First Reading: June 20, 1977 Second Reading: June 27, 1977 Adopted by the Council of the City of Virginia Beach on the 27th day of June -, 1977. ITEM #10964 BECAUSE OF A RECENT COURT DECISION, THE CITY OF CHESAPEAKE IS NO LONGER ABLE TO ACT AS THE FISCAL AGENT FOR THE LOCAL GROUP HOME SYSTEM. THIS PROGRAM CURRENTLY CONSISTS OF A GIRLS' GRoup HOME AND A CRISIS INTER- VENTION HOME (LOCATED IN VIRGINIA BEACH), THE CHESAPEAKE Boys' HOME, AND THE PORTSMOUTH Boys' lioME, AND AN ADt4lNISTRATIVE. LAST DECEMBER, A TASK FORCE REPRESENTING EACH LOCALITY REFERRING YOUNG PEOPLE TO THE HOMES WAS ESTABLISHED TO DETERMINE THE FUTURE OF THE GROUP HOME SYSTEM. VIRGINIA BEACH WAS REPRESENTED BY THE HONORABLE THOMAs F. ETZ, JR. HE TASK FORCE HAS ENDED ITS STUDY. IT RECOMMENDED THAT THE TIDEWATER EGIONAL GROUP FIOME COMMISSION BE ESTAOLISHED. THE CITY'S SHARE OF THE NE-TIME "UP-FRONT COSTS" WOULD BE $@'300. THIS FIGURE, TO BE REIMBURSED SHOULD THE COMMISSION BE DISBANDED, WAS DETERMINED BY A FORMULA BASED UPON AVERAGE INDIVIDUAL CITY USAGE RATES OF THE FACILITIES. As VIRGINIA BEACH PLACES BY FAR THE LARGEST NUMBER OF YOUNG PEOPLE IN THE FACILITIES, OUR SHARE IS THE LARGEST. BAUM CITY COUNCIL VOTED TO APPROVE ON FIRST READING THE FOLLOWING ORDINANCE TO APPROPRIATE FUNDS FOR OUR PRO-RATA SHARE IN THE INITIAL FUNDING OF THE REGIONAL JUVENILE GRoup HOME SYSTEM; AND FURTHER AUTHORIZED THE CITY MANAGER TO ENTER INTO THE NECESSARY AGREEMENTS. AN ORDINANCE TO APPROPRIATE FUNDS FOR OUR PRO-RATA SHARE IN THE INITIAL YUNDING OF THE REGIONAL JUVENILE GROUP HOME SYSTEM WHEREAS, the City Council is interested in providing Juvenile-type residential care facilities, and WHEREAS, the City of Chesapeake, City of Portsmouth, City of Suffolk, City of Franklin, County of Isle of Wight, and County of Southhampton desires to participate in providing Juvenile-type residential care facilities, and WHEREAS, implementation of a regional-wide system of service will allow a maximum use of available state and federal grants, NOW, THEREFORE, BE IT ORDAINED BY TIIE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA: That $54,300 be appropriated for the Regional Juvenile Group liome System in the Fiscal 1976-77 Operating Budget, as our pro-rata share of the initial funding of $100,000, with the remaining balance of $45,700 being provided by other localities in the region. That appropriate funds for the purpose specified therein be appropriated from the General Fund Balance. First Reading: JUNE 27, 1977 ITEIA #10965 THE CITY COUNCIL RECEIVED THE REPORT OF THE COMMUNITY DEVELOPMENT CITIZENs ADVISORY COMMITTEE CONCERNING THE ESTABLIS11MENT C)F A 11OUSING REHABILITATION LOAN AND GRANT PROGRAM. THE REPORT NOTED THAT CERTAIN WATER AND SEWER PROJECTS HAD BEEN COMPLETED IN THE " TARGET AREA" WHICH HAVE BEEN DESIGNATED TO RECEIVE SUCH FUNDS BY FIUD. A LETTER FROt4 T@IE CITY MANAGER SPECIFICALLY NOTED SOME RECOMMENDATIONS MADE BY THE CDCA COMMITTEE WHICH HE COULD NOT RECOMMEND TO THE CITY COUNCIL AS BEING CONTRARY TO THE GENERAL AND ESTABLISHED POLICIES OF THE CITY. THE CITY MANAGER RECOMMENDED THAT THE FEDERAL GUIDELINES, WHICH DEFINE " VERY LOW" INCOME AND " LOW INCOME" BASED UPON THE MEDIAN INCOME LEVEL FOR A FAMILY OF FOUR AS ESTABLISHED BY THE COMMONWEALTH OF VIRGINIA BE FOLLOWED IN DETERMINING NEED; THE CITY MANAGER ALSO RECOMMENDED THAT GRANTS OF COMMUNITY DEVELOPMENT FUNDS FOR COSTS OF HOUSING ITIRROVE@IENTS THAT ARE DIRECTLY RELATED TO OR CARRIED BY THE MANDATORY REQUIREMENT FOR CONNECTION TO WATER AND SEWER BE EVALUATED UPON A SCALE SIMILAR TO THAT USED IN DEFINING "INCC)ME LEVEL" AS PREVIOUSLY NOTED. MR. HANBURY FURTHER RECOMMENDED THAT PERSONS RECEIVING A WAIVER OF LI@4E AND TAP FEES OR STREET IMPROVEMENT CHARGES OR GRANTS FOR HOUSING IMPROVEMENTS SHOULD BE REQUIRED BY THE CORPORATION TO PLACE A LIEN ON THE PROPERTY FOR A PERIOD OF SEVEN (7) YEARS IN ORDER TO HAVE THE WAIVER OR GRANT COMPLETELY VESTED - WHICH MEANS THAT A PERSON COULD NOT AS A RECIPIENT OF WAIVERS, GRANTS OR LOANS REHABILITATE THE PFZOPERTY AND THEN IMMEDIATELY SELL IT AS IMPROVED PROPERTY WITHOUT HAVING ANY ENCUMBERANCE ON IT. THERE WERE SEVERAL QUESTIONS ABOUT THE R@-CO@IMENDATIONS MADE BY THE CITIZENs ADVISORY COMMITTEE WHICH WERE RAISED BY CITY COUNCIL MEMBERSS COULD A PERSON WHD QUALIFIES AS " LOW INCOME" OR " VERY LOW INCOME" OBTAIN A WAIVER, GRANT OR LOAN ON PROPERTY WHICH HE/SHE RENTS, BUT DOES NOT OWN, WHICH DOES NOT CONSTITUTE A LIE@4 ON THE PROPERTY. MEMBERS OF THE CDCA COMMITTEE INDICATED TO CITY COUNCIL THAT THEY HAD BEEN ADVISED By HUD REPRESEr4TATIVES THAT THE ONLY REQJIREMENT WAS TO BE A RESIDENT OF THE " TARGET" AREA IRREGARDLESS OF INCOME LEVEL OR OWNERSHIP OF PROPERTY. MEMBERS OF CITY COUNCIL QUESTIOt4ED WHETHER COUNCIL COULD PERMIT THE IMPROVEMENTS OF PROPERTIES BY RENTAL TENANTS WITHOUT HAVING A COMMITMEr4T BY THE OWNER OF THE PROPERTY AND ALSD WHETHER THE USE OF THESE FUNDS WAS TO BE FDR PERSONS NOT IN THE LOW INCOME AND VERY LOW INCDR.IE CATEGORY. IT WAS NOTED BY THE CITY MANAGER THAT REGARDLESS OF THE OWNERSHIP OF PROPERTIES IN THE "TARGET" AREA THAT MANY ARE HEALTH HAZARDS. AFTER A LENGTHY DISCUSSION DURING WHICH MEMBERS OF THE COUNCIL INDICATED THAT WHILE THEY DID NOT WISH TO HAVE THE CITY LOSE THE HUD FUNDS IF THIS MATTER WERE NOT APPROVED BY JULY 1, 1977, THEY WERE RELUCTANT TO APPROVE THE REPORT AND ESTABLISH THE HousING AND REHABILITATION LOAN AND GRANT PROGRAti AS SUGGESTED DUE TO THE CONFLICT WITH ESTABLISHED CITY POLICIES REQUIRING PARTICIPATION IN COSTS FOR PUBLIC IMPROVEMENTS BY ALL CITIZENS. CITY COUNCIL REQUESTED CLARIFICATION OF THE STATEMENTS ATTRIBUTED TO REPRESENTATIVES FROM HUD AND FROM THE CITY. THIS WILL RUN ALONG THE NORFOLK SOUTHERN RAILWAY 1,693 FEET WEST OF MILE POST 16 IN SEATACK. THEREFORE CITY COUNCIL VOTED TO AUTHORIZE THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE r4DRFOLK SOUTHERN RAILVJAY FOR THIS PIPE LINE CROSSING. ITEM #10967 THE CITY MANAGER STATED HE HAS BEEN INFORMED BY MR. JAMEs ECHOLS, OF THE TIDEWATER TRANSPORTATION DISTRICT COMMISSION, THAT AN ADDITIONAL APPROPRIATION OF $53,466 WILL BE REQUIRED TO FULFILL VIRGINIA BEACH'S FUNDING COMMITMENT TO THE COMMISSION. CITY COUNCIL HAS BUDGETED $334,190 FOR THE 1976-77 BUDGET YEAR. HOWEVER, BECAUSE OF THE COMPLEXITIES SURROUNDING CONSOLIDATION OF THE REGIONAL TRANSPORTATION SYSTEM, AND THE DELAY ON THE PART OF THE FEDERAL GOVERNMENT TO RELEASE FEDERAL FUNDS, THE CITY MUST CONTINUE TO FINANCE 100% OF THE OPERATING DEFICIT FOR THE BALANCE OF THIS YEAR. BECAUSE OF THE SLOWNESS OF THE FEDERAL CASH FLOW, FEDERAL FUNDS WILL NOT BEGIN COMING TO THE CITY FOR REIMBURSEMENT OF THE OPERATING DEFICITS UNTIL THE NEXT FISCAL YEAR. IN ORDER TO GIVE A FULL UNDERSTANDING OF THE TRANSIT EXPENDITURES, IT WOULD BE NECESSARY TO LOOK AT BOTH FISCAL YEARS' BUDGETARY EXPENDITURES PLUS THIS APPROPRIATION.
