Mayor Oberndorf called to order the REVIEW OF AGENDA ITEMS in the Council Conference Room,
City Hall Building, on Tuesday, November 14, 2000, at 11.'30 A.M..
Mayor Oberndorf recognized Mary Ann Graham, Chief of Business Services, United States Coast Guard,
who has requested to be the Mayor's "shadow "for three (3) days. Mayor Oberndorf said she was a bright
articulate young lady and a sterling example of the fine individuals employed, promoted and nurtured by the
Coast Guard. The Mayor introduced Ms. Graham to the members of City Council, City Manager, City Clerk,
and Assistant City Attorney.

Council Lady Eure requested clarification in the Income Statement of Kings Grant Community League,
Inc. The amount depicted was $435,000; however, their newsletter states the League raised $2,905 in total
revenue. The two funds do not match. Council Lady McClanan requested the four (4) tax exemptions be
voted on individually. This item will be discussed during the Formal Session

Ordinance to AMEND the FY 2000-O1 School's Capital Budget and
APPROPRIATE $6,662,282 in Reversion Funds and $3,890,538 in

Assistant City Attorney Randy Blow distributed a revised resolution. Mr. Blow advised:
Lines 59-60 and 112-113 shall be amended:
(b) $1,350,000 to CIP #1-218, Kempsville Meadows Elemental_
School Modernization;
Council Lady Wilson inquired relative the schedule of modernizations. Bayside Sixth Grade Campus was
not an original project. It became more time-sensitive when a huge overload of children was created with
the merging of two campuses. Council Lady Wilson believes this $1,350,000 was to be utilized toward the
Bayside addition. The City Manager shall provide information. Mayor Oberndorf advised Dr. Jenney,
Superintendent of Schools, spoke with the Mayor's Youth Council. Representatives of the Bayside Middle
School were in attendance and voiced their concerns relative the over crowding. Council Members Eure and
Branch met with Dr. Jenney and members of the School staff who reviewed the report of modernizations.
The difference between the amount projected in the modernization program, including all the lottery
proceeds, was approximately $134-MILLION. Cost overruns to-date are approximately $875,000, which
is very good The staff is preparing a report for City Council on December 12, 2000, relative the
modernization and revenue sharing formula. Councilman Branch advised their role as Liaisons was to
track the financing issues. Councilman Jones requested a representative of the School Board address the
issue of Bayside. Council Lady Henley referenced the $1,200,000, to reducepurchase of replacement buses
in the FY 2000/2001 Operating Budget. The City Manager advised the School Board is purchasing 50
buses and attempting to get into the routine schedule of the 12-year replacement cycle. Relative the funds
within the budget for the placement of the buses, representatives of the School Board will respond during
the Formal Session.

The applicant has requested DEFERRAL until the City Council Session of December 12, 2000, to revise his
plans to address concerns of property owners in the surrounding areas.

Council Lady Eure inquired relative the Board of Zoning Appeals ' variance to decrease a required 15-foot
buffer to five feet on the eastern border where the property abuts residential zoning. Steven White -
Planning, advised this is a buffer reduction which was part of the application on June 13, 2000. The building
itself will still be 15feet away from the residential area. A reduction in the width of the landscape buffer
is required as part of the stormwater facility is located within the buffer area.

ITEM # 47363
Mayor Oberndorf referenced Council Lady Parker's suggestion that City Council review the major high
finance projects and that they meet informally for approximately ~ day to determine priorities and examine
the recommended financing, i.e. Convention and Conference Center, Expansion of Marine Science Museum,
Stormwater Management fees and Open Space.
Council Lady Henley suggested a meeting be scheduled in January. Council Lady Eure requested the
Agricultural Reserve Program be included for a review of the funds which will be expended, how this fits
in with the reduction in income from the State and its impact,
Councilman Branch inquired relative the Five-Year Forecast Joint Meeting with the School Board. The
City Manager advised the date has not been scheduled Councilman Branch believes these issues shouM be
scheduled in proximity.
The City Manager advised the Governor's Budget will be available after December 19, 2000.
Januaryl 6, 2000, will be tentatively scheduled an informal meaningful dialogue of the above projects.
ITEM # 47364
Mayor Oberndorf accompanied the Director of Economic Development and others to New York for the
Governor's Report to Industry. While there, Mayor Oberndorf visited St. Vincents Catholic Medical
Center of New York. Mayor Oberndorf met the nurses who worked with the deceased (Maryann Dono,
Mary Ann Going, Kathleen Mollick-Kelly and Joan Ellen Walsh). One nurse was in charge of the premature
infants. As the staff is very close, almost like family, Mayor Oberndorf couM understand why four
individuals would be so desperately missed. Mayor Oberndorf told St. Vincents' personnel she was there
on behalf of the City Council and citizens of Virginia Beach to once again express the City's sorrow. A
nursing student scholarship fund, with tax-exempt status, has been established For one week, the New
York Times ran the pictures and story of the four nurses tragic deaths in Virginia Beach. Mayor Oberndorf
will receive a letter from Saint Vincents relative this fund and suggested the assistance of the Virginia Beach
Hotel/Motel Association as well as others. The police officers and fire fighters volunteered to drive the
hospital personnel to the wakes and back in time, as all personnel could not be absent at the same time. The
Executive Director said this brought New Yorkers together and made an extraordinary difference.

Councilman Mandigo complimented the City staff relative the Open Space Report on November 7, 2000.
This was a very comprehensive report and was presented very professionally. The staff did an excellent job
in synthesizing the opinions and comments of the public.

Steve Pittman
Dr. Hamada advised Virginia Beach and MiyazaM were very elated Mr. Pittman is going to carry a "torch
of spirit and friendship" to the internationally acclaimed "Marathon for the Visually Impaired" in Japan.
Mr. Pittman is not only an outstanding athlete, but a great ambassador of Virginia Beach to Japan in
December 2000..
Steve was accompanied by his wife, children, his mother-in-law and father.
Mayor Oberndorf presented a warm-up suit and running attire, bearing the City Seal of Virginia Beach.
Steve has been second in the competition each year. The Marathon this year is 26 miles.
The City Clerk advised Steve takes "leave without pay" from his work each year to participate in the
Marathon.
Ken Jessup - representing the Disabled Community, will be accompanying Steve. His own funds are utilized.
He will be leaving November 3ffh and returning December 14th.

brought 180 hours from Green Thumb, Inc. and as of March 29, 2000, 595 hours from
Community Corrections. Additional volunteer involvement by Friends School students
for Community Service requirements totaled 41 hours and a permanent volunteer
averages three hours per week for the past five years.

Things Unlimited provides a myriad of services. As a direct funding source to Virginia Beach
Friends School, it was, in the School's infancy, the prime income source. Now Things
Unlimited provides student financial aid for children who would benefit from Friend's
principles and practices but those parents lack sufficient funds for a private education. In
direct relation with the school, Things Unlimited provides some supplies through donations,
such as art supplies, books, equipment and costumes as well as marketing and public
relations.
The entry staff of Things Unlimited are often limited in education or experience or
capabilities. Management trains with the focus of responding to special needs while
providing security and concrete skills for the future.
Liaisons with other social outreach programs such as the Judeo-Christian Outreach Center,
Lutheran Center, and the Star of the Sea Outreach enable them to help their missions in a
cost-effective manner.
Things Unlimited provides Volunteer opportunities, in a morally clean atmosphere, for the
City of Virginia Beach Corrections, for individuals who have committed minor offenses.
Some individuals have also been hired after completing their community service. Other
volunteer opportunities are provided to the general public.
The physical structure has been part of the Virginia Beach Oceanfront for over seventy years
and serves as a point of interest for tourists and locals.
Information is consistently available on public services, community news and events, and
health services.

NOTE 9 - EMPLOYEE RETIREMENT PROGRAM
The school has a simplified employee pension (SEP) program for its employees. The
plan is funded from current operations at the discretion of the School Committee. Employees
with three or more years of service are eligible for participation and are fully vested for all
contributions. Contributions to the simplified employee pension program totaled $20,000 and
$17,006 for the years ended July 31, 1999 and 1998, respectively.

NOTES TO FINANCIAL STATEMENTS
NOTE 10 - RELATED PARTIES
The Friends School is affiliated with and in the care of the Virginia Beach Friends
Meeting, a religious organization. A majority of the School Committee Members are members
of the Virginia Beach Friends Meeting.
In connection with the sale of a portion of the School's land in 1984, approximately one
acre was transferred to the Virginia Beach Friends Meeting in order to conform with the city
zoning requirements. Substantially all of the School's buildings and improvements are located
on this property. As part of the agreement, the Friends Meeting entered into a long term lease
agreement with the School, whereby the School is leasing the land for $10 per year until 2083.
NOTE 11 - CAPITAL CAMPAIGN AND FACILITY EXPANSION
The school began a capital campaign, "Campaign for Friends", for the purpose of raising
$1 million to expand its existing facilities during 1998. Contributions of $247,293 have been
received through July 31, 1999. Preliminary building costs and campaign expenses totaling
$23,414 have been incurred to July 31, 1999. The balance of $248,903 including investment
income is reported as a temporarily restricted net asset.
The school has committed to begin construction on the classroom building portion of the
project in late 1999. Total costs of this portion of the project are expected to be $600,000 to
$700,000. The Friends Center portion of the project is currently being designed and will be
started as contributions are received and cash flow permits. It is anticipated that some interim
financing will be necessary during the construction period.
NOTE 12 - THINGS UNLIMITED LEASE AND PROPERTY PURCHASE
The school purchased the Things Unlimited property in August 1998 for $325,000. The
sellers' provided financing in the amount of $325,000. The note provides for interest payments
only at 9.5% for the first five years. Interest payments totaled $28,302 for the year ended July
31, 1999.
Prior to the purchase, Things Unlimited leased the premises. Rental expense for this
operating lease totaled $3,207 and $44,743 for the years ended July 31, 1999 and 1998,
respectively.

WHEREAS, The Friends School is exempt from taxation on the real and personal
property used for its school facility, pursuant to Article X, § 6(a)(4), but also owns a thrift store,
"Things Unlimited," which is currently subject to real and personal property taxation;
WHEREAS, The Friends School has requested the Council of the City of Virginia
Beach to adopt a resolution in support of its request that the General Assembly act in accordance
with Article X, § 6(a)(6) of the Constitution of Virginia to designate all of the real and personal
property of The Friends School, including its Things Unlimited property, as being exempt from
state and local real and personal property taxation;
WHEREAS, the real property owned by The Friends School in the City of Virginia
Beach on which the thrift store is located has an assessed value of $353,700, and in tax year 2000-
2001, the taxes on this property are $4315;
WHEREAS, the personal property owned by The Friends School in the City of
Virginia Beach which is used for the thrift store has an estimated value of $25,000, and in tax year
2000, taxes on this personal property would be $370;
WHEREAS, pursuant to § 30-19.04(B) of the Code of Virginia, the Council of the
City of Virginia Beach has properly advertised and conducted a public hearing prior to the adoption
of this resolution, giving all citizens an opportunity to be heard;
WHEREAS, the provisions of § 30-19.04(B) of the Code of Virginia have been
examined and considered by the Council of the City of Virginia Beach; and
WHEREAS, the Council of the City of Virginia Beach is of the opinion that The
Friends School should be designated as a benevolent organization within the context of § 6(a)(6) of
Article X of the Constitution of Virginia and that real and personal property located in the City of
Virginia Beach owned by The Friends School and used by it exclusively for benevolent purposes

1. That the Council of the City of Virginia Beach, Virginia supports the enactment

WHEREAS, King's Grant Community League, Inc., has requested the Council of
the City of Virginia Beach adopt a resolution in support of its request that the General Assembly act

personal property of the King's Grant Community League, Inc., as being exempt from state and
local real and personal property taxation;

WHEREAS, pursuant to the Agricultural Lands Preservation
Ordinance (the "Ordinance"), Appendix J of the Code of the
City of Virginia Beach, there has been presented to the City
Council a request for approval of an Installment Purchase
Agreement (the form and standard provisions of which have been
previously approved by the City Council, a summary of the
material terms of which is hereto attached, and a true copy
of which is on file in the City Attorney's Office) for the
acquisition of the Development Rights (as defined in the
Installment Purchase Agreement) on certain property located in
the City and more fully described in Exhibit B of the
Installment Purchase Agreement for a purchase price of
$256,036; and
WHEREAS, the aforesaid Development Rights shall be
acquired through the acquisition of a perpetual agricultural
land preservation easement, as defined in, and in compliance
with, the requirements of the Ordinance; and
WHEREAS, the City Council has reviewed the proposed terms
and conditions of the purchase as evidenced by the Installment
Purchase Agreement;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF VIRGINIA BEACH, VIRGINIA:
1. The City Council hereby determines and finds that
the proposed terms and conditions of the purchase of the
Development Rights pursuant to the Installment Purchase
Agreement, including the purchase price and manner of payment,

per annum or the per annum rate which is equal to the yield on
United States Treasury STRIPS purchased by the City to fund

rate of interest shall not exceed 7.0% unless the approval of
the City Council by resolution duly adopted is first obtained.
2. The City Council hereby further determines that
funding is available for the acquisition of the Development

3. The City Council hereby expressly approves the
Installment Purchase Agreement and, subject to the
determination of the City Attorney that there are no defects
in title to the property or other restrictions or encumbrances
thereon which may, in the opinion of the City Attorney,
adversely affect the City's interests, authorizes the City
Manager or his designee to execute and deliver the Installment
Purchase Agreement in substantially the same form and
substance as approved hereby with such minor modifications,
insertions, completions or omissions which do not materially

Tony Arnold, Director of Facilities Planning and Construction - Virginia Beach Schools, advised actually
CIP (42-240 is the Bayside Middle School addition and only design money was funded last year. Schools are
now undergoing a evaluation of secondary school capacity (Middle and High Schools). The evaluation of
the high schools is in relation to the redrawing of the boundaries for the new Landstown High School. An
A & Efirm will be hired to evaluate the scope of a classroom additions (12, 16 & 20) at Bayside Middle. The
selection of the A & E firm will be determined by the School Board on December Fifth. Hopefully, in
February, the evaluation will determine the need for additional classrooms.
Vickie Lewis, Chief Financial Officer - Virginia Beach Schools, advised relative replacement of school
buses. Department of Defense dollars were received which are a supplement to Impact Aid. These funds are
normally received in late Fall; however, they were received in June. There was a $1.2-MILLION "hole"
in next year's Operating Budget. Bus replacement was at a base line of $1.5-MILLION. Therefore, bus
replacements will be derived from the the $1.2-MILLON in Reversion Funds rather than through the
Operating Budget.
Upon motion by Vice Mayor Sessoms, seconded by Councilman Branch, City Council ADOPTED:
Ordinance, AS REVISED*, to AMEND the FY 2000-01 School's
Capital Budget and APPROPRIATE $6,662,282 in Reversion
Funds and $3,890,538 in Revenue Sharing Formula funds from the
General Fund Balance re various operational and elementary
modernization programs.
Lines 59-60 and 112-113 shall be revised:

not been appropriated;
WHEREAS, the Virginia Beach Public Schools' allocation
under the Revenue Sharing formula results in $3,890,538 to be re-
appropriated by City Council for non-recurring purposes;
WHEREAS, by resolutions adopted October 3, 2000, the
School Board formally requested the City Council to approve the
appropriation of school reversion funds and revenue sharing formula
funds to the City's FY 00/01 Capital Improvement Budget; and
WHEREAS, the School Board recommends the allocation of

WHEREAS, the City Council adopted the Revenue Sharing Formula February 25,
1997 which provides 53.13% of certain general fund revenues to meet obligations of
the Virginia Beach Public Schools; and
WItEREAS, the Revenue Sharing Formula calls for any actual revenues iii excess of
budgeted revenues to be allocated to Virginia Beach Public Schools in the same 53.13%
ratio; and
WItEREAS, the City Office of Management Services has estimated that FY 99/00
actual revenues exceeded budgeted revenues for the 6 designated revenue streams by
approximately $7,322,677; and
WHEREAS, the Virginia Beach Public Schools allocation under the Revenue Sharing
Formula provides approximately $3,890,538 to be re-appropriated by City Council for
non-recurring purposes; and
WHEREAS, the administration recommends the $3,890,538 of Revenue Sharing
Formula funds be allocated as follows:
· $2,040,538 for the School Division's match for the Instructional Technology
Replacement cycle to replace the funding from the State Teclmology Grant
which is restricted to high school computers at a 5'1 ratio for purposes of
on-line SOL testing and therefore cannot be used for the division's funding
obligation
· $ 1,350,000 for the elementary modernization program/Bayside Middle
School
· $ 250,000 for elementary math and reading materials
· $ 250,000 for repairs and maintenance projects
now, therefore, be it
RESOLVED: That tlie Virginia Beach School Board requests that City Council
reappropriate funds in the amount of $3,890,538 to the CIP; and be it further
RESOLVED: That the funds be re-appropriated $2,040,538 for instructional
technology, $1,350,000 to the elementary modernization program, $ 250,000 for

WHEREAS, two deputy sheriffs with the Virginia Beach
Sheriff's Department were charged by an inmate with disturbing the
peace for acts committed in the discharge of their official duties;
WHEREAS, the charges were tried before the Virginia Beach
General District Court on September 28, 2000, and were dismissed at
the conclusion of the trial;
WHEREAS, in their defense of said charges, the deputy
sheriffs incurred legal fees and expenses in the amount of $1,500
each;
WHEREAS, both deputy sheriffs have requested the City to
reimburse them for such fees and expenses;
WHEREAS, § 15.2-1711 of the Code of Virginia provides
that "[i]f any law-enforcement officer is investigated, arrested or
indicted or otherwise prosecuted on any criminal charge arising out
of any act committed in the discharge of his official duties, and
no charges are brought, the charge is subsequently dismissed or
upon trial he is found not guilty, the governing body of the
locality wherein he is appointed may reimburse such officer for
reasonable legal fees and expenses incurred by him in defense of
such investigation or charge"; and
WHEREAS, the City Attorney's Office has reviewed the
circumstances of this case, assessed the itemized bill submitted by
the deputy sheriffs' legal counsel, and determined the legal fees
and expenses incurred by the deputy sheriffs to be reasonable.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF VIRGINIA BEACH, VIRGINIA:
That the City Manager is hereby authorized to transfer
funds in the amount of $3,000 from the General Fund Reserve for
Contingencies to the Sheriff's Department's FY 2000-2001 Operating
