For some unknown reason, this Ordinance was never recorded and we cannot locate the original. Pursuant to Section 8.01-390 of the Code of Virginia, as amended, I enclose a certified copy of said Ordinance and an Affidavit which has been executed by Ruth Hodges Smith, City Clerk, for recordation by you. We will be glad to assist you in the recording of these documents. I thought, however, that you might wish to handle the recordation yourself to make certain that these documents appear in your client's chain of title. It is difficult to speculate as to why the Ordinance to vacate a portion of Pembroke Boulevard was never recorded. We apologize, however, for this oversight and any inconvenience your client may have suffered. Hopefully, the enclosed certified copy of the Ordinance and Affidavit will help resolve this matter.
