The regular meeting of the Council of the City of Virginia Beach, Virginia, was
ileld in the Council Chambers, in t~e Administration Building, in the Borough of
Princess Anne, on Nonday, October 20, 1975, at 2:00 p.m.
The invocation was given by the Reverend Sidney Willis, Haygood United Methodist

Application of Rosso and Mastracco, Incorporated for a Conditional Use Per-
'mit for a gasoline supply station (self-service) om certain property located
on the North side of Virginia Beach Boulevard beginning at a point 300 feet
more or less West of the intersection with North Lynnhaven Road running a
distance of 800 feet more or less along the Eastern property line, running
a distance of 830 feet more or less along the Northern property line, running
a distance of 780 feet more or less along the Eastern property line and run-
ninga distance of 1,200 feet more or less along the Southern property line
of which 720 feet more or less is the North side of Virginia Beach Boulevard.
Said parcel is located in the Southeast section of Lsmnhaven Shopping Center.
Plats with more detailed information are available in the Department of
Planning. (Chesopeian Colony Area). LYN~VEN BOROUGH.
Planning Cormmission Recommendation:
A motion was pass=_d by the Planning Commission by a recorded vote of 9 for th~
motion and 4 against the motion to approve this request.
For the information of the applicant, prior to the issuance of a building 'per-
,_.mit, the follc~.¢ing will be required by the administrative staff:
Standard site improw-~ments as required by the Site Plan Ordinance.
2. Operations shall include only the sale of gasoline and motor oil.
3. Appropriate striping and signing shall be installed to insure a one-:.,ay

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA:
WHEREAS, the Council of the City of Virginia Beach, Virginia has authorized the
Lynnhaven Parkway, Phase II Project and has approved same for right-of-way acquisition;
and
WHEREAS, in the opinion of the Council of the City of Virginia Beach, a public
necessity exists for construction of this important project for the preservation of
the safety, health, peace, good order, Comfort, convenience, morals and for the welfare
of the people in the City of Virginia Beach.
NOW, THEREFORE, BE I2~ ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH,
VIRGINIA:
Section 1. That the City Attorney and/or Assistant City Attorney is hereby
authorized to acquire by purchase or condemnation, pursuant to Section 15.1-236 et
seq. and Section 25-46.1 et seq., Code of Virginia of 1950, as amended, all that
certain real property, in fee simple, including temporary and permanent easements of
right-of-way ms shown on Plans for Lynnhaven Parkway Phase II as prepared by Wiley
and Wilson, Consulting Engineers, Virginia Beach, Virginia and on file in the Depart-
ment of Community Services, Municipal Center, City of Virginia Beac'h~ Virginia.
Section 2. The City Attorney and/or Assistant City Attorney is hereby authorized
to make, or cause to be made, in behalf of the City of Virginia Beach, a reasonable
offer to owners or persons having an interest in said lands, if refused, the City
Attorney and/or Assistant City Attorney is hereby authorized to institute proceedings
t© condemn said property.
Section 3. That an emergency is hereby declared to exist and this ordinanc~
shall be in force and effect from the date of its adoption.

DISCONTINUING A PORTION OF
PROVIDENCE ROAD, KEMPSVILLE
BOROUGH, CITY OF VIRGINIA BEACH,
VIRGINIA
WHEREAS, proper notice that the

i~ of Providence Road closed, vacated and discontinued as a public

0.365 acre, more or less, as appears on that

Portion of Providence Road adjacent to Avalon

Borough, Virginia Beach, Virginia, Consultant
Engineering Services, Inc., 305 Birchwood
Drive, Virginia Beach, Virginia" and further
described as follows:
Beginning at a point at the VDH Monument on
Beryl Avenue at its southwest intersection with
old Providence Road at the northeast corner of
property of Richard F. Humphries, et ux, and
from said point of beginning turning and running
along a curve to the left having a radius of
1,579.52 feet and an arc length of 140.27 feet
to a pin; thence 6ontinuing along the curve to
the left of a radius of 1,579.52 feet and an

at the southeast side of a certain VEPCO iRight
of Way Easement; thence turning and running North

thence continuing along the curve having a radius of

to a point; thence along a curve to the right
having a radius of 20 feet and an arc length
of 38.02 feet to a point which is the extended
western right of way of Beryl Avenue; thence
along said right of way south 14°25'35'' West

Section 2. That 30 days.after this date a copy of
this Ordinance, certified by the Clerk, be spread upon the public
records in the Clerk's Office of the Circuit Court of this City
and indexed in like manner as a deed to lands.

had been indicated that the use of a lime stabilizer, instead of the more

~,ir. F. Reid Ervin appeared before City Counc~il in regard to a statement made
by Scl~ool Superintendent, Doctor E. E. Brickell, concerning the availability
and/or ownership of certain school sites in the Indian Lakes area and the
Princess Anne Plaza area. It appears from remarks made by Doctor James .b~ounie,
Assistant Superintendent of Schools, that economic conditions have delayed the
development of subdivisions in both areas and resulted in change of ownership
in the u~developed sites. Tile question was raised as to the ~esponsibility of
..... he new owners to honor the commitments made by a former owner and some
.onsequent trading of real properties to provide school sites without cost to
~e City.
