The regular meeting of the Council of the City of Virginia Beach,
Virginia, was called to order by Mayor Clarence A. Holland, in the
Conference Room, in the Administration Building, Princess Anne
Borough, on @,londay, January 30, 1978, at 1:00 p.m.
Council Members present: John A. Baum, George R. Ferrell, John
R. Griffin, Mayor Clarence A. Holland, J. Henry McCoy, Jr.,
Councilwoman Meyera E. Oberndorf, J. Curtis Payne, Roger L.

Mayor Holland entertained a motion to permit Council to conduct
an informal session to be followed by an executive session for
the Durpose of discussing the following:
1. Discussion or consideration of emplovment,
assignment, appointment, promotion, demotion,
salaries, discipline or resignation of public
officers, appointees or employees of any public
body.
2. Discussion or consideration of the condition,
acquisition or use of real property for public
purpose, or other disposition of publicly held
property.
3. Consultation with legal counsel and briefing
by staff members, consultants, or attorneys per-
taining to actual or potential litigation, or other
legal matters within the jurisdiction of the public
body.

City Council voted to proceed into the executive session following
the informal meeting.

The City Manager stated that he and several members of Council
initiated a discussion on the Marine Patrol Unit concerning the
jurisdictional limits between the City of Virginia Beach and the
Coast Guard.
Rear Admiral J. E. Johansen, U. S. Coast Guard, appeared before
Council at the informal meeting and stated that the Coast Guard
has no jurisdictional limits per sa. The Coast Cuard will go
to the shore line, anC if a boater is in trotible and asks for
help the Coast Guard will respond.

Mayor Holland stated that several mer-.bers of the Legislature visited
the Tidewater area this weekend, and it proved to be a most informative
and well-organized tour.

Mayor Holland informed Council of an invitation for them to be present
at the Bayside Library on Tuesday, January 31, 1978, at 2:00 p.m.

Mayor Holland stated that there has been considerable discussion
regarding solid waste. On April 4 - 6, 1978, the Environmental
Protection Agency is holding a Resource Recovery -lechnology Seminar
in Orlando, Florida.

Mayor Holland informed Council of a letter he received from Senator
A. Joseph Canada regarding a bill he has introduced in the General
Assembly.

Mayor Holland stated that in the Legislative tours it was evident that
the Legislature is not intending to introduce any types of taxing
powers for localities, nor are they going to increase any taxes.

a three-member committee of the Council to oversee in the budget
review process the salaries for the persons appointed by Council.

THE PURPOSE OF UPGRADING THE I.IARINE
PATROL UNIT BY ACQUIRING THREE ADDITIONAL
VESSELS AND REPAIRING OTHERS
WHEREAS, the policing of the beach area is a responsibility
of the City of Virginia Beach, and
WIIEREAS, a Marine Patrol Unit is necessary to assure the
policing of the water portion of the beach area, and
WIIEREAS, the Marine Patrol Unit does not have a sufficient
number of vessels to patrol the water areas for whicli it is
responsible.
NOW, THEREFORE, be it ordained by the Council of the City
of Virginia Beach, Virginia:
THAT funds in the amount of $56,000 be appropriated to
the Police Department from Unappropriated Surplus for the purpose
of acquiring three additional patrol vessels and repairing two
existing patrol vessels.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA:
That Section 22-153 of the Code of the City of Virginia Beach, Virginia,
is amended and reordained to read as follows:
Section 22-153. Installation, operation and maintenance of meters; display of
signals generally.
In the parking meter zones established by section 22-151 and in such other
parking meter zones as may be hereafter created by ordinances of the city, the city
manager shall provide for the installation or placing of parking meters and the re-
gulation, control, operation and use thereof in accordance with the provisions of
this article and shall maintain such meters in good working condition. Such parking
meters installed in a parking meter zone shall be placed upon the curbing immediately
adjacent to individual parking spaces, which are to be designated as provided in
section 22-154. Each parking meter shall be placed or set in such a manner as to
show or display a signal that the parking space assigned to it is or is not legally
in use. Each parking ineter installed in the parking meter zones referred to in
the foregoing provisions of this section shall be installed and set to display, upon
deposit of a coin of the United States of America therein, a signal indicating legal
parking time for the time allotted for such coin for the part of the street upon
which such meter is placed. Each meter shall be so arranged that upon the expiration
of such parking limit, or the portion thereof for which the necessary coin or coins
have been deposited on the basis of twenty cent,, ppr hoiir, it will indicate by
mechanical operation and proper signal that the lawful parking period has expired.
This ordinance shall be effective from date of adoption.

WHEREAS, the Council of the City of Virginia Beach, on January 16,
1978, approved an ordinance vacating a certain portion of Great Neck Road
designated by the shaded area on that certain plat entitled, "Plat Showing
Residue Property of Parcel 095 Great Neck Road, Lynnhaven Borough,"pursuant to
a petition duly filed by the City of Virginia Beach and upon the recommendation
of the Planning Commission; and
WHEREAS, by the adoption of said ordinance vacating said street the
abutting property owners became vested with the simple interest in and to the
western one-half of said street and the City of Virginia Beach became vested
with the eastern one-half of said street; and
WHEREAS, the City of Virginia Beach has no need for this property;
and
WHEREAS, it is in the best interest of the public, the City of Virginia
Beach and the abutting land owners for the City to relinquish the interest the
City may have in the portion closed.
THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH,
VIRGINIA:
That the City Manager is hereby authorized to grant and convey a quit-
claim deed to the above interest the City may have in the eastern one-half of the
property closed and convey this interest to the adjacent property owner, Tidewater
Westminister Homes, Inc.

Councilman Baum congratulated John Allgood on his article regarding
the City Treasurer and his investigative reportin,- on the problems
of Oceana Naval Air Station.

Councilwoman Oberndorf stated that on Thursday she attended a play
at the Virginia Beach Recreation Center, and during the performance
the wind and rain hitting the roof made it almost impossible to hear
the performance.
Councilwoman Oberndorf requested the City Manager to check into
this problem for a possible solution.
ITEM #11734
Mayor Holland requested that at next weeks meeting, February 6, 1978,
appoint the committee to study salaries of persons appointed by the
Council.
The City Attorney is to see if the committee, which will consist of
Council llembers, can have more than two members.
ITEM #11735
Mayor Holland stated that the Eastern Virginia Health Systems Agency,
Incorporated, which is an agency that oversees the planning for health
problems in our Planning District plus two or three of the Planning
Districts on the north side of the James River, has decided that due
to the vastness of the area they will form two sub area Councils who
will report to the main agency.
The Agency requested the Council to provide two consumers of health
care. A consumer is one who is not a direct provider, sucb as a
physician, dentist, nurse, pharmacist; an indirect provider, such
as a member of a hospital board, cannot be a member of an immediate
family receiving more than 1/10th of its gross annual income from an
entity providing health services.
Mayor Holland requested these appointments be placed on the Council-
a,.,%enda for February 6, 1978.
ITEM #11736
Mayor Holland stated that Council zoned a piece of property near
Linlier, just west of Linlier, on which is a strip of land which
houses were to be constructed. The City has required curbing and
guttering in the stipulations. The residents in Linlier have re-
quested that curbing and guttering be omitted from the stipulations.
Mayor Holland stated that if Council is agreeable the minutes could

that the curb, gutter and storm drain along Windwood Drive, on the
left side of Windwood Drive, which is to be developed to single-family
residential be waived in keeping with the east side of the Drive; and
further that any improvements to the parcel being dedicated to the
civic league be made at the time of the development of that Darcel of
property.
There being no second, Councilman McCoy offered a substitute motion
to table for one week the above motion of Councilman Griffin, seconded
by Councilman Baum, and by recorded vote as follows:

Mayor Holland stated that he has been receiving from the Virginia
Municipal League a series of bills that have been introduced in
the General Assembly, and corrections to the bills, in order to
keep the people abreast of what bills have been introduced.
Mayc)r Ilolland stated if a-ny member of Council wishes copies of
these he will have them duplicated and forwarded to them.
ITEM #11738
The City Manager stated that at next week's Council meeting he will
be bringing up for Council's approval a request made by the Information
Center of Ilampton Roads.
The Center works much the same way as the City's Ilot Line Office,
however, they cover all Planning District jurisdictions. The Center
is concerned with human resource activities, and the availability of
such human resource data.
-The main use in the channeling of information is in the areas of
mental health, mental retardation, social services, public health,
Pendleton Project, especially in Virginia Beach, in trying to direct
people to the proper agencies.
ITEM #11739
The City @.lanager stated that although the City has a beautiful
Municipal Complex there are no eating facilities for the employees,
which has caused loss in manpower and workinl- time.
In the Operations Building there will be available space for future
growth, however, the Virginia Division for the Visuall@, Handicapped
offers the services that many other governmental agencies take
advantage of in the form of a cafeteria.
The Commission on the Visually Handicapped employs an individual
who is blind, establishes him in business, furnishes the individual
with all of the equipment, installs the equipment for the cafeteria
into an area such as the Operations Building, which allows short-
order cooking along with a snack bar. This will be a great benefit
to the City, however, if the space is needed the cafeteria will be
removed. There will be no charges incurred by the City on this
matter.
