City Council awarded a contract to E. V. Williams Company for the amoupt of
$238,300. for coverning, fertilizing and seeding @lt. Trashmore, as well as
the construction of a coasting ramp and access road. $120,000. is available
in the 1971 Parks and Recreation Bond Fund @ind tlie I-e(leral and State reimburse-
ment has been approved for an additional @1'10,000. I'herefore, City Council
approved on second reading an appropriatioji of $120,000. from Surplus to the
Parks and Recreation Bond Fund.

city Council approved on second reading an @idditional appropriation in the
amount of $216,7SO.80 for the dredging of l@@0,680 cubic yards of sand from
the sand trap at Rudee Inlet, plus 100,000 cubic yards of saild from Owls
Creek (totaling 220.680 cubic yards). This will make a total appropriation
of $433,SO1.60; however, the U.S. Ariny Corps of Engineers will reimburse the
City $216,750.80 upon completion of the pro-iect.

"@rs. Shirley Marlow appeared before City Cotincil regarding the establishment
of locations for Drug Rehabilitation Centers. Mrs. Marlow was informed that
this matte'r would be referred to the Drug Focus Committee for their recommenda-
tions and suggestions.
ITEM #4579
Mr. Robert Buffington appeared before City Council regarding the obstruction
of public thoroughfares and store fronts by individuals congregating so as to
block free passage, soliciting handouts, and riding bicycles on the sidewalks.
City Council informed Mr. Buffington that there are ordinances prohibiting the
obstruction of free passage on public thoroughfares and further requested
Mr. Buffington to inform the police when he observes these violations of the
law.

Mr. Walter Leveridge representing the Concerned Citizens for Conservation
and Recreation had been placed on the agenda, but due to sickness he requested
to be placed on the docket for May 22, 1972.

Application of the American Oil Company for a Use Permit to construct a gasoline supply
station on certain property located on the Nort@@iest corner of Bonney Road and Independence
Boulevard running a distance of 279.32 feet along the North side of Bonney Road, running a
distance of 161.02 feet along the West side of Independence Boulevard, and running a dis-
tance of 322.41 feet along the Northern property line. Said property is triangular in
shape. (Pocahontas Village Area). KEMPSVILLE BOROUGH.
The Planning Commission recommends approval of this application. Approval was con-
tingent upon a report from the State Toll Road Authority that this parcel would not
be necessary for the proposed cloverleaf interchange at this intersection. This
report is due in November.

The Planning Commission recommends denial of this application as the requested
density does not conform with the Bayfront Development Plan. Opposition from
the residents of the area was presented and considered by the Planning
Comission.
Mr. Reid M. Spencer appeared on behalf of the applicant.
Mr. Vernard F. Wagner appeared on behalf of Chesapeake Beach Civic League
and presented petitions in opposition to the above application.

The Planning Commission recommends approval of this request subject to the
applicant providing a buffer zone between the commercial property and the mobile
homes as well as private hornes in the area. Approval is further subject to City

dedication of right of way 40 feet from the center line of the existing right of
way along the 1571 feet more or less frontage on Indian River Road (a variable
dedication), as shown on the application; also a dedication of right of way 40

the application. Engineering Division requests that street improvements within

40--foot width. Entrances for the proposed gas station should conform to

Section 2. Subject to tile provisions o'L Article III2
Chapter 2, of the Vir.@iInia Beach City Code, the salaries and
wages set forth in detail in said Annual 3ud.,et, as amended by
the Council, are hereby authorized and. fixed as @'he Maximum
compensation to be paid for services rendered.
The positions, except in the labor class in cases where the
number thereof is not under the control of the Council, set as
line items in said Annual Budget, as amended bv the Council@
shall be the maximum number of positions authorized for the
various departments, bureaus and d.ivisions of the City during
said fiscal year, and the number thereof shall not be increased
d-uring said fiscal year unless authorized by the Council. The
City imanager may from time to time increase or decrease the number
of positions in the labor class provided the aggregate amount
expended for such services shall not exceed the respective
appropriations made therefor. The City Manager is authorized to
r,iake such rearrangements of positions into several departments
named. herein, as may best meet the uses and interests of the City.
Section 3. All collections of delinquent city taxes shall
be credited to the General Fund ol@ the City by the Treasurer.
Section 4. All collections of local taxes levied. shall be
credited to the General Fund of the City. Transfers shall be
made from the General Fund to the respective specially desig-
nated funds for which a levy is made in the respective amounts
levied for each such specially designated fund.
Section 5. All tax abatements and. tax supplements dated
subsequent to December 5. 10,72, for the 1973 tax year shall
accrue to the General Fund of the City.
Section 6. All balances of the appropriations payable out
of each fund of the City Treasury unencumbered at the close of
business on the thirtieth (30th) d.ay of June, 1072, except as
otherwise provided. @'Or. are liereby declared to be lapsed into
the surdlus of the respective funds, except Scllool operatin@
Fund whicti shall lapse into the General Fund Surplus, and shall
be used for the payment of the appropriations which mal- be made
in the appropriation ordinarice for the fiscal year beginning
July 1, 1972.
Section 7. No department, bureau, agency or individual
receiving appropriations under the provisions of this ordinance

VIRGINIA:
That Section 22-68 of the Code of the City of Virginia Beach is
hereby amended and reordained to read as follows:
Section 22-68. There is hereby imposed a license of fifteen
dollars per year for each license year as provided in this article upnn
every person owning a motor vehicle designed and used for the trans-
portation of passengers, which shall include every vehicle which is
self-propelled or designed for self-propulsion, regularly kept in the
city and used upon the public roadways of the city, except as herein
otherwise specifically provided.
No license fee shall be required of any person for any vehicle
not required to obtain an annual registration certificate and license
by Code of Virginia, Section 46.1-45 et seq., or any vehicle specifi-
cally exempt by Code of Virginia, section 46.1-66.
On and after January 1, 1967, the license tax for motorcycles
shall be three dollars per year for each license year as provided in
this article.
There is hereby imposed a license tax to be paid by owners of
all motor vehicles, trailers and semitrailers not desia.ned and used
for the transportation of passengers. T[iis tax shall be determined
by the gross weight of the vehicle or combination of vehicles of
,which it is a part, when loaded to the maximum capacity for which it
is registered and licensed, according to the schedule herein set
forti-t. For each thousand Dounds of gross wei-ht for which any such
vehi-cle is registered and licensed there shall be paid to the city
treasurer the tax indicated in the fol.Lowin-@ schedule immediately

behaviorial probleris in.the'Chesapeake-Virginia Beach

Vihereas these tvio comrnunities are of the opinion that a pilot
community-based jointly operated treatment program should

and Domestic and Relations Court, the Department of Healthy

the Community Health Board, and one member from the Department
of Juvenile Probation of the Virginia Beach area and one from
the division providing juvenile proba'Lion services through
the Department of Public Vielfare for the City of Chesapeake.
Representatives of the Commonwealth of Virginia on the Board
shall be one each from the Departments of Health, V1.1fare and
Institutions, Vocational Rehabilitation, Education, llental
Hygi6ne and Hospitals and Administration.
The Project hlanagement Board shall be empowered to direct
and control the establishment and operation of a residential
and outpatient treatmen'@ facility for juveniles and their
families to combat the problems se?- forth in the preamble to
this resolution. The Board shall establish a permanent
Project Planning Committee @@or the collection and evaluation
rrom aill agencies and other sour.ces relating to the prevention
of juvenile delinquency.
The Board is authorized to hire necessary staff to car@ry
out the purposes of this resolution.
A Project Sercice Team comoosed of entirely staff of
participating State and local agencies shall be appointed by
the Board and approved by the agency. The Project Service
Team shall de-termine admissi-on of clients and shall bo re-
sponsible ibr the overall serv4-ce delivery, pursuant to the
direction and control of the Bo;ard. In orde@- to perform its
functions, the Project Service Team is au-@Lhorized to or-
o-anize itself or u@@ili-ze available servic@s to coordinate
efforts at early iden-Lification of young people ivitIh be-
haviorial problems, to plan -Lo meet thc@se problems, to
diagnose and evalua-(Ie such problems,- and develop a program
of therapeu'Llic management of -Lhe problem.
