1. Letter from the City Manager recommending that City
Council adopt the Resolution replacing the name
"False Cape Parkway" with the name "Ferrell Parkway".
This Resolution directs the City Manager to make the
necessary administrative changes for this replacement.
G. CONSENT AGENDA
All matters listed under the consent agenda are considered
to be routine by the City Council and will be enacted by
one motion in the form listed. There will be no separate
discussion of these items. If discussion is desired, that
item will be removed from the Consent Agenda and considered
separately.
1. Letter from the City Manager recommending that City
Council appoint Viewers in the matter of the petition
of Arista Associates for the closure of a portion of
an unnamed 20-foot lane in the vicinity of 27th Street
and Pacific Avenue (Virginia Beach Borough).
2. Letter from the City Manager recommending that City
Council adopt the Resolution in regard to the location
and major design features of Holland Road - Phase III.
This Resolution authorizes the Virginia Department of
Highways and Transportation to proceed with the adver-
tisement for construction bids for this project.
A public hearing for this project was held on May 10,
1979, and no opposition was received.
3. Letter from the City Manager recommending approval of
the Ordinance to amend and reordain Section 17-3 of the
Code of the City of Virginia Beach, Virginia, relating
to littering.
4. Letter from the City Manager recommending approval of
the following raffle permits:

H. PLANNING ITEMS
1. Letter from the City Manager transmitting the reconmenda-
tion of the Planning Commission for approval of the
request of Elsie Tann for a variance to Section 4.4(b) of
the Subdivision Ordinance which requires lot dimensions
to conform to the Comprehensive Zoning Ordinance. Ms.
Tann wishes to subdivide an approximate 22,730-square foot
site located on the west side of South Birdneck Road,
south of Beautiful Street, into two lots.

2. Letter from the City Manager transmitting the recommenda-
tion of the Planning Commission for denial of the
application of James and Jean Drinko for a change of
zoning from R-6 Residential District to R-8 Residential
District on two parcels totalling 3.89-acres located on
both sides of Riddle Avenue, south of Airstation Drive
(Lynnhaven Borough).

3. Letter from the City Manager transmitting the recommenda-
tion of the Planning Commission for denial of the

appropriate funds for the City employee across-the-
board salary increase, and implementation of the
dental health plan.

1. Letter from the City Manager reconimending that City
Council accept the low bid of Crowder Contracrting
Company, in the amount of $203,700, for the Broad
Bay Manor - Division II - sewage pumping station,
utilities, and access road project;
and, authorize the City Manager to enter into the
necessary agreements for the iinplementation of this
project. Funds are available.
C. Grants
1. Letter from the City Manager recommending approval
of the Ordinance to accept a grant totalling $50,000
from the Commonwealth of Virginia and to appropriate
these funds.
2. Letter from the City Manager recommending approval of
the Ordinance to accept a grant totalling $76,137
from State Aid to Public Libraries and to appropriate
these funds.
3. Letter from the City Manager recommending approval of
the Ordinance to accept a grant totalling $21,777
from the Division of Justice and Crime Prevention and
to appropriate these funds.

The regular meeting of the Council of the City of Virginia Beach, Virginia, was
called to order by tlayor Patrick t.. Standing, in the Conference Room, in the
Administration Building, on Monday, September 10, 1979, at 1:00 p.m.

Mayor Standing entertained a motion to permit Council to conduct an INFORMAL
SESSION to be followed by an EXECUTIVE SESSIO[I for the purpose of discussing

or resignation of public officers, appointees or emplovees
of any public body. (Personnel Matters)

UPCOMING ELECTIO.NS ITEM #14153
Councilman Plerrick indicated that election time is getting close and political
signs should be properly displayed. Councilman Merrick asked the City tlanager
to meet with the Planning Director and have him send copies of the Sign Ordinance
to political candi(lates in the various elections.
RESCUE SQUADS ITEM #14154
Councilwoman Henley explained the difficulty the Knotts Island Rescue Squads
are having in getting a Cardiac Techician Certificate in North Carolina.
Mr. David Grochmal, Assistant to the City Manager, indicated it might be
appropriate to ask the Currituck County officials if they would request
their local State representatives to introduce a Bill in North Carolina
to exempt Knotts Island from the specific State regulations which require
that they go through a special training and report to a certified florth
Carolina physician.
WATER/SEWER RATES ITEM #14155
The City Manager requested a one (1) week deferral on the Ordinances regarding
water and sewer line fees. (FORMAL SESSION).
This matter will be heard by Council on September 17, 1979.
BURTOrl STATION/@4ORFOLK AIRPORT ITEM #14156
The City Manager introduced Mr. Kenneth R. Scott, Executive D4rector of the
Norfolk Port and Industrial Authority.
tlr. Scott indicated that in 1971-1974, the Norfolk Port and Industrial
Authority completed at Norfolk International Airportan expansion. Following
the completion of the expansion, the Norfolk Port and Industrial Authority
had to look to see where they could go from tllere.
An Airport Lay-out Plan was prepared, generally outlining where they were going
on the first stage development and some idea beyond that; however, the Norfolk
Port and Industrial Authority found it would be appropriate to take another look,
more detailed and comprehensive, at the Airport. Therefore, under a Federal and
State Grant Program a firi,,i was hired from Atlanta, Georgia, to undertake the
Airport's National Plan Comprehensive Study.
Mr. Gordon Jackson, Project Coordinator, appeared with Mr. Scott and showed
Council several slides of the proposed expansion of the Airport and how it
would affect the Burton Station area of Virginia Beach. (DISCUSSION)
SPILLWAY PROJECT-LAKE PEMBROKE ITEM #14157
The City Manager indicated that Councilman Ervin requested a status report on
the Spillway at Lake Pembroke. The study has been completed, the Engineering
Study, by Marsh and Basgier. The City Manager introduced Mr. C. Oral Lambert,
Director of Public Works, who gave a status report to Council.
Mr. Lambert indicated the status report is complete. The construction drawings
are in the process of being prepared. The design is underway, and tiarsh and
Basgier indicated to Mr. Lambert they could complete the construction drawings
by mid October. When the drawings are completed the City will submit them to
the Environnental Agency for the necessary permits.
The City Manager indicated that Lake Pembroke is private; however, the Spillway
was dedicated to the City of Virginia Beach when Lake Pembroke was developed.
The Public t4orks Director indicated the Spillway is 10-feet long, and the study
indicates the City will have to put in a Spillway approximately 175-feet long.

Mr. William Burke, Sales Manager for Electronic Engineering Company, Inc., appeared
before Council in the INFORMAL SESSION to explain to Council how to use the
new microphones.
MOBILE HOME ORDINANCE ITEII #14159
City Council deferred discussion on the Mobile Home Ordinance until the next
Council Meeting (September 17, 1979)
(ITEM II-E.1) ITEM #14162 PRESENTATION
Mr. Ivan D. Mapp, IAember of the Tidewater Automobile Association, appeared before
Council and presented to them the AVIARD OF EXCELLENC@@ from the American Automobile
Association.
Mr. Mapp indicated the City earned this award for its achievement in the prevention
of pedestrian fatalities and injuries and for its outstanding safety program. The
City of Virginia Beach won the top award from among 37 cities in the 200,000 to
500,000 population group. The City was recognized by this award for having achieved
a death rate of 1.6 as compared with the pedestrian death rate average of all Cities
in this population group of 4.2.
Mr. Tirnmons, Member of the Tidewater Automobile Association, also appeared before
Council regarding this matter.

On motion by Councilman Baum, seconded by Councilman Riggs, City Council voted
to APPROVE the following Resolution replacing thp name "False Cape Parkway"
with the name "Ferrell Parkway"; and furtherdirected the City Manager to make
the necessary administrative changes.

the following resolution was adopted.

WHEREAS, the name False Cape Parkway exists on maps and plats within
the City of Virginia Beach, Virginia; and
WHEREAS, City Council is of the opinion that said thoroughfare
should be more appropriately referred to as FERRELL PARKWAY.
THEREFORE, BE IT RESOLVED BY TRE COUNCIL OF THE CITY OF VIRGINIA
BF-ACH, VIRGINIA:
THAT the City Manager is directed to make the necessary administrative
changes to replace the name "False Cape Parkway" with the designation "FERRELL
PARKWAY."
Adopted by the Council of the City of Virginia Beach, Virginia, on the Tenth
day of September 1979.

Your petitioner, ARISTA ASSOCIATES respectfully
represents as follows:
1. That pursuant to the provisions of Section 15.1-364 of the Code
of Virginia, as amnded,.the petitioner applies for the vacating, closing,
and discontinuance of a portion of that certain street, which is more
specifically described as follows:
ALL that certain unnamed 20' lane as shown in the shaded
area of that certain plat entitled "Plat Showing Proposed
Street Closure Vicinity of 27th Street and Pacific Avenue,
Virginia Beach, Virginia, dated July 5, 1979, Scale 1" =
20., prepared by Freeman and Freeman, Engineers and Sur-
veyors, Virginia Beach, Virginia" said plat being attached
hereto and to which reference is made for a more particular
descri pti on.
Said parcel of land being a portion of an unnamed 20' lane, as
indicated on that certain aforesaid plat, which plat is attached hereto and
made a part hereof and intended to be recorded with the Ordinance closing
the aforedescribed street.
2. That no inconvenience will result to any persons by reason of
said closing, vacation, and discontinuance of said street, and the petitioner
prays that this Honorable Council appoint viewers as provided by law to view
said platted street proposed to be closed and to report in writing to the
Council on or before the day of 1979 as to whether
in the opinion of said Viewers, what inconvenience, if any, would result from
the discontinuance and closing of this portion of said street, as herein reported
and described.
3. That on the day of 1979,
Notice of the presenting of this Application was posted at the Courthouse
of the Circuit Court of the City of Virginia Beach, Virginia, on the premises
to be closed, and at the City Hall Annex, 19th Street and Arctic Avenue,
Virginia Beach, Virginia@ as evidenced by the Affidavit attached hereto,
and a copy of said Notice.
4. That the Petitioner is fee simple owner of all land along and
adjacent to and affected by said portion of the platted street to be closed
and consequently, your Petiioner is the only landowner affected by the same.

SECTION 17-3 OF THE CODE OF THE CITY
OF VIRGINIA BEACH, VIRGINIA, RELATING
TO LITTERING.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA:
That Section 17-3 of the Code of the City of Virginia Beach is hereby
amended and reordained as follows:
Section 17-3. Throwing paper, rags, old shoes, etc., on street, etc.; disposition
of floor trash.
No person shall throw upon any street, er sidewalk, or any public
grounds in the city, any paper, rags, old shoes, tin cans, bottles, fruit or
vegetable peelings or other refuse. Floor trash or dirt from stores or buildings
shall not be swept on the sidewalk or into the gutters but shall be placed in
approved receptacles for removal by the city. Any person who violates any
provision of this section shall be guilty of a Class IV misdemeanor.

W[iEREAS, a Public Hearing was conducted on May 10, 1979, in
the City of Virginia Beach by representatives of the Commonwealth of
Virginia, Department of Highways and Transportation after due and proper
notice for the purpose of considering the proposed location and design of
Holland Road - Phase III from 0.107 miles south of Rosemont Road to 0.108 miles
north of Lynnhaven Parkway, State Project: UOOO-134-114, PE-102, in the
City of Virginia Beach at which Hearing aerial photographs, drawings, and
other pertinent information were made available for public inspection in
accordance with State requirements, and
WHEREAS, all persons and parties in attendance were afforded full
opportunity to participate in said Public Hearing, and
WHEREAS, representatives of the City of Virginia Beach were present
and participated in said Hearing,
TFIEREFORE, BE IT RESOLVED that the Council of the City of Virginia
Beach hereby approves the location and major design features of the proposed
project as presented at the Public Hearing and the Council of the City of
Virginia Beach requests the Virginia Department of Highways and Transportation
to proceed with the advertisement for construction bids for Holland Road -
Phase III presented at the aforementioned Public Hearing.

ENCROACHMENT INTO A PORTION OF THE
RIGHT-OF-WAY OF ALBRIGHTDRIVE TO
BRIGADOON CIVIC LEAGUE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH,
VIRGINIA:
That pursuant to the authority and to the extent thereof contained
in Section 15.1-893, Code of Virginia, 1950, as amended, the Brigadoon
Civic League is authorized to erect and maintain a temporary encroachment
into a portion of the City right-of-way of Albright D ive.
That the temporary encroachment herein authorized is for the
purposed of erecting a community identification sign and that said sign
shall be erected in accordance with the City of Virginia Beach Public Works
Department's specifications as to size, alignment and location, and further
that such temporary encroachitientis more particularly described as follows:
An area of encroachment into a portion of the
City's right-of-way known as Albright Drive,
as designated denotes area of encroachment as
shown on that certain plat entitled, "Plat
Showing Right-Of-Way Encroachment Into A
Portion Of Albright Drive Granted To
Briqadoon Civic League, Kempsville Borough,
Virginia Beach, Virginia," dated May 31,
1979, made by Bureau of Surveys and Mapping,
Engineering Division, Department of Public
Works, City of Virginia Beach, Virginia,
recorded simultaneously herewith to which
reference is made for a more particular
description.
PROVIDED, HOWEVER, that the temporary encroachment herein authorized
shall terminate upon notice by the City of Virginia Beach to any officer of the
Brigadoon Civic League and that within ten days after such notice is given,
said sign shall be removed form the City right-of-way of Albright Drive by
the Brigadoon Civic League, and that the Brigadoon Civic League shall bear
all costs and expenses of such removal.
AND, PROVIDED FURTHER, that it is expressly understood and agreed
that the Brigadoon Civic League shall indemnify and hold harmless the City of
Virginia Beach, its agents and employees from and against all claims, damages,
losses, and expenses including reasonable attorney's fees in case it shall be
necessary to file or defend an action arising out of the location or existence
of such sign.

AN ORDINANCE TO AUTHORIZE A TEMPORARY
ENCROACHMENT INTO A PORTION OF THE
RIG[IT-OF-WAY OF HARBOUR POINT ROAD
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA,
That pursuant to the authority and to the extent thereof contained
in Section 15.1-893, Code of Virginia, 1950, as amended, Gary W. Seay is
authorized to construct and maintain a temporary encroachment into the right-
of-way of Harbour Point Road.
That the temporary encroachment herein authorized is for the express
purpose of installing and maintaining septic lines to enable construction of a
building unit at 509 Harbour Point Road and is more particularly described as
follows:
Beginning at a point approximately l'O" southeast
of the eastern corner o f Lot I and running
paral 1 el t o t h e eastern property I i ne of Lot I ,
532 degrees 13'33"west a distance of 165.16 feet
and thence in a northwesterly direction approxi-
mately l'O" to the eastern property line of Lot I
as shown on that plat entitled, "Revised Plat Of
A Portion Of 'Replat Of Rudee Heights' Now Known
As Harbour Point (M. B. 65, P. 46) For Gary W.
And Jacqueline E. Seay On March 15, 1978" which
is on file in the Department of Public Works,
City of Virginia Beach.
PROVIDED, HOWEVER, that such authority and permission so granted shal,@
terminate when the City sewage lines are installed to service the abovementionep
property, and within sixty (60) days after the date that service is available,
said owner, his heirs, assigns and successors in title, shall connect to the
City sewage lines and said temporary encroachment will terminate.
PROVIDED FURTHER, HOWEVER, that such temporary encroachment will
automatically terminate upon written notice from the City of Virginia Beach
that the portion of the right-of-way which is encroached upon has become
necessary for public purposes.
AND, PROVIDED FURTHER, that at such time when the temporary encroach-@i
iment herein authorized terminates, Gary W. Seay, his heirs, assigns and I

THE RESPONSE OF THE VIRGINIA BEACH
POLICE DEPARTMENT.
WHEREAS, a number of business, industrial and residential users
have connected automatic burglar alarm systems to City of Virginia Beach
alarm systems; and
WHEREAS, upon receipt of an alarm the Police Department immediately
dispatches, on an urgent basis, police force. This process depletes available
manpower and creates unnecessary risks for the general public; and
WHEREAS, the response to false alarm involves a direct cost to the
City and the City is rendering a special service; and
WHEREAS, the frequency of false alarms caused by carelessness on the
partof the business, industrial and residential users has reached serious pro-
portions costing the City unnecessary and lare expenditures.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA
BEACH, VIRGINIA:
THAT there be added a Division 7, Section 2-56.6 to the Code of the
City of Virginia Beach as follows:

Section 2-56.6. Response to negligent false alartns.
There is hereby established a service charge of twenty-five dollars
($25.00) to be paid by each business, industrial and residential user for each
false alarm caused by negligence to which the police of the City of Virginia
Beach are required to respond. Such charge shall be payable to the City
Treasurer.
ADOPTED by the Council of the City of Virginia Beach on the 10
day of September 1979.
THIS ordinance shall become effective on September 1, 1979.

No person shall use or operate, attempt to use or operate, or
cause to be used or operated, or arrange, adjust, program or otherwise
operate any device or combination of devices that will, upon activation,
either mechanically, electronically or by other automatic means, initiate
an intra-city or inter-city call and deliver a pre-recorded message to any
telephone number assigned to public safety services iri the City of
Virginia Beach.

IN THE PENDLETON CHILD SERVICE CENTER
BUDGET
WHEREAS, the Virginia Beach City Council approved an appropriation
of $352,191, estimated revenue from other agencies of $317,831, and a local
match of $34,360 in the Fiscal Year 1979-80 Pendleton Child Service Center
Budget; and,
WHEREAS, the Pendleton Child Service Center is in need of a new
central air conditioning system at a cost of $11,575.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
VIRGINIA BEACH, VIRGINIA:
That $11,575 be appropriated to the Pendleton Child Service Center
for the installation of the new central air conditioning system; and,

WHEREAS, on April 23, 1979, City Council approved the FY 1980 Operating
Budget; and,
WHEREAS, City Council, in the FY 1080 Budget, also approved for
City employees two across-the-board salary increases to be effective October 1,
1979 and January 1, 1980 and a dental health plan to be effective January 1, 1980;
and ,
WHEREAS, funds in the amount of $1,985,272 are available from various
Reserve for Contingencies accounts and the City Manager wishes these funds to be
distributed for this purpose.
WHEREAS, the total cost-for the across-the-board salary increases and
implementation of a dental health plan is estimated to be $2,034,951, of which
$1,985,272 will be coming from Reserve for Contingencies of the General, Water
and Sewer, Farmers' Market Enterprise and Golf Courses Enterprise Funds; and
$49,679 from the Fund Balance in the City Garage and Print Shop Internal Service
Funds .

Councilwoman Oberndorf further indicated that when she telephoned the gentlemen
in the Public Health Department he explained the specific areas that they were
actually testing. The streets in Ballylinn Farrqs have not been tested.
Councilwoman Oberndorf asked the City Manager if it would be possible for the
Health Department to go into Ballylinn to check the system, and if the septic
systems are not failing, to alleviate the sixty-(60) day hook-up notice and
grant them one (1) year in which to hook-up?
The City Manager indicated he has already taken care of that matter; however,
until he talked to Mr. Bartholomew from Ballylinn Farms he did not know about
the notice, and he asked for a double check. @he City Manager did indicate
that if the Health Department noted that Ballylinn Farms was not in a health
hazard area they would be granted the orle (1) year; however, if they were a health
hazard they had to hook-up to the system in sixty (60) days.
Councilman Merrick indicated the General Assembly Task Force, which will meet later
this month on 24 September 1979 to discuss the City's Public Utilities Department
and policies that require mandatory water and sewer hook-ups. The General Assembly
should look after their own people. The Policy for connecting to lines was
established by City Council, not the Department of Public Utilities.
Council requested the City Manager to have a member of the Staff attend the meeting
to defend the City's Policy.

Councilman Riggs requested an updated list of all water and sewer projects completed
and a list of yet-to-be completed projects in the City of Virginia Beach.

tlayor Standing indicated that some time ago there was a Bikeway Study Committee
with representatives from the Department of Recreation and also from the Recreation
Commission. That Committee has become somewhat inactive over the last six to eight
months; however, Mayor Standing did understand that the Planning Department was
preparing a Bikeway Study Plan.
Mayor Standing, with Council's concurrence, appointed the MAYOR'S BIKE14AY STUDY
COMMITTEE, composed of:

Councilwoman Henley asked if the City was going to wait to present the Comprehensive
Land Use Plan until after the decision on Burton Station?
The City Manager indicated No, he just wanted Council to meet with Ilr. Kenneth Scott,
Norfolk Port and Industrial Authority, and discuss and vote on the False Cape State
Parkway Resolution.
