Letter from the City Manager transmitting the recommendation of the Planning Commission for approval of the request of Harry H. and Anne W. Bonney for a change of zoning from R-5 Residential District to B-2 Community Business District on a .378-acre parcel located at the southwest corner of First Colonial Road and Wolfsnare Road (Lynnhaven Borough). 9. Letter from the City Manager requesting approval, on first reading, of an ordinance to accept a supplemental grant totalling $11,974 from the Division of Justice and Crime Prevention and to appropriate these funds. 6. Letter from the City Manager requesting approval of a resolution and authorization to him to submit same and other information and materials as may be necessary to the appropriate State and Federal agencies in order to permit the formulation, approval, and funding of a recreational boat launching facility at Pleasure House Creek. 7. Letter from the City Manager informing Council that the Department of Libraries has been notified by SEVAMP that it is being awarded $18,968 to fund the Department's project ACCESS. Funds totaling $5,645 have previously been budgeted as the City's share of this program. No additional personnel will be required after the end of the one year grant award period, it is therefore, requested by the City Manager that he be authorized to enter into the necessary agreements in order to accept this grant award and to allow the Library Department to initiate this program. 18. Letter from the City Manager informing Council that the Regional Juvenile Group IIome System, which is sponsored by Virginia Beach, Chesapeake, Franklin, Portsmouth and Suffolk, is presently pursuing commission status. As of January 1, 1977, the Board will no longer function as an operational board for the Group Ilome, however, the transition to commission status will not be completed until May or June of 1977. Therefore, City Manager requests approval to have Mrs. Ada Salsbury to continue as this City's representative on the Group Home Board. 19. Letter from the City Manager requesting approval for the following Bingo/Raffle permits: Star of the Sea Parish Board - Renewal Knights of Columbus, Father Nicholas J. Habets Council - Renewal 20. Old business, deferred from the previous meeting, including any report of the Mayor or committees named by Council. 21. New business, including any presentations by Council Members, citizens, and organizations. 22. Motion for adjournment. MINUTES OF THE HONORABLE CITY COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA January 10, 1977 The regular meeting of the Council of the City of Virginia Beach, Virginia, was called to order by Mayor Clarence A. Holland, in the Conference Room, in the Administration Building, Princess Anne Borough, on tionday, January 10, 1977, at 1:00 p.m. Council Members present: John A. Baum, Robert B. Cromwell, Jr., George R. Ferrell, John R. Griffin, Mayor Clarence A. Holland, J. Henry McCoy, Jr., Councilwoman Meyera E. Oberndorf, J. Curtis Payne, Roger L. Riggs, Vice Mayor Patrick L. Standing, and Floyd E. Waterfield, Jr. ITEM #10345 Mayor Holland entertained a motion to permit the Council to conduct an informal discussion to be followed by an Executive Session for the purpose of discussing the acquisition and disposal of real property and legal matters. On motion by Councilman Ferrell, seconded by Vice Mayor Standing, and by recorded vote as follows: Ayes: Councilmen John A. Baum, Robert B. Cromwell, Jr., George R. Ferrell, John R. Waterfield, Jr. Nays: None Absent: None City Council voted to proceed into Executive Session following the informal discussion. ITEM #10345(a) Attorney Bruce Mills, on behalf of himself as a property owner, discussed the construction of houses along the beachfront at Chesapeake Beach, a site plan approval having been denied by the Engineer Department as the site is partially under water on a normal high tide, and does not conform to the established City policy which prohibits construction below the six-foot contour line of the beach. While Mr. Mills conceded that a private individual might have some prescriptive rights regarding the property; he questioned the right of the City to condemn the property for public use upon that basis. Mr. Mills indicated that certain houses in the immediate vicinity to the east had been approved with a four-foot contour line within the past three and a half months (105 days). Mr. C. Habets Council - Renewal ITEM #10363 The City Clerk read the following letter from the City Manager: Dear Council Members: On December 14, 1976, the Planning Commission granted a variance in accordance with Section 9.3 of the Subdivision Ordinance to the developers of the Great Neck F@s subdivision in Lynnhaven Borough. This variance was to the requirement that the developer provide improvements and right- of-way dedication along Eastern Shore Road from Wildwood Drive north to Old Donation Parkway. Because I feel that this matter may have serious implications for other developments in the area and therefore deserves further considera- tion; this is to respectfully note an appeal to that decision in accordance with Section 9.4 of the Subdivision Ordinance. I expect to bring this matter before you at a later date after due notice is given. Cromwell, Jr. City Council voted to accept the letter from the City Manager re- garding the Subdivision Ordinance, Section 9.3, in relating to Great Neck Farm Subdivision, Lynnhaven Borough. ITEM #10364 Councilman Griffin introduced several gentlemen from the Lynnhaven Inlet area who had failed to register their wish to address Council on the matter of the dredging of Lynnhaven Inlet. The gentlemen: Mr. E. M. Davis, Mr. Charles Cashman, Mr. Bubba Fisher and Mr. Henry Braithwaite, are all owners or operators of business establishments at the entrance of Lynnhaven Inlet on the east side of the Inlet. The concensus of the address made by the gentlemen indicated that their request to have that portion of the Inlet lying between the sand island and the eastern bank of the inlet had been ignored by all parties concerned. The U.S. Army Corps of Engineers had indicated that the subject channel is not part of the main channel and therefore not the responsibility of the Corps to dredge and maintain, although they did remove a portion on the north side of the sand island, which obstructed the main channel. The gentlemen indicated that their rental boats were running aground and incurring damage, and on a low tide would be unable to even "drill" their way in or out of the Lynnhaven Inlet. They further submitted photographs depicting the discharge of dredged material from the highway bridge work on Great Neck Road, Route 615, over Long Creek which was being discharged into Long Creek and being carried downstream to silt up the boat channel under discussion. The representatives from the area indicated that since 1963 the date of merger they have been unable to obtain relief regarding the dredging and request the City @lanager, in his meeting scheduled with the Army -orps of Engineers, to plead for immediate relief and to determine to what extent the Army Engineers were held responsible in such matters in other political subdivisions, in that the silting of the inlet constituted a disaster for their business. Mr. Donald Frazier, Marine Surveyor for insurance companies, stressed the need for immediate relief to the subject applicants for dredging assistance in that it would be questionable if the boats using the inlet could obtain satisfactory marine insurance due to the losses being sustained resulting from grounding of the boats. He also stressed the need to review the run-off coming into Long Creek and adjacent bodies of water from ground water which carries a large portion of sand and gravel as well as contamination pollutants. City Council received the information and directed the City Manager to convey the problem to the Corps of Engineers, together with a request that the obtaining of spoil sites for the dredged material be expedited; through conferences with the Environmental Pollution Agency and the Virginia Department of Game and Fisheries. ITEM #10367 Councilman McCoy requested information from the City Manager regarding the delay of one month on the construction of two schools in the Kempsville Borough. If the delay is much longer the City will lose the bids. The City Manager stated that he will be bringing a recommendation for authorization of school projects prior to this bid running out, which according to Doctor E. E. Brickell, Superintendent of Schools, will be February 1, 1977. This matter will be brought back 1/17/77. ITEM #10368 Mayor Holland requested a resolution be prepared regarding the use of the Seashore State Park, lying on the northside of Route #60, for a Day Beach.
