An Ordinance to qualify those elderly persons for the fiscal year July 1, 1977 through June 30, 1978 for real estate tax exemptions. d. An Ordinance to provide for payment of real estate taxes for partial assessments for the period January 1, 1977 through March 31, 1977. 119. Letter from the City Manager recommending that @ity Council authorize him to enter into agreements with the engineering firm of Hayes, Seay, Mattern and Mattern of Roanoke, Virginia and officials of Princess Anne, Aragona and Pembroke Utilities and other private utilities as recommended by the report of the Mayor's Committee on Water and Sewer Rates 1977 to determine a purchase price for these private utilities and to appropri-ate $26,650 to fund the City of Virginia Beach's maximum sliare of the study. 20. Letter from the City Manager recommending approval of an agreement between the City of Virginia Beach and the liampton Roads Sanitation District in which the City agrees to waive connection line and tap fees and hydrant fees in return for HRSD's construction of an oversized water main down Old Dam ineck Road, which would ultimately service the Atlantic Wastewater Treat- ment Plant. 21. Letter from the City Manager recommending that City Council not approve tiie proposed amendment which would reordain Article 2 of the Comprehensive Zoning Ordinance pertaining to automobile service stations. 22. Letter from the City Manager recommending approval of the request of Virginia Beach Citizen Band Radio Club/County View Recreation Hall for a raffle permit. 23. MINUTES OF THE HONORAi3'-E CITY COUNCIL OF TIIE CITY OF VIRGIIIIA BEACH, VIRGINIA April 11, 1977 The regular meeting of the Council of the City of Virginia Beach, Virginia, was called to order by Mayor Clarence A. Holland, in the Conference Room, in the Administration Building, Princess Anne Borough, on Monday, April 11, 1977, at 1:00 p.m. Council Members present: John A. Baum, Robert B. Cromwell, Jr., George R. Ferrell, John R. Griffin, Mayor Clarence A. Holland, J. Henry McCoy, Jr., Councilwoman Meyera E. Oberndorf, J. Curtis Payne, Roger L. Riggs, Vice Mayor Patrick L. Standing, and Floyd E. Waterfield, Jr. ITEM #10658 Mayor Holland entertained a motion to permit the Council to conduct an informal discussion to be followed by an Executive Session for the purpose of discussing the following: 1. Discussion or consideration of employment, assignment, appointment, promotion, demotion, salaries, discipline or resignation of public officers, appointees or employees of any public body. 2. Discussion or consideration of the condition, acquisition or use of real property for public purpose, or other disposition of publicly held property. 3. Investing o@- public funds where conipetition or bargaining are involved where, if riade public initially, the financial interest of the governing unit would be adversely affected. 3. Consultation with legal counsel and briefing by staff members, consultants, or attorneys pertaining to actual or potential litigation, or other legal matters within the jurisdiction of the public body. On motion by Vice Mayor Standing, seconded by Councilman Waterfield, and by recorded vote as follows: Ayes: Councilmen John A. Baum, Robert B. Cromwell, Jr., George R. Ferrell, John R. Waterfield, Jr. Nays: lione Absent: None City Council voted to proceed into executive session following the informal discussion. ITEM #10659 The City Manager informed Council that lie had received the audit report of the Virginia Beach Neptune Festival, and presented the report to Council for their perusal. It was noted, however, that the festival was approximately $4,000 in arrears when this audit was made. The City Manager stated it would cost the City approximately $24,000 in City services for the Neptune Festival, such as: Police, highways, Refuse Collection, Parks and Recreation, and approximately $17,000 in City services to the Virginia Beach Boardwalk Art Show. ITEM #10660 The City Manager stated that in his letter, Item #20 on the regular agenda, should read: - - - - -- this plant would have a capacity of 100,000 gallons of water per day, with a peak flow of 250 gallons per minute. The plant is designed to start out as a 27 million gallon plant and expand to a 30 million gallon plant. ITEM #10661 The City Manager stated he wrote Council a letter requesting permission to participate in the hiring of the engineering firm of Hayes, Seay, Mattern and Mattern of Roanoke, Virginia, with the owners of Princess Anne, Aragona and Pembroke Utilities, for the purpose of determining the purchase price for the above mentioned private utilities. The City Manager further stated that the $39.9 Million Revenue Bonds will not be used in any way for the acquisition of the utilities, nor will the funds for the previously authorized $9.1 Million Revenue Bonds. ITEM #10662 At 2:15 p.m., City Council reconvened in the Council Chambers, with the following Members present: John A. Baum, Robert B. Cromwell, Jr., George R. Ferrell, John R. Griffin, Mayor Clarence A. Holland, J. Henry AIcCoy, Jr., Council- woman Meyera E. Oberndorf, J. Curtis Payne, Roger L. Riggs, Vice Mayor Patrick L. Standing, and Floyd E. Waterfield, Jr. The invocation was given by the Reverend Sefton B. Strickland, Jr., Bow Creek Presbyterian Church, followed by the Pledge of Allegiance. ITEM #10663 The City Council presented a plaque to Mr. J. Roy Alphin, retired Chairman of the Virginia Beach Bicentennial Commission, in appreciation for his untiring work on the Corqmission. ITEM #10664 City Council deferred consideration of the minutes of the regular meeting of April 4, 1977, due to an error. Waterfield, Jr. Nays: None Absent: None City Council approved on second reading the following ordinance authorizing the issuance of water and sewer bonds of the City of Virginia Beach, Virginia, in an amount not to exceed $39.9 Million, subject to approval by the qualified voters: AN ORDINANCE AUTHORIZING THE ISSUANCE OF WATER AND SEWER BONDS OF THE CITY OF VIRGINIA BEACH, VIRGINIA IN AN AMOUNT NOT TO EXCEED $39,900,000, SUBJECT TO APPROVAL BY THE QUALIFIED VOTERS WHEREAS, investigations made by the Depattment bf Pilblic Utilities disclose that the rapid growth of the City of Virginia Beach has placed burdens on both water and sewer facilities in excess of design capabilities which, together with anticipated future growth of the City, require that the City undertake extensive improvements to its water and sewer system; and WHEREAS, the Council has already authorized commence- ment of a capital improvement program for water and sewer which is expected to cost approximately $59,000,000 over the next five years; and WHEREAS, the recently submitted Report of Mayor's Committee on Sewer & Water Rates 1977 recommends that the major portion of such capital improvement program be financed through the proceeds of general obligation bonds of the City which shall be additionally secured by a pledge of the revenues of the water and sewer system; BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA: 1. It is hereby determined to be necessary and expedient for the City of Virginia Beach to undertake extensive improvements to its water and sewer system, which will promote the health and general welfare of its inhabitants and will facilitate the continued growth and orderly development of the City, and to finance a por- tion of the cost of a capital improvement program for water and sewer through the borrowing of $39,900,000 and issuing its general obliga- tion bonds therefor additionally secured by a pledge of the revenues (Ch. 147, Acts of Assembly of 1962, as amended) and the Public Finance Act, as amended, there are hereby authorized to be issued water and sewer bonds of the City in a-n amount not to exceed $39,900,000. 3. The bonds shall bear such date or dates, mature at such time or times not exceeding forty years from their dates, bear interest at such rate or rates not to exceed eight percent (8%) per year, be in such denominations and form, be executed in such manner and be sold at such time or times and in such manner as the Council may hereafter provide by appropriate resolution or resolutions. 4. The water and sewer system is an undertaking from which the City may derive a revenue, and such bonds are not to be included within the otherwise authorized indebtedness of the City; provided, however, that from and after five years from the date of the election approving the bonds whenever and for so long as the water and sewer system fails to produce sufficient revenues to pay for the cost of operation and administration (including interest on bonds issued therefore), and the cost of insurance against loss by injury to persons or property, and an annual amount to be placed into a sinking fund sufficient to pay the bonds at or before maturity, all outstanding bonds issued on account of such undertaking shall be included in determining the limitation of the power of the City to incur indebtedness. 5. The bonds shall be general obligations of the City for the payment of principal of and interest on which its full faith and credit, as well as the net revenue from its water and sewer system, shall be irrevocably pledged. 6. The bonds shall not be issued until approved by a majority of the qualified voters of the City voting on the question of their issuance at an election to be held in the City. Any person conducting a business, occupation or profession, or doing other things for which a license tax is required under this chapter, without first obtain- ing the requisite license, or who shall fail to obtain any tag or sign required under this chapter, shall be guilty of a misdemeanor and, unless otherwise specifically provided by law, shall on conviction thereof be fined not less than five dollars nor more than one thousand dollars for each separate offense. Each day of default shall constitute a separate offense. Such conviction shall not relieve any such person from the payment of any license tax imposed by this ordinance. Section 20-8 When license taxes due and payable. At the March 8, 1977, meeting, the Planning Commission denied the subdivision variance request of the Bayside Christian Church. Bayside Christian Church owns two adjacent Parcels of land on Greenwell The first of 0.69 acres in size, tlie second (known as Lot A) is Rc)ad. acres. The zoning is R-6- 2.06 acres, and the total of the two is 2.75 The minimum lot size for the churches in all zoning districts is 3 acres, according to the Comprehensive Zoning Ordinance. The church property is, therefore, nonconforming as to size at the present time. The proposed subdivision plat would have further subdivided Lot A into two lots of 0.68 acres and 1.37 acres, neither of which meets the minimum lot size requirement of 3 acres. The City Manager stated at that time that, "selection of this individual would have to be agreeable to both parties, and payment for his services would be shared equally by both" (City and private utilities). The engineering form of liayes, Seay, Mattern and Mattern of Roanoke, Virginia, is acceptable to both the Director of Public Utilities and officials of Princess Anne, Aragona and Pembroke Utilities. The fixed maximum fee is not to exceed $33,300 for engineering, and $20,000 for any television examination of underground lines, if needed. The City's share, naturally, would be 501@- of these costs. It will consist of approximately 10,000 feet of 1211 ductile iron main with the necessary valves, hydrants, fittings and appurtenances and will extend from Oceana Boulevard along Old Dam Neck Road to the site of the Atlantic Waste- water Treatment Plant. Installation will include the necessary meter and meter box approved by the City. Exact route of the line will be subject to precise determination during the design stages. ARTICLE II: CONSTRUCTION Section 1. If the water main receives Federal approval and funding, The HRSD agrees to install the main as described herein at its expense including engineering, testing and chlorination, and further agrees to require its contractor to furnish bond to hold The HRSD and the City harmless to any liability arising from installation of the main and guaranteeing the work for 12 months after acceptance. Section 2. While at the proposed future canal crossing, the City would normally require an above ground crossing using pile bents, in the absence of information as to if and when the canal will be extended, and to save The HRSD construction costs, the City agrees to accept installation at minimum grade, and The HRSD agrees in return that if the canal is extended through the main location within ten years, The HRSD will pay the cost of relocating the main to provide for the canal extension. ARTICLE III: CONVEYANCE Upon completion of the main according to approved plans and specifications, including testing and chlorination, and approval by joint final inspection by The IIRSD and the City, The HRSD agrees to grant and convey free of any encumbrance and without cost to the City, The HRSD's right, title and interest in all portions of the main to and through the meter location. ARTICLE IV: WAIVER OF FEES In consideration of construction of this main as previously set forth and conveyance by The HRSD to the City, the City agrees to -2- waive connection fees (including tap fees and line fees) and also to waive the $100.00/hydrant fee. ARTICLE V: OPERATION AND MAINTENANCE Upon final approval and conveyance as set forth in Article III of the main, valves, hydrants, meter and other appurtenances, the City will accept, operate and maintain the aforesaid facilities as part of its municipal water system. Webbon, Clerk ITEM #10684 At the Council meeting of march 21, 1977, the City PAanager requested, and the Council agreed, to defer action on an ordinance approved by the Planning Commission, requiring restrooms for all full-service and self-service automobile service stations. The City Manager was of the opinion that the restroom requirement would be more appropriately addressed through Health Department regulation as opposed to a land- use regulation. There is no State Health Code requirement for restrooms at self- service gasoline stations because of the very short time period that customers typically stay at such an establishment, and full- service restroom requirements are adequately enforced by Title 39-, Section 32-63 of the Code of Virginia.
