The regular meeting of the Council of the City of Virginia Beach,
Virginia, was called to order by Mayor Clarence A. Holland, in the
Conference Room, in the Administration Building, Princess Anne
Borough, on Monday, April 17, 1978, at 1:00 p.m.
Council Members present: John A. Baum, Robert B. Cromwell, Jr.,

@layor Holland entertained a motion to permit Council to conduct an
informal session to be followed by an executive session for the pur-
pose of discussing the following:
1. Discussion or consideration of emplovment,
assignment, appointment, promotion, demotion,
salaries, discipline or resignation of public
officers, appointees or employees of any public
body.
2. The protection of the privacy of individuals
in personal matters not related to public business
3. Consultation with legal counsel and briefin--
by staff members, consultants, or attorneys per-
taining to actual or potential litigation, or other
legal matters within the jurisdiction of the public
body.

City Council voted to proceed into the executive session following
the informal meeting.

The City Manager stated that as Council requested he asked the
Director of the Department of Public Utilities to provide a report on
the Birdneck Point water mains. The City @lanager noted the following
key points:
1. Although the main problem experienced by citizens
is the bigh iron content of the water, as a result of
no periodic flushing over the years, and although the
iron content in areas is above the 0.3 mg/l level, it
is not classified by the Health Department as a health
hazard.
The definition of iron, as per the State Health
Department, is that iron is a highly objectionable
constituent in water supplies for either domestic
or industrial use. Iron may impart brownigh discolora-
tion to laundered goods. The taste that it imparts to
water may be described as bitter or astringent, and may
adversely affect the taste of other beverages. 4/17/78

3. Replace the existing systeri without any improvements
at no cliarge to citizens of Birdneck Point.
4. Wait for the new installation of the 36-inch line
on Laskin Road that will improve pressures and thereb@,

deposits.

Phase II - Replace existing mains on Starling
Court and Oriole Drive
Construction time: 31/2 months
Total cost: $176,484
Phase III - Replace existing pipe on Cardinal
Dri-ve
Construction time: 21/2 months
Total cost: $137,214
Phase TV - Replace existing 2-inch pipe in
Courts and Cul-de-sacs with 4 and
6-inch mains
Construction time: 3 months
Total cost: $171,945
TOTAL CONSTRUCTION TIME (ALL PHASES) - 131/2 MONTHS
TOTAL COST (ALL PHASES) - $758,000
NOTE: The time shown above represents construction time only.
Prior to beginning construction, a minimum time of 4
to 6 months would be required for preparation of con-

Comparatively, the estimated cost for replacing the Birdneck
Point water system with existing sized mains is $442,000.
All of the proposed phases would include -,he installation of
new fire hydrants and water meters as required.
The approach which we have recominended is not meant to be a
fixed one, but one which will allow us flexibility as we monitor
the improvements resulting from each installation. We strongly
believe that Phases I and IT are required, but it is possible
that Phases III and IV may not be necessary if results from I
and II are very successful. Similarly, af-ler monitoring the
results of Phases I and II, we may find that Phase TV should
come ahead of Phase III. We do not recommend establishing the
priority of Phases III and IV until we have monitored and evalu-
ated any improvenients realized from the installation of Phases
I and II.

it should be noted that the Highway Division is attempting to
set up a paving schedule for Birdneck Point. Any repaving
schedule should be based upon the program established for im-

land, so consequently the City had to acquire the right-of-way for
Holland Road.
Until the developer dedicates the riglit-of-way the zoning maps
will not be changed to office.
Because of tlie conditions involved, the City @,lanager would like
to bring to Council at the next meeting a request to waiver the
right-of-way reqijirements for the widening of Holland Road.

That pursuant to the authority and to the extent thereof contained in
Section 15.1-893, Code of Virginia, 1950, as amended, John D. Mitchell, and N. P.
Simpson, III, owners of Alamar Apartments in Virginia Beach, Virginia, are
authorized to erect and maintain a temporary encroachment in the City right-
of-way of 16th Street.
That the temporary encroachment herein authorized is for the purpose of
erecting a sion for Alamar Apartments, and that said sign shall be erected in
accordance with the City of Virginia Beach Public Works Department's specifications
as to size, alignment and location.
PROVIDED, HOWEVER, that the temporary encroachment herein authorized
will terminate upon notice by the City of Virginia Beach to the owners of Alamar

That Sections 33-8 and 33-9 of the Code of the City of Virginia
Beach, Virginia, is hereby amended and reordained as follows:
Section 33-8. When city taxes due and payable.
City taxes on personal property for each year shall be due and
payable on or before June I of the year in which the same are assessed. Except
when the assessment is made after June 1, the taxes shall be due and payable
on or before December I of the year in which the sarie are assessed.
Section 33-9, Penalties and interest @,ihen not paid on time.
In the event any taxes on personal property are not paid on or before
the time the same are due and payable as set forth in Section 33-8, there shall
be added thereto a penalty of ten percent of the amount of such unpaid taxes or
the sum of ten dollars, whichever shtl reater, and such taxes and penalty
shall bear interest at the rate of six percent per annum, coinmencing not earlier
than due.
The assessment of such penalty shall not be deemed a defense tc a
criminal prosecution for failing to make r-Iturn of taxable property as may be
required by law.
This ordinance shall be effective UPON ITS ADOPTION.

Mrs. Beverly Woodhouse, rel)resenting tile Concerned Citizens of
Virginia Beach, as well as the Virginia Beach Branch of the NAACP,
addressed Council concerning the eviction notices given tenants in
the Beach Towne Apartments. @,lrs. Woodhouse noted that persons in
suCh circumstances had no place to rflove to as Virginia Beach does
not have a low-income subsidized housing authority, such as other
areas.
In this matter concerning the evictions @Irs. '@Voodhouse was told
to refer to the Virginia Beach Social Services Department. it
was indicated that the neivly established Virginia Beach Community
Development Commission will be helpful.
Nlr. James Bailey a local resident and member of the ITAACP reiterated
the statements made by Mrs. Woodhouse and urged the Council to take
ir.imediate action to provide proper housing for the low-income segment
of our society.

Mr. Bruce Challen, a resident of Acredale, submitted petitions signed
by residents requesting the installation of sewerage facilities which
had been in "process" for many months. It now appears that the streets
have deteriorated to such an extent that they will require extensive
repairs even before they are torn up to install tlie new sewer mains.
Relief from torn up streets and niuch needed sewers are requested by
the residents in Acredale.
