WEBBON, Cily Cl@,k The City Council of the City of Virginia Beach, Virginia, will assemble in the AdministratiOn Building, Princess Anne Borough, Virginia Beach, Virginia, in Regular Session, at 1:00 p.m., On Monday, August 1, 1977 for the purpose of conducting public business and will hear and act upon the following items: 1. Call to order by the Honorable Clarence A. Holland, Mayor, in the Council Conference Room. 2. Roll Call of the Council. 3. Motion to recess into Informal Discussion and Executive Session. Upon conclusion of the Executive Session, City Council will reconvene in the City Council Chambers. 4. Invocation will be given at 2:00 p.m., by the Reverend Junis Foster, Thalia Lynn Baptist Church, Virginia Beach, Virginia. Please remain standing for the Pledge of Allegiance. 5. Roll Call of the Council, Public Hearings and consideration of Public Business. a.) Resolution of Approbation in regard to issuance of $125,000,000 of General Obligation Bonds of the Commonwealth of Virginia which will be placed before the voters for approval at the general elections in November. b.) Resolution of Appreciation to Mr. Kurt Peterson and Mr. Jerry Lucas. 6. Minutes of the Regular Meeting of July 25, 1977 to be presented for approval and acceptance. 7. No Items for Second Reading. 8. Letter from the Acting City Manager recommending that City Council approve an ordinance to amend Chapter 13, Sections 13-1 and 13-2 of the Code of the City of Virginia Beach, and to prescribe election districts and voting places within the City of Virginia Beach. 9. Letter from the Acting City Manager recommending that City Council authorize the City Manager to enter into the necessary agreements for the purchase of property which would be required for the extension of Little Neck Road. The initial appraisal prepared on this property indicated the estimated market value to be $137,000. This offer was subsequently made to the owner, and he advised he would accept $140,000 as total compensation for this property. Funds are available. 10. Letter from the Acting City Manager, on first reading, recommending that City Council approve an ordinance to adjust appropriations in the F-Y 1977 appropriations ordinance. 11. Letter from the Acting City Manager recommendiiig that City Council approve an ordinance to amend and reordain Section 22-160 of Article VII of Chapter 22 of the Code of the City of Virginia Beach pertaining to parking violations, and an ordinance to amend and reordain Section 22-134.1 of Arti(!le VI of Cliapter 22 of the Co(le of t!ie City of Virginia Beach pertaining to parking violations. 12. Letter from the Acting City Manager recommending that City Council approve an ordinance 13. Letter from the Acting City Manager recommending that City Council approve the low bid of Central Builders, Inc., in the amount of $618,057.00 for the Virginia Beach Boulevard Water Line, Section III - Project #5-901 (Lynnhaven Borough) and authorize the City Manager to execute the necessary documents to implement the project. Funds for this project are available in CIP No. 5-901. 14. Letter from the Acting City Manager recommending that City Council approve the low bid of M. E. Wilkins, Inc., in the amount of $255,242.00 for the Great Neck Estates Sanitary Sewerage - Project No. 6-700 (Lynnhaven Borough) and authorize the City Manager to execute the necessary documents to implement the project. Funds for this project are available in CIP No. 6-700. 15. Letter from the Acting City Manager recommending that City Council approve State-Local Hospitalization contracts. As you are aware, the State pays 50% of the cost, with the municipality paying the remaining 50%. City Council is further requested to authorize the City Manager to execute them on behalf of the City. 16. Letter from the Acting City Manager recommending that City Council approve the following Raffle permit: Ladies Auxiliary Fleet Reserve Association (renewal) 17. Letter from the Acting City Manager recommending that City Council approve the request of Mr. V. A. Etheridge, City Treasurer, for tax refunds in the amount of $484.05. 18. Old business, deferred from the previous meeting, including any report of the Mayor or committees named by Council. 19. New business, including any presentations by Council Members, citizens and organizations. 20. Motion for adjournment. MINUTES OF TIIE HONORABLE CITY COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA August 1, 1977 The regular meeting of the Council of the City of Virginia Beach, Virginia, was called to order by Mayor Clarence A. Holland, in the Conference Room, in the Administration Buildin--, Princess Anne Borough, on Monday, August 1, 1977, at 1:00 p.m- Council Members present: John A. Baum, Robert B. Cromwell, Jr., George R. Ferrell, John R. Griffin, Ilayor Clarence A. Holland, J. Henry McCoy, Jr., Councilwoman @leyera E. Oberndorf, J. Curtis Payne, Roger L. Riggs, Vice Mayor Patrick L. Standing, and Floyd E. Waterfield, Jr. ITEM #11101 Mayor Holland entertained a motion to permit the Council to conduct an informal discussion to be followed by an executive session for the purpose of discussing the following: 1. Discussion or consideration of employment, assignment, appointment, promotion, demotion, salaries, discipline or resignation of pliblic officers, appointees or employees of any public body. 2. Discussion or consideration of the condition, acquisition or use of real Droperty for public purpose, or other disposition of publicly held property. 3. Consultation with legal counsel and briefing by staff members, consultants, or attorneys per- taining to actual or potential litigation, or other legal matters within the jurisdiction of the public body. On motion by Councilman Waterfield, seconded by Vice Mayor Standing, and by recorded vote as follows: Ayes: Councilmen John A. Baum, Robert B. Cromwell, Jr., George R. Ferrell, John R. Waterfield, Jr. Nays: None Absent: None City Council voted to proceed into the Executive Session following the informal discussion. ITEM #11102 Mayor Holland stated the House Public Works Subcommittee on Trans- portation has submitted a bill that there will be a five-cent increase in gasoline, with an amendment that half of that, or $2.7 Billion, would be directed to local public transportation. Mayor Holland stated that he would send a telegram to our representatives asking they support the amendment whereby half of the increase would be directed to local public transportation. 8/1/77 - 2- ITEM #11103 The City Manager stated that on the 16th of August, at 7:30 p.m. the Chesapeake City Council and the Tidewater Transporation District Commission will hold a joint Public Hearing regarding the possibility of eliminating four (4) bus routes on a bus line in Chesapeake. One of the routes, Indian River Road down to Virginia Beach, is the City's Route #12. Should the Tidewater Transportation District Commission and the City of Chesapeake see the need to eliminate this route Virginia Beach should consider eliminating this portion of the route. ITEM #11104 The City Manager stated that the City has been under the impression that a Borough could not be divided into election districts; however, the City has been advised by the State Election Office that if Council wishes to divide the Borough it should be done by Resolution and for- warded to the State Election Office for their consideration. ITEM #11105 At 2:00 p.m., City Council reconvened in the Council Chambers with the following Members present: John A. Baum, Robert B. Cromwell, Jr., George R. Ferrell, John R. Griffin, J. Holland City Council voted to adopt a Resolution of Appreciation in regard to issuance of $125,000,000 of General Obligation Bonds of the Commonwealth of Virginia which will be placed before the voters for approval at the general election in November. - 3 - RESOLUTION OF APPROBATION WHEREAS, THE GENERAL ASSEMBLY OF VIRGINIA AFTER DUE AND DELIB- ERATE CONSIDERATION HAS ADOPTED A BILL AUTHORIZING AN ISSUANCE OF $125,000,000 OF GENERAL OBLIGATION BONDS OF THE COMMONWEALTH FOR THE PURPOSE OF SATISFYING THE REQUIREMENTS OF THE STATE FOR EDUCATIONAL FACILITIES, OUTDOOR FACILITIES, IMPROVED PENAL FACILITIES AND RECON- STRUCTION OF PORT FACILITIES IN THE TIDEWATER AREA TO PROTECT AND PROMOTE A HEALTHY ECONOMY IN THE TIDEWATER AREA AND IN THE STATE AND NATION; AND, NOW, THEREFORE, THE MEMBERS OF THE VIRGINIA BEACH CITY COUNCIL AND THE REPRESENTATIVES FROM THIS AREA IN THE GENERAL ASSEMBLY INDI- VIDUALLY AND JOINTLY CALL UPON THE CITIZENS OF THIS CITY AND OF THE TIDEWATER AREA TO SUPPORT AND WORK FOR THE APPROVAL OF THIS BOND ISSUE WHEN IT COMES BEFORE THE PEOPLE TO BE VOTED UPON IN ORDER TO ASSURE THAT MUCH NEEDED AND LONG DELAYED CAPITAL IMPROVEMENTS OF GREAT IMPORTANCE TO THE HEALTH, WELFARE AND SECURITY OF THE PEOPLE MAY BE BEGUN AND COMPLETED. HOLLAND, MAYOR 8/1/77 ITEM #11107 -4- Vice Mayor Standing presented the following Resolution of Appreciation to Mr. Kurt Peterson and Mr. Jerry Lucas for assisting Mr. Robert E. Cuthrill, III, during an attack on he and his family. RESOLUTION OF APPRECIATION WHEREAS, on July 4, 1977, Mr. Kurt Peterson and Mr. Jerry Lucas, while enjoying the r6creational facilities at Princess Anne Park, did observe a man, accompanied by. his wife and child, being beaten upon by several youths, iiho in the course of the altercation discharged a revolver which did wound the man; and WHEREAS, Mr. Peterson and Mr. Lucas observing the seriousness of the attack did without hesitation and at, great risk to themselves proceed to assist the man, Mr. Robert E. Cuthrill, III, and in so doing demonstrated their concern for the welfare and safety of their fellow citizen. NOW, THEREFORE, in recognition of their unselfish and brav6 conduct during this regretable incident, the City Council of the City of Virginia Beach does direct the City C16rk, to enter this Resolution of Appreciation to Mr. Kurt Peterson and Mr. Jerry Lucas in the minutes of this day's meeting as a matter of permanent record in their honor. Specifically, it is felt that the Courthouse District, because of the large number of registered voters now living in same, should be further divided. Traffic counts and changing traffic patterns necessitate this extension. Officials of the Office of Real Estate have recently secured an executed Agreement of Sale covering the acquisition of the subject property which would be required for tile extension of Little Neck Road. The initial appraisal prepared on this property indicated the estimated market value to be $137,000, This offer was sub- sequently made to the owner, and he advised he would accept $140,000 as total compensation for this property. Therefore, City Council voted to authorize the City Manager to enter into the necessary agreements for the purchase of this property. Waterfield, Jr. Nays: None Absent: lqone In order to clarify the time period within which an individual must pay a parking violation fine, City Council voted to adopt the following ordinance to amend and reordain Section 22-160 of Article VII of Chapter 22 of the Code of the City of Virginia Beach pertaining to parking violations: @ (.)Eu-LNAN(z -Lu @t) AND REORDAIN SECTION 22-160 OF ARTICLE VII OF CHAPTER 22 OF THE CODE OF UM CITY OF VIIUINTA PERTADENG TIO PARKING VIOLATIONS BE IT 0 BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA: That Section 22-160 of Article VII of Chapter 22 be ed and reordained as follows: Section 22-160. Pa@t by @er of stipulated penalty within three imrking days of the City Bach owner, after a notice is attached to the vehicle in question, as provided in Section 22-159, shall pay a penalty of three dollars for each hour or fraction thereof duri,ng which such vehicle occupied a parking imter space illegally. Such payimnt shall constitute a plea of guilty of the violation in question and is payable at any offioe of the City Treasurer. Any person who shall desire to contest a parking citation shall present the citation at any office of the City Treasurer, who shall cerlify it on an appropriate forrn to the General District Court. If paynent is not postnarked or received by the City Treasurer within th-ree working days of the City after receipt of such notice, the penalty for each hour or fraction thereof during which such vehicle occupied a parking nieter space illegally shall be six dollars. The failure of such @er to @e such a payffent, or present such citation at any office of the City Treasurer for certification to the General District Court, within 30 days shall render such owner subject to the penalty provided in Section 22-166. The City Treasurer shall cause ccnplaints, summons or warrants to be issued for delinquent parking citations. This ordi-nance shall be effective frcm the date of its adoption. Since that time, Councilman Riggs has received numerous telephone calls from residents in the area regarding not only frisbees on the beaches, but also volley ball, Ilobie Cats, Catamarans, etc., at the Northern part of the beach. Councilman Riggs made a motion, seconded by Councilman Ferrell, to request the Virginia Beach Safety Council to conduct a study on not only frisbees on the beaches, but also the dangers of volley ball, Hobie Cats, Catamarans, etc., on the beaches. ITEM #11121 Mayor Holland requested Council to give some thought to not holding Council meetings the first two weeks in August. ITEM #11122 Councilman McCoy stated be was against the building of low-income homes in the Green Run section of the Kempsville Borough. The area has the Navy housing units, and Princess Anne Road is not adequate to handle this overflow of traffic from the Navy housing as well as from Green Run and the low-income area. Councilman McCoy stated he is somewhat concerned about bow Council gets their information, and even though this matter had been discussed on January 24, 1977, he did not realize that Green Run would be the section of the City for the low-income housing. Councilman McCoy stated he would like a moratorium, if it can be done legally. The problem won't be stopped by a moratorium, but it would at least slow the problem down. Councilman McCoy further stated he did not know how the rest of the Council felt about the project being in Green Run, but if enough Members of Council are interested in stopping this project then the City could call for an Environmental Impact Study of that area. it was noted that crowded highways and schools will not constitute the need for an Environmental Impact Study. Vice Mayor Standing stated that last week he and Councilman Payne met with the Liaison Committee between the Planning Commission and the Council. They requested the Planning Commission to forward to the Council in September a recommendation on how they would handle the period during which the City planned for the growth that's taking place. Also, discussed at the meeting, was the 90 day moratorium that the Planning Commission could do legally to hold any application in abeyance, and what additional time the Council has after the recommendation comes to Council. Mayor Holland requested Councilman McCoy to put his proposals in writing for Council's perusal. 8/1/77 - 2 0 - The City Manager stated that on the Community Development Block Grant, the City does indicate that they do encourage low-income housing in Virginia Beach, however; the City does not give the location of low-income housing, but the City has adopted in its plan Council's Policy Guidelines, and that is that a private enterprise develop the low income housing. If any developer makes application for federally-assisted programs - under Federal Housing Programs for low-income housing, all the govern- ment does is to write to the governing body and ask is that in Con- formance with your housing guidelines. The City cheeks to see if the property is properly zoned; two, if it has available water and sewer; and, three if federal funds are available. Councilwoman Oberndorf stated she knew Councilman McCoy had given a great deal of thought to the Environmental Impact Study, but who will pay for the study as the developer usually pays for it. Vice Mayor Standing stated that as far as locating the Navy housin- in Kempsville, there is an element that has been left and that is when that Navy housing was located in Kempsville, and moved from Fort Story, it was to balance out the housing in Virginia Beach for military. As you know, there's substantial housing already in Fort Story, there's been 600 units built at Camp Pendleton, and there is considerable military housing in the Bayside Borough. The southern and southwestern part of the City are the only areas without navy housing. Mayor Holland stated that if anyone has any proposals on the matters discussed, please put them in writing and forward them to Council for their perusal. Councilman Payne stated tliat at the Committee meeting Mr. Robert J. Scott, Planning Director, and his staff are in the process of updating the City's present Land-Use Plan, which will be given to Council by January of 1978.
