VIRGINIA BEACH CITY COUNCIL
WHEREAS: The Virginia Beach City Council convened into EXECUTIVE
SESSION, pursuant to the affirmative vote recorded in ITEM # 36088,
Page No. 4, and in accordance with the provisions of The Virginia
Freedom of Information Act; and,
WHEREAS: Section 2.1-344.1 of the Code of Virginia requires a
certification by the governing body that such Executive Session was
conducted in conformity with Virginia law.
NOW, THEREFORE, BE IT RESOLVED: That the Virginia Beach City
Council hereby certifies that, to the best of each member's knowledge,

ALTERNATIVES TO PROJECTED CASH SHORTAGES

Mrs. Patricia A. Phillips - Director of Finance, advised on August 4, 1992, the Virginia Beach
Development Authority (VBDA) presented its Annual Report to City Council 7he presentation included
a review of the VBDAS financial condition which revealed a projected cash shortage by January 1993
due to scheduled debt service payments. As a result, the VBDA has requested assistance from the City
Council in meeting its financial obligations during the current recession. City Council requested analysis
and recommendations from the City Manager. 77ie Virginia Beach Development Authoiity - Alternatives
To Projected Cash Shortages were prepared by Patricia A. Phillips, Director of Finance; Leslie L. Lilley
- City Attorney, E Dean Block - Director of Management and Budget; W. Andrew Burke - Director of
Economic Development; an4 Robert Scoff - Director of Planning. 7he VBDA was created in 1964 by
the General Assembly (Chapter 643, Acts of the Assembly of 1964 as amended); to foster and stimulate
economic development by encouraging the creation of new business and the relocation of existing industry
to Virginia BeaciL Since its creation in 1964, VBDA has developed five office and industrial parks that
have resulted in business and industrial property valued in excess of $415-MILLION, more than 12,400
jobs in 575 companies attracted to these parks and over $18-MILLION in real estate taxes paid to date.
Since its creation, the Authority has issued securities and obtained bank loans to finance the infrastructure
needed to fulfill its mission. Ihere is a cash shortage projected in January 1993 that will result in its
inability to pay the bank loans that were procurred to finance Corporate Landing.
Me Policy Report summarizes the assets of the Authority and their book value of approximately $31-
MILLION, the largest portion being Corporate Landing ($20-MILLION).

Mrs. Phillips advised the objectives:
Protect the City's credit position
Provide some flexibility to the City
Protect the Undesignated General Fund Balance
Promote Economic Development
Mrs. Phillips advised the following alternatives were identi)7ed because each would be seen by the credit
rating agencies as a positive approach to dealing with and effectively managing the problem, financially
and fi-om a debt management perspective:
1. Restructure VBDA Debt Service Requirements
2. Loan the Development Authority sufficient amounts to meet debt
payments over the next two years.
3. City payment of outstanding debt.

Mrs. Phillips cited the City staffs recommendation. Each of the three alternatives identified are positive
approaches to the VBDA projected cash shortage. However, the alternative that provides the most
flexibility is Alternative No. 1, Restructure VBDA Debt Service Requirements. Ae maxiinum cash outlay
by the City over the two -year period would be $2.2-MILLION and would represent loans to the YBDA.
After the required release fees are paid to NationsBank from the proceeds of future land sales, the City
should receive 80% of the remaining proceeds as repayment of the loans. Interest charge on the loans
sold be at a rate that approximates the City's investment rates, recalculated quarterly.
7he advantages of Alternative No. 3 were cited.-
Eliminates future interest payments of noteholders, including 9% notes.
City is in ':first position " - would hold First Deed Of Trust.
Eliminates risk of foreclosure upon and default by a "Virginia Beach"
authority.
Would enhance City control
Retains VBDA ability to continue to sell property.
Will be seen as a positive step by the credit rating agencies.
EUminates future cash shortfalls, if sales are slow.
Value of property is estimated at slightly greater.
77ie Development Authority is an arm of the City. 7he City Council created the Development Authority.
W. Andrew Burke, Director - Economic Development, advised it will be approximately 5 to 7years before
Burton Station can be utilized as an Industrial Park
Mayor Oberndorf advised these Alternatives would be SCHEDULED for the City Council Session of
October 13, 1992. Mayor Oberndorf advised all three alternatives are excellent; however, she is most
comfortable with the alternative proposed by the staff as it provides the most flexibility and the least
@ct on the Fund Balance.

11 (a) The chief of police, with the approval of the city
12 manager, shall make rules and regulations concerning the operation
13 of the department of police, the conduct of the officers and
14 employees thereof and their uniforms, arms, other equipment and
15 training.
16 (b) The chief of police shall assign all members of the
17 department of police to their respective posts, shifts, details and
18 duties.
19 (c) The chief of Police is authorized to permit police
20 officers to engage in off-duty employment which may occasionally
21 reciuire the use of police Powers in the Performance of such
22 employment, and may promulgate rules and regulations concernincr
23 such off-dutv employment.

1 AN ORDINANCE TO AMEND AND REORDAIN
2 SECTION 35-64 OF THE CODE OF THE
3 CITY OF VIRGINIA BEACH, VIRGINIA,
4 PERTAINING TO EXEMPTION, DEFERRAL OR
5 FREEZE FOR ELDERLY AND DISABLED
6 PERSONS.
7 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VIRGINIA
8 BEACH, VIRGINIA:
9 That Section 35-64 of the Code of the City of Virginia Beach,
10 Virginia, is hereby amended and reordained to read as follows:
11 Section 35-64. General prerequisites to grant; effect of
12 residency in hospital, nursing home, etc.
13 (a) Either the exemption, deferral or freeze, but not more
14 than one, as provided for in this division shall be granted to
15 persons subject to the following provisions:
16 (1) The title to the property for which exemption,
17 deferral or freeze is claimed is held, or partially
18 held, on June thirtieth immediately preceding the
19 taxable year, by the person or persons claiming
20 exemption, deferral or freeze and is occupied as
21 the sole dwelling of such person or persons.
22 (2) The head of the household occupying the dwelling
23 and owning title or partial title thereto or either
24 spouse in a dwelling jointly held by a husband and
25 wife is either permanently and totally disabled or
26 is sixty-five (65) years of age or older on June
27 thirtieth of the year immediately preceding the
28 taxable year; provided however, that a dwelling
29 jointly held by a husband and wife may qualify if
30 either spouse is over sixty-five (65) years of age
31 on such date.
32 (3) The total combined income received from all sources
33 during the preceding calendar year by: (i) owners
34 of the dwelling who use it as their principal
35 residence and (ii) owners' relatives who live in
3 6 the dwelling, shall not exceed twenty thousand
37 dollars ($20,000.00); provided that the first five
38 thousand dollars ($5,000.00) of income of each
39 relative, other than a spouse of the owner, or
40 owners, who is living in the dwelling shall not be
41 included in such total; and provided further that
42 the first seven thousand five hundred dollars
43 ($7,500.00) or any portion thereof of income
44 received by a permanently and totally disabled
45 owner shall not be included in such total.
46 (4) The net combined financial worth, including
47 equitable interests, as of December thirty-first of
48 the year immediately preceding the taxable year, of
49 the owners, and of the spouse of any owner,
50 excluding the value of the dwelling and the land,
51 not exceeding one acre, upon which it is situated,
52 does not exceed seventy thousand dollars
53 ($70,000.00).
54 (5) The dwelling is occupied.
55 (b) Notwithstanding subdivision (a) of this section, if a
56 person has already qualified for an exemption or deferral under
57 this article, and if the person can prove by clear and convincing
58 evidence that after so qualifving the person's Physical or mental
59 health has deteriorated to the point that the onlv alternative to
60 permanently residing in a hosr)ital, nursing home, convalescent home
61 or other facilitv for phvsical or mental care is to have a relative
62 move in and Drovide care for the person, and if a relative does
63 then move in for that purpose, then none of the relative's income
64 shall be counted towards the income limit.
65 (@c) The fact that persons who are otherwise qualified for tax
66 exemption, deferral or freeze pursuant to this division are
67 residing in hospitals, nursing homes, convalescent homes or other
68 facilities for physical or mental care for extended periods of time
69 shall not be construed to mean that the real estate for which tax
70 exemption, deferral or freeze is sought does not continue to be the

7 1 sole dwelling of such persons during such extended periods of other
72 residence, so lonq as such real estate is not used by or leased to
73 others for consideration.

IN DEA SHARED ASSETS FUNDS FOR THE PURPOSE OF
PURCHASING A REPLACEMENT HELICOPTER ENGINE
1 WHEREAS, the engine of the Police Department'S Bell JetRanger
2 helicopter has reached the end of itB UBeful life and without replacement the
3 helicopter will have to be taken out of service;
4 WHEREAS, this helicopter is one of two the City currently has to
5 handle police calls, airborne communications, search and rescue, transportation,
6 and natural disabters;
7 WHEREAS, there is sufficient funds within the DEA Shared Assets Fund
8 to allow for the purchase of this engine replacement and no City funding will be
9 required.
10 NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
11 VIRGINIA BEACH, VIRGINIA, that $130,000 in DEA Shared Assets be appropriated for
12 the purpose of purchasing a replacement engine for the Police Department's
13 Helicopter.
14 BE IT FURTHER ORDAINED, that estimated revenues from the federal
15 government be increased by $130,000 for this purpose.

1 WHEREAS, the Fire Department, in order to increase the effectiveness and efficiency of
2 personnel has attempted to utilize technology to reduce the volume of paper circulating within the
3 department, improve communications, and reduce duplicated/redundant tasks;
4 WHEREAS, the Fire Department has deemed technology important, R has proceeded in
5 attempting to procure microcomputer equipment for all fire stations, however, recent funding constraints
6 have limited this effort to 10 of the 18 fire stations;
7 WHEREAS, utilization of Fire Programs Funds will allow the department to purchase
8 computer equipment for the remaining 8 fire stations and provide 1 additional microcomputer for the Fire
9 Prevention Office;

11 the Commonwealth, and use of these funds requires no local funding match.

11 impact of rising health care costs on City employees by increasing
12 the City's monthly contribution to employees' health care premiums
13 in the amount of Ten Dollars ($10.00) per month in addition to the
14 Twenty Dollars ($20.00) per month increase previously included in
15 the Fiscal Year 1992-93 Operating Budget; and
16 WHEREAS, it is the intent of City Council, while
17 effecting such increase, not to adversely impact the City budget.
18 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
19 OF VIRGINIA BEACH, VIRGINIA:
20 That the City Manager is hereby directed to identify
21 available funds that may be transferred within the FY 1992-93
22 Operating Budget to increase the City's contribution to employees'
23 health insurance in the amount of Ten Dollars ($10.00) per month,
24 in addition to the Twenty Dollars ($20.00) per month increase
25 previously approved in the FY 1992-93 Operating Budget; and

That Section 35-64

THE CITY COUNCIL OF THE CITY OF VIRGINIA
of the Code of the City of Virginia Beach,
is hereby amended and reordained to read as follows:
Section 35-64.
General prerequisites to grant;
residency in hospital, nursing home,
effect of
etc.
(a) Either the exemption, deferral or freeze, but not more
than one, as provided for in this division shall be granted to
persons subject to the following provisions:
(1) The title to the property for which exemption,
(2)
deferral or freeze is claimed is held, or partially
held, on June thirtieth immediately preceding the
taxable year, by the person or persons claiming
exemption, deferral or freeze and is occupied as
the sole dwelling of such person or persons.
The head of the household occupying the dwelling
and owning title or partial title thereto or either
spouse in a dwelling jointly held by a husband and
wife is either permanently and totally disabled or
is sixty-five (65) years of age or older on June
thirtieth of the year immediately preceding the
taxable year; provided however, that a dwelling

jointly held by a husband and wife may qualify if
either spouse is over sixty-five (65) years of age
on such date.
The total combined income received from all sources
during the preceding calendar year by: (i) owners
of the dwelling who use it as their principal
residence and (ii) owners' relatives who live in

the dwelling, shall not exceed twenty thousand
dollars ($20,000.00); provided that the first five
thousand dollars ($5,000.00) of income of each
relative, other than a spouse of the owner, or
owners, who is living in the dwelling shall not be
included in such total; and provided further that
the first seven thousand five hundred dollars
($7,500.00) or any portion thereof of income
received by a permanently and totally disabled
owner shall not be included in such total.
(4) The net combined financial worth, including
equitable interests, as of December thirty-first of
the year immediately preceding the taxable year, of
the owners, and of the spouse of any owner,
excluding the value of the dwelling and the land,
not exceeding one acre, upon which it is situated,
does not exceed seventy thousand dollars
($7O,0OO.0O).
(5) The dwelling is occupied.
lb) Notwithstandinq subdivision fa) of this section, if a
person has already qualified for an exemption or deferral under
this article, and if the person can prove by clear and convincing
evidence that after so qualifyinq the person's physical or mental
health has deteriorated to the point that the only alternative to
permanently residinq in a hospital, nursinq home, convalescent home
or other facility for physical or mental care is to have a relative
move in and provide care for the person, and if a relative does
then move in for that purpose, then none of the relative's income
shall be counted towards the income limit.
(~) The fact that persons who are otherwise qualified for tax
exemption, deferral or freeze pursuant to this division are
residing in hospitals, nursing homes, convalescent homes or other
facilities for physical or mental care for extended periods of time
shall not be construed to mean that the real estate for which tax
exemption, deferral or freeze is sought does not continue to be the

sole dwelling of such persons during such extended periods of other
residence, so long as such real estate is not used by or leased to
others for consideration.

program enacted by a county., city or town pursuant to § 58.1-3210 shall be
subject to the following restrictions and conditions:
1. a Subject to subdivision 1 b of this section, the total combined income
received from all sources during the preceding calendar year by (i) owners of
the dwelling who use it as their principal residence and (ii) owners' relatives
who live in the d~velling, shall not exceed the greater of $30,000, or the income

I am writing in response to your request for an opinion as to whether you may
participate in City Council's consideration of an ordinance to appropriate $130,000 in DEA
Shared Assets Funds for the purchase of a replacement engine for the Police Department's
helicopter. The ordinance is scheduled for the October 6, 1992, meeting of the Council.
SUMMARY CONCLUSION:
I am of the opinion that since the Conflict of Interests Act does not anticipate the
personal interests of a legislator-employee regarding the transactions before a public body,
you do not have a personal interest in the transaction as defined by the Act. Thus, you are
permitted to participate in this matter without restriction.
Notwithstanding this conclusion, I have previously advised you by letter of July 2,
1990, to follow the dictates of the Act in cases in which you will realize a reasonably
foreseeable direct or indirect benefit or liability. The facts as referenced herein indicate that
you will not personally realize a financial benefit or liability as a result of the transaction.
For these reasons, you are permitted to participate in this matter without restriction.

I base the aforesaid conclusions on the following facts and discussions. Please review
and verify the accuracy of the facts as set forth as you may only rely upon this opinion if
they are correct and complete.
FACTS PRESENTED:
Your request for an advisory opinion is generated by Council's consideration of an
ordinance to appropriate $130,000 in DEA Shared Assets Funds for the purchase of a
replacement engine for the Police Depathnent's helicopter. The ordinance is currently
scheduled on the agenda for October 6, 1992. You advise that your area of concern with
respect to the transaction is that you are currently employed by the City of Virginia Beach
as a police officer assigned to a position in the Commonwealth's Attorney's Office, and that
you are also a Council member of the City of Virginia Beach. You receive an annual salary
in excess of $10,000.00 from the City.
ISSUE:
Are you precluded from participating in Council's consideration of the ordinance to
appropriate $130,000 in DEA Shared Assets Funds for the purchase of a replacement engine
for the Police Depathnent's helicopter?
DISCUSSION:
I. Applicable Definitions of 82.1-639.2:
A. City Council is a "governmental agency" under the definition, as it is a
legislative branch of local government.
B. You are an officer within the meaning of "officer".

C. Council consideration of the ordinance to appropriate $130,000 to the Police
Depa~h~ent is a "transaction" as defined by the Act. A transaction includes any matters
considered by any governmental agency on which official action is taken or contemplated.
D. "Personal interest" is defined as a financial benefit or liability which accrues
to an officer, employee, or to an immediate family member. The interest exists by reason
of one of five categories specified therein as: 1) ownership in a business if the ownership
interest exceeds 3 % of the total equity of the business 2) annual income from ownership in
real or personal property or a business in excess of $10,000.00 3) salary from the use of
property or paid by a business that exceeds $10,000.00 annually 4) ownership of real or
personal property when the interest exceeds $10,000.00 in value, exclusive of ownership in
a business, or salary 5) personal liability incurred or assumed on behalf of a business which
exceeds 3 % of the asset value of the business.
E. A "personal interest in the transaction" exists when an officer or employee or
a member of his immediate family has a personal interest in property or a business or
represents any individual or business and such property, business or represented individual
(i) is the subject of the transaction or (ii) may realize a reasonably foreseeable direct or
indirect benefit or detriment as the result of the agency considering the transaction.
II. A~lication of Definitions:
A. Personal Interest
My review of the facts indicates that you do not have a "personal interest" as defined
above, because you do not receive a salary from a "business". Instead your salary is paid
by the City of Virginia Beach which is classified under the Act as a governmental agency.
B. Personal Interest in the Transaction
You do not have a "personal interesff, as defined above, therefore you cannot have
a "personal interest in the transaction" under the definition of the Conflict of Interests Act.
III. Disclosure Requirements
Based on the fact that you have no personal interest in the Council's consideration of
the ordinance to appropriate $130,000 to the Police Department, it is my opinion that you
are able to participate in City Council's discussion and vote on the ordinance without
restriction.

The Conflict of Interests Act deals with the types of influences upon a public officer's
judgment which are clearly improper. The law does not, however, protect against all
appearance of improper influence. In that respect, the Act places the burden on the
individual officer to evaluate whether the facts presented create an appearance of impropriety
which is unacceptable or which would affect the confidence of the public in the officer's

helicopter has reached the end of its useful life and without replacement the
helicopter will have to be taken out of service;

and natural disasters;

WHEREAS, the Commonwealth of Virginia's Chesapeake Bay Local Assistance Department has
provided a grant in the amount of $20,956 to support a temporary position for up to one year's duration to
carry out day to day oversight and educational work of the City of Virginia Beach Chesapeake Bay
Preservation Program;
WHEREAS, this grant requires a cash match of $10,625 which is available in the FY 1992-93
General Fund Reserve for Contingencies in resources approved by the Council for the match;
WHEREAS, the work to be provided through these resources are considered vital to the continuing
work in Chesapeake Bay preservation in Virginia Beach.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH,
VIRGINIA, that a $20,956 grant be accepted from the Commonwealth of Virginia, and be appropriated to
the Department of Planning for Chesapeake Bay Preservation work, and that estimated Revenue from the
Commonwealth be increased by $20,956.
BE IT FURTHER ORDAINED that $10,625 be transferred from the FY 1992-93 Reserve for
Contingencies to the Department of Planning for a required cash match for the grant.
BE IT FURTHER ORDAINED that a full time temporary position be created within the Department of
Planning to carry out the work of this grant.

WHEREAS, the Fire Department, in order to increase the effectiveness and efficiency of
personnel has attempted to utilize technology to reduce the volume of paper circulating within the
department, improve communications, and reduce duplicated/redundant tasks;
WHEREAS, the Fire Department has deemed technology important, it has proceeded in
attempting to procure microcomputer equipment for all fire stations, however, recent funding constraints
have limited this effort to 10 of the 18 fire stations;

computer equipment for the remaining 8 fire stations and provide 1 additional microcomputer for the Fire
Prevention Office;

A RESOLUTION DIRECTING THE CITY
MANAGER TO IDENTIFY AVAILABLE FUNDS
THAT MAY BE TRANSFERRED WITHIN THE
FY 1992-93 OPERATING BUDGET TO
INCREASE THE CITY'S CONTRIBUTION TO
EMPLOYEES' HEALTH INSURANCE
WHEREAS, the cost of health care insurance for city
employees and their families will significantly increase effective
January 1, 1993;
WHEREAS, it is the desire of City Council to mitigate the
impact of rising health care costs on City employees by increasing
the City's monthly contribution to employees' health care premiums
in the amount of Ten Dollars ($10.00) per month in addition to the
Twenty Dollars ($20.00) per month increase previously included in
the Fiscal Year 1992-93 Operating Budget; and
WHEREAS, it is the intent of city Council, while
effecting such increase, not to adversely impact the City budget.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF VIRGINIA BEACH, VIRGINIA:
