A special meetin~ of the Council of the City of Virginia Beach, Virginia, was
held in the Council Chambers, in the Administration Building, in the Borough
of Princess Anne, on Monday, August 25, 1975, at 8:00 p.m., for the. purpose of

Methodist Church, Virginia Beach, Virginia.

Mrs. Ellen lq. Sneed, representing Eureka Park, appeared before Council
re.questing a play area for the children of the area.
The City Manager stated that the Department of Parks and Recreation has been
aware of the problem for some time, and will work ~ith the residents in the
area to alleviate this problem.

Mr. James Nimmo, representing the Clarence Morgan Committee, appeared before
Council requesting the reopening of the Clarence Morgan investigation.
Ms. Isabelle Vabriskie also appeared before Council regarding this matter.
Ms. Veronica Gold, a member of the Clarence Morgan Committee, sthted she
was very concerned as to the handling bf the investigation; and also informed
Council that the Committee was going to continue with the investigation.

City Council approved the following ordinance vacating portion of subdivision
plat which created certain drainage easements on certain property in the
Kempsville Borough:
AN ORDINANCE VACATING PORTION OF
SUBDIVISION PLAT WHICH CREATED CER-
TAIN DRAINAGE EASEMENTS ON CERTAIN
PROPERTY IN KEMPSVILLF BOROUGH,
VIRGINIA BEA CH
WHEREAS, a certain 20' drainage easement as shown on the plat
recorded in the Clerk's Office oY the Circuit Court of the City of Virginia
Beach in Map Book 10Z, at page 50, was previously dedicated to the City of
Virginia Beach, Virginia, for the installation and/or maintenance of
drainage facilities, including surface and underground drainage facilities
and
WHEREAS, Sir Galahad Company, the owner of a parcel of land over
which some of said easement runs, has applied for vacation of said ease-
ment; and
WHEREAS, public notice of intention to vacate said easement has been
given by publication and advertisement as required by law; and
WHEREAS, a portion of said easement to be vacated is not necessary
to drain said properties and said easement has not been used and is not
ne cessary for surface and 6nderground drainage facilities;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VIRGINId
BEACH, VIRGINIA:
Section 1. That the foll0wing portion of Subdivision Plat constituting
an easement for the installation and/or maintenance of drainage facilities
on a parcel of land owned by Sir Galahad Company and located in the
Kempsville Borough of the City of Virginia Beach is hereby vacated pursuant
to §15.1-482 of the Code of Virginia, as amended, said easement being more
particularly described as follows:
An easement 20' in width and approximately 1500' in length
running from the southwest to the northeast edge of Indian
Lakes Subdivision, Section B-1 and being shown as "Existing
20' drainage easement to be vacated on the 'Plat
of Indian Lakes Subdivision, Section B-l, Kempsville
Borough, Virginia Beach, Virginia,' which said plat
is duly recorded in the Clerk's Office of the Circuit
Court of the City of Virginia Beach, in Map Book
102, at page 50.
Said easement to be vacated is shown on that certain plat entitled, ,
"Plat of Indian Lakes Subdivision, Section B-I, Kempsville Borough,
Virginia Beach, Virginia," which plat is recorded in said Clerk's Office
in Map Book 10Z, at page 50.
Section Z. That this ordinance shall be effective from and after
date of adoption.

City Council approved the following ordinance to amend ordinance number 486
of the Code of the City of Virginia Beach relating to site plan regulations
Title III, Appendix:

AN ORDINANCE TO AMEND ORDINANCE NUMBER
486 OF THE CODE OF THE CITY OF VIRGINIA
BEACH RELATING TO SITE PLAN REGULATIONS,
TITLE III, APPENDIX
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF VIRGINIA BEACH,
VIRG IN IA:
That Ordinance Number 486, Title III, Appendix, is amended as
follows:
1. By adding to Section 1 a new subsection 1.14, as follows:
1.14. Undeveloped Property.
Either vacant land, or land with a building, the existing use
of which differs from its present zoning district classification, or
the existing use of which is proposed for a change of occupancy.
2.' By adding to subsection 4.1(b) a new subsection 11 as
follows:
11. A definite distance tie to an existing street intersection
shall be provided.
3. By deleting present section 5.2 and substituting therefor
the following:
5.2. Where undeveloped property is adjacent to a minor residential
street of less than fifty feet (50') in width, or a major residential
collector or commercial-industrial street of less than sixty feet
(60') in width, or any street designated on the adopted Master Street
and Highway plan which is less than the ultimate design width, the
City may require a dedication of right-of-way not to exceed fifteen
feet (15'). If the City determines additional right-of-way is
necessary, the City may either purchase it outright or at its option
reserve the additional right-of-way during the life of its inclusion
in the ~.~ster Street and. Highway plan. The value of any right-of-way
that the City decides to reserve or purchase shall be raw land value.
Raw land value shall be determined as of the date of recordation of
the reservation or purchase agreement or the date of final site plan
approval, whichever is sooner. Before an occupancy permit is issued,
the installation of full right-of-way improvements shall be made by
and at the expense of the site developer, and at no cost to the City;
provided, however, that the City may defer the actual improvements,
and in lieu thereof, the developer shall pay to the City an escrow
payment for the estimated cost of the required improvements. Ail
building setbacks shall be measured from the proposed right-of-way
line.
4. By deleting the present subsection 7.1 and 7.2 and sub-
stituting therefor the following:
7. Variances and Appeals
7.1. The City b~nager is authorized upon appeal in specific cases
to grant a variance from the terms of the ordinance as will not be
contrary to the public imterest, when owing to special conditions,
a literal enforcement of the provisions will result in unnecessary
hardship provided that the spirit of the ordinance shall be observed
and substantial justice done, as follows:
1) Strict application of the terms of the ordinance
will effectively prohibit or ~nreasonably restrict the use of
the property.
2) Granting of such variance will alleviate a clearly
demonstratable hardship approaching confiscation as distinguished
from a special privilege°
In authorizing a variance the City Manager may impose such
conditions as may be necessary in the public interest.
7.2. It is further provided that any decision of the City Manager
may be modified, reversed or affirmed by the City Council upon appeal
by any aggreived party to such decision if such appeal is filed within
30 days of such decision.

7.3. Final decisions under this ordinance shall be subject to
review by the appropriate court of record if filed within 30
days from the date of Coumcil action.

A 15-foot dedication of right-of-way along Bonney Road

Applicants shall submit an appropriate recordable
instrument entering into a covenant with the City

effective date of closure of the above referenced streets.

WHEREAS, it appearing by affidavit that proper notice

Vi,ce, Mayor Ferrell stated he received a call from Mrs. Masie Helpin with
~regards to a, petition she signed for water hook up.
Vice Mayor Ferrell informed the City Manager that the Department of Public
Utilities has misplaced the contract, and requested Mr. Hanbury to check
with the Department of Public Utilities with regards to this matter.

Councilman Holland stated he placed before each Councilman a paper on the
Solid Waste Study. The recent work that has been done by the consultants
on this, and the work that has been done toward obtaining customers for the
---ase of the trash to produce the steam has been worked out, but not signed.,
kt the last planning district meeting it was brought out that the Authority
could be incorporated in with the present Water Authority, if all of the
eight jurisdictions in the Water Authority agreed.
Councilman Holland further stated he was asked to bring this back up before
Council to see about the possibility of acting on the resolution and being
able to put in the resolution, if passed, that it would be at no expense to
the City; and further requested Council to act on this prior to the next
Planning District meeting, which will be the third Wednesday in September.
Mayor Payne requested the City Manager to have this matter placed on the
Council agenda for September 8, 197S, and also to invite Mr. Jim Kissell
to be present to discuss this with Council and answer any questions they
may have.

Councilman Callis requested that the City Manager expedite the submission of
the report being prepared by consultants regarding pollution in the Lynnhaven
River.
The City Manager stated that the Lynnhaven Report will be on the agenda of
_%eptember 8, 1975, and each Councilman will receive a copy of the report
rior to that meeting.

Councilman McCoy suggested that the City observe the law being enforced at
Ocean City, Maryland regarding thee wearing of shirts by males on the board-
walk, streets and public areas which is presently being tested in Maryland
by a court case.
