Waterfield, Jr. Nays: None Absent: None City Coun6il approved the Minutes of the Regular Meeting of Ju-ly 16, 1973, and the reading of said Minutes dispensed with inasmuch as each Councilman had a copy of the subject Minutes before him. ITEM #6163 Mr. Theodore J. Wool, President of the Exchange Club of Virginia Beach, appeared before City Council and dedicated to the City of Virginia Beach a Freedom Shrine. The documents, spaning some 325 years, includes the Mayflower Compact to the World War II instruments of surrounder in the Pacific. ITEM #6164 The following persons appeared before Council representing organizations as noted: Mr. Grover C. Wright - The Virginia Beach Civic Ballet Mrs. Virginia Biggs - The Virginia Beach Community Ballet Mrs. Vesta Cruser - The Virginia Beach Community Ballet Mrs. Nancy McClees - Tidewater Dance Guild, Inc. Miss Anna Smelser - Riverton-on-the-Elizabeth Company of Performing Art Mrs. Penelope Martin - Little Theater oy' Virginia Beach Miss Kay Gore - Little Theater of Virginia Beach The persons requested to be heard in the matter of an $8,000 donation of City funds made by City Council on July 2, 1973 to the Virginia Beach Civic Ballet, and approved on second reading on July 9, 1973, in support of the cultural developments in the City. The City Council understood at that time that the Virginia Beach Civic Ballet was the only non- profit ballet group in the city; subsequently it became apparent that there were other non-profit and profit groups operating in the City. On July 16, 1973, pending the submission of information in the matter, City Council, by vote, Item number 6123, instructed the City Manager to suspend payment of the $8,000 until the matter had been clarified. As there was considerable heated interest in this matter, Mayor @romwell requested direction from the Councilmen as to their wishes in considering the problem, where upon, Councilman Holland made a motion to limit the presentation to ten minutes, per organization, seconded by Councilman Rhodes and was approve by recorded vote as follows: Ayes: Councilmen Robert H. Callis, Jr., Mayor Robert B. Cromwell, Jr., George R. Ferrel'I, Clarence A. Holland, D. Murray Malbon, Donald H. Rhodes, and Floyd E. Waterfield, Jr. Nays: Councilmen John A. Baum, Vice Mayor F. Gardner Absent: None ITEM #6164 (a) City Council, upon motion by Councilman Payne, seconded by Councilman Waterfield, both having voted on the prevailing side in the matter, Item #6123 on July 16, 1973, and by recorded vote as follows: Ayes: Councilmen John A. Baum, Robert H. Callis, Jr., Vice Mayor F. Reid Ervin, Clarence A. Holland, D. Murray Malbon, J. Curtis Payne, and Floyd E. Waterfield, Jr. Nays: Councilmen Mayor Robert B. Cromwell, Jr., George R. Ferrell, and Donald H. Rhodes Abstain: Councilman Charles W. Gardner Absent: None City Council sanctioned the reconsideration of the $8,000 grant to the Virginia Beach Civic Ballet. ITEM #6164 (b) Mr. Grover C. Wright, Attorney, presented his case to the City Council on behalf of the Virginia Beach Civic Ballet indicating the non-profit status of the ballet and stating that he doubted that City Council could refuse to pay the appropriation of $8,000 made on July 2, 1973, and subsequently read on second reading on July 9, 1973, which money had already been committed by the Virginia Beach Civic Ballet in good faith, and that failure on the part of the City to honor its committment would reflect upon the credence of the City. Mr. Wright was interr;LPted-- by the City Clerk, who indicated that his time limit of 5 minutes had been reached, Mayor Cromwell sustained the interruption. Mr. Wright protested that he needed more time, whereupon one of the other representatives from the Virginia Beach Civic Ballet relinquished her time of five minutes to Mr. Wright. Mayor Cromwell permitted the exception-, Mr. Wright continued by relating the accomplishments of the Civic Ballet and stated that the ballet needed a place to present its programs, but had been unable to secure the Little Theatre Building. Mrs. Virginia Biggs of the Virginia Beach Community Ballet, employed her time to outlining the non-profit work and contributions made by her organization to the cultural developments of the City, and requested equal consideration in any future City funding of non-profit groups. Mrs. Vesta Cruser sustained Mrs. Biggs' and stated the good work done by the group. Mrs. Nancy McClees of the Tidewater Dance Guild, Inc. noted that while lwr organization was titled "Tidewater" Dance Guild, Inc. it had its offices and studios in Virginia Beach the title merely indicated the acceptance of students from the Tidewater area. Mrs. McClees noted that competition from a subsidized ballet group could effect her business. Miss Anna Smelser, representing the Riverton-on-the-Elizabeth Company of the Performing Arts, noted that her company had produced many outstanding artists and that competition from a government subsidized group would be difficult to cope with in the future, Miss Smelser requested consideration in any future grants. Mrs. Penelope Martin, appearing on behalf of the Little Theatre of Virginia Beach, City Council had extended an assistance grant to buy a theatre building. Mrs. Martin wanted to emphasize that the Little Theatre group was operating on a business basis and had to rent the building in order to amortize the mortgage payments, hence could not grant the ballet group free rental. At the conclusion of the presentation, Mayor Cromwell, again, reiterated that the Commission on the Arts and Humanities would be requested to give a recommendation regarding any grant to non- profit agencies. Mr. Wright noted that the Commission had not, as of this time, been appointed and that they were only required to make a report once a .year. He indicated that the Virginia Beach Civic Ballet would not wait that long for a determination as to their eligibility. Mayor Cromwell requested direction from the City Council. ITEM #6164 (c) Councilman Baum stated that the Council more or less simultaneously took up this matter and the formation of the Fine Arts Commission at the same time. It was discussed as to the problems Council might have with different charitable organizations, but we've already passed it. It seems to me Council does have a committment to stick to our word, unless Council has some over-riding reason to change our mind, and on that basis I move the $8,000 grant be made to the Virginia Beach Civic Ballet, seconded by Councilman Payne, and by recorded vote as follows: Ayes: Councilmen John A. On Motion by Mr. Ervin and seconded by Mr. Gardner the following resolution was unanimously adopted. R E S O L U T I O N WHEREAS, there exists an interest in the arts and humanities in the City of Virginia Beach; and WHEREAS, to promote this interest and to provide a coordinating agency to make recommendations to the City Council concerning financial assistance for cultural activities; and WHEREAS, to serve this purpose, the Council of the City of Virginia Beach desires to establish a Commission of the Arts and Humanities. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH: Section 1. That there is hereby established a Commission of the Arts and Humanities to serve in an advisory capacity to the City Council. Section 2. That said Commission shall be composed of eleven at large delegates, appointed bv the City Council, to serve for a period of two years, and a delegate from each of the following groups: Virginia Beach Civic Ballet Virginia Beach Arts Center Virginia Beach Civic Chorus Virginia Beach Civic orchestra & Beach Concert Singers Virginia Beach Friends of Music Little Theatre of Virginia Beach Princess Anne County Historical Society Tidewater Dance Guild Section 3. That the said Commission shall make its recommendations for financial assistance concerning cultural activities to the City Manager by January 31, 1974, and for each year thereafter. Section 4. That the City Manager is authorized to designate an ex officio member from his staff to serve the Commission as liason. Section 5. Such Commission shall serve in their advisory capacity until abolished by the Council of the City of Virginia Beach. WHEREAS, pursuant to Chapter 339, Acts of the Assembly, 1973, approved March 15, 1973, the Board of Directors of the Virginia Truck and Ornamentals Research Station, subject to the approval of the Governor, is empowered to sell and convey by deed to the City of Virginia Beach the following described property: All that land with any improvements thereon, lying and being in the Bayside Borouth of the city of Virginia Beach, Virginia, cons ating of that portion of the property designated as the Virginia Truck and Ornamentals Research Station, lying to the west of State Route 166. WHEREAS, the above described property is suitable for indus- trial and commercial development, BE IT ORDAINED by the Council of the City of Virginia Beach, Virginia: Section 1: That the City of Virginia Beach agrees to acquire the above said property from the Virginia Truck and Ornamentals Research Station for a purchase price and on terms and conditions of an agreement to be established between the Board of Directors of the Virginia Truck and Ornamentals Research Station and the City of Virginia Beach (working in conjunction with the City of Virginia Beach Development Authority) pursuant to Chapter 339, Acts of Assembly, 1973; Section 2: That upon conveyance of the said property to the City of Virginia Beach and payment therefor, the City of Virginia Beach agrees to convey the above described property to the City of Virginia Beach Development Authority for industrial and commercial development and the City Manager is authorized to execute and deliver a deed to the aforesaid land to the City of Virginia Beach Development Authority simultaneously with the receipt of a deed for the property from the Virginia Truck and Ornamentals Research Station; Section 3: That this ordinance shall be effective only if and when the City of Virginia Beach Development Authority agrees, by adoption of a resolution, to reimburse the City of Virginia Beach the total purchase price for the above described property as prescribed by the terms and conditions of the said agreement to be established between the Board of Directors of the Virginia Truck and Ornamentals Research Station and the City of Virginia Beach. Curtis Payne as an alternate to the Regional Water Authority. Councilman Baum then made a motion, which was seconded by Councilman Gardner, to nominate Vice Mayor F. Reid Ervin as an alternate to the Regional Water Authority. Councilman Holland, seconded by Councilman Waterfield, moved to close the nominations for alternates to the Regional Water Authority. ITEM #6170 Councilman Holland read a letter from the State Air Pollution Board regarding a public hearing, to be held on Auuust 9, 1973, regulating the additional requirements for approval of plants, industries and subdivisions to be made a condition of approving the building and use permits. Councilman Holland indicated it would be an appropriate move to send an official delegate to tht public hearing. ITEM #618(i Vice Mayor Ervin requested the City j%lan@iger to check into and make recommendations to Council to niodifn- thin BOCA Code to restrict the building of high rise apartments in"'critical zones,, without pile foundations. ITEM #618@ Vice Mayor Ervin requested the City Maniger to discuss with Colonel Davis the problems that arise from beaching catainarans on the public beaches in an effort to provide some of avoiding serious accidents. ITEM #6182 Vice Mayor Ervin requested the City Manager to take steps to insure,@ ly a stricter enforcement of the existing Dog Ordinance particuiiii in relation to stray dogs on the beaches.
