(,ouncilman Baum requested clarification relative legality of circulating petitions in public buildings. 7he City Attorney advised there are two areas: traditional pubuc forum and non-traditional pubfic forum. Traditional public forums are streets and sidewalks. Generally those individuals wishing to petition or protest may do so on streets and sidewalks. As to the public buildings, it is almost a case -by- case analysis as to whether the building is a public forum. ]he City Attorney's Office has been able to determine in Virginia Beaci4 that libraries, recreation centers and museums, the buildings theimelves are not traditional public forums for protest or for solicitation of petitions. liowever, each of those buildings can establish an area, in which they do permit petitiotting and protest. lhe libraries have a policy statement as to that issue as do most of the other City buildi)igs. The City Attorney's office is in 4he process now of discussing those various regulations with the martagers of each of the buildings. The CCO has also spoken with the City Attorney's office re their concern of this situation.
