ing that City Council approve the low
bid of Floyd B. Smith Contracting, Inc.,

a. Letter from the City Manager recommending
that Council consider an appropriate resolution

retirement on June 30, 1979.
b. It is further recommended that Council appoint
Dr. Richard Easton as Jail Physician, effective
July 1, 1979.
2. Letter fram the City Manager transmitting the
recommendation of Mr. J. Dale Bimson, City Attorney,
that Mr. R. J. Nutter III, be appointed by City
Council to the position of Assistant City Attorney.
This is a budgeted position, and funds are available.

was called to order by Vice Mayor J. Henry @!cCoy, Jr., in the Conference
Room, in the Administration Building, on flonday, June 11, 1979, at 1:00 p.m.

AVAILABILITY OF FRESH WATER ITEM #13800
**COIJNCILMAN ERVIN ENTERED INFORMAL SESSIO@L AT 1:07.
The City Manager indicated that Council authorized the search of fresh water
to determine the City's fresh water supply and to also try to determine if
the City had a sufficient amount to use as a viable source of water supply
for the citizens of Virginia Beach.
The City Manager presented a report from Geraghty and Miller, Consulting
Ground-l@ater Geologists and Hydrologists, which is greater than the
optomistic plans as there is more than what was anticipated. If the
desalting plarl works,Virginia Beach will have another viable alternative
to water supply.
The City Manager introduced Mr. Aubrey Watts, Director of Public Utilities.
Mr. Watts indicated that approximately one (1) year ago, he appeared before
Council and described the four (4) local options being taken by the City in
looking at the total issue of water resource management in Viralinia Beach.
In the desalting program, the City has had substantial information and good
news for Council. The water quality data based on a most recent well is very
good and well within the perimeters that the City has based its design on.
Virginia Reach has been selected the "number one" City in the United States
for the desalting demonstration program, and has obtained strong Congressional
support of the activities and the funding.
In addition, the Department of the Interior's engineers, Kaiser Engineering,
has confirmed that the two million gallon a day plant that the City had
discussed previously was the proper sizing and the ferry slip site was the
best location for this plant.
Pir. Watts introduced Mr. James J. Geraghty, President of Geraghty and Miller.
Mr. Ceraghty stated that the findings from the Pembroke pumping test, five
other tests, and the reconnaissance studies carried out by his Firm indicated
that the Water-Table and Yorktown Aquifers have a good potential for producing
appreciable quantities of ground water in many parts of the City.
A very conservative estimate of the potential quantity that could be safely
developed from these aquifers is from 10 to 15 milliorv gallons per day.
When more driII ing and tes ti ng is done at spec i fic si tes it is possib] e that
the total quantity of water that could be developed will be considerably
greater than 10 to 15 mgd.
There are a number of potential environmental impacts that would need to be
addressed before and during the development program. One of these relates
to the potential for contamination from existing pollution sources. Another
potential impact is water-level interference between the well field and nearby
privately owned wells. These impacts could, of course be rqinimized by proper
spacing and location of wells. The possibility of upc@ning of brackish water
known to be present below depths of 150 to 200 feet in the Yorktown Aquifer is
another potential impact. This impact could be minimized by properly defining
the depth to brackish water and determining safe well spacings and pumping
rates for a well field.

photographs, drawings, and other pertinent information were made available for
public inspection in accordance with State requirements; and
WHEREAS, all persons and parties in attendance was afforded full
opportunity to participate in said Public Hearing; and
WHEREAS, representatives of the City of Virginia Beach were present
and participated in said Hearing; and
WHEREAS, the Council had previously requested the Virginia Department
of Highways and Transportation on April 13, 1972, to program this project; and
WHEREAS, with regard to the project crossing at London Bridge Creek,
it is understood that the City's plan for the ultimate channel improvement is
to provide a channel at a design elevation of -8.00 (MSL) and having a bottom
width of eighty (80) feet; and
WHEREAS, it will be the responsibility of the City of Virginia Beach
to coordinate the ultimate provision for the existing railroad crossing along
this channel and south of Virginia Beach Boulevard, it is, therefore, requested
that the proposed sixteen-foot (16') clearance over London Bridge Creek be
maintained with the improvement of Virginia Beach Boulevard as previously
designed and presented at the Public Hearing. The need and commitment of the
City's long-range plans are evidenced by the inclusion of sixteen foot (16')
clearance structures at Route 44 and Potters Road; and
WHEREAS, the Council considered all such matters.
THEREFORE, BE IT RESOLVED that the Council of the City of Virginia
Beach hereby approves the location and major design features of the proposed
project as presented at the Public Hearing, including the proposed sixteen-
foot (16') clearance over London Bridge Creek, and the Virginia Department
of Highways and Transportation is hereby requested to proceed with the
advertisement for construction bids for Virginia Beach Boulevard from Newtown
Road to Farmington Road as presented at the aforementioned Public Hearing.

ACCESS TO FALSE CAPE ITEM #13801
The City Manager indicated there were nine (9) corridors studied regarding
the access to False Cape; however, only three or four seem to be the most
viable access to False Cape.
The City Manager indicated he had a resolution prepared requesting that
Corridor number 9, which is access to False Cape State Park and the
Currituck Outer Banks through the southern portion of Virginia Beach and
across Knotts Island, be omitted from the plans. The City further requests
the Governor of Virginia and the Joint Task Force study alternative accesses
to False Cape State Park which will impose the least environrnental, social,
and ecomonic impact on the citizens of Virginia Beach.

VIRGINIA BEACH BOULEVARD RESOLUTION ITEM #13802
The City Manager indicated he had placed in the agenda package, for information
only, a resolution regarding the proposed widening of Virginia Beach Boulevard,
and further indicated if Council concurred viith the resolution he would like it
brought up for formal vote on June 18, 1979.
The City Manager handed out transcripts of the public hearing held on the
proposed widening of Virginia Beach Boulevard.
The City Manager indicated that Mr. Jack Hodge, State Highway Department,
repeated the process of going through various alternatives to see if his
recommendation was still as sound. Mr. Hodge studied five (5) alternatives:
1. Leave Virginia Beach Boulevard as it is.
2. Provide just improved signalization on the business road.
3. Provide one-way service roads on each side
4. Purchase right-of-way for the ultimate eight-lane facility
5. Build the eight-lanes as recommended.
The following resolution approves the location and major design features of
the proposed project as presented at the Public Hearing, including the proposed
sixteen-foot (16') clearance over London Bridge Creek, and requests the Virginia
Department of Highways and Transportation to proceed with the advertisement for
construction bids for Virginia Beach Boulevard from Newtown Road to Farmington
Road as presented at the aforementioned Public Hearing:

The City Manager indicated that the report on the dredging of Rudee Inlet
will be presented to Council in July of this year, and the following is an

1. Standard improvements as required by the Site Plan
Ordinance.
2. Sewage disposal subject to state Health Department
requirements.
3. A bond for right-of-way improvements along the frontage
on Princess Anne Road will be required.
4. An adequately sized drainage easement along the northern
property line is required.
And further subject to the following condition prior to the change on the
official zoning map:
1. A dedication of right-of-way 40 feet from the centerline
of the existing 50 foot right-of-way and a reservation of
additional 5 feet along the 226.82 foot frontage on Princess
Anne Road (a 15-foot dedication and a 5-foot reservation).

That Article 2, Section 200, Zoning lots, of the C.Z.O. is amended and
reordained as follows:

That Article 2, Section 202, Height Regulations, of the C.Z.O. is amended
and reordained as follows:
(a) Whenever height limits for buildings and other structures are
established, no portion of any building or other structure shall
extend above such height limits, except residential chimneys,
k4g4-4Rehes, line-of-sight relaying devices, broadcasting towers,
radio or television antennas, spires, flagpoles, water tanks, or
monuments otherwise approved for erection; provided, however, that
smokestacks may also extend beyond such limits, if they do not ex-
ceed in height the distance to the nearest lot line; and further
provided that one (1) antenna for purposes of an amateur radio sta-
tion operated may extend beyond said height limits but shall not
exceed ninety (90) feet in height above ground elevation.
That Article 2, Section 203, Off-Street Parking Requirements, of the C.Z.O.
is amended and reordained as follows:
(a) General standards. Any off-street parking space shall have
minimum dimensions of nine (9) by twenty (20) feet; provided
that minimum dimensions for parallel parking spaces shall be
nine (9) by twenty-two (22) feet. Each space shall be un-
obstructed, shall have access to a street and shall be so
arranged that any automobile may be moved without moving an-
other, except in the case of parking for one and two family
premises. All spaces shall be provided and maintained with
an all weather surface except in the case of parking for
one and two family detached dwellings. Where parking areas
are illuminated, all sources of illumination shall be so
shielded as to prevent any direct reflection toward adjacent
premises in residential, apartment, or hotel districts. In

1. Only one single-family home is to be allowed per lot.
2. Rernoves consideration of roof overhangs from the section
on heiaht requirements.
3. The third change has the effect of requiring all commercial
parking spaces to be arranged so that all vehicles may
enter the city street in a forward manner and will not
have to back out into the street. It removes a paragraph
which contradicts this.
City Council further voted to DEFER INDEFINITELY the following change to
Section 203:
1. The fourth change would prohibit commercial vehicles from
parking in residential neighborhoods unless engaged in
the performance of their commercial function. The present
ban on overnight parking only has proven to be unenforceable.

AN ORDINANCE TO APPROPRIATE ADDITIONAL
FUNDS FOR DREDGING OF RUDEE INLET
WHEREAS, City Council adopted an ordinance in the amount of
$60,000 on April 2, 1979, for the purpose of dredging Rudee Inlet; and
WHEREAS, thereafter the City entered into an agreement under
the normal terms and conditions of a standard Army Engineer Rental
Agreement to fulfill this purpose; and
WHEREAS, the full rental rate of this agreement is $5,000
per 24 hours of dredging or 75@ll of the full rental rate when natural
opposing elements prohibited dredging; and
WHEREAS, the amount of work and unfavorable weather conditions
was greater than was estimated in the original proposal thereby necessitating
the need for additional funds in the amount of $108,212.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
VIRGINIA BEACH, VIRGINIA, that $108,212 be appropriated from the General
Fund Balance for the purpose of making final payment for the completion of
the dredging of Rudee Inlet Channel.

WHEREAS, mini-cycles have become an effective police tool in
the resort area of Virginia Beach; and
WHEREAS, it is planned in the FY 1980 budget to expand their
capabilities by the addition of one mini-cycle as well as the replace-
ment of the present six (6) units; and
WHEREAS, the new 1979 model mini-cycle is $54/unit more expensive
than the 1978 model of which some are still available;
WHEREAS, it is the desire of the Police Chief to purchase these
1978 units at the lower price as well as enhance the police service needed
in the resort area for this summer season.

grant from the Division of Justice and Crime Prevention; and
WHEREAS, this grant was designed, using outside consultants,
to review and upgrade the data processing programs within the Police
Department; and
WHEREAS, important review tasks were included in the bid
specifications which are considered by the Police and Data Processing
Departments to be essential to a comprehensive review and upgrading of
the Police Data Processing programs; and
LIHEREAS, DJCP has advised that additional grant funds can
not be made available.

and Legislative branches.

following resolution voicing Council's opposition to access to False Cape
State Park and the Currituck Outer Banks through southern Virginia Beach
and across Knotts Island.
Councilman Ervin offered an AMENDMENT directing the City Clerk to forward a
certified copy of this Resolution to the Congressional delegation representing
the City of Virginia Beach, with a letter asking that they reconsider their
position in this matter.

WHEREAS, a preliminary enqineering study was prepared
for False Cape State Park in Deceirber, 1976, which considered
nine alternative access routes to the park; and
WIIEREAS, these alternatives range from access through
Back Bay National Wildlife Refuge to the north, to access through
Mackav island Natiorial- Wildlife Refuge and Knotts Tsland to the
south; and
WHEREAS, no alternative has been decided upon because
of environipental constraints and increased construction costs; and
WHEREAS, the Goverr@ors of Vir(Tinia and North Carolina
have recently appointed a Joint Task Force to study issues of
mutual interests related to access to the Currituck outer Banks
and ralse Cape State Park, with primary emphasis on a route across
Knotts lsl.and; and
WHEREAc-, access to this major park facility across Knotts
Island will have irreversible environrrlental, social, and economic
consequences for the City of Virainia Beach in the form of:
(1) Adversely effecting the fragile ecoloqy of the
Back Bav system.
(2) Creating a great deriand for support facilities such
as gas stations, restaurants, stores, and even hotels which will
initiate an irreversible transition in the character of the area
from rural agricultural to resort cor,,,mercial.
(3) Requiring the extension and huild-up of City
services into the area including additional police, fire, public
utilities, and hiqhway construction; and

WHEREAS, for these reasons, access across Knotts Island
to False Cape State Park and the Currituck Outer Banks would
be completely inconsistent with the goals and policies of the
draft Comprehensive Plan for the City of Virginia Beach.

BE '-T FUPTIIER RESOLVED, by the Council of the City of
Virginia Beach that the Governor of Virginia and the Joint Task
Force studying alternative access to False Cape State Park, are
reauested to select an alternative which will iin.T)ose the least
environmental, social, and economic irr,,pact on the citizens of
Virginia Beach.
BE IT FURTHER RESOLVED, that the City Clerk is directed to foward
a certified copy of this Resolution to the Congressional delegation representing
the City of Virginia Beach, Virginia.

The regular meeting of the Council of the City of Virginia Beach,
Virginia, was held in the Council Chambers of the City of Virginia Beach on
the 11 day of June , 1979
On motion by Councilman Ferrell and seconded by Councilman
Holland the following Resolution was adopted
R E S 0 L U T I 0 N
WHEREAS, the City Manager has discussed the early advertising
and hearing of the zoning application of Expressway Construction Corporation; and
WHEREAS, the City Council is in agreement that same should be
expedited:
THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF VIRGINIA
BEACH, VIRGINIA:
That the Director of Planning is authorized to advertise the
application for an advance hearing on the above-mentioned application.
On motion by Councilman Ferrell, seconded by Councilman Holland, City Council
voted to ADOPT the above resolution authorizing the Director of Planning to
advertise the application of Express Construction Corporation for an advanced
hearing before City Council.

ITEM #13828
Councilwoman Oberndorf indicated that Mr. Cliff Burton, resident on Rudee
Inlet, telephoned her due to an accident which occurred to his home. The
Fire Department and Rescue Squad responded immediately; however he was
informed by the Fire Department that his electricity could not be turned
back on until the Inspections Department had inspected the wiring in his
home.
Mr. Burton talked to someone in the Inspections Department and was informed
that the office hours are five days a week, 8:30 to 4:00 in the afternoon,
call us on Monday and we will try to make an appointment to come out and
see you.
The City Manager indicated to Councilwoman Oberndorf that if she spoke with
him after the meeting he will look into this matter; however, there is an
emergency number and people on duty for matters such as this.
ITEM #13829
Councilman Ervin indicated that in July, the discharge permit for the Union
Camp Company comes up for renewal. Mr. Ervin stated he is not suggesting
the City oppose the renewal of the permit, but one of the long-range pro-
jections that concerns Norfolk, and indirectly the City of Virginia Beach,
is the ability to withdraw increasing amounts of water from the Nottoway
and Blackwater Rivers.
When discussing this with the State Water Control Board, COLincilinan Ervin
was informed by some that Union Camp vas using the best available technology
in their waste treatment, and for that reason cannot refuse the amount of
water they need to dilute those wastes.
Councilman Ervin requested the City to study this permit, discuss this matter
with the State Water Control Board, and see if Union Camp is contemplating,
in the renewal of the discharge permit, any changes.

On motion by Councilman Riggs, seconded by Vice Mayor McCoy, City Council voted
to RECONSIDER the application of Carlton E. and Josephine N. Coppersmith for a
zoning change from R-5 Residential District to 0-1 Office District, in the
Kempsville Borough of the City of Virginia Beach; and further voted to advertise
the rehearing of the above-mentioned application to be heard by Council on
July 2, 1979.
