HomeMy WebLinkAboutOCT 20-27, 1958 Before the Board of Supervisors of Princess Anne County, Virginia, at a meeting held on the 20th day of October, 1958, came the Petitioner, Croatan Beach Corporation, a Virginia Corporation, requesting that the Board of Supervisors close and vacate a portion of a certain street named Elm Avenue, as it is shown on the Plat of Croatan Beach duly recorded in the Clerk's Office of the Circuit Court of Princess Anne County in Map Book 24, at Page 37, and also as shown on the Plat of the Re-Subdivision of Part of Croatan Beach duly recorded in the aforesaid Clerk's Office in Hap Book 3?, at Page 11. Thereupon, upon motion duly made and seconded and by the af/irmative vote o£ all present, the recommendation of the Planning Commission, and the Board of Supervisors being satisfied that the statutes made and provided in such cases have been complied with, and find that no public necessity exists for the continuance or establishment of that portion of Elm Avenue herein- after described desired closed, and that the welfare of the public will be best served by the abandoning, vacating and closing of said portion of said street and such vacation does not abridge or destroy any of the rights or privileges o£ other property owners within the bounds of the area of land sho~n on said plats. IT IS HEREBY ORDERED, that the following described portion of the street known as Elm Avenue, as shown on the Plat of Croatan Beach, duly recorded in the Clerk's Office of the Circuit Court of Princess Anne County, Virginia, in Hap Book 24, at Page 37, and as shown on the Plat of Re-Subdivision of Part of Croatan Beach of Princess Anne County, Virginia, duly recorded in the Clerk's O//ice of the Circuit Court of Princess Anne County, Virginia, in Map Book 37, at Page 11, is hereby closed, vacated and abandoned, and the fee simple title of said property vesting in Croatan Beach Corporation, the owner o£ all property abutting said portion o£ Elm Avenue being closed. Said portion of Elm Avenue herein closed described more particularly as follows: All that certain portion of Elm Avenue, being fifty (50) feet in width, and beginning at the Eastern side of its intersection with Chautauqua Avenue and running from said Eastern side of said Chautauqua Avenue in an Easterly direction to the waters of the Atlantic Ocean as shown on said plats to which reference is hereby made for more particular description. IT IS FURTHER RESOLVED, that the Chairman of the Board of Supervisors of Princess Anne County join with Croatan Beach Corporation in an instrument to sisnify the approval of the Board of Supervisors to the vacation of that portion of Elm Avenue hereinbefore vacated and abandoned, and that the Clerk do attest such instrument and affix the seal of the County thereto, and the same shall be admitted to record. the above resolution was unanimously approved. SECTION 1. A UTHORIT y PAR. 1 Whereas, by virtue of a resolution entitled, Princess Anne County Water and Sanitation Authority, which is recorded in the Minute Book of the Princess Anne County Board of Supervisors, dated February 27, 1956, Page 489, and of a Charter granted May 2, 1956, by the Corporation Commission of the State of Virginia, The Princess Anne County Water and Sanitation Authority has been established, the following rules and regulations are adopted regarding the establishment, construction, maintenance and operation of water and/or sanitation facilities for Private and public consum- ption by any person, persons, firm, corporation or association within the bounds of Princess Anne County, Virginia. SECTION II. PROCEDURE PAR. 1 For the Purpose of clarity and brevity, any person, persons, firm, corporation or association desiring to construct a water or sanitary facility within the bounds of Princess Anne County is hereafter referred to ez. ~.~ ~ as the Contractor; any persor~ firm, corporation or association desiring to operate and maintain the same shall be hereafter referred to as the Owner; and the Princess Anne County Water and Sanitation Authority shall be re- ferred to as the Authority. PAR. 2 Any Contractor desiring to install a sanitary or water facility within the bounds of Princess Anne County shall, in accordance with the applicable provisions of Chapter 22 of Title 15 (Sections 15- 739.7, et seq., and Sections 15-754.1, et seq.) of the Code of Virginia, at least 60 days to commencing construction thereof, notify in writing the Princess Anne County Board of Supervisors; submit full and complete plans and specificat- ions of the Proposed installation which shall bear the name and registry -2- number of the civil or sanitary engineer qualified in the sanitary engineering who Prepared same; and appear before the Board of Supervisors at a regular meeting thereof and not~fy the Board of Supervisors in Person. Should the Board of Supervisors fail to act within 70 days after the submission of the and specifications, its failure to act shall be deemed its approval, ~rovided, however, that the Contractor shall, before commencing construction, notice to the Board of Supervisors by registered mail o fits intention to Proceed with such construction. No plans, specifications or drawings of Sanitation or Water Facilities shall be submitted for approval to The Board of Supervisors until (1) A plat of the Proposed sub-division has been accepted and recorded in The County Clerk ~s Office and (2) Use of the land for a Sanitation Facility has been approved by The Board of Supervisors, such use Permit is required under the county's zoning laws. 3 The Board of Supervisors shall submit such plans and s to the Authority and, if submitted, the Authority, upon receipt of such and specifications from the Board of Supervisors, shall promptly review same and make its recommendations to the Board of Supervisors. The shall fill out Form #1000 ( hereinafter referred to as the shall indicate the name of the Contractor, the name of the Owner ~f the Proposed facility and in the case of a ¢o~Poration the name and address registered agent and the residence and business address of both and the Owner. The ApPlication shall clearly state ( in engineering where applicable ): The location of the facility -= county, district, sub-division and areas to be served, and if such information is available, plat title, streets, and block and lot numbers to be served. The Proposed number of residential and/or comme units to be served. The probable number of persons to be served. The probable increase in population density per year in the area to be served. -3- The total daily capacity of the plant in gallons per 24-hour period. 0 The estimated contract cost for the construction. The engineer and/or contractor's name and registry number who prepared the plans and specifications for the proposed facility. The fee which the applicant has paid or is paying the County of Princess Anne for examination, inspection and approval of the aforesaid plans. Possible expansion of facility to acommodate addit- ional loads. 10. Whether such facility is to be operated as a public Private utility or turned over to the Authority for maintenance and operation. PAR. 4 The completed application shall be submitted with an and four (4) copies. The original shall remain in the permanent files of the Authority. The second copy shall be delivered to the applicant together urith a receipt for the fees on account thereof by the Treasurer of the County. The third and fourth copies shall be sent to the Princess Anne County Health De- partment. The fifth copy must be forwarded to the Water Control Board in Richmond for approval. PAR. 5 Upon receipt of the application accompanied by the plans an~ specifications, the Authority may, at its option, submit the aforesaid plans to a registered and licensed engineer, who is qualified as a sanitary engineer, examination, study, recommendation and report. The engineer or engin- ,,ring firm designated shall not be the engineer or engineering firm which originally drew the plans submitted. Within a reasonable Period not to exceed 30 days, the engineer or engineering firm shall submit to the Authority his written recommendations. He shall submit his report in writing in quadru- plicate; the original copy shall remain with the Authority, the duplicate shall be forwarded with the Authority's recommendation to the Board of Supervisors. the triplicate shall be forwarded to the Water Control Board in Richmond, -4- together with the action of the Board of Supervisors on said application, and the fourth copy shall be forwarded to the applicant. PAR. 6 Simultaneously with the application, or prior thereto, the applicant if required shall submit duplicate plans and specifications for said facility to the State Water Control Board in Richmond and any other agency having jurisdiction for approval of the same. t~rior to commencing construct- ion of said facility, the approval of the Board of Supervisors, and, if required, of the State Water Control Board shall be obtained. PAR. 7 In the event that the application is denied either by the Board of Supervisors, or the Water Control Board, the Authority will advise the applicant of the decision and forward a copy of the proposed recommend- ations. The applicant may then, within a period of twelve months and before any construction is begun on the proposed facility, re-submit his plans to the Authority to be again processed in the manner outlined above, without addit- ional fee. If the applicant does not re-submit his plans and specifications within twelve months, he shall forfeit his fee. PAR. 8 If said application is approved by the Board of Supervisors and the Water Control Board, the Authority shall, in meeting assembled or by designation of its secretary, indicate on Form #1001 (hereinafter referred to as the Certificate of Approval), which shall be made out in triplicate, that the proposed facility is approved by the Board of Supervisors and the Authority and that the fee required has been paid. The secretary shall forthwith, in acknowledgement of the above- stated items, affix his signature to the Form #1001 and stamp the said form with the seal of tke Authority. The original shall be forwarded to the applicant; the duplicate shall be forwarded to the Board of Supervisors; and the triplicate shall be filed in the folder of the proposed facility, with the plans, specifications, recommendations, and approvals of the consulting engineer and the Water Control Board. -5- PAR. 9 No change shall be made in the plans and specifications after they have been approved by the Princess Anne County Board of Supervisors, or its duly Authorized Representative, unless and until due notice of such change shalJ hqve beech s~ubrr~itted in ritin _t~. t o'upermsor~Vor its auly Au-thorixed Representative. Should the Board of Supervisors fail to act upon any proposed change or changes within 30 days after submission to it, such change or changes shall be deemed approved. SECTION HI. CONSTR UC TION PAR. 1 Upon receipt of the certificate of approval from the Authority, the Contractor may begin construction of the proposed facilities. He must begin construction within a period of twelve months from the date shown on said certificate of approval unless an extension of time is granted by the Authority. If construction is not begun within such Period, or any extensions thereof, the Contractor must re-submit his application, with plans and specifications, to be processed in the manner hereinabove provided for the original application, and a new fee must be paid. PAR. 2 The Contractor shall complete the construction of the facility within a reasonable length of time which shall not be longer than two years from the date shown on the certificate of approval unless an extension thereof shall be granted by the Authority. PAR. 3 Every thirty days, and at such other times as the Authority may require during construction, alteration, extension or major repair the owner shall submit to the Authority, at the owners expense, a written report compiled by a licensed (registered) civil or sanitary engineer which shall contain thereon a certification by him that the work is being performed in accordance with the approved plans and specifications and is of satisfactory quality based upon accepted engineering standards. No sewer mains, laterals, trunk lines, by-passes, manholes, sewer boxes, pumping stations, lifts, or other appurtenances shall be covered by soil, debris, -6- or fill until such times as said engineer has examined the same and has indicated to the foreman or superintendent in charge of the work that the wori has been Performed in a proper and workmanlike manner. The e~neer shali be held responsible for observing that joints are properly connected and sealed, that debris is removed from the tiles or Pipes before bein~ closed, that ballast is placed under the tile or pipes where required, a~d that cons- truction has been installed according to the approved plans a~d specifications. and that Proper safety precautions are observed by the Contractor. No Persons, firm, corporation, or association shall open up a public street, highway, thoro~kfare, alley, or any public area, for the Purpose of in~, installing, repairing, altering or extending sewer or water facilities, without first having obtained permission for the same from the Resident Engineer, Department of Highways, or from the Director of the t~rincess County Department of t~ublic Wor~s or his authorized representative in the event tke streets are not eligible for acceptance into the Primary or secon, system of highways. PAR. 4 Upon closing any opening under a permit, as provided under Section III, Paragraph 3, hereof, the Contractor or Owner, shall advise the agency which issued such permit, in writing, that the work has been completed. Upon the closing of such an opening the finished grade line shall be in accordance with the grade line prior to the beginning of the work, and proper measures shall be taken to restore drainage ditches, culverts, catchbasins, curbs and gutters to satisfactory operating condition in accord- ance with the specifications of the State Highway Department. PAR. 5 Any authorized representative of Princess Anne County have the right, to go upon any premises at any time to make an inspection to determine if the work of installing, constructing, altering, repairing or operating any water or sanitation facility is being properly performed. -7- SECTION IV FEES PAR. 1 Upon submission of the application, plans, specifications and drawings to the ExecutiVe - Secretary of the Board of Supervisors, the contractor shall tender, eitker in cash or by certified check, a fee based upon the estimated cost of construction as shown in the application for a permit in accordance with the following schedule: 1. Minimum fee - $100. 00. 2. 1/2 of 1~ of the first $100, 000. O0 of suck estimated cost plus 3. 1/4 of l ~ for amounts in excess of $100, 000. O0 PAR. 2 Upon the completion of the construction, the aforesaid engineer shall certify on Form #1002 (herein referred to as the "Certificate of Corr~pletion,9, that the construction of the facility has been under proper inspection, that the workmanship is in accordance with good engineering es, and that to the best of his ~nowledge the work has been performed zn a proper manner and installed according to final plans and specifications. A certified copy of the "As Built': drawings shall accompany Form #1002. This certification, however, shall not relieve the Contractor of any liability under his performance bond for the correct and proper Performance of the work where a bond is required hereunder. PAR. 3 Before opening a thoroughfare under the jurisdiction of Princess Anne County every person, firm or corporation constructing, repairing, altering or extending sewage or water pipes shall previous to the commencement of such work make application to the Director of Public Work. or his authorized representative for permission to perform such work, ' ' the place and extent thereof. The fee for such permit shall be $5. 00. PAR. 4 Before opening a thoroughfare under the jurisdiction of Princess Anne County the contractor shall post a cash security bond, approved by the Director of Public Works or his authorized representative, with the Department of Public Works to insure proper replacement of the 8 street. The said bond shall be in amount equal to the cost of the repair or installation. PAR. 5 A fee of $5. O0 per sewer or water connection shall be paid into the County Treasurer at the time building permit is obtained. SECTION V. REQUIREMENTS FOR THE CONTRACTOR pAR. 1 If the facility is to be operated by the Authority then upon receipt of the certificate of completion, the Contractor shall deposit with the Authority a surety bond which shall have a tern of one year, which shall guarantee good workmanship, proper installation and technical correctness of the installation. The surety bond or cash deposit shall be in an amount not less than 10~ of the estimated cost of construction shoum in the application for Permit. After one year from the date of issuance of the engineer's certificate of completion, there having been no defects in workmanship or material or engineering techn°~ogy develop, the Contractor's bond will be released or his cash deposit refunded. The cash deposit will not draw interest. In the event that, during one year~s term, defects develop, it shall be the responsibility of the Contractor to repair the same, either under his surety bond or by charge to his cash deposit. The Authority will be required to refund only that portion of his deposit over and above charges for such repair or defects. SECTION VI. PENALTY PAR. 1 Any person, firm, corPoration, or association violating any provision of this ordinance or failing or refusing to obtain a license or Permit shall be guilty of a misdemeanor and upon conviction thereof shall be fined not less than five dollars, nor more than five hundred dollars, and each day's continuation of such violation shall constitute a separate offense. The Enforcement Officer or any official of the County of Princess Anne may institute any appropriate action or proceeding to prevent the unlawful erection, construction, reconstruction, alteration, repair or -9- conversion of any building structure, or water or sanitation facility, or the unlawful use of land, to restrain, correct or abate such violation, to prevent the occupancy of such building, structure or land, or use of such water or sanitation facility, or to prevent any illegal act, conduct, business or use in or about such premises or facilities. PAR. 2 All ordinances and resolutions or parts thereof in conflict with the provisions of this ordinance shall be and are hereby repealed to the extent of such conflict. PAR. 3 If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. PAR. 4 This ordinance may be ~nown, designated and cited as THE WA TER AND SANITATION REGULATIONS OF PRINCESS ANNE COUNTY, VIRGINIA. PAR. 5 enactment.
