance to amend Article VII of the Code of the City of Virginia Beach by adding Section 2-85.3 establishing and authorizing relocation payments relating to real property acquisition for City road projects. This matter was deferred for one week on October 6, 1980, to correct a minor error in form. b. Ordinance to amend Section 37-11(b) of the Code of the City of Virginia Beach, Virginia. C. Ordinance to establish an emergency water allocation and rate plan. d. Ordinance to amend and reordain Sections 7-4, 7-5, 7-7, 7-8 and 7-9 of the Code of the City of Virginia Beach pertaining to bicycle license and registration. e. Ordinance authorizing certain events conducted on City property to be exempted from the prohibiti6n from working or transacting business on Sunday. H. ORDINANCES (continued) 2. FIRST READINGS a. Henry McCoy, Jr., in the Conference Room, in the Administration Building, on Monday, 13 October 1980, at one o'clock in the afternoon. Council Members Present: John A. Baum, F. Merrick ITEM #15702 Mayor McCoy entertained a motion to permit Council to conduct its INFORMAL SESSION to be followed by an EXECUTIVE SESSION for the purpose of discussing the following: 1. Merrick - 3- M A T T E R S B Y T H E M A Y 0 R - - - - - - - - - - - - - - - ITEM #15703 Mayor McCoy made reference to a news article regarding the water shortage, and asked the City Manager what the City was doing concerning the equitable billing of water to the citizens. The City Manager advised Council that when the City passed the rate increase imposed by the City of Norfolk, it was easier to pro-rate the bills so all individuals using City water would receive the rate increase based on tbe amount of water used when the rate increase went into effect, an that it would be virtually impossible to read 60,000 meters at one time. It was suggested, in order for all meters to be read and billed at one time, Public Utilities should employ additional personnel, and if over- time is required that it be granted in order to read all meters at least within a few days time. If necessary, Council could authorize an emergency appropriation to provide the funds necessary for the additional personnel. ITEM #15704 The following item will be discussed in the FORMAL SESSION: Pavilion Sunday Closing Exemption ITEM #15704(a) Discussion of the Wishart Cove Recreation Area was postponed until the Council Meeting of 20 October 1980. I N F 0 R M A L S E S S I 0 N ITEM #15705 The City Manager advised Council the proposed change to the "Timberlake" Land Use Plan should have read: Proposed Change to the GREEN RUN LAND USE PLAN. The City Manager discussed with Council changes to this Plan with regards to a proposed gasoline station site owned by the Texaco Oil Company on the corner of Lynnhaven Parkway and Princess Anne Road. R E S 0 L U T I 0 N WHEREAS, the Seventh Annual Virginia Beach Neptune Festival was a resounding success, as judged by attendance and by the quality of the entertainment and cultural events; and, WHEREAS, the Seventh Annual Virginia Beach Neptune Festival, with its emphasis upon the wealth of the resources of the people of the City of Virginia Beach, contributes to our sense of Community; and, WHEREAS, countless numbers of citizens of the City of Virginia Beach volunteer their time, their efforts, their skills and their enthusiasm in order to create this Festival for the enjoyment of all of us; and, WHEREAS, the participants in the Festival also contribute in their own way to the sense of accomplishment that we all feel at the conclusion of this successful Festival; and, WHEREAS, the Neptune Festival Committee and Event Chairman planned and executed the Festival events in such a way that their volunteer efforts deserve special recognition,. Merrick 8- ITEM II-E.2 ITEM #15708 RESOLUTION REQUESTING THE GOVERNOR OF THE COMMONWEALTH OF VLRGINIA TO DECLARE A STATE OF EMERGENCY ON WATER RESOURCES FOR THE CITY OF VIRGINIA BEACH, VIRGINIA WHEREAS, the users of water in the Norfolk system have reduced consumption from 85 MGD to approximately 50 MGD through conservation methods; and, WHEREAS, furtber conservation measures will be necessary effective November 1, 1980, without substantial rainfall; and, WHEREAS, as of October 13, 1980, at current consumption rates, the' Norfolk water supply sy.stem serving Norfolk, Virginia Beach, a portion of Chesapeake, and the United States Navy has approximately 84 days supply; and, WHEREAS, additionally, the only feasible engineering solution to provide additional water is the installation of deep wells adjacent to Norfolk reservoirs on the City of Norfolk's property located in Suffolk and Isle of Wight; and, WHEREAS, installation of said wells will take approximately 100 days to construct and have operational; and, WHEREAS, :SSince an emergency exists and time is of the essence, sufficient time to explore a legal Resolution of the rights of the parties to subterranean water is not possible now but should be pursued forthwith with respect to these wells. NOW, THEREFORE, BE IT DECLARED that the City Council of Virginia Beach calls upon the Governor of the Commonwealth of Virginia to declare a natural disaster to exist, pursuant to Chapter 3.2, Title 44, Code of Virginia, as amended (Emergency Services and Disaster Law), and use the powers of his Office to assist the local governments in meeting this Southeastern Virginia water resource shortage and to waive any local Ordinances not required by State Law. Merrick Councilman Ervin voiced a VERBAL "aye". 1 4- Requested by: Department of Permits and Inspections AN ORDINANCE TO AMEND AND REORDAIN SECTION 8-8 OF THE CODE OF THE CITY OF VIRGINIA BEACH, VIRGINIA, RELATING TO REQUIREMENTS FOR CONTRACTORS LICENSE AND BOND BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA: That Section 8-8 of the Code of the City of Virginia Beach, Virginia, is hereby amended to read as follows: Section 8-8. Permits. (a) When required. Any owner, authorized agent or contractor who desires to construct, enlarge, alter, repair, move, demolish or change the occupancy of a building or structure or to erect, construct, enlarge, alter, repair or move a sign of any description or to install a steam boiler, furnace, heater, incinerator or other heat producing apparatus or other appurtenances, the install- ation of which is regulated by this Code or to cause any such work to be done, shall first make application to the Building Official and obtain the required permit therefor. (b) Application contents. All drawings, specifications and accompanying data shall bear the name and address of the designer. In the case of buildings or structures exceeding two stories in height or five thousand square feet in area, except one and two family dwellings, such designer shall be an architect or engineer legally registered under the laws of the State regulating the practice of architecture or engineering and shall affix his official seal to such drawings, specifications and accompanying data. -1 5- (c) Contractors license and bond required. It shall be the duty of every contractor or builder, who shall make contracts for the erection or construction or repair of buildings for which a permit is required, in the City, and every contractor or builder making such contracts and subletting the same or any part thereof, to pay a license tax as provided in Chapter 20 and to register his name in a book provided for that purpose, with the Building Inspector, giving full name, residence and place of business and in case of removal from one place to another in the City to have made corresponding change in such register accordingly. it shall be the further duty of every such person contracting to work, other than those registered with the Commonwealth of Virginia as Class "A" or Class "B" contractors, pursuant to Chapter 7 of Title 54 of the Code of Virginia, 1950, as amended, to give good and sufficient bond in the sum of Five Thousand Dollars ($5,000), to be approved by the City Attorney, conditioned to conform to the building regulations, the regulations of this Section and other Ordinances of the City in reference to buildings. (d) Suspension and revocation of contractor's bond. The building official or the Board of Appeals shall have the Authority to suspend temporarily any building con- tractor's bond for failure to correct faulty work, doing construction work without a permit or for any other good and sufficient cause. The Board, upon the affirmative vote of three of its members, may revoke or annul any contractor's bond for repeated failure to comply with instructions of the building official for repeatedly undertaking construction work without a permit or other violation of this Chapter. -1 6- (e) Suspension or revocation not a bar to prosecution. Nothing in this Division shall be construed as a bar to prosecute for any violation of the Virginia Uniform Statewide Building Code or this Code. This Ordinance shall be effective upon date of its adoption. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA: That Section 8-17(b) of the Code of the City of Virginia Beach, Virginia, is hereby amended to read as follows: Section 8-17. Generally. (b) Each master electrician doing electrical work within the city, other than those registered with the Commonwealth of Virginia as class A or class B contractors, pursuant to chapter 7 of Title 54 of the Code of Virginia, 1950, as amended, shall give a bond of two thousand dollars, in the form approved by the city attorney, payable to the city with surety conditioned to indemnify and save harmless the city as well as any other person from all expenses and damage that may be caused by any negligent, defective or inadequate work done in the city under the certificate of competency issued to him under this chapter and to secure the payment of inspection fees and permit fees. This ordinance shall be effective upon the date of its adoption. Merrick - 38- Requested by Public Works Department - Real Estate AN ORDINANCE TO AMEND ARTICLE VII OF THE CODE OF THE CITY OF VIRGINIA BEACH BY ADDING SECTION 2-85.3 ESTABLISHING AND AUTHORIZING RELOCATION PAYMENTS RELATING TO REAL PROPERTY ACQUISITION FOR CITY ROAD PROJECTS WHEREAS, the Code of Virginia, Title 15.1, Chapter 18, confers and vests in Cities certain general powers relevant to and which are necessary or desirable to secure and promote the general welfare of the inhabitants of the municipality; and, WHEREAS, the Council of the City of Virginia Beach, Virginia, desires to establish a uniform policy for the treatment of persons displaced as a result of road programs or projects involving the acquisition of real property; NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA: Section 2-85.3. Establish and Authorize Relocation Payments Relating to Real Property Acquisition for City Road Projects. (1) Intent. This Ordinance is enacted to establish a uniform policy for treatment of persons displaced as a result of road programs or projects involving the acquisition of real property therefor. (2) Purpose and Applicability. (a) Purpose. In order to acquire the rights-of-way necessary for the construction, reconstruction maint- enance and repair of the public roads of the City, it often becomes necessary for individuals, businesses, farms and non-profit organizations to be displaced. To insure to the maximum extent possible the equitable treatment of these displaces, it is necessary for a uniform policy to be establ- ished for making moving cost payments, replacement housing cost payments and other expense payments so that these individuals will not suffer disproportionate injuries as a result of the road improvement programs which are necessary - 3 9- or desirable to secure and promote the general welfare of the inhabitants of the municipality. The main objective of this Ordinance is to provide payments to be made to those who are required to relocate, in whole or in part, for costs incurred for moving, replacement housing and certain other expenses because of City road programs and projects. (b) Applicability. (1) The provisions of this Ordinance are applicable to any person who is displaced by any City road project on which State or Federal funds are not used or for which State and Federal funds do not become available before or after the City road project is approved and funded. (2) This Ordinance shall not apply to acquisitions by a City agency which are voluntarily initiated or negotiated by the seller under no threat of condemnation, where pro- perty is dedicated pursuant to provisions of Chapter 11 (Sec. 15.1-427, et seq.) of Title 15.1, or where property is voluntarily dedicated or donated for no consideration, provided, however, that the provisions of this Ordinance relating to relocation payments shall apply for the benefit of persons, other than the owner, wbo are actually and lawfully occupying the real property to be acquired and who have been occupants thereof for at least ninety (90) days prior to the initiation of negotiations for acquisition. (3) Definitions -- as used in this Ordinance the term: (a) "City Agency" means any Department of the City. (b) "Person" means any individual, partnership, corporation or association. (c) "Displaced Person" means any person who, on or after July 1, 1980 moves from any real property or moves from his personal property from real property, as a result of the acquisition of such real property, in whole or in part, or as a result of the written order of an acquiring City Agency to vacate real property, for any road program or - 40- project untertaken by a City agency. (d) "Business" means any lawful activity, excepting a farm operation, conducted primarily; (1) For the purchase, sale, lease and rental of personal and real property and for the manufacture, processing, or marketing of products, commodities, or any other personal property; (2) For the sale of services to the public; (3) "Farm Operation" means any activity conducted solely or primarily for the production of one or more agricultural products or commodities, including timber, for sale or home use and customarily producing such products or commodities in sufficient quantity to be capable of contributing materially to the operator's support. The term "contributing materially" used in this definition means the farm operation must contribute at least one-third of the operator's income. (f) "Initiation of Negotiation for a Parcel" means the date the City agency makes the first personal contact with the owner of a parcel of property to be acquired or his designated representative to give him a written offer for the property to be acquired. (4) Payments for moving and relocation expenses. (a ) Whenever the acquisition of real property for a road program or project by a City agency will result in the displacement of any person, on or after July 1, 1980, such agency shall make fair and equitable relocation pay- ments to displaced persons as required by this Ordinance for: (1) Actual reasonable expenses in moving himself, his family, business, farm operation, or other personal property, but not to exceed Three Hundred Dollars ($300.00). (b) Any displaced person eligible for payments under Subsection (a) of this Section who is displaced from his place of business or from his farm operation and who elects - 41- to accept the payment authorized by this Subsection in lieu of the payment authorized by Subsection (a) of this Section, may receive a fixed payment in the amount equal to the average annual net earnings of the business or farm operation, except such payment shall not be-less than Two Thousand Five Hundred Dollars ($2,500.00), nor more than Ten Thousand Dollars ($10,000.00). In the case of a business, no payment shall be made under this Subsection unless the City agency is satisfied that the business; (1) cannot be relocated without a substantial loss of its existing patronage; and (2), is not a part of a commercial enterprise having at least one other establishment not being acquired by the City Agency, which is engaged in the same or similar business. For the purpose of this Subsection the term "average net earnings" means one-half (1/2) of any net earnings of the business or farm operation, before Federal and State income taxes, during the two (2) taxable years immediately preceding the taxable year in which such business or farm operation moves from the real property acquired for such project, or during such other period as such agency determines to be more equitable for establishing such earnings, includes some compensation paid by the business or farm operation to the owner, his spouse or his dependents during such period; (5) Additional payments to enable displaced persons to acquire dwellings. (a) In addition to payments otherwise authorized by this Ordinance the City agency shall make additional payments not in excess of Fifteen Thousand Dollars ($15,000.00) to any displaced person who is displaced from a dwelling actually owned and occupied by such displaced person for not less than one hundred and eighty (180) days prior to the initiation of negotiations for the acquisition of tbe property. Such additional payment shall include the following elements: (1) The amount, if any, which when added to the acquisition cost of the dwelling acquired, equals the reasonable cost of a comparable replacing dwelling. - 4 2- (2) Reasonable expenses incurred by such displaced person for evidence of title, recording fees, and other closing costs incident to the purchase of the replacement dwelling; but not including prepaid expenses. (b) The additional payment authorized by this Section shall be made only to such displaced person who purchases and occupies a replacement dwelling not later than the end of one (1) year period beginning on the date on which he receives final payment of all costs of the acquired dwelling, whichever is the later date. (6) Additional payments to certain persons not eligible for payments under Number 5 of this Section. In addition to amounts otherwise authorized by this Ordinance, a City agency shall make payment to or for any displaced person displaced from any dwelling not eligible to receive payment, under Number 5 of this Section, which dwelling was actually and lawfully occupied by such displaced person not less than ninety (90) days prior to initiations for acquisition of such dwelling. Such payment shall be the amount necessary to enable such displaced person to lease or rent for a period not to exceed one (1) year a dwelling adequate to accommodate such person, but not to exceed One Thousand Dollars ($1,000.00). (7) Funds for carrying out provisions of Ordinance. Funds appropriated or otherwise available to any City agency for the acquisition of real property or any interest therein for a road program or project shall be available also for obligation and expenditure to carry out the provisions of this Ordinance as applied to that program or project. This Ordinance shall be effective from date of adoption. Conservation of city water supply; penalties therefor (b) Should the implementation of all of the above measures fail to preserve sufficient supplies of water for the citizens of Virginia Beach, then the City Manager and/or director of public utilities are hereby authorized, in addition, to order the imposiiton of specific allotments of water supply to each cumstomer, both Residential and Commercial; and to provide for a surcharge of u]2 to twenty dollars ($20.00) per one thousand (1,000) gallons of water consumed in excess of such allocation. Such allotment and surcharge shall be subject to ratification within ten (10) days by City Council and shall remain in effect until removed by like councilmanic action. This Ordinance shall be effective retroactive to October 1, 1980, and shall be in effect for at least one complete billing period for each and every meter. Adopted by the Council of the City of Virginia Beach, Virginia, on 13 October 1980 RHM/ci/cb 10/7/80 (D) - 4 5- AN ORDINANCE TO ESTABLISH AN EMERGENCY WATER ALLOCATION AND RATE PLAN ,WHEREAS, on August 14, 1980, Council passed Resolution 80-623 recognizing the existence of a local emerency due to a water shortage and authorized the City Manager and/or Director of Public Utilities to invoke certain measures to conserve water pursuant to Section 37-11 of the Code of the City of Virginia Beach, Virginia; and WHEREAS, such state of local emergency has worsened and the need for mandatory conservation has become essential for preservation of remaining water supplies; and WHEREAS, imposition of a water allocation plan will assist in preserving such water supplies; and WHEREAS, in order to enforce such allocation plan, higher rates need to be imposed to discourage excessive water usage and encourage conservation. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Virginia Beach, Virginia: The following rates are hereby imposed for water usage which shall remain in effect until removed by City Council: 1.
