The regular meeting of the Council of the City of Virginia Beach,
Virginia, was called to order by Mayor Clarence A. Holland, in the
Conference Room, in the Administration Building, Princess Anne
Borough, on Monday, January 17, 1977, at 1:00 p.m.
Council Members present: John A. Baum, Robert B. Cromwell, Jr.,
George R. Ferrell, John R. Griffin, Mayor Clarence A. Holland, J.

Mayor Ilolland entertained a motion to permit the Council to
conduct an informal discussion to be followed by an Executive
Session for the purpose of discussing the following:
1. Discussion of employment, assignment,
appointments, promotions, demotions,
salaries, discipline and resignations
of public officers, appointees or employees
of any public body.
2. Consultation with legal counsel and briefings
by staff members pertaining to legal matters
within foundation of public body.

City Council voted to adopt the following Resolution regarding the
sudden death of Mr. Kenned L. Jard:

By the adoption of this Resolution the City Council of
the City of Virginia Beach, Virginia does express to the
fainily of Kenned L. Jard their deep regret at the loss of one
of the leaders of this community, and does likewise honor him
as a citizen who has unstintingly contributed his services to
public endeavors, as a fo=er member of the Virginia Beach
School Board, a past President of the Board of Realtors of
Virginia Beach, a member of the Rotary Club, a charter member
of the Virginia Beach Rescue Squad and as a trustee of the
First Baptist Church of Virginia Beach and particularly of
his activities with the Boy Scouts, has clearly demonstrated
the teachings and principles of the Masonic Lodge and the
Khedive Shrine Temple to which he belonged.
NOW, THERFFORE-, by adoption of this Resolution which
the City Clerk is directed to include in today's minutes of
City Council the name of Kenned L. Jard is hereby honored.

Mr. Gerald liarris, Member on the Mayor's Committee on Sewer and
Water addressed CitY Council and read the following letter from
Vice Mayor Patrick L. Standing, Chairman of the Committee:
The Honorable Mayor,
Members of Council
Dear Council Members:
The Mayor's Committee on Sewer and Water has been meeting
twice weekly since before Christmas to seek solutions to our
problems with the sewer and water system. As reported to you
last week, we are in aqreement that there are several
recommendations that we can make to you prior to the presentation
of our final report. These recommendations from the Committee
come to you in an effort to set in motion immediate steps to
give firm policy direction in the oderation of our utility system
and to cbrrect some obvious problem areas. @qe anticioate that
on subsequent Dionday Council meeting dates, we will be forwarding
additional recommendations for Council to consider so that action
can be taken without delay.
The Cor@imittee states flatly that to do nothing with our
utility system is not an acceptable alternative. In discussion
with various individuals, both public and private, and with
systematic review of the Capital Improvement Program and the
consultants' report we are aware of serious and disturbing diffi-
culties in the City water and sewer system that can, and possibly
will, have disasterous impact on the public's health, safety and
welfare. We recommend the following:
1. We find that the three-year period allowed
property owners to connect to the utility system
is unreasonable in terms of operating a self-
supporting Department of Utilities. We concur
with the consultants' renort that mandatory
connections be made to t@e sewer and water system
by all property owners within one year. At present
this would furnish approximately 4,390 connections
to the City sewer system and (at $780 per connection)
raise an estimated $3,400,000. Water connections to
existing lines would a.,@iount to appro)-.imately 3,493
hookups and (at $500. per hookup) would raise an
estimated $1,700,000 in revenue. The combined total
in estimated revenue raised with mandatory hookups
would be $5,100,00G. It should be einphasized that
existing utility lines in the ground have already been
paid for by the taxpayers of the City and failure to
connect, or prolonged delay in connecting, is depriving
all taxpayers of a financial asset and contributes to
the pollution of our natural resources.
2. The Committee feels that the three-year maximum
period allowed by the City before requiring the
connection to publ@ic utilities has been very
lenient. Despite this leniency, there are approxi-
mately 190 property owners who have refused to
comply with the City Ordinance to connect within
the three-year period pe--iod. ile reco-Lmend immedial@e
prosecution in the courts to enforce connections
to public utilities. The magnitude of the court
cases and the impo--tance of mandatory connections
may require the retention of a sdecial prosecutor
working in conjunction with the City Attorney.
The Committee would like for the Council to consider immediately
the recommendations offered and hode that firm direc--ion afforded
by the governing body will lead to an understanding bv all citizens
of the grave situation that exists.

Vice Mayor Standing complimented the Committee Members for having
devoted their time on this, and informed Council that another
recommendation will be presented to Council the first week of
February.

Bolen, and the Virginia Beach State Representatives, and the South-
eastern Planning District Commission:

Councilman Baum read the following resolution and requested same
be placed on the Council Agenda for January 24, 1977:
R E 8 0 L U T I 0 N
WHEREAS, Common Cause of Virginia Beach has prepared, and
plans to introduce, legislation requesting that provisions of
Virginia's Freedom of Information Act be applied to the Virginia
General Assembly and all of its committees; and
WHEREAS, this proposed legislation would also require pro-
cedures for calling executive sessions of State agencies,
committees, and General Assembly Committees, to parallel those
currently applicable to local governments;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF TIIE
CITY OF VIRGINIA BEACH, VIRGINIA:
That the Council goes on record as supporting "a single
standard of morality" regarding "openness in government " or
"Sunshine Laws" applying equally to all levels of United States
Government (local, State and Federal); and encourages its local
General Assembly representatives to support either of the following
alternatives:
1. Application of those existing State Laws
regulating local governments to also affect
the General Assembly as proposed by Common
Cause; or
2. If, after reflection, the General Assembly
believes that the suggested modifications
are too restrictive for reasonably honorable
people to responsibly perform their duties
as elected officials; and, if after additional
consideration, the General Assembly finally
realizes that in exempting itself from provisions
of the FOIA, it indicates that its sense of
legislative morality is greater than that of
local government, and, because the General Assembly
will want to erase this false impression by striving
for consistancy, it is encouraged to extend to
local governments the same exemption from the
provisions of the FOIA that it currently enjoys.

Councilman Cromwell discussed with Council the efficiency of
"Operation Seawall" and stated he thought the parties involved
should be complimented for a job well done, especially in view
of the fact that there was no loss of life.

Councilwoman Oberndorf made a motion to direct the City Attorney
to obtain a copy of the solicitation ordinance from the Commissioner
of Revenue for the City of Norfolk, which was adopted in November
of 1976, and adapt it to our solicitation ordinance so that it can
be considered for adoption by this City Council no later than
February 7, 1977, seconded by Vice Mayor Standing, and by recorded
vote as follows:
