The City Council of the City of Virginia Beach, Virginia, will assemble in
the Administration Building, Princess Anne Station, Virginia Beach, Virginia,
in Regular Session, at 1:00 p.m., on Monday, November 1, 1976, for the pur-
pose of conducting public business and will hear and act upon the following
items:
1. Call to order by the Honorable Clarence A. Holland, Mayor, in the Council
Conference Room.
2. Roll Call of the Council.
3. Motion and Roll Call to recess into Informal Discussion and Executive
Session. Upon conclusion of the Executive Session, City Council will
reconvene in the City Council Chambers.
4. Invocation will be given at 2:00 p.m. by Father Paul Gaughan, Star of
the Sea Catholic Church, Virginia Beach, Virginia. Please remain
standing for the Pledge of Allegiance.

6. Minutes of the Regular Meeting of October 25, 1976, to be presented for
approval and acceptance.
7. No items for Second Reading.
8. Letter from the City Manager recommending that City Council approve an
ordinance to amend and reordain Article II, Chapter 17, of the Code of
the City of Virginia Beach relating to notice from Director of Permits
and Inspections as to removal of trash, debris, weeds etc. from land or
premises.
9. Letter from the City Manager recommending that City Council approve a
budget transfer from the reserve accounts to the respective bureaus
within each of the funds as follows:
General Fund $765,717
Water & Sewer Fund 48,895
TOTAL $814,612
A cost of living increase was authorized by City Council to be effective
October 1, 1976. Funds for the increase were included in the budget in
lump sum as reserve for contingencies for salary adjustments.
10. Letter from the City Manager recommending that City Council approve the
bid of Carl J. Snowden, in the amount of $3,000 for City owned property,
formerly owned by James Shaw; and further authorize the transfer of the
deed to Mr. Snowden.
11. Letter from the City Manager recommending that City Council approve the
following standard water/sewer agreements:

The regular meeting of the Council of the City of Virginia Beach,
Virginia, was called to order by @layor Clarence A. Holland, in the
Conference Room, in the Administration Building, Princess Anne
Borough, on Monday, November 1, 1976, at 1:00 p.m.
Council Members present: John A. Baum, Robert B. Cromwell, Jr.,
George R. Ferrell, John R. Griffin, Mayor Clarence A. Holland,
J. fienry iMcCoy, Jr., Meyera E. Oberndorf, J. Curtis Payne, Roger
L. Riggs, Vice Mayor Patrick L. Standing, and Floyd E. Waterfield, Jr.

Mayor Holland entertained a motion to permit the Council to conduct
an informal discussion to be followed by an Executive Session for
the purpose of discussing financial matters and realestate.
On motion by Councilman Riggs, seconded by Vice Mayor Standing,

City Council approved the following ordinance to amend and reordain
Article II, Chapter 17, of tlie Code of the City of Virginia Beach,
relating to notice from Director of Permits and Iiispections:
AN ORDINANCE TO AMEND AND REORDAIN
ARTICLE II, CHAPTER 17, OF THE CODE
OF THE CITY OF VIRGINIA BF-ACH, RE-
LATING TO NOTICE FROM DIRECTOR OF
PERMITS AND INSPECTIONS
ARTICLE II: Notice from Director of Permits and Inspections as to
Removal of Trash, Debris, Weeds, etc., from Land or
Premises.
Section 17-25. Authority for, and purpose of, enactment of article.
This article is enacted pursuant to Code of Virginia, Section 15.1-11,
and in order to promote the general welfare of the city and the safety,
health, peace, good order, comfort, convenience, and morals of its inhabi-
tants.
Section 17-26. Duty of Director of Permits and Inspections to give.
Upon determination by the Director of Permits and Inspections, in
conjunction with the Director of Public Health, br their agents t at t ere
exists upon any land or premises wit in t e city, including the area in
front of such land or premises extending to the curb line, any trash,
garbage, litter, and other like substances, or that there exists on such
premises any grass, weeds or other growth which might endanger the health,
or safety of other residents of the city, notice shall be served on the owner
or his agent and the occupant of the land or premises to cause such trash,
garbage, refuse, litter, and other like substances or grass, weeds, or other
growth which might endanger the health or safety of other residents to be
removed or cut and removed from such land or premises within five days from
the date of such notice.
Section 17-28. Manner of service.
Notice, as provided for in section 17-26, shall be sent by registered
or certified mail.
If the owner or his agent or the occupant of the land or premises cannot
be found, notice required by Section 17-26 may be given by publication for three
consecutive days in a daily newspaper of general circulation in the city.
Section 17-30. Procedure upon failure, neglect or refusal of recipient to
comply therewith -- Generally.
Upon the failure, neglect or refusal of any owner, agent, or occupant
of the land or premises upon whom notice has been served, as provided in
Section 17-28, to remove or cut and remove such trash, garbage, litter or
other like substances or grass, weeds, or other growth which might endanger
the health or safety of other residents of the city lying or located on the
property in question within the time indicated in the notice, the City Manager
or his agent may have the requisite work done by city forces or by contract.
The actual cost of such work shall be charged to the owner of the land or
premises, upon whom such notice was served.
Section 17-31. Same -- Billing and collection of charges.
When the city manager has accomplished the removal or cutting and removal
of trash, garbage, litter, or other like substances or grass, weeds, or other
growth, he shall bill the owner of the land for the cost of such removal or
cutting and removing and the cost of publication, if any. If such bill is
not paid within (30) thirty days, the city manager shall transmit such bill
to the city treasurer who shall include such amount in the next regular tax
bill of the owner of such property. Every charge authorized herein which remains
unpaid shall constitute a lien against such property and may be collected as
taxes and levies are collected.
Section 17-32. Failure, etc., to comply as misdemeanor.
In addition to the remedies set forth in sections 17-30 and 17-31, the
failure, neglect or refusal of an owner, agent, occupant or lessee of land
or premises, or owner or beneficiary of an easement or other right to use
such land or premises to comply with the terms of a notice served as provided
in section 17-28, after the expiration of the time provided for in such notice,
shall constitute a misdemeanor and shall be punishable by a fine of not less
than five dollars nor more than twenty-five dollars. Each day of wilful
refusal or failure to comply shall constitute a separate offense.

Mr. J. Roy Alphin, Chairman, Virginia Beach Bicentennial Commission,
appeared before City Council and presented Council with a letter from
the President of the United States commending the officers and members
of the Commission on their dedication of a memorial honoring French
Admiral Count Joseph Paul DeGrasse, who played a decisive role in our
Revolutionary War.
