City Council denied the following application for change of zoning and
a use ermit.
Application of Shell Oil Company for James M. Pickrell, Attorney,
for a hange of zoning from Limited Commercial District 3 (C-L 3)
to General Commercial District 2 (C-G 2) and a Use Prmit to construct
a gasoline supply station on certain property located on the South side
of Independence Berulevard beginning at a point 650 feet East of
Bradford Road, ruilning a distance of 195 feet along the South side
of Independence Boulevard, running a distance of 141 feet along the
Eastern property line, running a distance of 169 feet along the
Southern property line, running a distance of 165 feet along the
Western pr.operty line. (Robbins Corner Area). BAYSIDE BOROUGH.
The Planning Commission recommends approval of this request subject
to City water and sewer and the requirements of the Site Plan
Ordinance.

1043 Mr. Patrick L. Standing, Planning Director, presented the following
application for a Future Land Use Plan.
Mr. Author Winder, Vice President of Nqrth Virginia Beach Improvement
League, appeared in op@osition to any change of zoning and the con-
venience center proposed. The League took a poll in North Virginia
Beach to find if the people there wanted this convenience center.
Completion of the poll showed that a total of 903 people cast votes,
874 voted against and 29 voted in favor.
James V. Batchelor, Director of South Rudee Shores Civic League
presented a petition signed by 78 residents of the South Rudee Shores
area opposing the shopping center proposed to be located in Rudee
Heights.
Wilson haplain appeared representing the Chaplain hotels, three of
which are on Atlantic Avenue. He is in opposition to making Atlantl'C
Avenue a one-way street and the closure of the streets adjacent to
his property to erect restrooms.
Councilman J. Curti Payne stated that he is not particuiarly in favor
of the one-way proposal, but that he realizes there needs to be som@
solution to the traffic problem.
Charles Burlage appeared suggesting the elimination of parking meters
and suggested that Council considered metered parking for the summer
on a large tract of unused land.
C. C. Carpenter representing the Carpenter Construction Company, co-owners
of a tract of land at the south end of the Beach, and Mr. Harrv Pincus,
Attorney, appeared in opposition to the proposed schoo it., b@l@g
identified as such on the Land Use and.City Maps.
On motion by Mr. McCombs, seconded by Mr. Malbon and by recorded vote
as follows:

lisection 3.02
On the second Tuesday in June in 1970, there shall be
a general election at which the qualified voters of the
City shall elect four council-men running from the boroughs
of their residence and two councilmen running at large for
terins of four years, and three councilmen running from the
boroughs of their residence and two running at large for
terms of ti..,o years. Th@eafter, all couiicilmen shall be
elected for terms of four years. The term of office for each
councilm-an shall commence on the first day of September next
follotiing the date of ele--tion and shall continue until his
successor has been duly elected and qualified. Of th--
councilmen ruiining at large in June of 1970, the two receivinc.,
the largest nuiiibc@r of votes shall serve for a term of
four years, a,ld of ttie councilmen running from the
borough of their residence the four receiving the
largest number of votes shall be elected for a term of
foiir years. T@e five council.men elected by a lesser
nv--,nber of votes shall. be elected for terms of two years.
Thereafter, there shall. be a general election on the
second TLiesday in June for the selection of councilmen
to replace those whose terms expire at the end of August
of that year. The term of office for each councilm@an
shall courqence on thc first day of September next follow-
ing tlie date of election and shall continue until his suc-
cessor hzis been duly elected and qualified. Each candidate
shall state, at tiie tiine of fl.ling, whc@ther he is running
at large or from tlie borough of his residence. Candidates

2. That, Section 3.04 of tl-ie Chartcr of the City of Vi.rg.'Lni.-I

"Section 3.04.
Councilmen shall receive as compensation for their
services such amounts as ttie Council may detelilline, not to
exceed four hundred dol.lars per month for councilmen Ind
five hundred dollars per month for the mayor. No merv-ber of
the Council shall, be appointed to any office of profit uncler
the City government during the term for iqhich elected and for
one year thereafter."
3. That, Section 3.07 of the Charter of the city of Virginia
Beach, Virginia, be amended by the General Assembly of Virgi-nia
to read as follows:
"Section 3.07.
At the first regular meeting of the Council in September
following a general election of councilmen, the Council shall
choose by majority vote of all the members thereof one of
its members to be mayor and one to be vice-mayor. The
mayor shall preside over the meetings of the Council, shall
act as head of the City government for ceremonial purposes
and shall have sucti other rights and duties as the Council
may prescribe, in addition to all the rights and privileges
of councilmen of the City. The vice-mayor shall. perform the
duties of mayor in the absence or disability of the mayor."
4. That, a public hearing on the proposed Charter amendments
shall be held in the Council Chamber of the City of Virginia Beach,
Virginia, at 10:00 o'clock a.m., on December 15, 1969, pursuant to
Section 15.1-912 of the Code of Virginia of 1950, as ainended. The
Clerk shall cause noti.ce of such public hearing to be given in the
manner required by said Section 15.1-912.

Mr. Harry MarshaZZ, Gity Attorney, stated that thi? PubZic Hearing was caZZed
pursuant to Resolutions adopted by the CounciZ an November 24, 1969, with respect
to prop ed changes in the Charter of the City of Virginia Beach.
Various interested citizens addressed the counciz concerning the Charter changes
under contempzation.
The meeting adjourned.

An informaz session was hezd after the PubZic Hearing regarding the redistricting
of the voting districts in the City of Virginia Beach. Mr. John Jones of the
ElectoraZ Board, together with Mr. SteZZ of the PZanning Department, presented
the folzowing information:
Redistricting from 26 to 34 numbered districts as shown on a map @mitted.
Mr. Barry 14arshal7l, City Atto@ey, stated that an Ordinance could be prepared to
properlY adopt the proposed redistricting to be presented at the reguzar meeting
of City Council on December 22, 1969.
