The City Council of the City of Virginia Beach, Virginia, will assemble in
the Administration Building, Princess Anne Borough, Virginia Beach, Virginia,
in Regular Session, at 1:00 p.m., on Monday, June 6, 1977, for the purpose of
conducting public business and will hear and act upon the following items:
1. Call to order by the Honorable Clarence A. Holland, Mayor, in the Council
Conference Room.
2. Roll Call of the Council.
3. Motion to recess into Informal Discussion and Executive Session. Upon
conclusion of the Executive Session, City Council will reconvene in the
City Council Chambers.
4. Invocation will be given at 2:00 p.m., by the Reverend Robert Newland,
St. Aidans Episcopal Church, Virginia Beach, Virginia. Please remain
standing for the Pledge of Allegiance.
5. Roll Call of the Council.

7a. Minutes of the Regular Meeting of May 23, 1977 to be presented for
approval and acceptance.
b. City Council is requested to approve the correction of the minutes of
May 9, 1977, item #10780--Specification #4 to read as follows: One
curb cut on Lynnhaven Parkway and one curb cut on South Lynnhaven Road.
Further there is to be no median cross-over on South Lynnhaven Road or
Lynnhaven Parkway.
8. Items for Second Reading:
a. City Council is requested to approve on second reading an ordinance
to amend and reordain Section 20-8.1 of the Code of the City of
Virginia Beach relating to business license taxes.

10. Lettcr from the City Manager transmitting the recommendation of the
Planning Commission for approval of the application of Water-Boggan
International, Inc. for a Conditional Use Permit for a recreational
facility of an outdoor nature (water slide), to be located on the
west side of Atlantic Avenue (The Loop), south of Third Street
(Virginia Beach and Lynnhaven Boroughs).
11. Letter from the City Manager transmitting the recommendation of the
Planning Commission for approval of the petition of First American
Savings & Loan Association for a change of zoning from R-6 to B-2
on a 27,500 square foot parcel located on the south side of Indian
River Road, east of Kempsville Road (Kempsville Borough).
12. Letter from the City Manager recommending that City Council approve
the following ordinances:
a. An ordinance to amend Sections 1.1, 4.1, 5.3, 5.7, 5.8, 5.10 and
5.12 of the Site Plan Ordinance of the City of Virginia Beach,
relating to references to the Department of Public Works.
b. An Ordinance to amend Article II, Chapter 31, Sections 31-12 and
31-13, Erosion, Sediment Control and Tree Protection of the Code
of the City of Virginia Beach relating to references to the Depart-
ment of Public Works.
13. Letter from the City Manager recommending that City Council approve the
low bids of Carter-Bell Corporation, in the amount of $204,586.00, for
contract I (pipework) and Van de Riet Construction Co., Inc., in the
amount of $49,603.00, for contract II (pump station). City Council, on
March 28, 1977, approved seven projects for inclusion in the second
year funding cycle of the Community Development Act program. These
projects included water, sewer and road work in Seatack, Queen City and
Newlight. In addition, a park in Doyletown was authorized. City
Council is further requested to authorize the City Manager to execute
the documents necessary to implement the projects. Funds from the
Community Development Act program are available. (Bids were received
for the first of such work, Phase II, Sanitary Sewerage, Seatack Area.)
14. Letter from the City Manager recommending that City Council approve the
low bid of Service Electric Corporation of Virginia, in the amount of
$61,851.00, for installation of field and court lighting at Bayville
Farms Park; and further, authorize the City Manager to execute the
necessary documents to implement the project.
15. Letter from the City Manager recommending that City Council approve
an ordinance to accept $584,335 from the Southeastern Tidewater Man-
power Authority and to appropriate these funds:

16. Letter from the City Manager recommending that City Council authorize
an appropriation adjustment of $17,380 from the Water and Sewer Fund

existing sewer pump station radio alarms. The balance in the Reserve
for Contingencies account after this transfer will be $168,557.

easement for a power line to the Witchduck Road Water Pump Station.

THE CITY MANAGER STATED THAT ON JULY 10, 1977, CITY COUNCIL GRANTED A USE
PERMIT FOR A HOME OWNED BY MR. G. R. GIMBERT FOR A REGIONAL GROUP HOME FOR
DELINQUENT GIRLS. THE REQUIREMENT AT THAT TIME WAS STANDARD SITE IMPROVEMENTS
AS REQUIRED BY THE SITE PLAN ORDINANCE.
IT HAS BEEN REQUESTED THAT OFF-SITE IMPROVEMENTS ON PHILLIPS ROAD BE DEFERRED
UNTIL SOME FUTURE DATE, IF COUNCIL AGREED.

THE CITY MANAGER STATED THAT ON THE DOCKET FOR TODAY THERE IS APPROXIMATELY
$584,000 FOR CETA FUNDS. SINCE INITIATION OFRHE CETA PROGRAM THE CITY HAS
RECEIVED APPROXIMATFLY $2,300,000 IN FEDERAL GRANTS. IN THE FUTURE THE
CITY SHOULD RECEIVE NOT ONLY THE $584,000 TODAY, BUT IN APPROXIMATELY TWO
WEEKS ANOTHER $2,284,000, GIVING A TOTAL IN FUTURE FUNDS OF $3 MILLION.

THREE WEEKS.

THEM THE OPPORTUNITY TO WORK IN THEIR DEPARTMENTS. THIS YEAR SAW TWO
MAJOR STEPS IN THE YOUTH OF VIRGINIA BEACH; GiGi GLUCKENSON WAS APPOINTED
TO THE COURT SERVICEs ADVISORY BOARD. MAJOR STEP NUMBER TWO WAS OBVIOUSLY
THE COMPLETION OF THE VIRGINIA BEACH RECREATION CENTER IN KEMRSVILLE. To
THE YOUTH THE BEAUTIFUL BUILDING IS A MANIFESTATION OF YOUNG IMPUT.
MIss DEFER STATED THAT THE YOUTH COUNCIL VISITED THE GENERAL ASSEMBLY IN
FEBRUARY AND FOUND IT A VERY REWARDING EXPERIENCE.

In the course of our daily lives it is with pride that we can
puhlicly honor the accomplishments of a fellow citizen, particularly
a young man who through his efforts has demonstrated the effectiveness
of the Vocational-Technical Training System, designed to provide a
vocation to any individual who will apply himself to learning a skill
with which he can earn a livin,-.
Phillip Grauberger, a native of Virginia Beach, Virginia, a
senior at the Virginia Beach Vocational-Technical Educational Center,
has brought honor to himself, his family, to the Vo-Teeli Center and
to the City by his accomplishments in winning top honors iD the local,
state, regional and national championships in machine drafting held
by the Vocational-Industrial Clubs of America, Phillip will now
represent the United States in the International Olympic Competition
being held this July in Utrecht, Holland. The expenses of tlie trip
will be borne by contributions from engineering, architectural and
industrial firms and the Vo-Tech Center, which further attests to the
ability of this young man;
NOIV, THEREFORE, the City Council of the City of Virginia Beach,
Virginia, does by the adoption of this Resolution of Honor express its
approbation of the accomplishments of Phillip Grauberger and extends its
congratulations and satisfaction of the skill he has learned and the
recognition earned as a result of the opportunity offered by the
Vocational-Technical Educational Center of the City of Virginia Beach.

City Council voted to approve the following correction to the minutes of
May 9, 1977, Item #10780, specification #4:

The above stipulation was amended on August 22, 1977 to read as follows:
Only two curb cuts on Lynnhaven Parkway of
24' maximum width, each clearly marked "in
only" and "out only", and one curb cut on
South Lynnhaven Road. Further, there is

Lynnhaven Road or Lynnhaven Parkway."

City Council voted to approve on second reading the following Ordinance to
amend and reordain Section 20-8.1 of the Code of the City of Virginia Beach
relating to Business License Taxes.

AN ORDINANCE TO AMEND AND REORDAIN
SECTION 20-8.1 OF THE CODE OF THE
CITY OF VIRGINIA BEACH, VIRGINIA,
RELATING TO BUSINESS LICENSE TAXES.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA,
That Section 20-8.1 is hereby amended to read as follows:
Section 20-8.1. Penalties when license tax not paid on time.
In addition to the fine imposed by Section 20-4 of the Code of the City
of Virginia Beach, if any license tax other than that of a beginner be not paid on
or before the tenth day of June of the license tax year, there shall be added a
penalty of ten per centum (10%) of the amount of said license tax; if not paid
within forty-five days after the tenth day of June of the license tax year, a
penalty of fifteen per centum (15%) shall be added to the amount of said license
tax; and thereafter, the penalty shall be increased five per centum (5%) for every
thirty days or fraction thereof of delinquency. In no event shall the total penalty
exceed thirty per centum (30%) and in no case shall such penalty be less than two
dollars. All penalties shall be assessed and paid along with and in addition to
said license tax.
Every person beginning business between the first day of May and the
tenth day of June of any license year shall pay his license tax on or before the
tenth day of June or said person shall be subject to the penalties as set forth
in the foregoing paragraph.
Every person beginning business after the tenth day of June of any license
tax year shall pay his license tax immediately. If such license tax be not paid
within ten days from the beginning of business, the license tax shall be subject
to a penalty of ten per centum (10%); if not paid within forty-five days after the
date of beginning business, a penalty of fifteen per centum (15%) shall be added
to the amount of said license tax; and thereafter the penalty shall be increased
five per centum (5%) for every thirty days or fraction thereof of delinquency. In
no event shall the total penalty exceed thirty per centum (30%), and in no case shall
such penalty be less than two dollars. All penalties shall be assessed and paid
along with and in addition to said license tax.

CHAMPIONSHIP FOR THE FOURTH TIME IN SIX YEARS.

COUNCILMAN RIGGS REQUESTED THE RESEARCH DEPARTMENT To MAKE A STUDY ON
POLICE AND FIRE SAFETY PATROLS ON ALL OF THE WATERWAYS THROUGHOUT THE
CITY. WITH THE NUMBER OF PEOPLE BOATING IN THIS CITY IT WOULD BE FEASIBLE
TO STUDY THE SITUATION AND PERHAPS IF MORE EQUIPMENT IS NEEDED THEN THE CITY
CAN BE PREPARED TO HANDLE SITUATIONS BETTER.

COUNCILMAN RIGGS STATED THAT THE MO-PED SITUATION WAS GETTING OUT OF HAND
AND CAUSING PROBLEMS BY THE WAY THEY ARE BEING HANDLED. IT SHOULD BE NOTED
THAT THE MO-PEDS ARE GOVERNED BY THE SAME ORDINANCES AS A BICYCLE.
COUNCILMAN WATERFIELD STATED THAT THE SITUATION IS BAD AND BEFORE THE
SUMMER IS OVER COULD BECOME A MAJOR PROBLEM. THE PERSONS HE OBSERVED
RIDING NO-PEDS WERE VERY RECKLESS IN HANDLING THE BIKES, AND THE POLICE
DEPARTMENT SHOULD OBSERVE THEIR BEHAVIOR.
THE CITY MANAGER STATED THAT IF THEY ARE VIOLATING THE TRAFFIC LAWS THEN
THE CITY CAN HANDLE THE PROBLEM, BUT THE CITY CANNOT LIMIT THEIR USE ON
THE STREET. THERE ARE LAWS, HOWEVER, PROHIBITING THEIR BEING ON THE
BOARDWALK, SIDEWALKS, ETC.
MR. DALLAs TOWHILL APPEARED BEFORE COUNCIL REGARDING THIS MATTER, AND STATED
THAT 25-26 IS THE AVERAGE AGE OF A PERSON RIDING A MO-PED, AND IN ORDER FOR
THE PERSON TO RENT A BIKE HE MUST HAVE A VALID DRIVERS LICENSE, WHICH IS HELD
AS COLLATERAL, AND THE PERSON MUST SIGN A CONTRACT.
MR. TOWHILL REQUESTED COUNCIL TO EXTEND THE BIKE TRAILS FROM 35TH STREET UP
To ARCTICI DOWN ARCTIC UP TO MEDITERRANEAN AND STRAIGHT DOWN AND OVER THE
RUDEE INLET BRIDGE To RED WING PARK.

ECONOMIC DEVELOPMENT THE POSSIBILITY OF GETTING AN AMUSEMENT PARK TO LOCATE

MAKING THE EAST-WEST STREETS ONE WAY IN THE BEACH BOROUGH.
THE CITY MANAGER STATED THAT THE STAFF HAS BEEN WORKING ON TI-IE MATTER OF
HAVING EVERY OTHER STREET GOING EAST-WEST ONE WAY, WITH DIAGONAL PARKING,
AND THIS WILL BE BROUGHT BACK TO COUNCIL IN THE NEAR FUTURE.

VICE MAYOR STANDING STATED THAT THE CITY RECENTLY HAD A FIRE AT THE SALT
WATER PUMPING STATION AT LITTLE ISLAND, AND WHEN AND IF THE PIER IS RE-
BUILT CONSIDERATION SHOULD BE GIVEN BY THE DEPARTMENT OF PARKS AND RECREATION
TO OPERATE THE PIER AS A FISHING PIER IN CONJUNCTION WITH THE SALT WATER
PUMPING OPERATION.
