Henry McCoy, Jr. ity Council voted to approve the following ordinance to amend and reordain rticle I, Chapter 10, of the Code of the City of Virginia Beach, Virginia, relating to misdemeanor offenses: AN ORDINANCE TO AMEND AND REORDAIN ARTICLE I, CHAPTER 10, OF THE CODE OF THE CITY OF VIRGINIA BEACH, VA., RELATING TO MISDEMEANOR OFFENSES BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH, VIRGINIA: That Article I, Chapter 10, of the Code of the City of Virginia Beach, Virginia is amended and reordained as follows: Section 10-1. General Penalty. Whenever in this Code or in any other ordinance of the city any act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, and no specific classification has been ascribed to it, nor any reference made to any penalty or punishment prescribed in the section or sections that thus define or include the offense, then the violation of such provision of this Code or other ordinance of the City shall be punished as a class I misdemeanor as hereafter provided. Each day of any violation of the provision of any section of this Code or other ordinance of the city shall constitute, except where otherwise provided, a separate offense. Section 10-1.1 Punishment for Classified Misdemeanors. The authorized punishments for conviction of classified misdemeanors are: (a) For a class I misdemeanor, confinement in jail for not more than twelve .months and a fine of not more than one thousand dollars, either or both. (b) For a class II misdemeanor, confinement in jail for not more than six months and a fine of not more than five hundred dollars, either or both. (c) For a class III misdemeanor, a fine of not more than five hundred dollars. (d) For a class IV misdemeanor, a fine of not more than one hundred dollars. This ordinance shall be in full force and effect on October 1, 1975. Laboratories and establishments for the production and repair of eyeglasses, hearing aids and prosthetic device s; Marinas, including facilities for storage and repair of boats and sale of boating supplies and fuel; Museums and art galleries; Newspaper printing and publishing, job and commercial printing; Nightclubs, bars, taverns, dance halls; Passenger transportation terminals; Personal service establishments, including barber and beauty shops, shoe repair shops, cleaning, dyeing, laundry, pressing, dressmaking, tailoring and garment repair shops with processing on the premises; Private clubs, lodges, social centers, eleemosynary establishments and athletic clubs; Public buildings and grounds; Public utilities installations and substations including offices; provided storage or maintenance facilities shall not be permitted; and provided, further, that utilities substations, other than individual transformers~ shall be surrounded by a wall, solid except for entrances and exits, or by a fence with a screening hedge five (5) to six (6) feet in height; and provided also, transformer vaults for underground utilities and the like shall require only a landscaper] screening hedge, solid except for access opening; Radio and television broadcasting stations and line- of-sight relay devices; (27) Retail establishments, including the incidental manu- facturing of goods for sale only at retail on the pre- mises; retail sales and display rooms and lots, provided that yards for storage of new or used building materials or yards for any scrap or salvage operations or for storage or display of any scrap, salvage or second-hand building materials or automobile parts shall not be allowed; Veterinary establishments and commercial kennels, provided that all animals shall be kept in sound- proofed, air-conditioned buildings; (29) Wholesaling and distribution operations, provided that such operations do not involve the use of: (i) more than 2,000 square feet of floor area for storage of wares to be sold at wholesale or to be distributed, or (ii) any vehicle rated at more than one and one-half ton capacity, or (iii) a total of more than five (5) delivery vehicles.
