The regular meeting of the Council of the City of Vir@.inia Beach, Virginia, was
called to order by Mayor Clarence A. Holland, in the Conference Room, in the
Administration Building, Princess Anne Borough, on Monday, March 13, 1978, at
1:00 P.M.
Council Members present: John A. Baum, Robert B. Cromwell, Jr., George R.
Ferrell, John R. Griffin, Mayor Clarence A. Holland, J. Henry @IcCoy, Jr.,
Councilwoman Meyera E. Oberndorf, J. Curtis Pavne, Roger L. Riggs, Vice
Mayor Patrick L. Standing, and Floyd E. Waterfield, Jr.

Mayor Tiolland entertained a motion to permit Council to conduct an informal
session to be followed by an executive session for the purpose of discussing
the following:
1. Discussion or consideration of employment, assignment,
appointment, promotion, demotion, salaries, discipline or
resignation of public officers, appointees or employees of
any public body.
2. Discussion or consideration of the condition, acquisition
or use of real property for public purpose, or other disposition
of publicly held property.
3. Consultation with legal counsel and briefing by staff menbers,
consultants, or attorneys pertaining to actual or potential
litigation, or other legal matters within the jurisdiction of the
public body.

City Council voted to proceed into tbe executive session following the informal
meeting.

The City Manager introduced Mr. Alfred W. Craft, Jr., Chairman of the Virginia
Beach Development Authority.
Mr. Craft presented the following members to Council, and presented to Council
the Authority's Annual Report:

Mr. Craft stated that the Airport Industrial Park is approximately 93% occupied with
only 21 acres remaining in tlie park. In 1977, no new companies located in the
park, which brings the total businesses in the park to approximately 54. The new
businesses created 349 new jobs. The land and building value for the new firms is
approximately $1,865,010.00. Also, during the past year 427,200 square feet of
existing vacant spec space was leased. This is important in maintaining a balance
of available building space on the market.

In addition to Airport Industrial Park, efforts are being made to secure a
purchaser or leasee for Little Creek, which is composed of + 39 acres of land
and water area. At the present time, portions of the area are being used by
Fraser Boiler Company and Spencer Construction. A portion of the property
was also leased to Brown and Root, Incorporated for a short period of time.
The major efforts of the Virginia Beach Development Autbority and the Industrial
Division are directed at the Oceana West Industrial Park complex. This 100 acre
park offers land for light industrial uses, heavy industrial uses, office use
and commercial development.
In 1977, Stihl, Incorporated moved into their new office and production facility.
The Stihl complex consisting of 100,000 square feet of offices and manufacturing
space, serves as the company's United States headquarters. In the new plant,
large scale manufacturing will begin to serve both the national and international
markets.
Also, Furmanite America, Incorporated (a British firm), announced the location
of its western hemisphere international office in Oceana West Industrial Park.
The two new facilities will add approximately 250 jobs to the economy.
The Authority has authorized in excess of $10 Million in tax free Tndustrial
Revenue Bonds to foreign and domestic firms located in Virginia Beach.
Through the efforts of the Authority and the Department of Economic Development,
the industrial parks contributed approximately $376,783 in real estate taxes for
the preceding year.
Each year the City of Virginia Beach Development Authority has an Audit conducted
by the firm of A. Lee Rawlings and Company. The following is a summary of their
recently completed Audit which is on file in the Offices of the City Manager, the
Finance Director and the City Clerk:

NOTES TO FINANCIAL STATEMENTS

1. The Authority was created by Chapter 643, Acts of the General
Assembly, as amended, for the purpose of attracting industry
to the City of Virginia Beach.
2. Significant Accounting Policies - The financial statements
@ave been prepared on the accrual basis of accounting; expenses
have been recognized 4.n the period benefited and income has been
recognized in the period earned.
Revenue Bonds and Notes Pavable - The Authority has issued reve-
nue bonds and notes payable (Schedule A-3) to finance the con-
struction on properties sold. The bonds and not6s, both as,to
principal and interest, are payable solely from the lease proceeds.
In the event of default by the lessee, the holders of the bonds
and notes have no recourse to the Authority, but must look to the
property and lessee for indemnity. The Authority does not reflect
in its accounts any incidences of ownership in the properties.
For accounting purposes, the bonds and notes have been treated as
financing arrangenients consummated in respect of the individual
lessees with any and all liabilities tllerefor being offset by
lease rentals receivable.
'Depreciation Expense - Depreciation expense was computed using the
straightline method, based upon the estimated useful lives of the
individual assets which range from 10 to 25 years.
Land and Cost of Land Sold - Land is stated at acquisition cost
plus the cost of improvements made to both land owned by the Author-
ity and land subject to purchase options held by the Authority. For
purposes of determining cost of land sold, the total accumulated
acquisition and development costs are allocated as of year end on
a per acre basis to all parcels owned by the Authority and charges
are made to income as the individual parcels are sold. Thus, the
cost of improve-,nents made to land not ovrned by the Authority has
been included eitlier in the cost of land owned at year end or has
been charged to the cost of sale with respect to parcels sold.
3. option deposits held in escrow or with escrow agents are not avail-
able for operations. The dep'osits are normally applied to the sale
price of optioned land if the sale is consummated, or forfeited in
the eveiit the optionce elects not to exercise his option. In the

event the Authority is unable to perform its obligations stated
in the option agreements, the option deposits would be fully
refundable to the optionee.
4. The amount reported as note receivable and accrued,interest
represents a note dated August 18, 1976 in the amount of
@128,000 due from the Seven-Up Bottling Co. of Norfolk, Inc.,
which is secured by a deed of trust encumbering 7 acres of land
located in Airport Industrial Park. The note constitutes a part
of the consideration-received for Parcel XLII, as reported.on
Schedule B-1. The note principal and interest of 8% annually
are due in installments as follows:

6. The balance reported.as right-of-way and easements on Schedule
A-2 in the amount of $144,664.12 represents costs that will be
allocated to future land purchases. In the event the Authority
does not purchase the land adjoining the right-of-way or the land
upon which easements have been granted, it will be necessary to
write-off these costs, resulting in a charge against income.
7. Accrued Interest Payable - Accrued interest payable to the City
of Virginia Beach has been initially recorded in the books of
account during the year ended J'une 30, 1976 and the aiiiount
accrued as of June 30, 1975 has been charged to the balance for
reserve for authorized expenditures as of July 1, 1975 as foll.ows:

8. Litigation - The Auth'ority is a defendant in four lawsuits. In the
opinion of counsel, these actions are considered either groundless
o@ the potential liability would not materially affect the finan-
cial condition of the Authority, altliough the aggregate amount of
damages alleged is substantial.
9. Continqencies:
a. The Authority has the right to sell for industrial development
72.9 acres owiied by Mr. Lannie widgeon in Oceana West Industrial
Park and also, according to the agreement, the Autliority has the
obligation to purchase in August, 198o, at $10,617.00 an acre,
all usable land of tliat parcel unsold at that date.
b. The Authority acquired title to approximately 50 acres of land
from the Estate of Jack Stein on February 15, 1973 for $387,942.00.
The agreeinent states that the purchase price is to be paid in
$50,000.00 annual payments, beginning three years after the
closing date, or February 15, 1976. The final payment of
$37,942.00 is to be made ten years after the closing date. The
agreement stipulates that the payments wiil be made without
interest and oniv if the land is sold. As of June 30, 1977,
25.8 acres of the 50 acres remained unsold.

TO ESTABLISH AN R-7A RESIDENTIAL DISTRICT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA:
That Article 5 of the Comprehensive Zoning Ordinance is amended and re-
ordained by adding the R-7A District, as follows:
G-1 R-7A Residential District
565. Legislative Intent
The purpose of the R-7A Residential District is to provide for single
family homes on small lots with narrow frontages in concentrated rather
than scattered areas. It is for general application throughout the
city wherever facilities are adequate to accomodate it.
566. Use Regulations
Within an R-7A Residential District only the following uses and struc-
tures shall be permitted:
(a) Principal uses and structures:
(1) Dwellings, one family detached;
(2) Agricultural and horticultural uses and structures; provided
that uses and structures relating to the keeping of livestock,
poultry or bees shall not be allowed;
(3) Day care centers and child care education centers in connec-
tion with public or private elementary schools or churches;
(4) Non-illuminated golf courses, including par 3 but not iiiiniature,
with a minimum area of ten (10) acres, together with such uses
which are incidental to golf courses, provided that such uses
shall be designed and scaled to nieet only the requirenients of
the members, guests, or users of the golf course, and no signs
or other indications of such uses shall be visible froni arly
public way;
(5) Parks, playgrounds and community centers, botanical and zoolo-
gical gardens and other public buildings and uses;
(6) Public elementary, intermediate, and high schools, colleges
and universities, business colleges (but not trade schools);
day nurseries in connection with public or private elementary

(7) Public utilities installations and substations, provided
offices or storage or maintenance facilities shall not be
permitted; and Drovided, further, that utilities substations,
other than individual transformers, shall be surrounded by
a wall, solid except for entrances and exits, or by a fence
with a screening hedge five (5) to six (6) feet in heiglit; and
provided also, transformer vaults for underground utilities and
the like shall require only a landscaped screening hedge, solid
except for access opening.
(b) Accessory uses and structures. Uses and structures which are
customarily accessory and clearly incidental and subordinate to
principal uses and structures, including but not limited to garages,
tool sheds, green houses, swimming pools, barbecue facilities and
tennis courts.
(c) Conditional uses and structures. Uses and structures hereinafter
specified; subject to cDMpliance with the provisioiis of Part C
of Article 2 hereof:
(1) Churches;
(2) Day care centers;
(3) Extractive industries, including the reffloval of sand and soil;
(4) Facilities for the production of live theatre and allied pur-
poses including education in the theatre arts;
(5) Museums and art galleries when not operated by a public agency;
(6) Private schools having academic curriculunis sinlilar tD public
schools;
(7) Recreation and amusement facilities of an outdoor nature, other
than as specified under permitted principal uses and structures,
which may be partially or temporarily enclosed on a seasolial
basis with approval of City Council, except that riding acadelilies
and recreational campgrounds shall not be allowed as a conditional
use or otherwise;
(8) Storage and maintenance installations for public utilities.
567. Minimum Lot Area, Lot Width, Yard Spacing, and Height Regulations
Within the R-7A Residential District, the following shall apply:
(a) The minimum lot area for churches shall be three (3) acres.
(b) The minimum lot area for one family detached unit shall be 5,000
square feet, and the minimum lot width shall be fifty (50) feet.
(c) The minimum size for any parcel under @his provision is 30,000 square
feet. For uses other than the residential dwelling unit perillitted in
the R-7A District, the itiinimum front yard setback shall be thirty (30)
feet, and the minimum side and rear yard setbacks shall be fifteen
(15) feet.

(d) For one family detached dwelling, the minimum front yard
setbacks shall be thirty (30) feet, the minimum side yard
setbacks shall be ten (10) feet on one side and five (5)
feet on the other side, and the minimum rear yard setbacks
shall be ten (10) feet.
(e) Maximum Lot Coverage. The maximum lot coverage for all
structures in the R-7A Residential District shall be 40
percent.
(f) Height Regulations. The maximum height for all structures
in the R-7A residential District shall be thirty-five (35)
feet.
568. Off-Street Parking Regulations:
(a) For all residential structures the minimum off-street parkin.-
requirement shall be two (2) spaces per dwelling unit.
(b) For uses other than dwelling units, the minimum off-street
parking shall be as specified in the R-1 Residential District.
569. Sign Regulations:
(a) For subdivisions not to exceed one (1) identification sign
not more than thirty-two (32) square feet in area for each
principal entrance of frontage of any use.
(b) Signs advertising property for sale, lease or rent, Provided
that no such sign shall exceed eight (8) square feet in area,
that not more than two (2) such signs shall be erected for each
lot. Any property having less frontage or lot line adjoining
a street may have only one (1) sign not exceeding four (4)
square feet of surface area.
(c) In the case of new subdivisions, one (1) sign not exceeding
three hundred (300) square feet may be erected at each
principal entrance or frontage to facilitate initial sales.
Signs must be removed when seventy (70) percent of property
has been sold or leased, or after a period of twenty-four
(24) months, whichever comes first.

(d) For one family detached d@velling, the minimum front yard

VIRGINIA:
That Section 9. 3, Variances, of the Subdivision Ordinance of the City
of Virginia Beach, Virginia, is hereby amended and reordained as follows:
9. 3 Variances. The Planning Commission may authorize upon appeal in
specific cases such variances frorn the strict application of the terms of
this ordinance as will not be contrary to the public inte rest when, owing
to special conditions, a literal enforcement will result in unnecessary
hardships, provided that the spirit of this ordinance shall be observed
and substantial justice done.
No variance shall be authorized by the Comrnission unless it finds that:
(a) Strict application of the ordinance would produce undue hardship.
(b) The authorization of the variance will not be of substantial detrirnent
to adjacent property, and the character of the neighborhood will
not be adversely affected.
(c) The problem involved is not of so general or recurring a nature
as to make reasonably practicable the formulation of general
regulations to be adopted as an amendment to the ordinance.
(d) The hardship is created by the physical character of the property,
including dimensions and topography, or by other extraordinary
situation or condition of such property, or by the use or develop-
rnent of the property immediately adjacent thereto. Personal or
self-inflicted hardship shall not be considered as grounds for the
issuance of a variance.
(e) The hardship is created by the requirements of the zoning district
in which the property is located at the time the variance is authorized
whenever such variance pertains to provisions of the Zoning Ordinance
incorporated by reference in this ordinance.

Where a variance is granted, the Planning Commission may attach such
conditions and safeguards as are deemed necessary to protect general
public interest or the character of the neighborhood, and may require
a guarantee or bond to assure compliance.

WHEREAS, the Sandbridge Salt Water Pump Station is essential
to retaining the salinity level of Back Bay; and
WHEREAS, the pump station and pier appraised at $63,000
depreciated cash value were recently destroyed by fire; and
WHEREAS, this loss of $63,000 was covered fully by the self-
insurance fund of which $22,913 has previously been paid for repairs to
the pump and motor, electrical control system, and engineering design
fees; and
WHEREAS, the construction of the new pier is estimated to cost
$298,935 since it is to be enlarged and improved so it can be expanded for
use as a public fishing pier in the future; and
WHEREAS, $40,087 of the cost remains to be paid by the self-
insurance fund,
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF

shall be permissable to display the number of the house on the curb in
front thereof. Any display of the house number on the curb shall conform
to the following standard:
The numbers shall be in b,.Iock forrn painted with
black paint. The numbers shall be four 4 inches
high and three-fourths (3/4) inches w de. There
shall be no more than two (2) inches between numbers.
'Every person convicted of violating this section shall be fined
not exceeding ten dollars, and for each day that such violation shall
continue after conviction thereof shall be deemed to consitute a
separate offense.

Mr. Raymond Harper appeared before Council regarding Sewer Clean-Outs.
Mr. Harper stated that a plumber will clean out sewers for $50.00, and the City
charges $100.00 to do the same job, and requested the Council to give the citizens
an option of whether they want a private plumber or the City to handle the job.

Councilman Baum read to Council the law concerning the Freedom of Information Act
and stated that the same restrictions should be placed on the General Assembly.
