The regular meeting o@ the Council of the City of Virginia Beach, Virginia was hezd
in the CounciZ Chambers in the Administration BuiZding, in the Borough of Princess
Anne, on t4onday, Au@t 31, 1970, at 10:00 a.m.
'The invocation was given by Reverend CarZ Martin, Bayside Congregational Church, Virginia
Beach.
CounciZmen present: Mayor Frank A. Dusch, Vice Mayor Robert B. Cromwell, Jr., AZbert
L. Bonney, Sr., George R. FerreZZ, D. 14urray MaZbon, Lawrence E. Marshazz, Tohn W.
McCombs, J. Curtis Payne, G. Dewey Simons, Jr., EarZ H. Tebau7t, and Kenneth N.
Whitehurst.
On motion by Mr. PerreZZ, seconded by.@Ir. Bon-ney, and by unanimous vote, City Counciz
approved the Minutes of the meeting of the Recessed 14eeting of August 4, 1970, and the
reading of said Minutes dispensed with, inasmuch as each CounciZman had a copy of said
Minutes before him.
On motion by Mr. MarshaZZ, seconded by Mr. McCombs, and by unanimous vote, City Council
approved the Minutes of August 10, 19YO, @ject to the fotzowing correction amending
the ResoZution (.Ttem #2525) creating the Conmnity MentaZ HeaZth and MentaZ Retardation
Service Board of Virginia Beach to provide that the term of menzbers of the Board shaZZ
begin as of January 1, 1970, as provided by State Statute instead of Juzy 1, 1970 and
that "the term of each member of the Board after the initiaz appointments shazz be for
(3) three years from January 1, of the year appo-,nted.11 The reading of said iiinztes
dispensed with, inasmuch as each CounciZman had a copy of said Minutes before him.

WHEREAS, CounciZman EZect DonaZd ii. Rhodes has conferred with the Cormon-
wealth Attorney, Andre Evans, regarding any possibze co.nfzict of interest as a resuzt
of the eprpzoyment of CounciZman-eZect Rhodes wife by the SchooZ @Ystem of the City
of Virginia Beach, and
PIHEREAS, ConmonweaZth Attorney, Andre Evans has indicated that in his
opinion no confzict of interest exist under the provision of the-State Statute
governing such matters,
NOPI, THER-FFORE, the City Clerk is directed to enter this opinion as a
matter of record in the minutes of this City CounciZ.

for sewer construction.

R E S 0 L U T I 0 N
WHEREAS, the necessity for the construction and operation of sanitary sewer
systems in the City of Virginia Beach has become a matter of par=ount importance to
the health and wezfare of the inhabitants; and
WHEREAS, the United States Government, through the Department of the Interior,
has made avaiZabZe certain federaz assistance funds to assist in the construction of
sanitary sewer systems in order to protect the pubzic heazth and eziminate pazzution
from the pubzic waters.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNC.TL OF THE CITY OF VIRGINIA BEACH:
That the City Manager is herean instructed to authorize the Coordinator of
Urban Affairs, Mr. Richard J. Webbon, acting on behazf of this City, to sign and submit
final applications for federaz assistance funding of the eligibze items previouszy
designated by the State Water ControZ Board, after review of the preziminary appzications,
as being acceptabze for such funding and totazing apprcximately 30% of the finaz con-
struction costs, and to sign such other doeiments and reports as may pertain to the
projects hereon approved as Zisted bezow:

WHEREAS, pursuant to tlie authority therefor cojitained in, and
in accordance with the i-nanner prescribed for the institution of proceed-
ings: for the vacation of a street by, Code of Virginia, SS15.1-364, there
has this day been presented to 'he Council of the City of Virginia Beach,
Virginia, hereinafter called tlie Council, the application of Paul W.
Ackiss, et al, hereinafter called the Applicants, for the vacation and
discontinuance of a portion of Oriole Drive, in Lynnhaven Borough, in
the City of Virginia Beach, described more particularly hereinafter,
(hereinafter called the street), and in accordance with the procedilre
prescribed by such section for the conduct of such proceedings, that the
Council appoint viewers to view such street and report to the Council
their opinion whether, any and if any, what, inconvenience would result
from discontinuing the street; and
WHEREAS, in conformity with the procedures prestribed by
said section at least ten days n6tice of the intended application has been
posted at the Court House of the Circuit Court of the City of Virginia
Beach, Virginia, and at two public places in the City of Virginia Beach,
Virginia;
Now, THEREFORE, BE IT ORDAINED, that in conformity with
the procedure set forth in Code of Virginia, SS15. 1-364, for the institution
and conduct of proceedings for the vacation of a street,

furnish more water than its distribution systein as now laid, with the
pressure carried, will deliver into said mains, and if the said supplying
of water shall not be in accordance with tlie standard service, the said
City of Norfolk shall not be held responsible in any way.

mains, the City of Norfolk will supply the same only from its surplus
