Jack Jennings appeared before Council witli the Crime Prevention Steering Committee to present their status report. The Committee first began in August of 1977, when a group of concerned citizens began meeting informally to discuss the need for a Community- Police partnership regarding crime prevention in the City. The Committee is com-Drised of approximately 9-5 volunteers and service organizations, along with police representation. The Committee has been meeting every two weeks on Mondays. 5 / 2 2 / 7 8 - 2 - *COUNCILMA,'i CROMWELL ENTERED MEETING AT 1:08 p.m. Mr. Jennings introduced @Irs. Alary Russo, who serves as the Committee's Public Relations Chairperson. @,,Irs. Russo stated that the press media has helped overwhelmingly in the Committee's "People lfelp Pec)ple" pro,iect. ITEill #12184 Senator A. Joseph Canada appeared befor-- Council regarding a letter he had written to Council concerning the use of the old incinerator site off of Laskin Road. The City Manager stated that the legal matters should be clarified in the near future, and the bids will be brought before Council for their approval. ITENI #12185 The City Manager stated that Councilman @IeCoy had forwarded a letter to Council regarding tlie appointment of a "Growth Committee". Councilman McCoy stated that he has received many comments on this particular proposal, and was requesting Council's opinion on the formation of this Committee. Jay Condrey, Youth @layor, appeared I)efore Council to present the Youth Council's annual report. Mr. Condrey thanked the Council and City employees for making Youth in Government Day an interesting and edtication experience for the P,Iayor's Youth Council. The Mayor's Youth Council represents their peers to the best of their ability, so @vhen they take a stand on an issue the Youth Council is representilig all of the youth in the Cit:y of Virginia Beach. At the request of the Mayor's Youth Council, Mayor Holland proclaimed the week of January 16 through 0-2, 1978, at "Drug Prevention Week." 5 / 2 2 / 7 8 - 3 - Th@ Legislative Committee lias been monitoring State and City legislation that could affect the youth of Virginia Beach. 'Ar. Condrey also stated that a student should be appointed to the Virginia Beach School Board to present the youth's side of a part- icul.ar issue. Subject to the provisions of Chapter 2, Article III, of the Virginia Beach City Code, the salaries and wages set forth in detail in said Annual Budget, are hereby authorized and fixed as the maximum compensation to be paid for services rendered. The total of positions, shall be the maximum number of positions authorized for the various departments of the City during said fiscal year unless authorized by the Council. The City Manager may from time to time increase or decrease the number of positions in the labor class provided the aggregate amount expended for such services shall not exceed the respective appropriations made therefore. The City Manager is authorized to make such rearrangements of positions within bureaus and divisions named herein, as may best meet the uses and interests of the City. Section 3. All collections of delinquent City taxes shall be credited to the General Fund of the City by the Treasurer. Section 4. All collections of local taxes levied shall be credited to the General Fund of the City. Transfers shall be made from the General Fund to the respective specially designated funds for which a levy is made in the respective amounts levied for each such specially designated fund. Section 5. All tax abatements and tax supplements dated subsequent to June 1, 1979 for the FY 1979 tax year shall accrue to the General Fund of the City. Section 6. All balances of the appropriations payable out of each fund of the City Treasury unencumbered at the close of business on the thirtieth (30th) day of June, 1979, except as otherwise provided for, are hereby 5 / 2 27 8 - 3 3 - declared to be lapsed into the surplus of the respective funds, except School Operating Fund which shall lapse into the General Fund Surplus, and shall be used for the payment of the apporpriations which may be made in the appropriation ordinance for the fiscal year beginning July 1, 1979. Section 7. No department, agency, or individual receiving appropriations under the provisions of this Ordinance shall exceed the amount of its or his appropriations except with consent and approval of the City Council first being obtained, but it is expressly provided that the restrictions with respect to the expenditure of the funds appropriated shall apply only to the totals for each department, agency, or individual included in this Ordinance. The City Manager is hereby authorized to approve transfers for appropriations within any department or between departments in an amount not to exceed $5,000 in any single transaction, and further, he is authorized to approve transfers and expenditures from the Reserve for Contingencies in an amount not to exceed $5,000 in any single transaction. In addition, the City Manager may limit expenditures to classes of appropriations as set forth in the budget document. Section 8. Section 10. All traveling expense accounts shall be submitted on forms approved by the Director of Finance and according to regulations approved by the City Council. Each account shall show the dates expenses were incurred or paid; number of miles traveled; method of travel; hotel expenses, meals and incidental expenses. The Director of Finance is specifically directed to withhold the issuance of checks in payment of expense accounts submitted for "lump-sum" amounts, except in the case of Council Members and employees of the School Board. Tow Truck Service Operations - Definitions. Unless a different meaning is required by the context, the following terms as used in this ordinance shall have the meaning hereinafter respectively ascribed to them: (a) "Tow Truck Service" means a person engaged in the businessof providing the services of one or more wreckers for hire or used to tow, trans,oort or move motor vehicles on public streets or on or from private property by way of public streets. (b) "Person" is a natural person, firm, partnership, association or corpora- tion and their legal successors. (c) "Operator" means any person operatina a tow truck for a tow truck service. Section 22-149.3. Same - Enforcement of private parking by towing. Each owner of private property conducting a business and offering parking to customers who intends to enforce parking restrictions by the use of tow truck service shall post, at each point of ingress and egress to the parking area, clearly legible signs containing the following, or substantially the same, wording: PRIVATE PARKING - CUSTOMERS ONLY Unauthorized cars towed at owner's expense. Call 427-5000 for location of and information concerning return of car if car towed. Section 22-149.4. Same - Tow truck service storage yard operation. (a) At the storage yard of each tow truck service, there shall be a sign prominently displayed specifying tow and storage rates. (b) If an attendant is not on duty 24 hours a day, seven days a week, to return cars upon the payment of towing and storage charges, the sign provided for in subsection (a) hereof shall also contain a telephone number where the owner, manager or attendant of the tow truck service storage yard may be reached at any time so that a towed car may be reclaimed by its owner in a minimum amount of time not to exceed two hours. (c) Each tow truck service storage yard shall provide reasonable security and protection for all cars towed,, including a fence enclosin," the storage yard. 5 / 2 27 8 - 3 9 - Section 22-149.5. Same - Police to be notified. Prior to or simultaneously with the removal of any car by a tow truck service operator, the Police Dispatcher shall be notified in accordance with the provisions of Section 22-149. Section 22-149.6. Same - Tow truck service operator's log. Tow truck service operators shall keep a log of all cars towed including the make, model and year, if known, of the car; its license number and state of issuance; time and date of tow; and for each entry of tow, the signature of the owner of the private lot or his representative requesting and authorizing the tow shall be required. A letter of authorization shall be sufficient to meet this requirement. Such log sh I be available for inspection by the City of Virginia Beach Police Department during normal business hours of the tow truck operator. Failure to keep such a log shall be unlawful. Section 22-149.7. Same - Procedure when owner returns after tow truck service arrives, but before tow is started. If the owner of any car not authorized to be parked in a private lot returns after a tow truck service has arrived but before the car has been towed from the private lot, the owner thereof may reclaim his car by paying an amount not to exceed the minimum towing fee, but no storage charge may be required. Section 22-149.8. Same - Signs on tow trucks. All tow trucks operated by a tow truck service shall display the name, address and telephone number of the operator thereof on both sides of said tow truck in letters large enough to be readily legible, but in no case less than one inch in height. Section 22-149.9. Same - Penalty for violation. It shall be unlawful for any person to violate or refuse, fail or neglect to comply with any of the above provisions. Each day of any violation of the provi- sions of any section of this ordinance shall constitute a separate violation. Any person found guilty of violating any provision of this ordinance shall be guilty of a Class IV misdemeanor and, upon conviction, shall pay a fine of not more than one hundred dollars. Section 22-149.10. Same - Applicability. The provisions of sections 22-149.2 through 22-149.9 shall apply only to tow truck services which tow vehicles on or from privately owned lots or property at the request of the owner of such lot or property and without the consent of the owner of the vehicle towed.
