PUNGO TRAIL- STATUS OF ISTEA GRANT

Susie Walston, Director of Parks and Recreation, advised the Pungo Trail is a Parks and Recreation
Capital Project (CIP 4-961) which was new in FY 1994-1995. The project was created because of the
approval of an ISTEA (Intermodal Surface Transportation Enhancement Act) Grant in December 1993.
The grant was applied for by City Staff and was based on the 1986 Master Bikeway Plan. One of the
bikeways in the 1986 plan was along the Virginia Power Right-of-Way from Dam Neck Road to Pungo
and ultimately to Munden Point Park. This trail corridor has been named the Pungo Trail A portion of
the trail (approximately 2,500 linear feet) has been developed from Dam Neck Road to Winterberry Lane
in the Landstown Meadows Subdivision. There has been OPPOSITION from neighborhoods along the
trail primarily from Courthouse Farms and Princess Anne Crossing. Mrs. Walston recognized Marilyn
Lombardy, a resident, who has written correspondence expressing these concerns. This briefing is to
address those concerns.
Barry Frankenfield, Planner- Department of Parks and Recreation, displayed the completed section on
the map. Approximately eight Public Meetings were held with the Virginia Beach Outdoors Plan; however,
the Princess Anne Crossing neighborhood did not attend. The "dash red line" depicted on the
aforementioned map, is the area through the neighborhoods who oppose the trail When surveying and
site testing was done, it was found some residents were not aware of the trail. Another meeting was held
in December with surveys conducted. Approximately seventy (70) people attended. The reasons for
opposition were safety, increased crime, property values, privacy, unauthorized access by motor vehicles
and homeowner liability. The staff met with a Subcommittee of the Princess Anne Crossing and
Courthouse Farms' residents. Attempts were made to devise alternates and address concerns. The
"dashed blue line" on the map is the alternative presented to VDOT, which wouM completely avoid the
Courthouse Farms and Princess Anne Crossing neighborhoods. The VDOT responded that if the trail
was not continuous, it did not meet the intention of the grant; however, VDOT was willing to have it be
continuous, just in space, and not in the paving (left open and be the extsting grass situation). The City
has acquired a twenty-foot easement in the Virginia Power Right-of-Way to all#w for the development
of the trail. In conjunction with the neighborhoods, VDOT and planning for other improvements, four
alignments for the Pungo Trail in this area have been developed as listed below.

Based on the research, coordination with other projects, and the opposition from adjacent neighborhoods,
it is recommended the Pungo Trail be realigned to Princess Anne Road in the corridor from Winterberry
Lane to the Municipal Center (Option tM). This will allow for complete bicycle/pedestrian access to
future amenities developed along this corridor while avoiding the conflicts with an opposition from
residential neighborhoods. It is possible the grant could be applied to another trail project in Virginia
Beach. City staff recommends the Princess Anne Road Alignment, as the appropriate option for this trail
project.

Councilman Jones referenced the traffic light at Bay Lake/First Court under consideration.
Representatives of the Church Point area have a petition of approximately 600 signatures regarding
design changes.
John Herzke, Traffic Engineer, advised the residents attended a meeting with all the area Civic League
representatives on .4pril 24, 1997. Mr. Herzke spoke on Friday with Alfred ~4rthur - President, Church
Point Civic League, who indicated the modification requested was to delete the new signal proposed to
be installed at Bay Lake and Shore Drive. Mr Herzke explained part of the project was to close off the
intersection of First Court and Shore Drive due to the accident situation at this intersection. When the
traffic at this intersection is combined with traffic already existing at Bay Lake, plus with the development
of the golf course, the continued development of Church Point, the Recreation Center and the Park all
being serviced by that roadway, a traffic signal is needed. The Civic League wishes the improvements
made without the traffic signal. Response comments will be assembled and faxed to the City Council.
Mayor Oberndorf referenced the opposition of Mrs. Boyd, who expressed concern over the closing the
intersection of First Court.

This letter is in response to thc written comments that you submitted at our May 6, 1997
public hearing on the 1997-98 budget. Thank you for your interest in the budget process as it
relates to the funding of our school system. As you are aware, we face critical and expensive
long-term needs in technology and modernization for both our City and Schools. We must look
ahead to a strategy for addressing these issues while providing adequate resources to provide
continued quality services.
Consistent with our conversations with school staff, we anticipate that the level of funding
provided to the schools wiU be adequate to maintain current instructional programs and provide
for expansion ofthe gifted and magnet programs, the class size initiative, and the four-year old at-
risk program. We have allocated ~nds that we feel are sufficient, however, it is up to the School
Board to make these specific funding decisions.
The revenue sl~aring policy that you have dismissed as insincere was developed as a
framework to objectively divide all of our projected revenue growth with the school system. For
next year, it provided our schools with the largest percentage increase in local funding in our
history. It was adopted only after weeks of delay to permit discussions with school officials. The

Wc are responsible for balancing the needs of all of our citizens, includin~ those who
spoke up loud and clear to indicate that they did not want a tax increase. Since only City Council
has taxing authority, we must be responsible as well as responsive to the citizens. Every year,
Council re, embers scrutinize all of the budget requests received from the City and thc Schools
We did not feel that answers to our questions about the school budget justified cutting City
services or raising taxes.
Your argument that we can find an additional $5 million for school operating expenses
from our fund balance is not based on factual information. You refer to a cash reserve of almost
$103 million when, in fact, our undesignated fund balance is actually about $57 million. We
maintain our fund balance at thc equivalent of at least 75% of our annual debt service requirement
to protect our AA bond rating This keeps down the cost of borrowing for projects like roads and
schools and cushions the community against a catastrophic incident
I agree it would be irresponsible to attempt a budget adjustment by inflating revenue
projections We suggested an increase in the projected F~leral Impact Aid estimate by $250,000
to a level substantially below the level already received this fiscal year. Comparing that with what
went on during Fiscal Year 1995 is either intentionally misleading or misinformed!
We share your concern that the real needs of the community, not politics, should be the
number one priority during this important process. We hope that the School Board and City
Council will work cooperatively toward a common, realistic vision for our community, as that is
our best hope for addressing thc major needs that loom befor~ us.

Mayor Ob~rndorf and Members of City Council,
No single attribute has been more in.,~rumental to the success and quality of life of this
community than its public school system. I know this personally as a parcnt whose successful
children are graduates of Vir$inln Beach City Public Schools. I know it professionally as well.
As a man who has been involved in real estate and land development in Virginia Beach, I can
attest to the simple truth: This city owes its phenomenal economic development over the past 20
years to its public school system. I challenge each and everyone of you to start taking a poll
among members of this community. Ask them why they live here and I bet an overwhelming
majority ~11 reference the schools. '
Have you forgotten the economic development engine that has brought you to the point
that you cna consider a soccer stadium and a professional golf course? More importantly, have
you forgotten thc children whose future success depends largely on this excellent school system?
It appears to me and to many others that you have.
Recently I beard a s~nker at a School Board meeting note that the debate between
Council and the School Board was not about education or children, but about power. Inside
myself I shouted, "Amen.'
The arrogance that has been exhibited by this City Council and city administration during
these budget negotiations is nothing short of frightening. I*11 share a few examples in a few
minutes. Quite frankly, I address this part of my remarks to the audience here today, to whatever
media is here and to those who watch these meetings on television, because our only hope lies
with you. The only way we can change the tragedy of under-funding our schools is if this
citizenry rises up and demands it.
· Consider these sad facts:
1. Our school system has been held hostage by a revenue-sharing policy volleyed over by
thc city administration and rnmrodded through by City Council in spite of the expressed
concerns of the School Board and school administration. If the city was sincere about
developing a policy that was in the best interests of both entities then why was this imperator
document not developed collaboratively? I f'md this strangely reminiscent of Norfolk's
experience, when Virginia Beach signed a contract with North Carolina that adversely affected
that city's water sales area and didn't even bother to invite them to the bargaining table. Do we
see a ~ of arrogance here? Shouldn't stakcholdcrs be allowed to come to thc table?
2. The city has consistently tried to point to the school system as the reason behind tax
increases. Yet, even in the year of the deficit when a tax increase was levied and thc schools
cited as the reason, this city ended the year with a $21 million surplus.

l~. Thc city has asked thc school system to adjust its budget by inflating its revenue
estimates; by using most of its reversions in a stop-gap way for tho opcrating budget and capital
projects; and by dramatically adjusting its appropriation for staffing positions. This is exactly the
kind of thinking that put the school system into a deficit position in FY 95. How can a city that
faced such a tragedy employ practices that will put its school system at risk again? Can this, too,
be chalked up to the arrogance of power? Fool us once, shame on you. Fool us twice, shame on
tlS.
4. Why is it that a city that has a cash reserve of almost $103 million cannot deign to find
$$.$ million for its schools? The answer? It bee to bc arrogance.
So I close by entreating, not City Council, but thc good people of this community. This
City Council needs to fully fund our school system's budget request which has already been
reduced by $7 million. We can no longer tolerate the fact that our school system, the second
largest in thc state, ranks 71~ out of 133 localities in per pupil expenditures. Let City Council
hear your voice. Virginia Beach's future most certainly depends on it.

16 current technology the Vehicle Management System central computer
17 to further improve air quality in Virginia Beach;

WHEREAS, the Virginia Department of Transportation has
19 designated $72,000 in available Congestion Mitigation and Air

The City of Virginia Beach, Commonwealth of Virginia, hereinafter referred to as
VIRGINIA BEACH, and the Commonwealth of Virginia, Department of Transportation,

Quality project for the purchase of equipment for a VMS
computer upgrade, Project U000-134-151, PE-101, C-501
and Federal Project CMG-5413 (476).
VIRGINIA BEACH will prosecute the project as designed and
requests .the DEPARTMENT to submit the project with
recommendation that it be approved by the Commonwealth
Transportation Board/Federal Highway Administration and
agrees that if such project is approved by the DEPARTMENT,
VIRGINIA BEACH, thereafter, at its own expense, will
maintain the equipment, or have it maintained, in a manner
satisfactory to the DEPARTMENT or its authorized
representatives and will make ample provision each year for
such maintenance.
